JUNE 5, 2025 MEETING MINUTES
APPROVED JUNE 19, 2025
President Jeanne Bellile called the meeting to order at 6:00 p.m. in the Community Center at
531 N. Nash St., Hortonville, Wisconsin.
Trustees present: Bob Jewell, Shauna Keel, Carrie Lathrop, Jim Moeller, Jane Olk, and Julie
Arendt Vanden Heuvel.
Trustees absent:
Officials/Staff present: Administrator Nathan Treadwell, Clerk-Treasurer Jane Booth, Director of
Public Works Aaron Steber, Chief of Police Brian Bahr, Library Director Alexandrea
Krause, and Attorney Ashley Lehocky.
Consent Agenda
Motion [Arendt Vanden Heuvel/Olk] to approve as outlined points A and B only with the
corrections noted in the previous minutes and pulling C out for further discussion. Roll call vote
5 ayes, 0 nays, 2 abstain (Moeller/Keel) motion carried.

Motion [Olk/Jewell] to approve the vouchers as presented. Roll call vote, 7 ayes, 0 nays, motion

Agenda Changes

Preregistered Citizens to be heard
David Cushman, 211 Oak Knoll Court, I am a newer resident in Hortonville, I moved here about
two years ago. I learned from the Inspector, Paul Hanlon and the Village Administrator of
Hortonville believes that if there is no provision for something in the zoning ordinance that it is
prohibited. I disagree with this conclusion. Using a word search of the ordinance, I could not find
a provision for flag poles. So that means there is a lot of red tags set to go off in this Village for
flag poles, since there is no provision for that. I contacted Paul Hanlon in regard to antenna
power related for the amateur radio service. The amateur radio service has existed since the
early 1900’s and made the first transatlantic radio communications.
I think it is in the best interest of the Village of Hortonville to expeditiously review the Federal
Communications Commission declaratory ruling regarding Federal preemption. No doubt
everyone would like to keep legal costs to a minimum as I pursue this matter further.

License
Motion [Olk/Moeller] to approve O-2-25 ordinance amending retail Class C Wine License.
Roll call vote, 7 ayes ,0 nays, motion carried.
Discussion and possible action on Alonzo Park Playground/Splash Pad Pay Application

DPW Director Steber said that this is the application for the work completed on the Splash Pad
and Playground. We are holding a little money back until the grass is grown in.
Motion [Moeller/Jewell] to approve the payment to Vinton Construction for the Alonzo Park
Playground/Splash Pad construction in the amount of $295,768.41.
Roll call vote, 7 ayes, 0 nays, motion carried.
Discussion and possible action on R-11-25 to approve 2024 Compliance Maintenance
Annual Report
DPW Director Steber said that we do this every year for our Wastewater Treatment Facility.
Compliments to Sean Kuske and all the Public Works employees.
Motion [Arendt Vanden Heuvel/Olk] to approve R-11-25 the Compliance Maintenance resolution
to accept the 2024 Compliance Report.
Roll call vote, 7 ayes, 0 nays, motion carried.
Discussion and possible action on Request for reimbursement for asphalt repair of
resident at 455 E Main Street.
Administrator Treadwell said that a resident wanted to have the Village repair their driveway
apron that the state DOT caused on their driveway for the 2024 Hwy 15 construction. They
approached the DOT about it and basically it is closed, and they will not do anything for it. It is a
stretch of our old road that used to connect to the landfill site. The dump trucks did park on this
in 2024 when the construction was underway and used it as a staging area and could have
damaged it.
Motion [Jewell/Moeller] to deny the request. Unanimous voice vote, motion carried.
Discussion on Pocket Park TID Agreement
Administrator Treadwell said that there has been no movement on this, and we did do a one-
year extension. Technically they would have a year to complete it, and there is no claw back
mechanism for this and they will not get the reimbursement of $7,000 from the Village per the
agreement.
Attorney Lehocky said that claw backs are really hard to enforce. One option, depending on the
project, is to offer a mortgage and then to forgive a certain portion of that if they add value to the
property.
Discussion on food trucks in the Village
Administrator Treadwell said that this was asked to be put on the agenda for discussion. I did
hand out a sample of the City of Marshfield’s mobile food ordinance. I do know that there are a
lot of municipalities looking at similar types of things.
Attorney Lehocky said that Gibraltar had one that was discussed among the municipal attorneys
for some time and the argument there was that the ordinance was unconstitutional, and it was
essentially eliminating food trucks in order to prevent any negative impact it would have on a
local business, on brick-and-mortar restaurants. And ultimately the court determined in that case
that it was an unconstitutional ordinance because it did have that impact. The same group, I
believe, was looking at the City of Marshfield ordinance and they had some issues with regards
to, it was unclear whether you could have food trucks on private property, and they amended it
and then that group went away. I provided the City of Marshfield’s ordinance to be a starting
point.
Trustee Olk said that she can see this happening in Alonzo Park and are they licensed, are they
reputable, are they safe, etc. What happens if they aren’t licensed if they aren’t safe?
Attorney Lehocky said that this ordinance allows food trucks to participate in special events on
city property, but only for those designated events. But now if you are going to allow that, your
staff is going to have to oversee that process, so maybe it is easier to say we aren’t going to
allow this in a park.
Discussion ensued.
President Bellile said that she contacted almost every business in town, and I will tell you that
every single business that serves food in our Village were very upset that we allowed food
trucks. They said you finally did something good to bring citizens into the community, we pay
taxes, we pay our water/sewer bills, we make donations to the Fire Department, and we support
our community. Why would you ever allow food trucks to go into that park and take business
away from our business?
The consensus was to look at the ordinance and bring it back to the board at the next meeting.
Report of Village Officials
Clerk-Treasurer: The report is in the packet.
Director of Public Works: The report is in the packet. I wasn’t able to be at the grand opening,
and I want to give thanks to the village staff and to the construction contractor.
Chief of Police: The report is in the packet. The one thing that I wanted to mention is the siren
and I will have the maintenance contract for that at the next board meeting. President Bellile
asked if we could have speed bumps on John Street. There have been numerous episodes on
John Street. Chief of Police Bahr said they could do extra patrol at this time. Trustee Arendt
Vanden Heuvel asked about the stop light at Alonzo Park and which stoplight do you go by. It
was decided to have a one-way entrance to the park and to add signage.
Library Director: I provided my report in the packet. We had a part-time employee leave, and
we have hired a new person within a month. Highlights for the summer – 46 or more programs
that we have going for the eight weeks. We have some really great prize packets, Brewers club-
level tickets, T Rats tickets, Packers gear, and 20 prize baskets have been donated so far. We
are also doing a school supply drop – all six schools will have a bin the first week of June where
any unused, unwanted school supplies can be donated. We will hold on to them until August
and then provide them to families that need them.
Two unique programs are coming up; we are having an indigenous performer coming on
Monday, June 16. He will be putting on his dance regalia layer by layer and explain exactly what
each item means in their culture.
of native dancing outfits and Plantable Pages is another program. You make paper from scratch
adding native seeds to it then turn it into postcards, greeting cards, etc. There is currently a
statewide campaign where people can write to their legislator’s explaining why Libraries are so
important. We have postcards in the library available for this.
Attorney: Nothing new
Administrator: The report is in the packet. I had a decent amount of meetings with developers;
I met with Appleton Alliance Church regarding their future intent on the Opera House.
Any other miscellaneous topics for future discussion
Trustee Arendt Vanden Heuvel said that we have a plate reader, do we have any
policy/procedure regarding the waste site. Greenville uses FABS for their waste site.
Consensus was to have a COW before the board meeting on June 19th at 5:00 pm to discuss.
Communications and Miscellaneous Business
Black Otter Lake District news: I was not able to attend the meeting last time. DPW Director
Steber said that we met last week and discussed potential work at the boat landing and a
sinkhole that has developed. We received an update on the harvester thanks to a person that is
here. We received an update on our watershed study from our consultant and additional
sampling that will take place this summer.
Building permit report: The May building permit report was submitted.

Gold Cross Ambulance run reports and news: None
Hortonville Civic Association: Nothing new
Senior Activities Committee: We meet next week on Tuesday at noon.
