140 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, SEPTEMBER 28, 2021 The City Council of the City of Hueytown met on Tuesday, September 28, 2021 in Council meeting room at 5: 30P. M. at City Hall. The meeting was called to order with Council President Pickens and Council members Hurliman, Wright and Jacks present. Council Member Zinnerman was absent. Mayor Ware was also present during the Pre -Council meeting. The purpose of the meeting was to discuss general municipal business and review the City Council agenda. MINUTES OF CITY COUNCIL CITY OF HUEYTOWN, ALABAMA TUESDAY, SEPTEMBER 28, 2021 A regular meeting of City Council of the City of Hueytown, Alabama was held in the Council Chamber of Hueytown City Hall on Tuesday, September 28, 2021. 1. CALL TO ORDER, INVOCATION, ROLL CALL AND MEDIA RECOGNITION The meeting was called to order at 6: 02P. M. with approximately Twelve people in the audience. The invocation was given by Council Member Jacks, followed by the Pledge of Allegiance. Upon roll call, with Council members Pickens, Hurliman, Wright and Jacks were present. Council Member Zinnerman was absent. Council President Pickens presided over the meeting. Mayor Ware was present and the City Attorney, Charlie Waldrep, of Waldrep Stewart 8s Kendrick, LLC. was present. Kailah Hegler was also present from the Western Star. 2. APPROVAL OF MINUTES Council member Hurliman moved, seconded by Council member Wright, that the minutes of the Pre -Council and the Regular Council Meetings held Tuesday, September 14, 2021 be approved as previously received and thereby dispensing with reading of the minutes. Upon roll call, President Pickens, and Council members Hurliman, Wright and Jacks voted yes. There were no nay votes. President Pickens declared the minutes approved. 3. MAYOR' S REPORT The Mayor welcomed everyone present and was glad of their attendance to listen to what's happening in the City. The Mayor gave an update of the Pavilions being constructed at the Storm Shelter site, stating the concrete slab should be this week followed by the posts, electrical and roof; weather permitting. The Mayor informed everyone of the well played game last week by the Golden Gophers and invites everyone to attend this week' s Home Coming game this coming Friday. The Mayor also reminds everyone of the Hueytown Harvest Farmers Market this Saturday at the Stadium Park. 4. STANDING COMMITTEE REPORTS a) Finance Committee: Council Member Jacks, no report. b) Planning and Development: Council Member Zinnerman, Absent. c) Public Safety: Council Member Hurliman, no report. d) Public Works and Parks: Council Member Wright reports the HVAC system has been installed and asked the Mayor if he has met with Alabama Power about lighting with the Mayor' s response, yes. 5. OFFICERS REPORTS Page 1 of 5  141 a) Police Chief Mike Yarbrough: no report. b) Fire Chief Morris: Chief Morris reports of resuming presentations at the City's Schools and Churches promoting Fire Prevention. c) Public Works Director Mike Butts: absent. d) Building and Zoning Inspector Barry Humphries: Inspector Humphries reports Residential Permitting continues to be brisk in the Westwind and Virginia Ridge subdivisions. Humphries states the Department has received plans for a new section for the Westwind Subdivision. 6. GREAT THINGS HAPPENING IN HUEYTOWN ( LOCAL ORGANIZATIONS AND CHAMBER OF COMMERCE) Debbie Kiker, Acting Director for the Hueytown Chamber of Commerce, reports the following: A) Director Kiker presented a Two -Hundred dollar check to Tina Collier of the Hueytown Pet Pantry. The funds are donated from the Chambers' proceeds from the Paw Palooza event. B) Hueytown High School Homecoming Week Paint the Town Purple Contest winners are; 3rd place; Speedy' s, 2nd place; McKinney Tax Service and 1st place; Just Like Moms BBQ. C) The Hueytown Area Chamber of Commerce 2021 " Awards Dinner and Silent Auction" has been postponed due to COVID and many of the participants could not attend. The event is being rescheduled for the Spring. D) Thank You to new Chamber Members; Charlie Waldrep and Associates and Morrow Railroad joining as a Chamber Champion. E) Ribbon Cutting for Gifted hands Multiplex scheduled for Monday, October 4, 2021 at 4: OOP. M. F) Chamber City Wide Fall event scheduled for Saturday, October 30, 2021 which is a free event for the Community. 1. The event starts with a Halloween Parade at 4: OOP. M. followed with activities at the Stadium Park. 2. There is a planned free Hayride, crafts, trick or treating, inflatable Dion Derby Dash, free hot- dogs for kids and more. 3. Asking businesses, churches and City to have a tent or table and pass out candy and business information. 4. Presentation on Talk of Alabama program October 11, 2021. G) The Hueytown Chamber Keepsake Cookbooks on Sale now which has over four -hundred recipes. H) Munch and Mingle scheduled for Thursday, November 4, 2021 from 6: OOPM to 7: OOPM at Venue 3131. I) The Hueytown Harvest Farmers Market continues through October 31 st at the Stadium Park from 8: OOA. M. to Noon. J) Remember to Shop Local! 7. CORRESPONDENCE: There was a letter of appreciation received from the Hueytown Chamber of Commerce and a letter of concern for the City' s Dog Park. 8. BILLS FOR APPROVAL: Council member Jacks then moved, seconded by Council member Wright, that the List of Bills be approved in the total amount of $ 255, 282. 87. RESOLUTION 6084: Resolution 6084 was presented to consider the listed properties to be a public nuisance and the nuisance be removed or abated. RESOLUTION NO. 6084 PUBLIC NUISANCE AND WEED ABATEMENT JURISDICTION TO PROCEED AND DESIGNATION OF PERSONS TO PERFORM THE WORK FOR REMOVAL OR ABATEMENT Council member Wright moved, seconded by Council member Hurliman, to adopt Resolution 6084. Motion by Council Member Jacks with a second by Council Member Hurliman to suspend the regular meeting to discuss items contained in the Resolution. Upon roll call, President Pickens and Council members Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. Motion by Council Member Jacks with a second by Council Member Hurliman to return to regular session. Upon roll call, President Pickens and Council members Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. Motion by Council Member Wright with a second by Council Member Hurliman to rescind the initial motion. President Pickens declared the initial motion rescinded. Motion by Council Member Hurliman to amend Resolution 6084 to omit the address of 142 Lindberg Road with a second by Council Member Jacks. Upon roll call, President Pickens and Council members Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. Resolution 6085: Resolution 6085 was presented to consider the waiver of the Special Event Business License fee for the Hueytown Chamber of Commerce event scheduled for October 30, 2021 at Stadium Park. RESOLUTION NO. 6085 SPECIAL EVENTS - REQUEST FROM HUEYTOWN CHAMBER OF COMMERCE ( A NON- PROFIT CORPORATION) TO HOLD SPECIAL EVENT AT STADIUM PARK Council member Jacks moved, seconded by Council member Hurliman, to adopt Resolution 6085. Upon roll call, President Pickens and Council members Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 11. Resolution 6086: Resolution 6086 was presented for the City to consider the authorization to purchase two emergency dispatch radio consoles. RESOLUTION NO. 6086 AUTHORIZE THE PURCHASE OF TWO EMERGENCY DISPATCH RADIO CONSOLES Council member Jacks moved, seconded by Council member Wright, to adopt Resolution 6086. Upon roll call, President Pickens and Council members Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 12. Resolution 6087: Resolution 6087 presented to consider was the authorization of maintenance agreements for the City's Emergency Generation Page 3 of 5 equipment. RESOLUTION NO. 6087 AUTHORIZE THE MAINTENANCE AGREEMENTS FOR THE CITY' S EMERGENCY GENERATION EQUIPMENT Council member Jacks moved, seconded by Council member Wright, to adopt Resolution 6087. Upon roll call, President Pickens and Council members Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 13. Resolution 6088: Resolution 6088 was presented to consider the transfer of the Alcohol License for Sportsters, LLC located at 242 Forest Road, Hueytown. RESOLUTION NO. 6088 RESOLUTION APPROVING THE TRANSFER OF ALCOHOL LICENSE FOR SPORTSTERS, LLC Council member Jacks moved, seconded by Council member Wright, to adopt Resolution 6088. Upon roll call, President Pickens and Council members Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 14. Resolution 6089: Resolution 6089 was presented to consider setting the City Council meeting dates for the 2021 Holiday Season and notice City Hall Holiday Closing dates. RESOLUTION NO. 6089 SET COUNCIL MEETING DATES FOR 2021 HOLIDAY SEASON AND NOTICE CITY HALL HOLIDAY CLOSING DATES Council member Hurliman moved, seconded by Council member Jacks, to adopt Resolution 6089. Resolution 6090: Resolution 6090 was presented to consider the declaration of certain Municipal personal property surplus and not needed for public purposes. RESOLUTION NO. 6090 DECLARING AND DEEMING CERTAIN MUNICIPAL PERSONAL PROPERTY SURPLUS AND NOT NEEDED FOR PUBLIC PURPOSES AND AUTHORIZING AND APPROVING THE DISPOSAL THEREOF Council member Jacks moved, seconded by Council member Hurliman, to adopt Resolution 6090. Upon roll call, President Pickens and Council members Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 16. Resolution 6091: Resolution 6091 was presented to consider the approval of the Alcohol License for Victory Marketing, LLC located at 609 Allison Bonnett Memorial Drive, Hueytown. RESOLUTION NO. 6091 RESOLUTION APPROVING THE ALCOHOL LICENSE FOR VICTORY MARKETING, LLC Council member Wright moved, seconded by Council member Jacks, to adopt Resolution 6091. Upon roll call, President Pickens and Council members Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 17. Ordinance 21- 0928- 1: Ordinance 21- 0928- 1 was introduced for a First Reading/ Public Hearing to consider the annexation of property located at 4811 Washington Road, Hueytown into the City. Page 4 of 5 144 ORDINANCE NO. 21- 0928- 1 AN ORDINANCE TO ANNEX CERTAIN REAL PROPERTY 4811 WASHINGTON ROAD, HUEYTOWN, ALABAMA WHICH IS CONTIGUOUS TO THE CITY OF HUEYTOWN, ALABAMA Upon no one coming present to discuss Ordinance 21- 0928- 1, Council member Jacks moved, seconded by Council member Hurliman, to Close the Public Hearing. Upon roll call, President Pickens and Council members Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried with President Pickens closing the Public Hearing. A motion by Council Member Jacks to suspend the rules to vote on Ordinance 21- 0928- 1 with a second to the motion by Council Member Wright. Upon roll call, President Pickens and Council members Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. EXTEND FLOOR TO THE PUBLIC Prior to extension of the floor to the public, President Pickens reminded that anyone wishing to address the Council should state their name and address; must be a resident of Hueytown to speak and should limit comments to three minutes. A) Mary Meyer at 502 Saddleridge inquired about: i. Resolution 6082 and what was the Public Safety Committee with the Mayor supplying information on this matter to Ms. Meyer. ii. Asked to define " abatement" to which the City Attorney supplied the definition. iii. Inquired if the homeowner was noticed of the public hearing to which Inspector Humphries responded to the question. iv. Informed the Mayor and Council the doors at the Senior Center are heavy and are difficult to operate. B) Inspector Humphries informed the Mayor and Council of the property located at 121 Lindberg has met compliance. C) Tina Collier at 769 McLean Road thanks the community for the Community' s support of the Pet Pantry. 16. ADJOURNMENT There being no further business to come before the meeting; Council President Pickens declared the meeting adjourned at 6: 46P.M.
