Borough of Ho-Ho-Kus County of Bergen Mayor and Council Combined Meeting November 24th , 2020 7:30 p.m. The Combined Work/Regular Public Meeting of the Municipal Council of the Borough of Ho-Ho-Kus was held via teleconference on November 24, 2020. The meeting was called to order at 7:30 p.m. by Mayor Randall who asked the Municipal Clerk to read the open public meeting statement: The Public Meeting of the Mayor and Council of the Borough of Ho-Ho-Kus is now in session in accordance with the provisions of Section 5 of the “Open Public Meetings Act”, adequate notice of this meeting has been posted in the front lobby entrance to the Borough Hall and Council Chambers, a copy has been filed with the Borough Clerk, and copies of the Annual Notice of Meetings, of which this is a part, have been heretofore sent to the Record and the Ridgewood News. FLAG SALUTE Mayor Randall led those present in the salute to the American Flag. APPROVAL OF MINUTES A motion was offered by Councilman Iannelli and seconded by Councilwoman Moran to approve the minutes of October 20, 2020 Closed and Work Session Meeting of the Mayor and Council. Motion carried on a roll call vote – all present voting “Ayes. A motion was offered by Councilwoman Moran and seconded by Councilman Iannelli to approve the minutes of October 27, 2020 Closed and Public Meeting of the Mayor and Council. Motion carried on a roll call vote – all present voting “Ayes with the exception of Council President Troast who abstained. DEPARTMENT REPORTS Reports on file in the Clerk’s Office Police Report – October 2020 Court Report for October 2020 and Budget Proposal Library Report - November 2020 PUBLIC COMMENTS Mayor opened the meeting to the public. He stated if anyone desired to be heard, state your name and address for the record. Hearing and Seeing none, Mayor closed the meeting to the public. ADMINISTRATOR REPORT Old Business Library – library application for the grant through the NJ Construction Bond Act was not awarded. 1  Borough of Ho-Ho-Kus County of Bergen Mayor and Council Combined Meeting November 24th , 2020 7:30 p.m. Applicants may reapply in the spring. DOT Train Station Project – NJDOT Project is moving forward with the one-way going into Ho-Ho-Kus, looking at the possibility to break ground sometime in the Spring. BC United Way/Madeline Partnership Affordable Housing Project – Continuing to move forward, this project received a $520,00 home loan. There is a meeting scheduled for December 3rd with Joe Citro, CFO, himself and Mr. Toranto to see how this funding will work. HHK Crossing Project – will be discussed in close session. Budget – Budget process is well underway; All Departments submitted all request. Administrator Jones suggested all liaisons meet with the department heads to discuss their wants and needs. New Business Resolution #20-123 - transfer of funds. Administrator Jones explained every November the State allows monies to be transferred to line items that have not been spent to items that may have over spent. Revenues –revenues are in other then the train station parking which is taking a hit due to residents working from home. All other monies, tax, water and solid waste are in line with last year. NJDOT Municipal Aid – Ho-Ho-Kus was awarded $144,346.00 through 2021 Municipal Aid Program, which will go towards the repaving of Brookside, First Street and the upper and lowers train station parking lot. BC Open Space – Bergen County is in the process of allocating its Open Space Trust Fund for 2020. Ho-Ho- Kus is proposing $60,000 for work at North Field foot bridge and security features to add there. This would be a matching grant. Resolution #20-115 – Best Practice Survey was submitted on November 3, 2020, we are doing 95% of the best practices. Annual Tree Lighting – Tree lighting is schedule for December 4, 2020, at 7pm which will be a virtual event this year. CORRESPONDENCE a) BC Division of Community Development annual application for CDBG Grant, HOME Grant, and Emergency Solutions Grant - deadline Friday, January 29, 2021 b) Chief Minchin memo for his completed investigation/recommendation for the towing applications that were submitted. c) Northwest BC Utilities Authority Special Meeting Tuesday, December 8, 2020. d) Notice of Adoption for the Village of Ridgewood Master Plan e) BC Open Space 2020 Proposed Trust Funding Allocations f) Notice from a resident regarding rubbish in their neighbors’ yard g) Teaneck Resolution endorsing Senate Bill 3781 to Establish Permanent Daylight-Saving Time h) NJDOT notice awarding HHK $144,346.00 for the 2021 Municipal Aid Program i) Resident requesting the Mayor and Council to waive her water penalty fee. **Administrator Jones explained on correspondence “f” he will be reaching out to the resident as the ordinance they refer to in their letter does not apply to the situation as they see it. Property Maintenance has been notified and is aware of this situation. ADOPTION OF ORDINANCES and PUBLI HEARING ORDINANCE 2020-40 AN ORDINANCE TO AMEND CHAPTER 81 OF THE CODE ENTITLED “WATER AND WATER RATES BE IT ORDAINED by the Mayor and Council of the Borough of Ho-Ho-Kus that Chapter 81 of the code is hereby amended as follows: 81-21 Rates and Charges is amended as follows: 2  Borough of Ho-Ho-Kus County of Bergen Mayor and Council Combined Meeting November 24th , 2020 7:30 p.m. (a) Effective January 1, 2021 all water taken or consumed shall be charged to consumers at the following rates: (1) Seven dollars ($7.00) per one thousand (1,000) gallons, with a minimum charge of Fifty-Six Dollars ($56) per quarter, or any part thereof. (2) For Water usage over the minimum the following chart will apply: Rate per Gallons 1,000 Gallons Amount Minimum 8,000 $7.00 $56.00 Next 12,000 $7.50 Next 20,000 $8.00 Next 40,000 $9.00 Over 80,000 $11.00 SECTION III: Repealer. All other ordinances of the Borough, or parts thereof, which are in conflict with this ordinance, are hereby repealed to the extent of such conflict. SECTION IV: Effective Date. This ordinance shall take effect upon passage and publication as required by law. A motion was offered by Councilman Crossley and seconded by Councilman Iannelli to adopted Ordinance #2020-40. Motion carried on a roll call vote – All present voting “Aye”. Resolution #20-116- Introduced by Council President Troast A Resolution – Towing Renewals WHEREAS, application has been made by certain towing companies for a license pursuant to Chapter 75 of the Borough Code: Towing Services; and WHEREAS, the Police Department has reviewed such applications and has recommended two (2) towing companies for consideration of the Mayor and Council; and WHEREAS, the Council has reviewed the tower list; NOW, THEREFORE, BE IT RESOLVED by the Governing Body that it does hereby authorize the Borough Administrator to issue an official tower’s license to Citywide Towing, 205 Chestnut Street, Ridgewood, N.J. 07450 and All Points Towing, 145A Hopper Avenue, Waldwick, NJ 07463 for a three (3) year term effective January 1, 2021 until December 31, 2023; and BE IT FURTHER RESOLVED, that said licenses shall be subject to all requirements of Chapter 75 of the Code and the approved towers shall sign a hold harmless agreement and file a certificate of insurance coverage in accordance with Sections 75-8 and 75-9 of the Code, respectively; and BE IT FURTHER RESOLVED, that notice of said licenses shall be provided to the approved towing companies within seven (7) days of the date of this Resolution; and Resolution #20-117- Introduced by Council President Troast A Resolution – Drive Sober or Get Pulled Over WHEREAS, approximately one-third of all fatal traffic crashes in the United States involve drunk drivers; and WHEREAS, impaired driving crashes cost the United States almost $45 Billion a year; and WHEREAS, 29% of motor vehicle fatalities in New Jersey in 2014 were alcohol-related; and WHEREAS, an enforcement crackdown is planned to combat impaired driving; and WHEREAS, the holiday season in particular are traditionally times of social gatherings which include alcohol; and WHEREAS, the State of New Jersey, Division of Highway Traffic Safety, has asked law enforcement agencies throughout the state to participate in the Drive Sober or Get Pulled Over 2020 Statewide Crackdown; and WHEREAS, the project will involve increased impaired driving enforcement from December 8, 2020 through January 1, 2021; and WHEREAS, an increase in impaired driving enforcement and a reduction in impaired driving will save lives on our roadways; THEREFORE, BE IS RESOLVED that the Borough of Ho-Ho-Kus declares it's support for the Drive Sober or Get Pulled Over 2020 Statewide Crackdown from December 8, 2020 through January 1, 2021 and pledges to increase awareness of the dangers of drinking and driving. Resolution #20-118- Introduced by Council President Troast A Resolution – Tax Appeal –Governara v. Ho-Ho-Kus WHEREAS, Daniel J. Governara and Jessica Governara are owners of real estate known as Lot 3, Block 306, better known as 5 Brookview Court, Ho-Ho-Kus, New Jersey; and WHEREAS, the owners have filed a 2019 tax appeal challenging the tax assessment; and WHEREAS, Lot 3, in Block 306 was assessed for the 2019 tax year in the total amount of $1,650,000; and WHEREAS, the Borough has completed full discovery with respect to this matter, has consulted with the Borough’s Tax Assessor and has conducted exhaustive negotiations with counsel for the taxpayer; and WHEREAS, the parties have been able to arrive upon a proposed settlement agreement as follows: 2019 - $1,425,000 assessment; 2020 – Freeze Act; 2021 - $1,400,000 assessment; and 7  Borough of Ho-Ho-Kus County of Bergen Mayor and Council Combined Meeting November 24th , 2020 7:30 p.m. WHEREAS, the parties have agreed that pre-judgment interest shall be waived as a condition of the settlement; and WHEREAS, the Borough’s Tax Assessor Edmund Brown is in agreement with the terms of the settlement and believes that it would be in the best interests of the Borough to settle this particular case in accordance with the terms set forth above; NOW, THEREFORE, BE IT RESOLVED that the Governing Body of the Borough of Ho-Ho-Kus agrees to authorize the Municipal Attorney to execute a Stipulation of Settlement on behalf of the Borough of Ho-Ho- Kus with respect to the Daniel J. Governara and Jessica Governara v. Ho-Ho-Kus tax appeal pending in the Tax Court of New Jersey under Docket No. 013297-2019 at the new assessment set forth above; and BE IT FURTHER RESOLVED, that upon receipt of the Tax Court Judgment, the Tax Collector is hereby authorized to calculate the amount of the refund and cause same to be paid to the taxpayer, without statutory interest, within 60 days from the date of the Tax Court Judgment; and BE IT FURTHER RESOLVED, that this resolution is subject to approval thereof by the taxpayer; and BE IT FURTHER RESOLVED, that upon adoption of the within Resolution, a certified copy of same shall be served by the Municipal Clerk upon the Tax Assessor, the Tax Collector, the Chief Financial Officer and the Municipal Attorney. Resolution #20-119- Introduced by Council President Troast A Resolution – Health Coverage Waiver WHEREAS, in accordance with Chapter 92, P.L. 2007 and Chapter 2, P.L. 2010, the following employees agreed to waive all health care coverage provided by the Borough of Ho-Ho-Kus which includes the State Health Benefits Program (SHBP-medical), WHEREAS, Mrs. Perricelli and Thomas Kirk in accordance with the rules set forth by Chapter 92 & Chapter 2; filed the necessary applications and has submitted proof of the other health coverage, WHEREAS, the Borough of Ho-Ho-Kus has accepted the terms of these individuals opting out of the Borough's Health Plan, and; also, has agreed to the terms and guidelines set forth by Chapter 92 & Chapter 2, WHEREAS, the Borough of Ho-Ho-Kus in place of providing Health Coverage to the following individuals the Borough will issue payment to the above employee which may not be more than 25% (twenty-five), of the amount saved by the employer because of the waiver or $5,000, whichever is less, NOW, THEREFORE BE IT RESOLVED, that Borough of Ho-Ho-Kus authorize the Finance Department to go forward in calculating the 2020 payment and implement the rules set forth by Chapter 92 & Chapter 2. Resolution #20-121- Introduced by Council President Troast A Resolution – Forgiveness of Solid Waste 4th Qtr. 2020 Bill WHEREAS, 4 Brookview Ct., 6 Saddle Ridge Rd., 1 Powderhorn, 19 Addison Place, 20 N. Saddle Brook Dr., 19 North Saddle Brook Dr., which are lots under construction; and WHEREAS, the above residential structures will be credited accordingly and then will be reviewed for the balance. Resolution #20-122- Introduced by Council President Troast A Resolution – Shared Service w/Paramus – Maintenance & Repairs of DPW Vehicles WHEREAS, the Uniform Shared Services Act N.J.S.A. 40A:65-1 et seq. promotes the broad use of shared services as a method to reduce local expenses funded by property taxpayers; and WHEREAS, the Uniform Shared Services Act allows for any local unit to enter into an agreement with any other local unit or units to provide or receive any services with each local unit participating in the agreement that is empowered to provide or receive within its own jurisdiction; and WHEREAS, the Borough of Paramus is willing to provide certain labor and maintenance of DPW vehicles owned by the Borough of Ho-Ho-Kus as needed; and WHEREAS, the Borough of Ho-Ho-Kus may require the use of such labor and maintenance for its DPW vehicles; and WHEREAS, the Chief Financial Officer has attached hereto a certification that adequate funds will be provided in the 2021 budget to pay for this agreement; NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of Ho-Ho-Kus that it does hereby authorize and approve a Shared Services Agreement with the Borough of Paramus for use of certain labor and maintenance for its DPW vehicles in the form of the Shared Services Agreement currently on file with the Municipal Manager’s office; and BE IT FURTHER RESOLVED, that this Shared Services Agreement shall be open to public inspection immediately after passage of this Resolution; and BE IT FURTHER RESOLVED, that the subject Shared Services Agreement is intended to take effect upon adoption of authorizing resolutions by both the Borough of Paramus and the Borough of Ho-Ho-Kus as well as execution of said Agreement by authorized officials of both entities and shall continue for a period of one (1) year commencing January 1, 2021 to December 31, 2021 unless either party notifies the other in writing of intent to cancel the Agreement; and BE IT FURTHER RESOLVED, that the Mayor and Municipal Clerk are authorized to sign such Shared Services Agreement following legal review. WHEREAS, the Borough of Ho-Ho-Kus and the Borough of Saddle River have each received a New Jersey Department of Transportation 2020 Municipal Aid Grant for the Resurfacing of Mill Road, Section 2; and WHEREAS, it is in the best interest of the municipalities to combine the resurfacing projects into a larger project to reduce the overall costs of the project which is beneficial to both municipalities; and WHEREAS, the Borough of Ho-Ho-Kus and the Borough of Saddle River propose an Inter-local Agreement for the Resurfacing of Mill Road, Section 2; and WHEREAS, the Borough of Ho-Ho-Kus will bid, award and administer the project; and WHEREAS, the Borough of Ho-Ho-Kus and the Borough of Saddle River will each be responsible for their portion of the project; NOW, THEREFORE, BE IT RESOLVED by the Governing Body that an Inter-Local Agreement be entered into with the Borough of Saddle River for the Resurfacing of Mill Road, Section 2. BE IT FURTHER RESOLVED that the Mayor and Municipal Clerk are hereby authorized to execute an Inter- Local Agreement with the Borough of Saddle River for the Resurfacing of Mill Road, Section 2. LIAISON REPORTS Recreation – Councilman Iannelli reported the football season has ended with no missed games with the A team. There was only one missed game on the B team as there was a positive COVID case from the other team. Soccer season has ended and again with no reported COVID cases. Wrestling season has been postponed until March. Basketball has been cancelled for the season; however, travel will continue with limited games and no spectators. Traveling Baseball winter training program is set to begin with all precaution in place. Library – Councilman Policastro reported the library application for the grant through the NJ Construction Bond Act was not awarded. Applicants may reapply in the spring. The Library Director, Gretchen Corsillo resigned from her position, Alyssa Harvey will be the interim Director until such time a new Director is hired. The Library Board will be advertising for the position. Board of Education – Councilman Policastro reported there was Monday, (2) cases of COVID at the school that caused school closure yesterday and today to allow contact tracing. The school health office has been in contact with those individuals who have been in close contract and need to quarantine. The school will re-open on Monday, November 30th which is the first day of phase 3 of the roll back plan that goes until January 15, 2021. Transmission rate for schools are low when compared to outside activities. The school maintains strict adherence to health and safety protocols, mask wearing, social distancing and no large gatherings. New health protocols changes go into effect on Monday, all family siblings must stay home if one is experiencing symptoms so a test can determine the cause. All students and staff must stay home during the period someone in their household is being tested for COVID. The school prefers to remain opened for the student’s education and well being Ambulance Corp. – No report Fire Department – Councilman Shell reported the Fire Department had their election of officers. The Chief will serve a 3rd term. The Fire Department decided given the circumstances with COVID, to change the by-law for that to happen. Chamber of Commerce – Councilman Shell reported the business are decorating for the Holiday and are doing a competition among themselves. Insurance – Councilman Crossley reported there was 100% of attendance from the Mayor and Council for the virtual Risk Management class, that normally takes place in Atlantic City.
