Mayor and Council Combined Meeting
July 21st, 2020 7:30 p.m.
The Combined Meeting of the Municipal Council of the Borough of Ho-Ho-Kus was held in the Municipal
Building at 333 Warren Avenue, Ho-Ho-Kus on July 21, 2020 in the Council Chambers and via teleconference
to the Public. The meeting was called to order at 7:30 p.m. by Mayor Randall who asked the Municipal Clerk to
read the open public meeting statement:
The Public Meeting of the Mayor and Council of the Borough of Ho-Ho-Kus is now in session in accordance
with the provisions of Section 5 of the “Open Public Meetings Act”, adequate notice of this meeting has been
posted in the front lobby entrance to the Borough Hall and Council Chambers, a copy has been filed with the
Borough Clerk, and copies of the Annual Notice of Meetings, of which this is a part, have been heretofore sent
to the Record and the Ridgewood News.

APPROVAL OF MINUTES
A motion was offered by Council President Troast and seconded by Councilman Crossley to approve the
minutes of June 23, 2020 Closed and Public Meeting of the Mayor and Council. Motion carried on a roll call
vote – all present voting “Ayes.

Mayor opened the meeting to the public. He stated if anyone desired to be heard, state your name and address
for the record.
Hearing none, Mayor closed the meeting to the public.
ADMINISTRATOR REPORT
Old Business
Library –.Regarding the renovation/ expansion project, the Library is expected to hear in approximately a
month or so if they will be awarded any grant monies they applied for.
1-9 North Franklin Turnpike Issues –A letter was sent to the property owner regarding additional work that
he has done without permission or permits. Still due to come back to court next month as he retained again
another attorney.

DOT Train Station project – No new updates
Train Station Parking Lot – Repaving is completed
Parking App – The new parking APP(Parkmobile) is now up and running. Administrator Jones is working
on getting this information to the residents.
New Business
BERGEN COUNTY UNITED WAY/Madeline Partnership – Ho-Ho-Kus Affordable Housing Project -
Administrator Jones discussed there was a pre-construction meeting, work is scheduled to begin Monday July
27, 2020, for approximately 14 months.
HHK Planning Board Resolution – Preliminary Investigation to Determine an area in need of Redevelopment –
This project which is commonly known as the Ho-Ho-Kus Crossing Project. Mr. Jones stated we added to the
agenda tonight Resolutions #20-89 & 20-90 which is for the Governing Body to concur with the
recommendations of the Planning Board for the (3) lots that this project is slated for and then direct the
Planning Board to prepare a Redevelopment Plan for the those designated redevelopment areas. Borough
Attorney added, these resolutions need to be sent down the Department of Community Affairs where they have
30 days to appeal.

and Engineering Capital Improvement in the amount of $2,343,500.
b) West Milford Resolution supporting High Speed Internet Accessibility.

Resolution #20-81- Introduced by Council President Troast
A Resolution – Payment of Bills for July
WHEREAS, claims have been submitted to the Borough of Ho-Ho-Kus in the amount of $1,711,345.76;
and
WHEREAS, such claims have been listed according to Department and account number with corresponding
vouchers to be reviewed and approved by the Mayor and Council; and,
WHEREAS, the CFO has determined that the funds have been properly appropriated for such purposes and are
available, in the Borough of Ho-Ho-Kus and that the claims specified on the schedule attached hereto,
following examination and approval by the Mayor and Council, be paid and checks issued accordingly; and,
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Ho-Ho-Kus that the
claims totaling $1,711,345.76 be approved and ratified respectively

A Resolution – Developer’s Agreement – Wearimus Properties, LLC
WHEREAS, the Wearimus Properties, LLC. (the “Developer”) filed an application with the Borough of Ho-
Ho-Kus Planning Board (the “Board”) for preliminary and final major subdivision approval of the property
known as 262 Wearimus Road, Ho-Ho-Kus, New Jersey, which is designated on the Borough’s official Tax
Map as Block 905, Lots 5 (the “Property”, which approval was granted by the Board on September 12, 2019
and memorialized by written resolution on October 17, 2019; and
WHEREAS, it is appropriate that a Developers Agreement be entered into between the Borough and the
Developer to memorialize the understandings between the parties with regard to the construction of the
improvements contemplated under the Board’s approval and the rights and obligations of the parties thereto;
NOW, THEREFORE, BE IT RESOLVED by the Governing Body that it does hereby authorize a Developers

A Resolution – Cancellation of Receivable Balances
WHEREAS; A grant receivable balance of $213,120.12 must be cancelled as per the Auditors; and;
WHEREAS, it is necessary to formally cancel the receivable balance and its’ offsetting appropriation reserve
balance from the balance sheet;
NOW THEREFORE, BE IT RESOLVED, by the Mayor and Council of Ho-Ho-Kus that the following

Resolution #20-84- Introduced by Council President Troast
A Resolution – Tax Appeal - Dowicz v. HHK
WHEREAS, Stephen M. Dowicz is owner of real estate known as Lot 15 in Block 903 better known as 209
Wearimus Road, Ho-Ho-Kus, New Jersey; and
WHEREAS, the owner has filed a 2019 tax appeal challenging the tax assessment; and
WHEREAS, Lot 15 in Block 903 was assessed for the 2019 tax year in the total amount of $2,169,300; and
WHEREAS, the Borough has completed full discovery with respect to this matter, has consulted with the
Borough’s Tax Assessor and has conducted exhaustive negotiations with counsel for the taxpayer; and
WHEREAS, the parties have been able to arrive upon a proposed settlement agreement as follows: a revised
assessment of $1,800,000 for 2019, with the Freeze Act to apply for the year 2020; and
WHEREAS, the parties have agreed that pre-judgment interest shall be waived as a condition of the settlement;
and
WHEREAS, the Borough’s Tax Assessor Edmund Brown is in agreement with the terms of the settlement and
believes that it would be in the best interests of the Borough to settle this particular case in accordance with the
terms set forth above;
NOW, THEREFORE, BE IT RESOLVED that the Governing Body of the Borough of Ho-Ho-Kus agrees to
authorize the Municipal Attorney to execute a Stipulation of Settlement on behalf of the Borough of Ho-Ho-
Kus with respect to the Dowicz v. Ho-Ho-Kus tax appeal pending in the Tax Court of New Jersey under Docket
No. 007197-2019 at the new assessment set forth above; and
BE IT FURTHER RESOLVED, that upon receipt of the Tax Court Judgment, the Tax Collector is hereby
authorized to calculate the amount of the refund and cause same to be paid to the taxpayer, without statutory
interest, within 60 days from the date of the Tax Court Judgment; and
BE IT FURTHER RESOLVED, that this resolution is subject to approval thereof by the taxpayer and his
attorney; and
BE IT FURTHER RESOLVED, that upon adoption of the within Resolution, a certified copy of same shall be
served by the Municipal Clerk upon the Tax Assessor, the Tax Collector, the Chief Financial Officer and the
Municipal Attorney.

WHEREAS, The Borough of Ho-Ho-Kus is subject to a Final Judgment of Compliance and Judgment of
Repose pursuant to Docket No. BER-L-6215-15 in the Superior Court of New Jersey Bergen County; and

WHEREAS, Unit #1, located at 614 Maple Avenue, Ho-Ho-Kus, New Jersey, at Block #1015, Lot #9, is a unit
which must be deed restricted with affordable housing covenants and restrictions pursuant to law;
NOW, THEREFORE, BE IT RESOLVED by the Governing Body that it does hereby authorize and approve a
Deed Restriction with affordable housing covenants and restrictions for the aforesaid property;
BE IT FURTHER RESOLVED that said Deed shall be substantially in the form attached hereto and
incorporated herein by reference; and
BE IT FURTHER RESOLVED that the Mayor and Municipal Clerk, as appropriate, are authorized to execute
such Deed on behalf of the Borough following legal review.
Resolution #20-86- Introduced by Council President Troast
A Resolution – Amendment to Resolution #20-71 for the 2020 Resurfacing Contract
WHEREAS, the Borough has previously awarded the 2020 Resurfacing Program Contract to Cross Roads
Paving & Maintenance LLC (“Cross Roads”) pursuant to Resolution #20-71, adopted June 23, 2020; and
WHEREAS, the Borough Engineer has recommended, by letter dated July 9, 2020, that the Contract be
amended for a total award of $221,972.68, which is the bid amount of $178,656.68 plus the additional concrete
work and stripping ($43,316.00); and
WHEREAS, the total Contract award will be $221,972.68; and
WHEREAS, the Chief Financial Officer has attached hereto a certification that adequate funds are available and
duly budgeted to pay for the Contract;
NOW, THEREFORE, BE IT RESOLVED by the Governing Body that the aforesaid Contract with Cross
Roads be amended to include estimated additional work of $43,316.00 for a total contract price of $221,972.68;
and
BE IT FURTHER RESOLVED that the Mayor and Municipal Clerk are authorized to sign an amended
Contract following legal review.
Resolution #20-87- Introduced by Council President Troast
A Resolution – Payment Plan & Waive Utility late fee
WHEREAS, the Borough of Ho-Ho-Kus received a request from Mr. & Mr. Sheiban located at 8 Stratford
Lane, Ho-Ho-Kus, NJ 07423 for a payment plan and a late fee be waived for a delinquent utility payment.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Ho-Ho-Kus hereby
authorizes the Water & Solid Waste Registrar to provide a 12 month payment plan for a $5,025.36 third (2nd)
quarter water bill and removal of a late fee of $502.54 upon completion of payments for Mr. & Mr. Sheiban
located at 8 Stratford Lane, Ho-Ho-Kus, NJ 07423.
BE IT FURTHER RESOLVED that a certified copy of this resolution shall be sent to the Water & Solid Waste
Registrar and the owner of said property.
Resolution #20-88- Introduced by Council President Troast
A Resolution – 2020-2021 Liquor License Renewal for Red Cellar Inc.
WHEREAS, applications have been made by certain persons and corporations for the renewal of Plenary Retail
Consumption, and Plenary Retail Distribution licenses for the year commencing July 1, 2020 and terminating
June 30, 2021; and
WHEREAS, no complaints or objections have been filed with the Borough Clerk against said persons or
corporations; and
WHEREAS, the Police Department of the Borough of Ho-Ho-Kus has not received any complaints of
violations of Alcoholic Beverage Control regulations by any of the applicants hereinafter named; and
WHEREAS, said applicant have filed their applications with the Alcohol Beverage Control of the State of New
Jersey, paid the State fee, received their Tax Clearance Certificate from the NJ Division of Taxation and paid
the municipal fees of $825.00 for the Plenary Retail Distribution license.

Resolution #20-89- Introduced by Council President Troast
A Resolution - Whereas the Governing Body concurs in the recommendation of the
Planning Board Non-Condemnation area in need of Redevelopment
WHEREAS, the Ho-Ho-Kus Planning Board adopted a Resolution dated July 16, 2020, a true copy of which is
attached hereto and incorporated herein; and
WHEREAS, said Resolution recommended that property consisting of Block 1016, Lots 3, 5 and 11, commonly
known as 619 North Maple Avenue, 217 First Street and 239 First Street, respectively (“entire area”), should be
determined to be a non-condemnation area in need of redevelopment; and
WHEREAS, the Governing Body concurs in the recommendation of the Planning Board;
NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of Ho-Ho-Kus, County of
Bergen, State of New Jersey, that it does hereby designate the entire area set forth above to be a non-
condemnation redevelopment area.
Resolution #20-90- Introduced by Council President Troast
A Resolution - Directing the Planning Board to prepare a Redevelopment Plan for the
designated redevelopment area.
WHEREAS, the Governing Body has adopted Resolution 20-89, determining that Block 1016, Lots 3, 5 and 11,
commonly known as 619 North Maple Avenue, 217 First Street and 239 First Street, respectively, is a non-
condemnation redevelopment area;
NOW, THEREFORE, BE IT RESOLVED by the Governing Body that it does hereby direct the Planning Board
to prepare a Redevelopment Plan for the designated redevelopment area.
A motion was offered by Council President Troast and seconded by Councilman Shell to approve Resolutions
#20-81 through #20-90. Motion carried on a roll call vote – All present voting “Aye”.
LIAISON REPORTS
Recreation – Administrator Jones reported he had spoken to Ed Gartner the recreation director regarding
proceeding with a movie night and/or a concert in late September, he has some concerns, however more
information to follow.
Library – Councilman Policastro reported the Library re-opened to the public on July 16th , 2020 with a number
of safety measures in place. Full details can be found on the Library website –www.ho-ho-kuslibrary.org
Board of Education – Councilman Policastro reported as part of the roll back plan for the State, on July 26th,
2020 Governing Murphy release guidance of the re-opening on NJ Schools. Per State directive, each district
was tested, developed and administered a re-start program tailored to their community. Two Committees were
established; 1) a re-start committee to formulate a plan for the re-opening of the Ho-Ho-Kus School 2) a
pandemic response team to determine how to establish and maintain the safest environment for the students and
educators once the school is re-opened. Himself and OEM Coordinator Jay Ludwig have been appointed to the
Public Schools Pandemic Response Committee, which is comprised of School Leadership, Health
Professionals, Borough Officials and Community Members. Further details regarding the re-start plan can be
found at Ho-Ho-kus.org as they are finalized.
Ambulance Corp. – No Report
Fire Department – Councilman Shell reported they had their first in-person meeting in the parking lot as well as
Zoom.
Chamber of Commerce – Nothing new to report, however Café Amici is scheduled to re-open in August.

Public Meetings Act, NJSA 10:4-6; and
Whereas, the Open Public Meetings Act, NJSA 10:4-12 provides that an Executive Session not open to the
public may be held for certain specified purposes when authorized by resolution; and
Whereas, it is necessary for the Borough Council of the Borough of Ho-Ho-Kus to discuss in a session not open
to the public certain matters relating to the item or items authorized by NJSA 10:4-12 (b) as follows:

Now therefore, be it resolved by the Borough Council of the Borough of Ho-Ho-Kus assembled in public
session on July 21, 2020 that an Executive Session closed to the public be and the same is hereby

Closed Session began at 8:00 p.m. and ended at 8:15 p.m.
On a motion by Councilman Shell, seconded by Councilman Moran, the meeting returned to open public
session.
