TOWN OF HOLLYWOOD PARK BOARD OF ADJUSTMENT MEETING & PUBLIC HEARING MONDAY, MAY 22, 2023, AT 6:00 P.M. 2 MECCA DRIVE, HOLLYWOOD PARK, TEXAS 78232 AGENDA I. CALL TO ORDER II. ROLL CALL III. OATHS OF OFFICE IV. REVIEW POWERS AND DUTIES OF BOARD OF ADJUSTMENT Sec. 78-51. Powers and duties. The Board of Adjustment shall have the power to: 1) Hear and decide appeals where it is alleged there is error in any order, requirement, decision, or determination made by the administrative officer in the enforcement of this chapter; 2) Hear and decide special exceptions to the terms of this chapter upon which it is required to pass as provided in this chapter; 3) Authorize upon appeal in specific cases such variance from the terms of this chapter as will not be contrary to the public interest, where, owing to special conditions, a literal enforcement of the provisions of this chapter will result in unnecessary hardship, and so that the spirit of this chapter shall be observed and substantial justice done; 4) Bring about the discontinuance of a nonconforming use under a plan whereby the owner's actual investment in the use prior to the time that the use became nonconforming can be amortized within a definite time period. V. CITIZEN PARTICIPATION A maximum of three (3) minutes per person is allowed. Those wishing to speak should sign up before the meeting begins. Time cannot be passed to other speakers. The Board of Adjustment cannot discuss any presented issue or take any action at this time. VI. PUBLIC HEARING A. Open Public Hearing: Public Hearing to receive comments from the public to consider an application for a variance from the Town of Hollywood Park Code of Ordinances Section 78-133(1) to construct a front porch extending into the front yard setback of the main structure at 146 Tall Oak Drive, more particularly described as BCAD Property #365007. Chapter 78, Section 78-133 – Area Regulations (1) Front yard. The Town will use appropriate social distancing guidelines, which will reduce the capacity level allowed within town hall during the meeting. Members of the public wishing to watch and listen to the meeting may do so through our city website under the "watch our meetings" tab. This meeting will be recorded and posted on the city YouTube channel. Any resident who would like to comment on any of the topics listed on the agenda, please either attend the meeting and sign up for citizen participation or submit your comment(s) via email to paten@hollywoodpark-tx.gov no later than two hours prior to the start of the meeting. Your comment(s) may be read to the board during the topic and will be provided to the board. Please include your name and address with your comment(s). Due to limited available seating an email will ensure the board will receive your comment(s). Decorum Required: Any disruptive behavior, including shouting or derogatory statements or comments may be ruled out of order by the Presiding Officer. Continuation of this type of behavior could result in a request by the Presiding Officer that the individual leave the meeting, and if refused, an order of removal. Attendance by Other Elected or Appointed Officials: It is anticipated that members of the City Council, or other city board, commissions and/or committees may attend the meeting in numbers that may constitute a quorum of the other city boards, commissions and/or committees. Notice is hereby given that the meeting, to the extent required by law, is also noticed as a meeting of the other boards, commissions and/or committees of the City, whose members may be in attendance. The members of the boards, commissions and/or committees may participate in discussions on the same items listed on the agenda, which occur at the meeting, but no action will be taken by such in attendance unless such item and action is specifically provided for on an agenda for that board, commission or committee subject to the Texas Open Meetings Act.
