240 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, JUNE 14, 2022 The City Council of the City of Hueytown met at 5: 30P. M. in the Council Chamber meeting room at the City of Hueytown City Hall on Tuesday, June 14, 2022. The meeting was called to order with Council Members Zinnerman, Pickens, Wright and Jacks present and Hurliman absent. The Mayor was absent. City attorney Charlie Waldrep, of Waldrep Stewart 8v Kendrick, LLP was present. There were approximately five individuals in the audience. The Council went into Executive Session as 5: 36P. M. when Charlie Waldrep, the City Attorney, made a public statement to the Public present in the meeting room that the subject matter relates to real- estate with potential legal issues which meets the qualifications of the Alabama Open Meetings Act for the Council to go into Executive Session. The Executive Session concluded at 6: 20P. M. with the Council returning to the Council Chamber meeting room. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, JUNE 14, 2022 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber of Hueytown City Hall on Tuesday, June 14, 2022. 1. CALL TO ORDER, INVOCATION, ROLL CALL AND MEDIA RECOGNITION The meeting was called to order at 6: 27P. M. with approximately twenty- six individuals in the audience. The invocation was given by Council Member Jacks followed by the Pledge of Allegiance. Upon roll call, Council Members Pickens, Zinnerman, Wright and Jacks being present. Council Member Hurliman was absent. Council President Pickens presided over the meeting. Mayor Ware was absent and the City Attorney, Charlie Waldrep, of Waldrep Stewart & Kendrick, LLP was present. 2. APPROVAL OF MINUTES Council Member Zinnerman made a motion followed by a second to the motion by Council Member Wright to approve the May 24, 2022 Council Meeting and the June 2, 2022 Council Work Session meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon a roll call vote, President Pickens and Council Members Zinnerman, Wright and Jacks voting yes. There were no nay votes. President Pickens declared the minutes approved. 3. MAYORS REPORT The Mayor was absent at the meeting. 4. STANDING COMMITTEE REPORTS a. Finance Committee: Council Member Zinnerman, no report. b. Planning and Development: Council Member Jacks, no report. c. Public Safety: Council Member Wright, no report. d. Public Works and Parks: Council Member Hurliman, absent. 5. GREAT THINGS HAPPENING IN HUEYTOWN ( LOCAL ORGANIZATIONS AND CHAMBER OF COMMERCE) a. Debbie Kiker, Executive Director of the Hueytown Chamber of Commerce reports the following: i. Announced American Pride Trophy and Awards, Rod Hodges is the June Business Of The Month. ii. The next Munch and Mingle/ Business After Hours is scheduled for Thursday, July 16, 2022 at 6: 30P. M. to 7: 30P. M. at Venue 3131. iii. The Health and Wellness Expo is scheduled for Tuesday, July 19, 2022 at 8: 30A. M. to 11: 30A. M. at the Hueytown Intermediate School. iv. The " Flag" pole banners will be installed soon. v. T- shirts are available. vi. The fourth annual Paw Palooza and Weiner Dog Races is scheduled for Saturday, September 10, 2022. There are sponsorship opportunities and vendor spots available. vii. The Farmers Market continues through August at 8: OOA. M. to Noon at the Stadium Park. viii. Reminds Everyone to Shop Local to support the City's Local Businesses. b. Michele McKlinton representing the Hueytown Arts Council reports the following: i. Spoke of the City Fest Event which was held June 1 lth with approximately four -thousand attendees. Next years event will be held Saturday, June 10, 2023. ii. A huge thank you to the City Departments for the extra work done to make this year's City Fest a great success. iii. The next event is an Art and Author at the Health and Wellness Expo July 19, 2022 at the Hueytown Intermediate School. c. Carol Rector, Interim Director of the Hueytown Library reports the following: i. Announced the Library has been awarded a $ 20, 000. 00 grant. Ms. Rector informed persons present how the funds will be used. ii. Reports the first Story Time event was a huge success with approximately 41 children in attendance plus an additional 40 adults. 7. CORRESPONDENCE: There was no correspondence. 8. BILLS FOR APPROVAL: Council Member Zinnerman moved followed by a second to the motion by Council Member Jacks that the List Of Bills be approved totaling the amount of 668, 879. 30. RESOLUTION 6228: Resolution 6228 was presented as a Public Hearing request regarding a declared Public Nuisance at 120 Mahone Avenue. A letter received by the City from Ms. Jeanie Wilbert was reviewed by the Council with Building Inspector Humphries supplying additional information to the Council. Upon no other discussion regarding this topic, President Pickens closed the Public Hearing. A motion by Council Member Zinnerman was made to allow a sixty- day ( 60) extension to allow additional time for the property owner to abate the Public Nuisance followed by a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 10. RESOLUTION 6229: Resolution 6229 was presented as a Public Hearing request regarding a declared Public Nuisance at 1438 Virginia Lane. Building Inspector Humphries reports the Nuisance has been abated. President Pickens closed the Public Hearing. There was no action taken by the Council on Resolution 6229. 11. RESOLUTION 6174: Resolution 6174 was presented to the Council as a Public Hearing as follow- up from the April 12, 2022 Council Meeting regarding a declared Public Nuisance at 115 Kenilworth Road. Ms. Kristel Reed, representing the property owner to report there has been some progress made. The remaining items are being used in the remodeling of the house. Building Inspector Humphries reports to the Council progress has been made from the April 12, 2022 Council Meeting but there are items which continue to need to be addressed. Ms. Reed states the remaining items are required for the remodeling of the home and is seeking additional time. President Pickens closed the Public Hearing. A Motion by Council Member Zinnerman that Resolution 6174 be addressed at the June 28, 2022 Council Meeting to allow such time for Building Inspector Humphries to inspect the property to confirm the remaining items are related to the home remodeling project. A second to the motion was made by Council Member Jacks. Upon a roll call vote, President Pickens and Council Members Zinnerman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 12. RESOLUTION 6181: Resolution 6181 was presented to the Council as a Public Hearing as follow- up from the April 12, 2022 Council Meeting regarding a declared Public Nuisance at 108 Kenilworth Road. The Ms. Victoria Tolly, the property owner, informed the Council of had made arrangements for the vehicle to be removed from the property. Building Inspector Humphries confirms the vehicle has been removed from the property. President Pickens closed the Public Hearing. No further action was required by the Council. 13. RESOLUTION 6230: Resolution 6230 was presented to the Council as a Public Hearing request for the declared Public Nuisance at 3605 Stump Town Road. Ms. Crista Paniagua addressed the Council to inform the Council of having difficulty securing a contractor to remove the structure and is seeking additional time. Inspector Humphries reports the property has been cleaned up and is seeking additional time to locate a contractor to remove the structure. The Council requests the City' s Inspection Department compile a list of contractors with a City Business License to supply to property owners seeking such services. Upon no other discussion, President Pickens closed the Public Hearing. A motion by Council Member Jacks to allow additional thirty ( 30) days for the property owner to secure a contractor to remove the structure and to bring this matter before the Council at the July 12, 2022 Council Meeting. A second to the motion was made by Council Member Jacks. Upon a roll call vote, President Pickens and Council Members Zinnerman, Wright and Jacks voting yes. There were no nay votes. RESOLUTION 6231: Resolution 6231 was presented to the Council to consider to repeal Resolution Number 6222 and to declare a Public Nuisance and Order Abatement of an unsafe structure located at 120 Mahone Avenue. A motion by Council Member Jacks to adopt Resolution Number 6231 was made with a second to the Motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 15. RESOLUTION 6232: Resolution 6232 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement and the demolition of an unsafe structure located at 432 Patterson. Avenue. A Motion by Council Member Jacks to adopt Resolution Number 6232 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 16. RESOLUTION 6233: Resolution 6233 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement and the demolition of an unsafe structure located at 2005 High School Road. A Motion by Council Member Jacks to adopt Resolution Number 6233 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 17. RESOLUTION 6234: Resolution 6234 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement and the demolition of an unsafe structure located at 2727 19th Street North. A Motion by Council Member Jacks to adopt Resolution Number 6234 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 18. RESOLUTION 6235: Resolution 6235 was presented regarding the property located at 3605 Stump Town Road. This item relates to item 13 above with the Council granting a thirty ( 30) day extension for the property owner to abate the Public Nuisance. 19. RESOLUTION 6236: Resolution 6236 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 116 Greenridge Road. A Motion by Council Member Wright to adopt Resolution Number 6236 was made with a second to the motion by Council Member Jacks. Upon a roll call vote, President Pickens and Council Members Zinnerman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 20. RESOLUTION 6237: Resolution 6237 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 121 East Crest Road. A Motion by Council Member Wright to adopt Resolution Number 6237 was made with a second to the motion by Council Member Jacks. RESOLUTION 6238: Resolution 6238 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 140 East Crest Road. RESOLUTION 6250: Resolution 6250 was presented to the Council to consider amending the fiscal year 2022 City Budget for the replacement of the Heating and Cooling Unit in the Police Department Criminal Investigation Division and to appropriate funds to the Community Program Account. A Motion by Council Member Zinnerman to adopt Resolution Number 6250 was made with a second to the motion by Council Member Jacks. RESOLUTION 6251: Resolution 6251 was presented to the Council to consider authorizing the Invitation To Bid the Solid Waste Collection and Disposal Services Garbage Contract) . RESOLUTION 6252: Resolution 6252 was presented to the Council to consider authorizing the Invitation To Bid the Grounds Maintenance Contract. A Motion by Council Member Zinnerman to adopt Resolution Number 6252 was made with a second to the motion by Council Member Jacks. Upon a roll call vote, President Pickens and Council Members Zinnerman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 36. ORDINANCE 22- 0614- 01: Ordinance 22- 0614- 01 was presented as a First Reading/ Public Hearing to consider amending the City's Zoning map for the property located at 2109 Windcroft Road from R 1 to AG. Mr. Syx, who resides at the property being considered for the rezoning addressed the Council of the proposed rezoning. President Pickens closed the Public Hearing after no other person came forward to address the Council regarding this proposed Ordinance. June 14, 2022 Council Meeting Minutes Page 6 of 7 246 37. ORDINANCE 22- 0614- 02: Ordinance 22- 0614- 01 was presented as a First Reading/ Public Hearing to amend the City Code Section 82. 4 entitled Waste Collection. Public Works Director, Mike Butts, addressed the Council about the proposed amendment to the City Code, President Pickens closed the Public Hearing after no other person came forward to address the Council regarding this proposed Ordinance. 38. RESOLUTION 6253: A motion by Council Member Zinnerman to add — Resolution 6253 as item number 38 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Pickens and Council Members Zinnerman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. Resolution 6253 was presented to the Council to consider the ratification of the appraised values and to authorize the purchase of rites -of -way for the Hueytown Road ( CR- 46) Widening Project known as the Alabama Department of Transportation Project Number STPBH- 7021- 600. A motion by Council Member Jacks to adopt Resolution 6253 followed by a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 39. EXTEND FLOOR TO THE PUBLIC: Prior to the extension of the floor to the public, President Pickens reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a. Mary Meyer residing at 502 Saddleridge thanks the Council Members for the service to the community. Ms. Meyer inquired following up regarding the placement of the U. S. Flag. Council Member Jacks informed Ms. Meyer of the placement of the US and State Flags as being correct. b. Shelia Winfield at 3206 191h Street North informed the Council of the alley behind her house which is in bad condition with pot -holes and ruts from all the recent rain events. Ms. Winfiled also informed the Council of the storm drain on 19" Street at the end of the alley is not working properly. Public Works Director, Mike Butts informed the Council the Department will address the issues discussed. 40. ADJOURNMENT: With no further business to come before the Council Meeting; a motion by Council Member Zinnerman was made to adjourn the meeting.
