February 24, 2026, at 7:00 PM, in the Committee Meeting Room, with the following members

◦ Committeeman Buontempo provided a report from the Department of
Information Technology.
Deputy Mayor Foster provided a report from the Department of Public Safety,
and the Board of Education.
Committeeman Vanderham provided a report from the Veterans Committee,
and the Holmdel Heritage Committee.
Mayor Impreveduto provided a report that included: post blizzard updates,
community clean up events, road closures, and E-Bike safety updates.

◦ Jay Yanello, Ladwood Drive- Mr. Yanello thanked DPW for their hard work
during the blizzard, and encouraged the Mayor to reconvene the ad-hoc
committee to review the plans for the Vonage site redevelopment.
Vincent Belcastro, Orchard Avenue- Mr. Belcastro stated that there is a coffee
drive-thru being built on the corner of Miller and Route 35, and raised concerns
about traffic.
Jennie Blumenthal, Stoney Brook Road- Ms. Blumenthal stated that the street
light in front of her house is out, and several others on her street are as well.
Dennis Pavlick, Orchard Avenue- Mr. Pavlick echoed Mr. Belcastro's concerns.
Mary Ellen Principe, Bethany Road- Ms. Principe said plows did not come
down her street until after midnight.
Lance Lupi, Line Road- Mr. Lupi inquired about cell phone reimbursements,
radon test availability, and there was an issue with the recording of the
December 9th meeting.

WHEREAS, the Open Public Meetings Act provides that the Township Committee may
enter into Executive Session to discuss matters that are of a confidential nature, pursuant to
N.J.S.A. 10:4-12; and
WHEREAS, it is recommended by the Township Attorney and Township Administrator
that the Township Committee enter into Executive Session to discuss matters set forth

RESOLUTION

RESOLUTION AUTHORIZING SCOPE OF WORK FOR TOWNSHIP
ENGINEER
WHEREAS, T&M Associates is currently retained as Township Engineer to the
Township of Holmdel; and
WHEREAS, there exists a need to obtain professional engineering services for the
Wilson Park Improvement Project; and
WHEREAS, T&M Associates has submitted the attached proposal, which is
attached hereto and incorporated by reference, proposing to complete the required tasks
on a billed hourly basis in a total amount not to exceed $170,050.00; and
WHEREAS, the governing body wishes to have the Township Engineer complete
the professional services outlined in the attached document, under the Township’s current
retainer of T&M Associates, subject to further authorization by the Township
Administrator and Township Attorney; and
WHEREAS, the Chief Financial Officer has certified as to the sufficiency of
funds in budget.
NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the
Township of Holmdel hereby approves the attached proposal from T&M Associates to
provide engineering services relating to the Wilson Park Improvement Project consistent
with the foregoing terms.
BE IT FURTHER RESOLVED that the foregoing authorization shall be
contingent upon further authorization from the Township Administrator and Township
Attorney in authorizing and directing the completion of work within the proposed scope
on an as-needed basis.

RESOLUTION AWARDING CONTRACT FOR EXTRAORDINARY UNSPECIFIABLE
SERVICE OF EMPLOYEE ASSISTANCE PROGRAM
WHEREAS, there exists a need for the Township to retain a firm to provide employee
assistance program services; and
WHEREAS, the Local Public Contracts Law, N.J.S.A. 40A:11-5(1)(a)(ii), does not
require competitive bidding for the provision of such extraordinary unspecifiable services
(“EUS”); and
WHEREAS, Mark White, Ph.D. P.A. has submitted a qualifying proposal to furnish the
employee assistance program, upon the terms set forth therein; and
WHEREAS, the Township Administrator and/or Qualified Purchasing Agent has filed a
certificate with the governing body supporting this EUS award, consistent with N.J.A.C. 5:34-
2.3(b), and the Township Committee concurs with the reasons set forth therein; and
WHEREAS, the total contract amount shall not exceed $17,500.
NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the
Township of Holmdel hereby awards a contract to Mark White, Ph.D. P.A. for the furnishing of
the employee assistance program to the Township on an as needed basis during calendar year
2026, consistent with the foregoing and subject to the certification of availability of funds by the
Chief Financial Officer.
BE IT FURTHER RESOLVED that the Mayor and the Clerk are hereby authorized and
directed to execute an agreement consistent with the foregoing, a copy of which shall be
maintained by the Clerk with notice of the awarded contract advertised in the Township’s official
newspaper pursuant to law.

RESOLUTION APPROVING REFUND OF 2026 PROPERTY TAXES PAID BY 100%
DISABLED VETERAN
8 LILAC COURT – BLOCK 50.34 LOT 42
WHEREAS on May 3, 2007, the Department of Veteran Affairs determined Robert C.
McBurnie to be 100% disabled; and
WHEREAS Robert C. McBurnie purchased 8 Lilac Court, Block 50.34 Lot 42, on
August 20, 2025; and
WHEREAS the 100% DAV exemption was approved by the Tax Assessor on January 5,
2026, effective January 1, 2026; and
WHEREAS Robert C. McBurnie paid 1Q 2026 property taxes in the amount of
$2,442.40; and
WHEREAS the 100% DAV exemption created an overpayment of 2026 property taxes in
the amount of $2,442.40 which is now due and owing to Robert C. McBurnie.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Township Committee of the
Township of Holmdel that the Tax Collector is hereby authorized to refund Robert C. McBurnie
the overpayment of $2,442.40 resulting from this action.

hereby is appointed as Deputy Registrar for Holmdel Township.

BE IT FURTHER RESOLVED by the Township Committee of the Township of
Holmdel do hereby authorize the appointment of Brian O’Malley Alternate Registrar for the

RESOLUTION AUTHORIZING SPECIAL MEETING
WHEREAS, P.L. 2024, c. 2 requires municipalities to enact ordinances to comply with
the Fourth Round of affordable housing by March 15, 2026; and
WHEREAS, the Township is a party to litigation challenging the Fourth Round
affordable housing law; and
WHEREAS, specifically, there is an emergency application pending before the Supreme
Court of the United States seeking an injunction against the March 15, 2026 deadline; and
WHEREAS, the Township Committee wishes to allow as much of an opportunity as
possible for the Supreme Court of the United States to decide this emergency application and to
then have a sufficient opportunity to reflect upon that outcome, before taking any formal action
relative to the March 15, 2026 deadline.
NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the
Township of Holmdel hereby authorizes and directs the Township Clerk to notice a special
meeting for Friday February 27, 2026 at 10:00 am for potential action on affordable housing
ordinances, consistent with the foregoing.

COUNTY OF MONMOUTH
RESOLUTION APPROVING ENTRY INTO A SHARED SERVICES AGREEMENT
WITH THE BOROUGH OF HIGHLANDS FOR THE PROVISION OF A TECHNICAL
ASSISTANT TO THE CONSTRUCTION OFFICIAL
WHEREAS, the Township of Holmdel (“Township”) is a municipal corporation of the
State of New Jersey, in the County of Monmouth, State of New Jersey; and
WHEREAS, the Borough of Highlands (“Borough”) is a municipal corporation of the
State of New Jersey, in the County of Monmouth, State of New Jersey; and
WHEREAS, the Uniform Shared Services and Consolidation Act, N.J.S.A. 40A:65-1 et
seq., authorizes local governmental entities to enter into agreements, among other things, for the
sharing of services; and
WHEREAS, the Township finds that it is in its best interest to establish a Shared
Services Agreement with the Borough to provide for a Township employee to serve as
Technical Assistant to the Borough’s Construction Official; and
WHEREAS, under the terms of the Shared Services Agreement, the Township shall
provide these services to the Borough from in the amount of $15,000 per year with annual
escalations for inflation for up to a three-year term.
NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the
Township of Holmdel, as follows:
1. The foregoing recitals are hereby incorporated as if set forth at length.
2. The Township Committee hereby approves entry into a Shared Services
Agreement with the Borough for the provision of a Technical Assistant to the
Borough Construction Official, consistent with the foregoing, substantially in the
form attached hereto as Exhibit A, and subject to the final approval of the
Township Attorney as to legal form.
3. The Mayor and Township Administrator are hereby authorized and directed to
take any and all steps reasonably necessary to effectuate the purposes of this
Resolution, including the execution of a shared services agreement consistent
with the foregoing terms.
4. This Resolution shall take effect immediately upon adoption.

5. Upon full execution, a true copy of the Shared Services Agreement shall be
transmitted to the Director of the Division of Local Government Services in the
Department of Community Affairs pursuant to law.

RESOLUTION APPROVING ENTRY INTO A SHARED SERVICES AGREEMENT
WITH THE BOROUGH OF LITTLE SILVER FOR THE PROVISION OF
INFORMATION TECHNOLOGY SERVICES
WHEREAS, the Township of Holmdel (“Township”) is a municipal corporation of the
State of New Jersey, in the County of Monmouth, State of New Jersey; and
WHEREAS, the Borough of Little Silver (“Borough”) is a municipal corporation of the
State of New Jersey, in the County of Monmouth, State of New Jersey; and
WHEREAS, the Uniform Shared Services and Consolidation Act, N.J.S.A. 40A:65-1 et
seq., authorizes local governmental entities to enter into agreements, among other things, for the
sharing of services; and
WHEREAS, the Township finds that it is in its best interest to establish a Shared
Services Agreement with the Borough to provide information technology services to the
Borough; and
WHEREAS, under the terms of the Shared Services Agreement, the Township shall
provide these services to the Borough in the amount of $32,000 per year with annual escalations
for inflation for up to a three-year term with the option to renew for two optional one-year
extensions.
NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the
Township of Holmdel, as follows:
1. The foregoing recitals are hereby incorporated as if set forth at length.
2. The Township Committee hereby approves entry into a Shared Services
Agreement with the Borough for the provision of information technology services,

ORDINANCE AMENDING CHAPTER 12 TITLED “FIRE PROTECTION AND
PREVENTION”
WHEREAS, the Township of Holmdel (“Township”) wishes to amend Chapter 12 of the
Township Code to clarify department roles, update fees pursuant to New Jersey Administrative
Code, and repeal ordinances regarding nursing homes, extended care facilities, and storage
facilities to conform to the Uniform Fire Code.
NOW, THEREFORE, BE IT ORDAINED, by the Township Committee of the
Township of Holmdel, in the County of Monmouth and the State of New Jersey, as follows:
SECTION 1. Chapter 12, titled “Fire Protection and Prevention,” is hereby amended as
follows (underlined text added; stricken text deleted):
§ 12-1. ENFORCEMENT OF THE UNIFORM FIRE SAFETY ACT.
[Sections 12-1.1 through 12-1.2 remain unchanged.]
§ 12-1.3. Establishment and Duties of Fire Prevention Bureau.
a. Local Enforcement. This section shall be enforced by the Bureau of Fire Prevention in
the Township of Holmdel which is hereby established pursuant to this section and
which is hereby designated as the Local Enforcing Agency (LEA) pursuant to the New
Jersey State Uniform Fire Code, N.J.A.C. 5:70-1 et seq.
b. Composition. The Bureau of Fire Prevention shall consist of the Senior Fire Official of
the Bureau who shall be appointed by the Township Committee pursuant to Title 11,
Civil Service, of the New Jersey Statutes. It shall be maintained and operated under
the immediate supervision of the Township Administrator or his duly appointed
designee. Director of Community Development. The Township may hire such other
inspectors and employees as may be necessary for fulfilling the duties set forth herein
and in the Fire Prevention Code. Such personnel shall be hired by the Township, after
consultation with the Senior Fire Official and the Fire Chief.
c. Duties. The Bureau shall be charged with the duties of the enforcement of this section
and such other ordinances, rules and regulations of the Township that pertain to fire
prevention, protection and control, including but not limited to making periodic
inspections of Life Hazard Uses (LHU's) pursuant to the New Jersey State Uniform
Fire Code, N.J.A.C. 5:70-1 et seq.; making other inspections as deemed necessary and
listed hereinafter in Section 12-1.7; reviewing plans and issuing permits; aiding the
fire chiefs in the investigation of fire; coordinating fire safety activities with the
Holmdel Fire and Police Departments; establishing and conducting programs for the
promotion of fire safety, prevention and education; maintaining an appropriate record
system and performing such related duties as may be assigned by the Township

Committee.
d. Salary. The salary of the Senior Fire Official, Fire Inspectors and any other personnel
in the Bureau shall be established by the Township Committee as required by law.
e. Reports. The Fire Prevention Bureau Official shall file an annual report with the
Township Committee Director of Community Development and the Fire Chief, in
addition to any reports required under the Uniform Fire Code. It shall contain all
proceedings under this article with such statistics as will show the nature and extent of
the performance of the duties of the office during the year.
f. The Senior Fire Official, inspectors and other employees shall be subject to removal by
the Township Committee for good cause and pursuant to Title 11, Civil Service, of the
New Jersey Statutes, where applicable.

§ 12-1.6. Permit Fees.
a. For the issuance of the permits described in N.J.A.C. 5:70-2.7, the following fees shall
be collected:
1. Type 1: $54100.

b. Commercial storage facilities available to the general public on a "per unit" basis:

§ 12-1.7. Additional Required Inspection and Fees.Life Hazard and Non-Life
Hazard Use Registrations.
In addition to the inspections and fees required pursuant to the Act and regulations of the
Department of Community Affairs, the following annual inspections and fees shall be
required:
a. All businesses, whether within a structure or on open land, including service
businesses and apartment house multiple dwellings, shall be inspected subject to
inspection annually. The annual inspection fee shall be as follows, with
measurements based on the floor area, gross:
b. Life hazard uses’ annual registration fees as set forth in the New Jersey State
Uniform Fire Code, N.J.A.C. 5:70-1 et seq. shall be collected by the Division of
Fire Safety in the Department of Community Affairs of the State of New Jersey.
c. All premises and businesses, including businesses on open land and vacant
properties, not classified as a "life hazard use" pursuant to the Uniform Fire Code
shall be classified as "non-life hazard use." Exception 1: Businesses that
are located within a “Collaborative Working Space”, as defined by Ordinance
20-10a, shall comply with Ordinance 20-10.
d. All non-life hazard uses shall be registered with the Holmdel Fire Prevention
Bureau and pay the annual registration fees below. All Fees are billed on January
1 of each year, or upon registration of a non-life hazard for the full annual Fee
amount. All Fees shall be paid within 30 days of the billing date, with the
exception of fees prescribed in 12-1.7g. Measurements shall be based on the
gross floor area of the space.
1. Under 500 square feet: $6080.
1.2. 501 to 1,000 square feet: $80110.
3. 1,001 to 2,499 square feet: $90140.
4. 2,500 to 3,499 square feet: $155170.
5. 3,500 to 4,999 square feet: $160200.
6. 5,000 to 6,499 square feet: $175230.
7. 6,500 to 7,499 square feet: $185260.
8. 7,500 to 8,499 square feet: $210290.
9. 8,500 to 9,999 square feet: $225360.
10. 10,000 and above: $275360 plus $340 for each additional 1,000 square feet,
floor area, gross.
e. Commercial photovoltaic sites: $2300.
f. An owner of a commercial multiple-occupancy building or complex, which

requires a common area inspection or site inspection of common parking, fire suppression
or fire detection systems, shall be registered as a landlord and shall pay an annual fee of
$200250 for the largest building and $75100 for each additional building on the premises.
g. An owner of a commercial building or complex, which requires a common
area inspection or site inspection of common parking, fire suppression or fire
detection systems, shall be registered as a landlord and shall pay an annual fee of
$300 for the largest building and $125 for each additional building on the
premises.
g. Any special event, as defined by Section 4-6.1, including weekend and after
business hour special events, requiring Fire Prevention or Uniform Construction
Code (UCC) inspector stand-by or inspections: $85.00 per hour for each required
inspector. It shall be at the discretion of the Fire Official for fire inspectors, and the
Construction Official, for UCC inspectors, with the approval of the Director of
Community Development, as to the number of inspectors and time required at any
event. All fees shall be paid prior to the event.
h. Any space that is or becomes vacant space shall be charged as calculated as
specified in 12-1.7d above and paid by the owner of the property.
i. Any inspection, other than those required in 12-1.7 h, that is required to be
performed after regular office hours, weekends, or holidays shall be charged at a
rate of $175 per inspection, and shall be paid prior to the scheduling of the
inspection.
[Section 12-1.8 remains unchanged.]
§ 12-1.9. (RESERVED.) Nursing Homes, Boarding Homes for Sheltered Care,
Rooming Houses and Boarding Houses.
a. All nursing homes, boarding homes for sheltered care, rooming houses and
boarding houses licensed by the State, or otherwise operating in the Township shall
have automatic fire detection systems installed in accordance with specifications as
set forth in the New Jersey State Uniform Fire Code. The system shall be connected
to an approved Central Station, which shall notify the Holmdel Police Department
simultaneously with the sounding of an audio-visual alarm in the facility. There
shall also be a monitoring device at each nursing station which shall indicate when
an alarm has been sounded. All systems shall have a service contract, with a fire
alarm service company, inspected and tested semiannually and a copy of the
contract along with the test results report shall be forwarded to the Holmdel
Township Fire Prevention Bureau for their file.
b. Nursing homes and extended care facilities as defined by N.J.S.A. 30:13-1 et seq.
are hereby required to install and maintain emergency electrical generators having
sufficient capacity to insure the provision of basic essential services such as
emergency lighting, life support equipment, heat, fire alarm and suppression
equipment, elevators, air conditioning to supply 10% of resident population, sump
pumps and food preservation equipment. Said generators shall also be capable of

furnishing electrical power to heating systems in the event of public utility power
failures. The generating system required to be installed by this subsection shall meet
the basic intent and requirements of the National Fire Protection Association
(Standard #99), Section 4.4.1.1. There shall be sufficient fuel capacity on hand for
forty-eight-hour operation of the generators.
A certificate signifying compliance with the terms and provisions of this shall be
supplied by nursing homes and extended care facilities to the Township. Existing
emergency generating systems meeting the requirements of NFPA Standard #99
shall be deemed as meeting the requirements of this subsection.
The owners or operators of covered facilities shall inspect and test the emergency
generating system installed in their facilities at least once per month and keep a log
of said inspections and tests. This log shall indicate whether or not the system was
fully functional on the date of the test and shall be available, during regular business
hours, for inspection by Township officials.
The Code Enforcement Officer, Fire Official or Electrical Subcode Official of the
Township of Holmdel shall be responsible for performing an annual inspection to
insure compliance with the terms and provisions of this subsection. The cost of said
annual inspection shall be $50 and shall be paid to the Township of Holmdel by the
owner or operator of the subject property. The annual inspection shall be for the
purpose of insuring that an emergency generating, system is in place and fully
functional. Records relating to these inspections shall be kept in the office of the
Construction Code Official of the Township of Holmdel.
§ 12-1.10. (RESERVED.) Storage Facilities.
At least annually, the Fire Official, or his designated representative, shall conduct
inspections of all commercial structures used for the storage of property. The
purpose of the inspection is to ensure that any fire protection systems are not
blocked or otherwise inhibited from serving the purpose for which they were
designed and installed. The Fire Official may increase the frequency of the
inspections provided for in this section if violations are noted, in order to assure
that the violations are corrected and do not proliferate.

SECTION 2. Severability.
The provisions of this Ordinance are non-severable. In the event that any portion of this
Ordinance is found to be invalid for any reason by any Court of competent jurisdiction, this
Ordinance shall be deemed invalid in its entirety.
SECTION 3. Repealer.
All ordinances and resolutions, and parts of ordinances and resolutions which are
inconsistent with provisions of this ordinance shall be, and are hereby, repealed to the extent of
any such inconsistency.

Township Code to amend fees consistent with the Uniform Construction Code and make various
other amendments consistent with State recommendations.
NOW, THEREFORE, BE IT ORDAINED, by the Township Committee of the
Township of Holmdel, in the County of Monmouth and the State of New Jersey, as follows:
SECTION 1. Chapter 10 of the Revised General Ordinances, titled “Local Enforcement of
the Uniform Construction Code,” is hereby amended as follows (underlined text added;
stricken text deleted):
§ 10-1. LOCAL ENFORCEMENT OF THE UNIFORM CONSTRUCTION CODE.

§ 10-1.3. Fees.
a. New Jersey State Permit Surcharge Fees. Amount: This fee shall be in the amount of
$0.00371 per
cubic foot volume of new buildings and additions. Volume shall be computed in accordance
with
N.J.A.C. 5:23-2.28. The fee for all other construction shall be $1.90 per $1,000 of value of
construction. Minimum fee $1. The above fee is subject to periodic change and exemptions
established by the Department of Community Affairs and will be calculated in
accordance with
N.J.A.C. 5:23-4.19 hereafter and as applicable with the regulations.
b. General Fees. The fee for plan review shall become due upon completion of subcode review.
The feeto be charged for a construction permit will be the sum of the basic construction fee plus
all applicable special fees. This fee shall be paid before a permit is issued and proposed work
commencing as contained within the regulations. The fee to be charged for a certificate of
occupancy shall be paid before a certificate is issued. This fee shall be in addition to the
construction permit. All fees shall berounded to the nearest dollar. Fees shall be as follows:
1. Plan Review Fee. The fee for plan review shall be 25% of the amount to be charged for
a construction permit. When prototype plans have been released a plan review fee shall
not be collected for permits issued therefrom and the total permit fee shall be reduced by
25%. There shall be an additional plan review fee of $85 per hour or part thereof for
review of an amendment or change to any plan that has already been released per
subcode having assigned plan review responsibility to perform such a review in

conjunction with the regulations and actual submittal. This fee may be waived at the
discretion of the Construction Official in the event the work and review is of a minor
nature.
2. The basic construction permit fee shall be the sum of the parts computed on the basis of
the volume or cost of construction, the number of plumbing fixtures and pieces of
equipment, the number of electrical fixtures and rating of electrical devices, the number
of sprinklers, standpipes and detectors (smoke and heat) at the unit rates and/or the
applicable flat fees as provided herein plus any special fees. The minimum fee for a
basic construction permit shall be
$85100 for any subcode permit.
3. Individual Tenant Space Fit-Up. When plans and specifications for individual tenant
spaces in multitenant spaces or buildings have been submitted and were not part of the
original permit application, the fee for permit updates shall be based upon the cost of the
work. For electric, fire and plumbing, the fees shall be based upon the equipment
installed.
4. There shall be a fee for a mechanical inspection performed by a mechanical inspector or
a plumbing inspector in an existing structure of Use Group R-3 or R-5. A mechanical
subcode technical section shall be completed, as appropriate, for work in an existing Use
Group R-3 or R-5, and the fees shall be the same as established for that device under the
plumbing subcode fees, except that no separate fee shall be charged for gas, fuel oil, or
water-piping connections, including the bonding conductor (jumper), associated with the
mechanical equipment inspected.
c. Building Volume or Cost. The fees for new construction or alteration are as follows:
1. Fees for new construction and additions shall be based upon the volume of the structure.
Volume shall be computed in accordance with N.J.A.C. 5:23-2.28.
2. Fees for renovations, alterations and repairs or site construction associated with
preengineered pre-engineered systems of commercial farm buildings, premanufactured
construction, and the external utility connection for premanufactured construction shall
be based upon the estimated cost of work. For the purpose of determining estimated cost,
the applicant shall submit to the agency such cost data as may be available and produced
by the architect or engineer of record, or by a recognized estimating firm, or by the
contractor. A bonafide contractor's bid, or contract if available, shall be submitted upon
request. Fee for additions shall be computed on the same basis as for new construction
for the added portion. Fees for combination of renovations and additions shall be
computed as the sum of the fees computed separately in accordance with the above
stated provision.
d. Individual subcode fees shall be as follows:
1. UCC Building Subcode Fees.

automatic transfer switch, disconnecting means, and future electric, such as circuits
installed for future use or intermittent needs.

except those which are portable plug-in-type, shall be counted.

(ff) When new gas piping is installed in conjunction with the replacement of water
heaters, boilers, furnaces and similar devices, the fee for the new gas piping shall be
in addition to the fee for the device installed. At the discretion of the Plumbing
Subcode Official this fee may be waived in the case of minor gas-pipe-type
alterations.
5. UCC certificate and other fees.
(a) Certificate of occupancy fee shall be in the amount of 10% of the total construction
permit fee. The minimum fee shall be $85100 for R-5-type use groups and the
minimum fee for all other use groups shall be $125 per building. Buildings
with multiple certificates of occupancy (such as a shopping center or similar
conditions) the fee shall be an additional
$85 fee per unit, tenant space or area.
(b) Temporary certificate of occupancy renewal: $30.
(c) Certificate of occupancy based on change of use: $175.
(d) The fee for a certificate of continued occupancy issued under N.J.A.C. 5:23-2.23(c):
$175.
(e) The fee for a certificate of continued occupancy issued in response to work
performed without construction permits pursuant to and described in DCA Bulletin

06-1 shall be $125 per subcode having jurisdiction over the work performed. This
fee shall be in addition to any permit fees required for work performed.
(f) Application for variation in accordance with N.J.A.C. 5:23-2.10:
(1) Class I residential R-5 use group structures: $150.
(2) All other Class I and Class II III structures, other than R-5: $350.
(3) Class III I and Class II structures: $600.
(g) Application for variation resubmission: $125.
(h) Application for change of use analysis: $350
(i) Reinstatement of suspended or abandoned permit described in N.J.A.C. 5:23-
2.16(b): 10%of the cost of the original permit per outstanding subcode and not less
than $25 per open (not finaled) subcode. This fee may be waived at the discretion
of the Construction Official.
[Sections 10-1.3(d)(5)(e)-(h) remain unchanged.]
SECTION 2. Severability.
The provisions of this Ordinance are non-severable. In the event that any portion of this
Ordinance is found to be invalid for any reason by any Court of competent jurisdiction, this
Ordinance shall be deemed invalid in its entirety.
SECTION 3. Repealer.
All ordinances and resolutions, and parts of ordinances and resolutions which are
inconsistent with provisions of this ordinance shall be, and are hereby, repealed to the extent of
any such inconsistency.
SECTION 4. Effective Date.
This ordinance shall take effect upon final adoption and publication in accordance with law.

This Ordinance amends fees consistent with the Uniform Construction Code and makes various
other amendments consistent with State recommendations.
LEGAL NOTICE
The foregoing ordinance was introduced and passed on the first reading at a meeting of
the Township Committee of the Township of Holmdel held on February 24, 2026 and will be
considered for final passage and adoption at a meeting of said Township Committee to be held
on March 10, 2026 at Township Hall, 4 Crawfords Corner Road, Holmdel, NJ at 7:30 PM at
which time and place all persons desiring to be heard thereon will be given full opportunity.
