Mayor and Council Combined Meeting
August 18th , 2020 7:30 p.m.
The Combined Meeting of the Municipal Council of the Borough of Ho-Ho-Kus was held in the Municipal
Building at 333 Warren Avenue, Ho-Ho-Kus on August 18, 2020 in the Council Chambers and via
teleconference to the Public. The meeting was called to order at 7:30 p.m. by Mayor Randall who asked the
Municipal Clerk to read the open public meeting statement:
The Public Meeting of the Mayor and Council of the Borough of Ho-Ho-Kus is now in session in accordance
with the provisions of Section 5 of the “Open Public Meetings Act”, adequate notice of this meeting has been
posted in the front lobby entrance to the Borough Hall and Council Chambers, a copy has been filed with the
Borough Clerk, and copies of the Annual Notice of Meetings, of which this is a part, have been heretofore sent
to the Record and the Ridgewood News.

FLAG SALUTE
Mayor Randall led those present in the salute to the American Flag.
Mayor Randall asked for a motion to change the order of the Agenda to have the Administrator report first.
Motion was offered by Councilman Crossley and seconded by Councilwoman Moran. Motion Carried by voice
vote – all present voting “Aye”.
ADMINISTRATOR REPORT
Old Business
Library – Nothing new too report.
1-9 North Franklin Turnpike Issues – Case is still on-going, going to court next week.
DOT Train Station Project – no new updates.
Parking APP – The APP is up and running.
BC United Way/Madeline Partnership Affordable Housing Project – Project has begun and is well
underway.
HHK Crossing Project – The Planning Board at the last meeting moved forward with recommending the
Borough Planner to prepare the re-development plan.
New Business
Mr. Jones reported tonight will be accepting the audit findings and the corrective action plans for the audit of
2019. Resolution #20-92- Cancel Unexpended & Dedicated Balances – General Capital Appropriations, this is
where we had many old ordinances for bonding where not all the monies were spent or the project never
happened. This was authorizing debt that was never spent; therefore, those monies will offset a grant we did
not receive for Blauvelt Paving back in 2012/2013. We never got the grant from the DOT for that project;
therefore, we have to settle that debt now as a result of the audit. That is part of our corrective action plan. Mr.
Jones continued, we have resolution #20-96 for Chapter 159 Lloyd Road Resurfacing-2019, this was for the
work that was done last year . We where awarded a grant for $117,000, which we just received.

Storm Damage – Due to a recent storm, there was extensive damage done through-out the town with down trees
and wires. DPW has been working overtime to clean-up the town. Shade tree has compiled their list and have
contractors coming in to do the more dangerous clean-up. We are expected to get reimbursed as this was
considered a State of Emergency.
Movie Night – Scheduled for September 11, 2020.
APPROVAL OF MINUTES
A motion was offered by Councilman Shell and seconded by Councilwoman Moran to approve the minutes of
July 21, 2020 Closed and Public Meeting of the Mayor and Council. Motion carried on a roll call vote – all
present voting “Ayes, with the exception of Councilman Iannelli who abstained.

A Resolution – Payment of Bills for August
WHEREAS, claims have been submitted to the Borough of Ho-Ho-Kus in the amount of $3,017,491.30; and
WHEREAS, such claims have been listed according to Department and account number with corresponding
vouchers to be reviewed and approved by the Mayor and Council; and,
WHEREAS, the CFO has determined that the funds have been properly appropriated for such purposes and are
available, in the Borough of Ho-Ho-Kus and that the claims specified on the schedule attached hereto,
following examination and approval by the Mayor and Council, be paid and checks issued accordingly; and,
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Ho-Ho-Kus that the
claims totaling $3,017,491.30 be approved and ratified respectively

A Resolution – Cancel Unexpended & Dedicated Balances – General Capital Appropriations
WHEREAS; certain General Capital Improvement appropriation balances remain dedicated to projects now
completed; and
WHEREAS, it is necessary to formally cancel said balances so that the unexpended balances may be returned
to each respective Capital Improvement Fund or credited to Surplus, and unused debt authorizations may be
canceled;
NOW THEREFORE, BE IT RESOLVED, by the Mayor and Council of Ho-Ho-Kus that the following

A Resolution – Approving the By-Laws of the BC Municipal Joint Fund
WHEREAS, The Borough of Ho-Ho-Kus is a member of the Bergen County Municipal Joint Insurance fund,

hereinafter the “FUND; and
WHEREAS, Recent changes were made to the FUND’S bylaws; and
WHEREAS, after a public hearing conduced on March 19,2020 the Executive Committee of the FUND
distributed the proposed bylaw amendment to the membership for their considerations; and
WHEREAS, these revised bylaws must be ratified by at least three fourths of the member towns before they
can become effective.
NOW THEREFORE, BE IT RESOLVED, by the Governing Body of Ho-Ho-Kus that the revised bylaws are
hereby ratified.
Resolution #20-94- Introduced by Councilman Crossley
A Resolution – Accept and Comply Audit Findings for 2019
WHEREAS, N.J.S.A. 40A:5-4 requires the governing body of every local unit to have made an annual audit of
its books, accounts and financial transactions, and
WHEREAS, the Annual Report of Audit for the year 2019 has been filed by a Registered Municipal
Accountant with the Municipal Clerk pursuant to N.J.S.A. 40A:5-6, and a copy has been received by each
member of the governing body; and,
WHEREAS, R.S. 52:27BB-34 authorizes the Local Finance Board of the State of New Jersey to prescribe
reports pertaining to the local fiscal affairs; and,
WHEREAS, the Local Finance Board has promulgated N.J.A.C. 5:30-6.5, a regulation requiring that the
governing body of each municipality shall by resolution certify to the Local Finance Board of the State of New
Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit
entitled “Comments and Recommendations, and;
WHEREAS, the members of the governing body have personally reviewed as a minimum the Annual Report of
Audit, and specifically the sections of the Annual Audit entitled “Comments and Recommendations, as
evidenced by the group affidavit form of the governing body attached hereto; and;
WHEREAS, such resolution of certification shall be adopted by the Governing Body no later than forty-five
days after the receipt of the annual audit, pursuant to N.J.A.C. 5:30-6.5; and;
WHEREAS, all members of the governing body have received and have familiarized themselves with, at least,
the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have
subscribed to the affidavit, as provided by the Local Finance Board, and;
WHEREAS, failure to comply with the regulations of the Local Finance Board of the State of New Jersey may
subject the members of the local governing body to the penalty provisions of R.S. 52:27BB-52, to with: R.S.
52:27BB-52: A local officer or member of a local governing body who, after a date fixed for compliance, fails
or refuses to obey an order of the director (Director of Local Government Services), under the provisions of this
Article, shall be guilty of a misdemeanor and, upon conviction, may be fined not more than one thousand
dollars ($1,000.00) or imprisoned for not more than one year, or both, in addition shall forfeit his office.
NOW, THEREFORE BE IT RESOLVED, That the Mayor and Council of the Borough of Ho-Ho-Kus, hereby
states that it has complied with N.J.A.C. 5:30-6.5 and does hereby submit a certified copy of this resolution and
the required affidavit to said Board to show evidence of said compliance.
Resolution #20-95- Introduced by Councilman Crossley
A Resolution – 2019 Corrective Action Plan
WHEREAS, Local Finance Notice 92-15 issued by the Division of Local Government Services requires all
municipalities to prepare a Corrective Action Plan as a part of their annual audit process; and
WHEREAS, The Chief Financial Officer has prepared the attached 2019 Corrective Action Plan in conjunction
with the appropriate department heads;
NOW THEREFORE BE IT RESOLVED that the attached 2019 Corrective Plan is approved by the Borough
Council of the Borough of Ho-Ho-Kus as required by Local Finance Notice 92-15.
BE IT FURTHER RESOLVED that the Borough Clerk is directed to send a certified copy of this resolution to
the Director of Local Government Services;

A Resolution – Forgiveness of Solid Waste 3rd Qtr. 2020 bill
WHEREAS, 4 Brookview Ct., 6 Saddle Ridge Rd., 1 Powderhorn, 20 N. Saddle Brook Dr., 19 North Saddle
Brook Dr., which are lots under construction; and
WHEREAS, forgiveness of Solid Waste for 2nd & 3rd Quarter 2020 Bills for 19 Addison Place, new home
construction.
WHEREAS, the above residential structures will be credited accordingly and then will be reviewed for the
balance.
NOW THEREFORE, be it resolved that the bills in question be cancelled.
Resolution #20-97- Introduced by Councilman Crossley
A Resolution – Chapter 159 Lloyd Road Resurfacing-2019
WHEREAS, N.J.S. 40A:4-87 provides that the Director of the Division of Local Government Services may
approve the insertion of any special item of revenue in the budget of any County or Municipality when such
item shall have been made available by law and the amount thereof was not determined at the time of the
adoption of the budget, and
WHEREAS, said Director may also approve the insertion of an item of appropriation for an equal amount, and
WHEREAS, the Borough received $117,093.00 from the NJ Department of Transportation and wishes to
amend its 2020 Budget to the entire portion of this amount as a revenue.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Ho-Ho-Kus, in the
County of Bergen, New Jersey, hereby requests the Director of the Division of Local Government Services to
approve the insertion of an item of revenue in the Budget of the year 2020 in the sum of $117,093.00 which is
now available as a revenue from the NJ Department of Transportation:

A motion was offered by Councilman Crossley and seconded by Councilman Shell to approve Resolutions #20-
91 through #20-97. Motion carried on a roll call vote – All present voting “Aye”.
LIAISON REPORTS
Recreation – Councilman Iannelli reported Summer Travel Baseball was a success. Fall sports are scheduled to
move forward, there is a board meeting scheduled for tomorrow to discuss the logistics.
Library – Councilman Policastro reported the facility remains open to the public at a limited capacity with an
optional curbside pick-up program. Employees continue to work staggered shifts. More information can be

Board of Education – Councilman Policastro reported the Board of Education with the assistance Pandemic
Response Committee has developed and formally submitted a 74-page Restart and Recovery Plan consistent
with NJDOE to the County of Bergen. The plan includes locally developed protocol to ensure school(s) in the
district re-open safely and are prepared to accommodate staff and students’ unique needs during this
unpresented time. The Pandemic Response Committee will continue to meet through-out the re-start of the
2020/2021 school year. More information can be found on www.ho-ho-kus.org.
Ambulance Corp. – no report.
Fire Department – Councilman Shell reported the Fire Department continues to meet in the parking lot as well
as Zoom and is well attended. They did an amazing job through the storms there were approximately 27 calls
that came in and more that came in the following day without injuries. Councilman stated he met with the
Chief and they are still undecided about having an Open-House regarding Fire Safety Month. More
information to follow.
Chamber of Commerce – Councilman Shell reported the Chamber of Commerce would like to be involved with
the movie night which is scheduled for September 11th , 2020. They are also proposing a “Tent Sale” for all
business in town as well as home base business where they would be a tent up on the Town Green. They might
want to align that event with the re-opening Ho-Ho-Kus event. More information to follow. Ho-Ho-Kus Inn
will be opening for outdoor dining on September 10, 2020. Lastly, Councilman Shell reported that September
is Turn the Towns Teal month for “A National Awareness Campaign for Ovarian Cancer” and asked for Board
approval.
Resolution #20-98- Introduced by Councilman Shell
A Resolution – Permission to Turn the Town Teal
WHEREAS, Turn the Towns Teal is a national campaign to create awareness of ovarian cancer and its
symptoms which are often subtle; and
WHEREAS, the campaign consists of volunteers tying ribbons primarily in town centers, stores, health clubs,
spas, libraries, etc. with symptom cards and information pertaining to ovarian cancer during the month of
September, National Ovarian Cancer Month; and
WHEREAS, the campaign also includes lawn signs for more impact;
NOW THEREFORE BE IT RESOLVED, that the Mayor and Council of the Borough of Ho-Ho-Kus authorizes
the Mayor to sign the letter granting the campaign permission to Turn the Town Teal.
Motion by Councilman Shell, seconded by Councilwoman Moran to approve resolution #20-98, motion carried
on a roll call vote – All present voting “Aye”.
DPW Report – Jeff Pattman reported due to the storm he has had 730-man hours, they are just over 42 cubic
yards of debris. They are almost done with the clean-up; the first round should be done by Thursday and then
go around one-more time from district to district. Councilman Shell asked when DPW has time to look at the
potholes on Valley Forge. Jeff stated he is aware, however there is still some drainage work being done in the
next few months.
MAYOR REMARKS
Mayor and Councilman Crossley thanked and commended the DPW staff for all their hard work. Questions
was asked if we were still having the 911 Memorial Service, Mayor stated he still plans on having some sort of
Ceremony.
