CITY OF HORICON ZONING BOARD SEPTEMBER 30, 2013
OF APPEALS
The Horicon Zoning Board of Appeals met in Regular Session with Chairman Daryl
Levenhagen presiding. The meeting was called to order at 4:01 p.m.
Members Present: Daryl Levenhagen, Milton Schessow, James Grigg, Michael
Krueger, and Paul Kruel.
Members Absent: None
Motion by Grigg, second by Schessow, to approve the Zoning Board of Appeals
minutes from June 26, 2013.
All voting AYE. Motion carried.
Chairman Levenhagen clarified that the meeting was being recorded for the
convenience of the transcription for the secretary, not for publication. Levenhagen
requested that all those wishing to speak state their names and speak loudly.
Chairman Levenhagen announced this was a Public Hearing requesting a variance
to erect an addition to the current garage which will occupy the side yard and
approximately 58% of the required rear yard on the property located at 314 N Elm
Street, owned by Don and Sara Counard.
Motion by Grigg, second by Kruel, to open the Public Hearing for a variance to erect
an addition to the current garage which will occupy the side yard and approximately
58% of the required rear yard on the property located at 314 N Elm Street, owned by
Don and Sara Counard.
All voting AYE. Motion carried.
In attendance for the public hearing: Don Counard, property owner, and Craig
Halsema, alternate to the Board.
Chairman Levenhagen asked Don Counard to tell the Board what he is proposing to
do.
Counard stated due to the way his yard is positioned he has more side yard then
back yard which is why it is more than 30% of rear yard green space. Counard added
he is looking to add on a 26 foot by 26 foot addition to the current garage to get his
current things like boat and vehicles out of the driveway plus have a shop area to
work on his custom car.
Schessow asked if when the addition is built if both garages will be sided the same.
Counard replied the addition would be attached to it and once it was complete the
entire structure would be sided and roofed the same and match.
Schessow asked for the main reason for putting the addition on. Counard answered
there is not enough garage space. Counard stated he currently has a 2 1/2 car
garage but it is not deep so he is unable to put vehicles, plus boat and utility trailer

into the garage. Counard added that he needs a bigger shop area as he is building a
custom car with his son and does his own car repairs.
Schessow asked if the stuff that is currently outside will be placed in the new
addition. Counard answered the only thing that might not be would be the utility
trailer. Schessow clarified that all that would remain outside was a trailer. Counard
replied the utility trailer and his squad car because the county requires it be left out.
Grigg inquired if there would still be a buffer between the addition and the neighbor’s
driveway. Counard replied there will be grass between this and the neighbor’s
driveway and the neighbor’s driveway is right on the lot line.
Schessow asked how the driveway is going to be. Counard answered the driveway
will remain the same as it is now, with an entrance, and the new addition will be in
front of the existing slab already there.
Levenhagen verified the addition was for private use only. Counard answered yes, he
isn’t working on cars for a living anymore.
Schessow asked if there was anyone against this being done. Counard answered
there was no one he was aware of. Levenhagen stated nothing had come in that he
was aware of.
Schessow stated you are here because your building permit was denied. Counard
replied because of the green space issue.
Levenhagen asked if there was any further discussion.
All interested individuals and/or their representatives were given an opportunity to be
heard.
Motion by Schessow, second by Krueger, to close the Public Hearing for a variance
to erect an addition to the current garage which will occupy the side yard and
approximately 58% of the required rear yard on the property located at 314 N Elm
Street, owned by Don and Sara Counard.
All voting AYE. Motion carried.
Motion by Grigg, second by Schessow, to approve the variance to erect an addition
to the current garage which will occupy the side yard and approximately 58% of the
required rear yard on the property located at 314 N Elm Street, owned by Don and
Sara Counard.
All voting AYE. Motion carried.
Variance approved.
Non-Action Discussion: Discussion about what determined a side yard, front yard,
and back yard area.
