Borough of Ho-Ho-Kus County of Bergen Mayor and Council Work/Public Combined Meeting August 20, 2019 7:30 p.m. The Combined Meeting of the Municipal Council of the Borough of Ho-Ho-Kus was held in the Municipal Building at 333 Warren Avenue, Ho-Ho-Kus, NJ on August 20, 2019. The meeting was called to order at 7:30 p.m. by Mayor Randall who asked the Municipal Clerk to read the open a public meeting statement: The Public Meeting of the Mayor and Council of the Borough of Ho-Ho-Kus is now in session in accordance with the provisions of Section 5 of the “Open Public Meetings Act”. Notice of this meeting has been posted in the front lobby entrance to the Borough Hall and Council Chambers, a copy has been filed with the Borough Clerk, and copies of the Annual Notice of Meetings, of which this is a part, have been heretofore sent to the Record and the Ridgewood News. FLAG SALUTE: Mayor Randall led those present in the salute to the American Flag. APPROVAL OF MINUTES A motion was offered by Councilman Shell, seconded by Councilman Iannelli to approve the minutes of July 16, 2019 – Closed and Work/Public Meeting of the Mayor and Council. Motion carried on a roll call vote – all present voting “Ayes. DEPARTMENT REPORTS Reports on file in the Clerk’s Office Police Report – July 2019 Court Report– July 2019 PUBLIC DISCUSSION Mayor Randall opened the meeting to the public. He stated if anyone desired to be heard, please raise your and to be recognized, come forward to the microphone and state your name and address for the record. Seeing none, the Mayor closed the meeting to the public. ADMINISTRATOR’S REPORT Old Business Library – Administrator will be meeting with the Library Board sometime in September. 1-9 East Franklin Turnpike Issues – The court date was recessed until September as per their attorney. DOT Train Station – Nothing new to report, they are on target for spring work regarding the one-way. It should be noted this will be added to the Master Plan. 124 Elmwood – Stone Wall in ROW – To be discussed in close session 1 Borough of Ho-Ho-Kus County of Bergen Mayor and Council Work/Public Combined Meeting August 20, 2019 7:30 p.m. 68 Brandywine – Fence in ROW – Resident decided to put up her own fence on her property 598 Cliff Street, Ridgewood – Widen of Driveway in ROW – Received clearance report from the Borough Engineer, however, additional discussion needed in close session. Paving – Paving projects are completed. Lloyd Road will be milled and paved this week. Floodplain maps – Borough has received confirmation that the ordinance was received and approved. Changes to the maps will take effect on August 28th, 2019. Letters from FEMA explaining what individuals are to do to get relief from their flood insurance will be forth coming. Borough has no further obligations. New Business Movie Night – Schedule for September 6th, featuring the Incredibles 2 movie, with a rain date of September 19th. Bruno Associates – Will be submitting a grant application from Firehouse Subs for some EMS, Fire & PD equipment. Taxes – This is the last week for taxes, they are due by August 23rd, 2019 with no penalties. Any payments received after that date the interest goes back to August 1st, 2019. Solid Waste/Water - Grace period for payment ended on the August 15th, 2019. 150 people were late paying the water bill and 250 late on the solid waste. Board President Troast asked when we will be going to on-line payments. Administrator responded it is in the works. Administrator added we are in the process of preparing our bid specs for our solid waste contract which expires at the end of this year. CORRESPONDENCE a) Resignation letter from Kristine Mancuso, Police Department Secretary. b) Certification of Mailing of Tax Bills/Affidavit of Bill Mailing. c) BC Ordinance #19-22 –Guaranteed Revenue Bonds for the Northern Valley Regional High School District – Valley Program School Acquisition project – not to exceed $5,200,000. d) Letter regarding the speeding on Racetrack Road. e) The BC Board of Chosen Freeholders Park & Recreations invitation to participate in the 14th Annual Bocce Tournament on 9/29/19. f) Thank you note from Christine Cavalier-Bole and David Bole. INTRODUCTION OF ORDINANCES ORDINANCE 2019-26 AN ORDINANCE TO AMEND AND SUPPLEMENT CHAPTER 79 OF THE CODE OF HO-HO-KUS ENTITLED VEHICLES AND TRAFFIC BE IT ORDAINED by the Mayor and Council of the Borough of Ho-Ho-Kus, County of Bergen, State of New Jersey, that pursuant to Code Section 79-5, Schedule VI is hereby amended and supplemented as follows: Section I Schedule VI The following described intersection is hereby designated as a Stop Intersection: Intersection Stop Sign On Cliff Street and First Street Cliff Street All other provisions of Schedule VI not amended herein, remain in full force and effect. Section II – Severability. If any portion of this ordinance is adjudged unconstitutional or invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this ordinance, but shall be confined in its effect to the provision directly involved in the 2 Borough of Ho-Ho-Kus County of Bergen Mayor and Council Work/Public Combined Meeting August 20, 2019 7:30 p.m. controversy in which such judgment shall have been rendered. Section III – Repealer. All other provisions of this chapter which are not affected by this ordinance are hereby ratified and confirmed and shall remain in full force and effect. However, all ordinances or parts of ordinances which are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. Section IV – Effective Date. This ordinance shall take effect upon passage and publication as required by law. A motion was offered by Councilman Policastro and seconded by Councilman Iannelli to approve Introduction of Ordinance #2019-26. Motion carried on a roll call vote – All present voting “Aye”. Resolution #19-81 – Introduced and read by Council President Troast A Resolution – Grant permission - Halloween Window Painting for Friday, October 18, 2019 WHEREAS, the Borough of Ho Ho-Kus has received a request from Youth Activities Council requesting permission to hold the annual Halloween Window Painting event sponsored by the Ho-Ho-Kus HAS and the Youth Activities Council on Friday, October 18, 2019 with a rain date of Friday, October 25, 2019; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Ho-Ho-Kus, that permission is hereby granted to hold the annual Halloween Window Painting event. Resolution #19-83– Introduced and read by Council President Troast A Resolution – The Hollow of Ho-Ho-Kus – Release of the Performance Bond 7 Borough of Ho-Ho-Kus County of Bergen Mayor and Council Work/Public Combined Meeting August 20, 2019 7:30 p.m. WHEREAS, the Developer for the project known as “The Hollows at Ho-Ho-Kus” has requested a return of the Performance Bond for the public improvements relating to said project located at lots 1.01, 2.01, 3.01, 4.01, 10.02 – 10.08 in Block 802; and WHEREAS, the Borough Conflict Engineer Thomas R. Lemanowicz, P.E., has reviewed the improvements and has provided a letter dated August 1, 2019 to the Borough Administrator which is adopted and incorporated herein by reference; and WHEREAS, the Governing Body has reviewed this matter and finds just cause; NOW, THEREFORE, BE IT RESOLVED by the Governing Body that the original Performance Bond in the amount of $190,785.00 shall be released contingent, however, upon (1) the Developer depositing $3,700.00 as a cash performance guarantee for the unfinished sidewalk until the Borough Conflict Engineer certifies that the work has been satisfactorily completed and (2) the Developer providing a check in the amount of $9,539.25 which shall be added to the $19,078.50 already on account for a total of $28,617.75 which represents the two-year Resolution #19-85– Introduced and read by Council President Troast A Resolution – Grant Permission – Cub Scout Pack 54 – Utilize East Park WHEREAS, the Borough of Ho Ho-Kus has received a request from Cub Scout Pack 54 to utilize East Park for their Annual Campfire Kickoff on Sunday, September 15, 2019 from 5pm – 8:30pm with a rain date of Sunday September 22, 2019; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Ho-Ho-Kus, that the request to use East Park for the Campfire Kickoff is approved; A motion was offered by Council President Troast and seconded by Councilman Rorty to approve Resolutions 19-77 through 19-83 and Resolution 19-85. OFF-CONSENT RESOLUTIONS Resolution #19-84 – Introduced and read by Council President Troast A Resolution – Tax Appeal Settlement – Astleford v. Ho-Ho-Kus WHEREAS, Chad Astleford is the owner of real estate known as 50 Jacquelin Avenue, Ho-Ho-Kus, New Jersey, also known as Lot 5 in Block 403 on the Borough tax map; and WHEREAS, the owner has filed a tax appeals challenging the tax assessment for the years 2017-2019; and WHEREAS, the Borough has completed full discovery with respect to these matters and has conducted exhaustive negotiations with counsel for the taxpayer; and WHEREAS, the parties have been able to arrive upon a proposed settlement agreement as follows: a revised assessment of $700,000.00 for 2017; a revised assessment of $880,500.00 for 2018-2019; and WHEREAS, the parties have agreed that pre-judgment interest shall be waived as a condition of the settlement; and WHEREAS, the Borough’s Tax Assessor Edmund Brown is in agreement with the terms of the settlement and believes that it would be in the best interests of the Borough to settle these particular cases in accordance with the terms set forth above; NOW, THEREFORE, BE IT RESOLVED that the Governing Body of the Borough of Ho-Ho-Kus agrees to authorize the Municipal Attorney to execute a Stipulation of Settlement on behalf of the Borough of Ho-Ho-Kus with respect to the Astleford v. Ho-Ho-Kus tax appeals pending in the Tax Court of New Jersey under Docket Nos. 003234-2017, 003347-2018 and 002673-2019 at the new assessments set forth above; and BE IT FURTHER RESOLVED, that upon receipt of the Tax Court Judgment, the Tax Collector is hereby authorized to calculate the amount of the refund and cause same to be paid to the taxpayer, without statutory interest, within 60 days from the date of the Tax Court Judgment; and BE IT FURTHER RESOLVED, that a true copy of this Resolution be provided to the Borough Tax Collector, Tax Assessor, Chief Financial Officer and Municipal Attorney. 8 Borough of Ho-Ho-Kus County of Bergen Mayor and Council Work/Public Combined Meeting August 20, 2019 7:30 p.m. A motion was offered by Council President Troast and seconded by Councilman Rorty to approve Resolution 19-84. Motion carried on a roll call vote – All present voting “Aye”. LIAISON REPORTS Recreation – Baseball Association had their quarterly meeting where they appointed a new president. Football is underway, their senior team has 21 seniors, however there are only (3) three 7th graders, where last year they had 14. Junior team has 19. Peewee is struggling with only 16 who registered and 2 already dropped out. Cheerleading has 22 registered. Registration for soccer is doing well. Fall registration for softball is now opened. Library – No report as they are in summer recess. Board of Education – No report. Ambulance Corp. – No report until September. Fire Department – No Report Chamber of Commerce – Councilman Shell reported that September is Turn the Towns Teal for A National Awareness Campaign for Ovarian Cancer month. Board approved to put teal ribbons around the trees during this time. MAYOR'S REMARKS Mayor asked the Police Chief for an update regarding the speeding on Rack Track and Blauvelt. Police Chief responded they installed electronic speed sign to obtain a reading and the average speed was 21 miles per hour with approximately 2400 cars a day. Speed signs have been installed by the county. CLOSED SESSION: On a motion by Councilman Rorty, seconded by Councilman Shell, the Mayor and Council approved entering into Executive Session closed to the public. NJSA 10:4-12 Whereas, the Borough Council of the Borough of Ho-Ho-Kus is subject to certain requirements of the Open Public Meetings Act, NJSA 10:4-6; and Whereas, the Open Public Meetings Act, NJSA 10:4-12 provides that an Executive Session not open to the public may be held for certain specified purposes when authorized by resolution; and Whereas, it is necessary for the Borough Council of the Borough of Ho-Ho-Kus to discuss in a session not open to the public certain matters relating to the item or items authorized by NJSA 10:4-12 (b) as follows: 7- Matters relating to litigation, negotiations and attorney-client privilege Contract negotiations Now therefore, be it resolved by the Borough Council of the Borough of Ho-Ho-Kus assembled in public session on August 20, 2019 that an Executive Session closed to the public be and the same is hereby authorized for discussion of matters relating to the specified items designated above.
