Borough of Ho-Ho-Kus County of Bergen Mayor and Council Public Meeting Minutes June 23, 2020 7:30 p.m. The Public Meeting of the Municipal Council of the Borough of Ho-Ho-Kus was held in the Municipal Building at 333 Warren Avenue, Ho-Ho-Kus on June 23, 2020 in the Council Chambers and via teleconference to the Public. The meeting was called to order at 7:30 p.m. by Mayor Randall who asked the Municipal Clerk to read the open public meeting statement: The Public Meeting of the Mayor and Council of the Borough of Ho-Ho-Kus is now in session in accordance with the provisions of Section 5 of the “Open Public Meetings Act”, adequate notice of this meeting has been posted in the front lobby entrance to the Borough Hall and Council Chambers, a copy has been filed with the Borough Clerk, and copies of the Annual Notice of Meetings, of which this is a part, have been heretofore sent to the Record and the Ridgewood News. FLAG SALUTE APPROVAL OF MINUTES A motion was offered by Councilman Shell and seconded by Councilman Iannelli to approve the minutes of the May 19, 2020 Public Meeting of the Mayor and Council. Motion carried on a roll call vote – all present voting “Ayes. DEPARTMENT REPORTS Reports on file in the Clerk’s Office Police Report – May 2020 Court Report – May 2020 Library Report - June 2020 PUBLIC COMMENTS Mayor opened the meeting to the public. He stated if anyone desired to be heard, state your name and address for the record. Hearing none, Mayor closed the meeting to the public. ADMINISTRATOR REPORT Old Business Library – Library has re-opened for curbside pick-up only. 1-9 North Franklin Turnpike Issues – Court date TBD as the Courts has just started to resume via ZOOM. Train Station Parking Lot – Project should be completed by next week. Recycling – Continues to be very high volume. DOT Train Station project – No new updates 1  Borough of Ho-Ho-Kus County of Bergen Mayor and Council Public Meeting Minutes June 23, 2020 7:30 p.m. New Business County Open Space Grant - This grant is for repairs at Northfield where the footbridge needs to be replaced as well as some added security features. BC Cares Act Municipality Reimbursement Agreement - Administrator explained the County seeks to provide Municipalities within the County access to Stimulus Funds for COVID-19 related expenditures on a reimbursement basis in order to alleviate a degree of the economic damage and hardship caused by COVID-19. Also provides business that were deemed non-essential up to $10,000. He shared this information with the Chamber of Commerce. Parkmobile – There is a resolution on the agenda tonight to award Parkmobile for our Parking APP for a 3-year term as the previous vendor we used closed their business due to the COVID-19 Pandemic. Discussion was brought up about reimbursement for parking passes. The administrator stated maybe later on we can think about a credit in lieu of reimbursement, more discuss will follow. CORRESPONDENCE a) Proposed Legislation pertaining to the Municipal Clerks acceptance of Mail-In Ballots b) Letter from the President of Atlantic City Municipal Clerk’s Association expressing concerns regarding the proposed legislation for acceptance of mail-in ballots. c) Resolution from the Borough of Leonia – Declaring Racism a Public Health Crises d) BC Executive Order#2020-01G - reopening Park Amenities, Outdoor Dining, & Non- essential Retail. e) State of NJ Executive Order #20-014 – Protocols for food or Beverage Establishment offering Outdoor Services. f) Requesting Municipality to pass a resolution opposing Construction of the NJ Transit Gas- Fired Power Plant Kearny g) ZBA notice of hearing – 755 W. Saddle River Rd. ADOPTION OF ORDINANCES and PUBLI HEARING ORDINANCE 2020-37 AN ORDINANCE TO ESTABLISH CHAPTER 71 OF THE CODE OF THE BOROUGH OF HO-HO-KUS TO REGULATE TEMPORARY STORAGE UNITS BE IT ORDAINED by the Mayor and Council of the Borough of Ho-Ho-Kus, County of Bergen, State of New Jersey, as follows: Section 71-1. Definitions: Temporary Storage Unit. An outdoor unit commonly referred to as a “pod,” “temporary garage,” “soft-side storage unit” or similar unit used to store home furnishings and/or personal items on a temporary basis during a time of home repair, construction, renovation or relocation. Section 71-2. Regulations Governing Temporary Storage Units. A. No person shall place upon any property in the Borough of Ho-Ho-Kus a temporary storage unit unless the owner of the property has obtained a temporary storage unit permit from the Building Department or Zoning Department. B. Application for such temporary storage unit shall be in writing on a form provided by the Borough and shall be presented to the Building Department or Zoning Department. C. Temporary storage units shall not exceed 160 square feet in foot print. D. The temporary storage unit shall be placed on the driveway or on alternative approved location as directed by the Borough Building Department or Zoning Department. E. The application shall be submitted to the Borough Building Department or Zoning Department, which shall review the application for completeness and issue said permit. 2  Borough of Ho-Ho-Kus County of Bergen Mayor and Council Public Meeting Minutes June 23, 2020 7:30 p.m. F. The temporary storage unit shall be temporary in nature, and no temporary storage unit shall be placed or remain on the same premises more than 60 days cumulatively in a calendar year. The start date of the time period shall be the date of delivery, as shown on the delivery ticket, which must be supplied to the Building Department or Zoning Department Officer upon request. G. An initial temporary storage unit permit shall be issued for 30 days, provided however, that two extensions of up to 15 days for each extension of the permit may be granted. No more than two extensions may be granted. Any application for an extension shall be required to be submitted at least 14 days prior to the expiration of the initial permit or of the first extension. H. No more than one temporary storage unit may be placed upon any single residential property at one time. Section 71-3. Fees. The permit application and review fee shall be $50 for the initial temporary storage unit permit and $25 for each extension not to exceed two extensions. Section 71-4. Enforcement; Issuance Permit. A. The Police Department, Construction Official, Zoning Enforcement Officer and Property Maintenance Officer or their duly authorized designated persons are hereby authorized as enforcement officers of this Ordinance. B. It shall be the responsibility of the Borough Construction Official or Zoning Officer to issue temporary storage unit permits. Section 71-5. Violation and Penalties. Any person, firm, corporation and/or entity violating or neglecting to comply with any provision of this Ordinance shall be subject to a fine of up to $500 for the first offense and $750 for each and every subsequent offense. Each and every day such violation or non-compliance exists shall constitute a separate offense and an additional fine shall be imposed as set forth herein. If any conditions/regulations are violated, the Borough can revoke the permit and request its removal immediately. Section 71-6. Severability. If any portion of this ordinance is adjudged unconstitutional or invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this ordinance, but shall be confined in its effect to the provision directly involved in the controversy in which such judgment shall have been rendered. Section 71-7. Repealer. All ordinances or parts of ordinances which are inconsistent with the provisions of this Ordinance are hereby repealed to the extent of such inconsistency. Section 71-8. Effective Date. This ordinance shall take effect upon passage and publication as required by law. PUBLIC HEARING Mayor opened the meeting to the public. He stated this is the time and place for the public hearing on Ordinance #2020-37 and all persons who wishes to be heard, please state your name and address before making your statement. Hearing none, the Mayor closed the meeting to the public. A motion was offered by Councilman Shell and seconded by Councilman Iannelli to adopt Ordinance #2020- 37. Motion carried on a roll call vote – All present voting “Aye”. Resolution #20-72- Introduced by Council President Troast A Resolution – BC Cares Act Municipality Reimbursement Agreement WHEREAS, the United States of America, the State of New Jersey, Counties, and Municipalities have experienced significant economic damage and hardship as a result of the COVID-19 Virus Pandemic (COVID-19); and WHEREAS, on March 27, 2020 the Coronavirus Aid Relief and Economic Security Act (the "CARES Act") was enacted, among other purposes, to provide ready funding to address unforeseen financial needs and risks created by the COVID-19 public health emergency and to combat the economic damage caused to states, counties and municipalities because of COVID-19; and WHEREAS, the County has received CARES Act funds from the United States Treasury (the "Stimulus Funds") to be used to reimburse specific COVID-19 related expenditures within the County due to economic damage and hardship caused by COVID-19; WHEREAS, the County, as the recipient of the Stimulus Funds, has the responsibility to disburse the Stimulus Funds to eligible recipients in accordance with the terms and provisions of the CARES Act and any guidelines or regulations issued by United States government or any of its agencies and/or departments; WHEREAS, the County seeks to provide Municipalities (the "Municipalities") within the County access to Stimulus Funds for COVID-19 related expenditures on a reimbursement basis in order to alleviate a degree of the economic damage and hardship caused by COVID-19. 8  Borough of Ho-Ho-Kus County of Bergen Mayor and Council Public Meeting Minutes June 23, 2020 7:30 p.m. NOW THEREFORE, it is stipulated and agreed as follows: l. Purpose of Stimulus Funds. The Municipality understands and agrees that the County shall determine eligibility for the receipt of any Stimulus Funds in accordance with the terms of the CARES Act, the "Coronavirus Relief Fund - Guidance for State, Territorial, Local and Tribal Governments -April 22, 2020" (“the Guidelines"), attached hereto as Schedule A, and any subsequent amendments and/or changes to the Guidelines. Excluded from the Guidelines as an eligible reimbursement are the categories detailed in Number 4, related to long distance learning, and in Number 5, on Page 3 of the Guidelines. 2. Role of County. As the recipient of the Stimulus Funds it shall be the responsibility of the County to establish a reasonable process for the acceptance of an application by the Municipality for an eligible reimbursement from the Stimulus Funds. The Municipality agrees and understands that the decision as to whether the reimbursement sought by the Municipality is not within the discretion of the County but is governed by the Guidelines. Attached hereto as Schedule B is the process to be employed by the County to accept applications for a reimbursement from the Stimulus Funds. 3. Use of Stimulus Funds. The Municipality understands that the Stimulus Funds represent an amount of funds for which the County along with the Municipalities in Bergen County are eligible to file a claim for reimbursement. However, neither the County, nor any of the Municipalities in Bergen County, has a vested right to receive any of the funds, and the receipt of funds shall be subject to any claim for reimbursement meeting the eligibility requirements established by the CARES Act and the Guidelines. It should also be noted that the Municipality shall not receive reimbursement for eligible expenses pursuant to this Agreement if reimbursement for those same eligible expenses has been received pursuant to another source including but not limited to FEMA. Please note that claims for Stimulus Funds must be filed and disbursed by no later than December 30, 2020 or the Stimulus Funds must be returned to the Secretary of Treasury, so time is of the essence. 4. Processing of Claims. The County shall process and accept all claims for Reimbursements in the order in which the claim is received and shall pay any eligible payment in the order it is determined to be eligible. Subject to the provisions of Paragraph 8 hereinafter written, any claim of the Municipality cannot exceed the initial allocation provided to the Municipality pursuant to the provisions of Paragraph 8 hereinafter contained. 5. Non-Liability of the County. The Municipality understands that the County cannot Guaranty that a claim for reimbursement is eligible for payment nor that any claims for reimbursements beyond the amount of the Stimulus Funds can be paid. In the event there is dispute by the Municipality as to determination made by the County, either as to the eligibility for a reimbursement or the amount of a reimbursement, then the County shall, if requested by the Municipality, pursue an appeal or a request for clarification with the United States Treasury, at the cost of the Municipality. 6. Indemnification by Municipality. The Municipality acknowledges that the role of the County as to the distribution of the Stimulus Funds shall be as an intermediary. Consequently, if as the result of any audit performed by the United States Treasury, or any other auditing agency, department or office of the Government of the United States determines that any reimbursement made to the Municipality by the County from the Stimulus Funds was not eligible for reimbursement, then the Municipality shall repay any ineligible reimbursement within the time mandated by the United States Treasury or the agency, department or office of the Government of the United States for the return of any Stimulus Funds. The Municipality shall indemnify and hold harmless the County from any claim made by the United States Treasury or any agency, department or office of the Government of the United States for the return of any payment received by the Municipality from the Stimulus Funds. Included in the claim for reimbursement shall be any legal fees, court costs or professional fees incurred by the County in defense of any claim made for return of any Stimulus Funds received by the Municipality. 7. Documents Required and Preservation of Records. Any application for reimbursement must be sufficiently documented so that the County can determine the eligibility of the claim for reimbursement including a provision whereby the Municipality certifies that it has not applied to the State or Federal governments for the reimbursement of the same claim submitted to the County. The Municipality agrees that it will not destroy or discard any documents or records maintained and/or relied upon by the Municipality in filing any claim to the County for the receipt of Stimulus Funds without providing written notice to the County at the address first written, or at any other address provided to the Municipality by the County in writing. Any notice shall be given not less than thirty (30) days prior to the date on which the records are to be destroyed or discarded. The County shall at its sole cost and expense have the right to make copies of any documents or records pertinent to the claim for Stimulus Funds and the Municipality shall provide the County with reasonable access to the documents and records. 8. Allocation to Municipality. The County has allocated Stimulus Funds for the benefit of the 9  Borough of Ho-Ho-Kus County of Bergen Mayor and Council Public Meeting Minutes June 23, 2020 7:30 p.m. Municipalities (the "Allocation"). However, the Municipality understands that the Allocation is not a guaranty of the receipt of a reimbursement to the Municipality from the Allocation. The Municipality understands that each of the Municipalities has also received an Allocation. The Municipality acknowledges that the Allocation is only an estimate of that portion of the Stimulus Funds which the Municipality will be eligible to receive. Any reimbursement will be subject to the claim being eligible for reimbursement as per the Guidelines. By June 29, 2020, the Municipality shall submit reimbursement applications for March and April; by July 31, 2020 for the months of May and June; and by October 23 for the months of July, August and September. Any further claims for reimbursements must be filed by no later than December 18, 2020. Beginning on the date of approval and thereafter on July 31, October 23, and December 18, 2020, the County shall review the Allocation and make an adjustment to the Allocation dependent upon the claims for reimbursement made by and paid to date to the Municipality and the Municipalities and the estimated budgets of future expenditures to be made by the Municipality and the Municipalities in the ensuing time period. The Municipality understands that the decision by the County as to any adjustment to the Allocation shall take into consideration the needs of the County, the Municipalities and the Municipality; the amounts of reimbursements made to the County, the Municipalities and the Municipality to date; and the remaining balance contained in the Stimulus Funds. 9. Subsequent Funds. Should the County be in receipt of any additional funds provided by the Government of the United States to combat the Coronavirus, which the Municipality shall be eligible to receive payment, then in the event the Municipality files a claim for those funds the terms and provisions of this Agreement shall apply to the disposition and processing of those claims. 10. Applicable Law and Attorney Fees. Any action for the enforcement of any term or provision of this Agreement shall be governed by the law of the State of New Jersey and shall be filed in the Superior Court of the State of New Jersey having a venue in Bergen County. In addition to any other relief which a party may receive, the prevailing party shall receive an award of reasonable attorney fees and court costs against the non-prevailing party. 11. Duration of Agreement. This Agreement shall begin on the date first written and shall continue until either party terminates it upon thirty (30) days written notice or the depletion of the Stimulus Funds, whichever event occurs sooner. 12. Approval. By signing below the individual signing this Agreement represents that this Agreement has been approved and ratified by the governing body of the party signing it or that the Party has been advised by its counsel that the approval is not legally necessary. IN WITNESS WHEROF, the parties have signed and sealed this Agreement on the date set forth above. NOW, THEREFORE, BE IT RESOLVED by the Municipality of the Borough of Ho-Ho-Kus that the Agreement entitled “Three Year Cooperative Agreement” (an Agreement superseding the Cooperative Agreement dated July 1, 2000 – June 30, 2003) to clarify the planning and implementation procedures and to enable the Municipality to make a Three Year irrevocable commitment to participate in the Community Development Block Grant Program (CDBG), the Home Investment Partnership Program (HOME), and the Emergency Solutions Grant Program (ESG) for the Program Years 2021, 2022, and 2023 covering the period July 1, 2021 – June 30, 2024 be executed by the Mayor and Municipal Clerk in accordance with the provisions of law; and BE IT FURTHER RESOLVED, that this resolution shall take effect immediately in accordance with law and that an original copy be made available to the Director of the Bergen County Division of Community Development as soon as possible and no later than Friday, July 17, 2020. Resolution #20-76- Introduced by Council President Troast A Resolution – Authorizing the Borough of HHK to assist with local business to allow outdoor dining under appropriate guidelines & Safety standards. WHEREAS, the Governor has signed Executive Order No. 150 permitting outdoor dining commencing Monday, June 15, 2020 with accompanying Executive Directive No. 20-014 from the New Jersey Department of Health which identifies health and safety standards that food or beverage establishments are required to follow; and WHEREAS, the Borough of Ho-Ho-Kus wishes to cooperate with local businesses to allow outdoor dining under appropriate guidelines and safety standards; and WHEREAS, Chapter 39A of the Borough Code “Outdoor Dining” sets forth application procedures and other requirements; 11  Borough of Ho-Ho-Kus County of Bergen Mayor and Council Public Meeting Minutes June 23, 2020 7:30 p.m. WHEREAS, the Borough of Ho-Ho-Kus will waive the “Outdoor Dinning” one-time application fee for the 2020 season. NOW, THEREFORE, BE IT RESOLVED by the Governing Body that outdoor dining within the Borough is authorized subject, however, to the following: 1. Applicants shall comply with all requirements of Chapter 39A “Outdoor Dining”; 2. Applicants shall obtain written permission from all owners and/or businesses where sidewalks in front of such locations are proposed for use; 3. Applicants shall file with the Borough a Hold Harmless Indemnification Agreement and Certificate of Insurance protecting all owners or businesses that would be affected by such outdoor dining use; 4. Applicants shall provide a Hold Harmless Indemnification Agreement and Certificate of Insurance naming the Borough as an additional insured for liability purposes pursuant to Chapter 39A; and 5. Outdoor dining restaurants are subject to inspection by the Borough Zoning and Health Officers to comply with all health and safety standards as provided by law. Resolution #20-77- Introduced by Council President Troast A Resolution – Authorizing the Submission of a FY2021 Municipal Aid Grant Application & Execution of Grant Contract w/the NJDOT for Roadway Improvement to Brookside Avenue WHEREAS, the New Jersey Department of Transportation has funds available for transportation infrastructure projects through its FY21 Municipal Aid Program; and WHEREAS, this application would provide funding for roadway improvements along Brookside Avenue from North Maple Avenue to the train station on First Street within the Borough of Ho-Ho-Kus’s central business district; and NOW, THEREFORE, BE IT RESOLVED, that the Council of the Borough of Ho-Ho-Kus formally approves the grant application for the above-stated project. BE IT FURTHER RESOLVED, that the Mayor and Borough Clerk are hereby authorized to submit an electronic grant application identified as MA-2021-Ho-Ho-Kus Borough-00530 to the New Jersey Department of Transportation on behalf of the Borough of Ho-Ho-Kus. BE IT FURTHER RESOLVED, that the Mayor and Borough Clerk are hereby authorized to sign the grant agreement on behalf of the Borough of Ho-Ho-Kus, and that their signatures constitute acceptance of the terms and conditions of the grant agreement and approves the execution of the grant agreement. Resolution #20-78- Introduced by Council President Troast A Resolution – Snow Plowing/Salting Shared Service Agreement with Bergen County WHEREAS, the Mayor and Council of the Borough of Ho-Ho-Kus desires to enter into an agreement with the County of Bergen to provide snow plowing and salting services on county roads, and WHEREAS, the period of service would be October 1, 2020 through April 30, 2022, and WHEREAS, the Municipality shall be compensated by the County at a rate of one hundred ten dollars ($110) per hour of active plowing, and WHEREAS, the municipality agrees to provide the County with the insurance requirements outlined in item 3 of the agreement, and WHEREAS, the County will continue to provide the municipality with salt sufficient to allow the municipality to salt county roads in the same manner and whenever conditions are such that the municipality salts its municipal streets. NOW THEREFORE BE IT FURTHER RESOLVED that the Mayor and the Borough Clerk are hereby authorized and directed to execute said agreement. Resolution #20-79- Introduced by Council President Troast A Resolution – Chapter 159 Clean Communities 12  Borough of Ho-Ho-Kus County of Bergen Mayor and Council Public Meeting Minutes June 23, 2020 7:30 p.m. WHEREAS, N.J.S. 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any County or Municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget, and WHEREAS, said Director may also approve the insertion of an item of appropriation for an equal amount, and WHEREAS, the Borough received $8,830.99 from the Clean Communities Program and wishes to amend its 2020 Budget to the entire portion of this amount as a revenue. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Ho-Ho-Kus, in the County of Bergen, New Jersey, hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the Budget of the year 2020 in the sum of $8,830.99 which is now available as a revenue from the Clean Communities Program: Miscellaneous Revenues Special Items of General Revenue Anticipated with Prior Written Consent of the Director of Local Government Services: Public and Private Revenues Offset with Appropriations (continued) Clean Communities Program, and; BE IT FURTHER RESOLVED that a like sum of $8,830.99 be and the same is hereby appropriated under the caption of: General Appropriations (a) Operations Excluded from Caps Public and Private Programs Offset by Revenues: Clean Communities Program: Other Expenses BE IT FURTHER RESOLVED, that the Borough Clerk forward two copies of this resolution to the Director of Local Government Services. OFF-CONSENT RESOLUTION Resolution #20-80- Introduced by Council President Troast A Resolution – Authorizing Submission of a 2020 BC Open Space Trust Fund Municipal Park Improvement grant application WHEREAS, the Bergen County Open Space, Recreation, Floodplain Protection, Farmland & Historic Preservation Trust Fund (“County Trust Fund”), provides matching grants to municipal governments and to nonprofit organizations for assistance in the development or redevelopment of outdoor municipal recreation facilities; and, WHEREAS, the Borough of Ho-Ho-Kus desires to further the public interest by obtaining a matching grant of $100,000 from the County Trust Fund to fund the following project: North Field Bridge; and, WHEREAS, the Mayor and Council of the Borough of Ho-Ho-Kus has reviewed the County Trust Fund Program Statement, and the Trust Fund Municipal Program Park Improvement application and instructions, and desires to make an application for such a matching grant and provide application information and furnish such documents as may be required; and, WHEREAS, as part of the application process, the Mayor and Council of the Borough of Ho-Ho-Kus held the required Public Hearing to receive public comments on the proposed park improvements in the application on June 23, 2020; and, WHEREAS, the County of Bergen shall determine whether the application is complete and in conformance with the scope and intent of the County Trust Fund; and, 13  Borough of Ho-Ho-Kus County of Bergen Mayor and Council Public Meeting Minutes June 23, 2020 7:30 p.m. WHEREAS, the applicant is willing to use the County Trust Fund in accordance with such rules, regulations and applicable statutes, and is willing to enter into an agreement with the County of Bergen for the above- named project and ensure its completion on or about the project contract expiration date. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Ho-Ho-Kus: 1. That it is hereby authorized to submit the above completed project application to the County by the deadline of June 29, 2020 as established by the County; and, 2. That, in the event of a County Trust Fund award that may be less than the grant amount requested above, the Mayor and Council has, or will secure, the balance of funding necessary to complete the project, or modify the project as necessary; and, 3. That the Mayor and Council is committed to providing a dollar for dollar cash match for the project; and, 4. That only those park improvements identified and approved in the project application, its Trust Fund contract, or other documentation will be considered eligible for reimbursement. 5. That the Mayor and Council agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the project; and, 6. INTRODUCTION OF ORDINANCES - None LIAISON REPORTS Recreation – Councilman Iannelli report travel baseball season has begun which will run from July 6th – to August. No other recreation summer sports have begun. Library - Councilman Policastro report the Library Facility operations resumed approximately 2 weeks ago. Employees are currently working staggered shifts. Board of Education – Councilman Policastro reported the last day of school was June 19 th and yesterday 8th grade students celebrated their graduation at the public school while maintaining social distancing followed by a reception at a home on Brookview Ct. Ambulance Corp. – No report Fire Department – Councilman Shell report the Fire Department continues to have their meeting via Zoom, there are starting to easing there way back into the firehouse with the necessary precautions taken. Chamber of Commerce – Councilman Shell reported the Chamber has been very appreciative for all the support from the Mayor & Council. The “Focus on HHK Campaign” continues as of date there has been $27,000 raised.
