247 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, JUNE 28, 2022 The City Council of the City of Hueytown met at 5: 30P. M. in the Pre -Council Chamber meeting room at the City of Hueytown City Hall on Tuesday, June 28, 2022. The meeting was called to order with Council Members Zinnerman, Pickens, Hurliman, Wright and Jacks present. The Mayor and City attorney Charlie Waldrep, of Waldrep Stewart & Kendrick, LLP was present. There were no individuals in the audience. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, JUNE 28 2022 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber of Hueytown City Hall on Tuesday, June 28, 2022. 1. CALL TO ORDER, INVOCATION, ROLL CALL AND MEDIA RECOGNITION The meeting was called to order at 6: 17P.M. with approximately twenty- four individuals in the audience. The invocation was given by Council President Pickens followed by the Pledge of Allegiance. Upon roll call, Council Members Pickens, Hurliman, Zinnerman, Wright and Jacks being present. Council President Pickens presided over the meeting. Mayor Ware and the City Attorney, Charlie Waldrep, of Waldrep Stewart 8s Kendrick, LLP were present. Kailah Hegler was also present from the Western Star. 2. APPROVAL OF MINUTES Council Member Zinnerman made a motion followed by a second to the motion by Council Member Jacks to approve the June 14, 2022 Council Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. President Pickens declared the minutes approved. 3. MAYORS REPORT The Mayor welcomes everyone present and taking the time from their busy schedules to attend the meeting to learn what's happening in the City. The Mayor read a letter from State Senator Greg Reed regarding a grant recently received for the City's Park Facilities and the Youth Sports Programs. 4. STANDING COMMITTEE REPORTS a. Finance Committee: Council Member Zinnerman, no report. b. Planning and Development: Council Member Jacks, no report. c. Public Safety: Council Member Wright, no report. d. Public Works and Parks: Council Member Hurliman, no report. 5. OFFICERS REPORT a. Police Chief, Mike Yarbrough: reports there was a large presence of law enforcement in the City from various surrounding jurisdictions as a result of June 28, 2022 Council Meeting Minutes Page 1 of 7  an incident which originated in the City Of Homewood. Yarbrough reports the felon has been apprehended. b. Fire Chief, Scotty Morris: No report. c. Mike Butts, Public Works and Parks Director: Absent. d. Barry Humphries, Building and Zoning Inspector: Humphries reports lots of activity in the Department and supplied information on the site next to Huddle House. 6. GREAT THINGS HAPPENING IN HUEYTOWN ( LOCAL ORGANIZATIONS AND CHAMBER OF COMMERCE) a. Debbie Kiker, Executive Director of the Hueytown Chamber of Commerce reports the following: i. Announced A Health 8v Wellness Expo scheduled for Tuesday, July 19, 2022 from 8: 30A. M. to 11: 30A. M. at the Hueytown Intermediate School. ii. The Local Social Event is scheduled every Friday through August at the Stadium Park from S: OOP. M to 9: OOP. M. iii. The Farmers Market is every Saturday through August at Stadium Park from 8: OOA. M. to Noon. iv. Announced God and Country Event at the Pleasant Ridge Baptist Church on Sunday, July 3, 2022. v. Announced a new program sponsored by the Chamber, " Hometown Heroes" signs. vi. Reminds Everyone to Shop Local to support the City' s Local Businesses. b. Regina Evans Barrentine informed everyone present about the Farmers Market and the Local Social Events reports the following: i. Local Social this Friday, July 1" from 5: OOP. M. to 9: OOP. M. ii. Saturday is the Farmers Market with five new vendors added. c. Michele McKlinton representing the Hueytown Arts Council reports the following: i. First time ever Art and Author expo July 19th to coincide with the Chamber' s Health Expo. At the Hueytown Intermediate School. d. Carol Rector, Interim Director of the Hueytown Library reports the following: i. Ms. Rector updated persons present about the planned use of the Grant Funds which was recently awarded to the Library. ii. Tomorrow is orientation for Seniors. iii. Reports the Story Time event continues to be a huge success with approximately sixty-five people present with three dogs. iv. Informs everyone present that the Library is known for many different things, including offering Notary Service. 7. CITY BOARDS REPORT: a. Michael Merritt, President of the Hueytown Parks 8v Recreation Board reports the following: i. Thanks to all those involved in the Youth Sports Programs. ii. The Softball Program 8U Girls won the State Championship and will be heading off to the World Series. iii. The Baseball Program the 9U and 12U Boys both won Second Place and is heading to the World Series Run- off State Championship. iv. The fall Soccer, Youth Football and Softball programs sign- up has begun. v. The Marin Luther King, Jr. Community Center is nearing completion with the Termite Infestation remediation and the installation of LED Light fixtures at the Brooklane Community Center. Reservations for the community centers can be obtained at www. Huevtownparks. com vi. Seeks clarification of the responsible entity for the City's recently acquired King Street Park with maintenance and Pavilion rentals. June 28, 2022 Council Meeting Minutes Page 2 of 7  249 vii. Requests an update of the sign replacement at Brooklane Park which was damaged from a storm event. viii. Announced the Board' s award of a $ 45, 564. 00 bid for the installation of Rubber Playground Mulch for the Brooklane and Martin Luther King, Jr. Parks. The Park Board has the ability to pay for half of the cost and is seeking financial assistance from the City for half of the cost. 8. CORRESPONDENCE: The Mayor and Council received a thank you note from Judge Thrash and a sign request from the American Legion. 9. BILLS FOR APPROVAL: Council Member Zinnerman moved followed by a second to the motion by Council Member Jacks that the list of bills be approved totaling the amount of $ 504, 190. 27. RESOLUTION 6273: Resolution 6273 was presented as follow- up from the May 28, 2022 Council Meeting Public Hearing request regarding a declared Public Nuisance at 114 Dabbs Avenue. Ms. Miranda Meredith supplied an update to the Mayor and Council with Building InspectorsupplyingHumphries additional information to the Council. Upon no other discussion regarding this topic, President Pickens closed the Public Hearing. A motion by Council Member Zinnerman was made to allow a six -day ( 6) extension to allow additional time for the property owner to abate the Public Nuisance followed by a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 11. RESOLUTION 6274: Resolution 6274 was presented to the Council to consider securing Termite Bonds for the City' s Facilities. A Motion by Council Member Jacks to adopt Resolution Number 6274 was made and to add the Storm Shelter, Martin Luther King, Jr. Community Center facilities with a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 12. RESOLUTION 6254: Resolution 6254 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 114 Pine Street. A Motion by Council Member Wright to adopt Resolution Number 6254 was made with a second to the motion by Council Member Hurliman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 13. RESOLUTION 6255: Resolution 6255 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 213 Pine Street. A Motion by Council Member Wright to adopt Resolution Number 6255 was made with a second to the motion by Council Member Hurliman. A Motion by Council Member Wright to adopt Resolution Number 6256 was made with a second to the motion by Council Member Hurliman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 15. RESOLUTION 6257: Resolution 6257 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 223 Woodward Drive. A Motion by Council Member Wright to adopt Resolution Number 6257 was made with a second to the motion by Council Member Hurliman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 16. RESOLUTION 6258: Resolution 6258 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 225 Pine Street. A Motion by Council Member Wright to adopt Resolution Number 6258 was made with a second to the motion by Council Member Hurliman. RESOLUTION 6259: Resolution 6259 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 301 Pine Street. A Motion by Council Member Jacks to adopt Resolution Number 6259 was made with a second to the motion by Council Member Hurliman. RESOLUTION 6260: Resolution 6260 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at Inglenook Drive. A Motion by Council Member Jacks to adopt Resolution Number 6260 was made with a second to the motion by Council Member Hurliman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 19. RESOLUTION 6261: Resolution 6261 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 426 Murphy' s Lane. 20. RESOLUTION 6262: Resolution 6262 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 620 Wright Avenue. A Motion by Council Member Wright to adopt Resolution Number 6262 was made with a second to the motion by Council Member Hurliman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 21. RESOLUTION 6263: Resolution 6263 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 1636 Second Avenue. A Motion by Council Member Wright to adopt Resolution Number 6263 was made with a second to the motion by Council Member Hurliman. RESOLUTION 6272: Resolution 6272 was presented to the Council to consider the declaration of a Structure being a Public Nuisance for the property located at 304 Oakwood Avenue. A Motion by Council Member Jacks to adopt Resolution Number 6272 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 31. RESOLUTION 627313: Resolution 6273B was presented to the Council to consider the declaration of a Structure being a Public Nuisance for the property located at 2935 Allison Bonnett Memorial Drive. A Motion by Council Member Zinnerman to adopt Resolution Number 6273B was made with a second to the motion by Council Member Jacks. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 32. ORDINANCE 22- 0614- 01: Ordinance 22- 0614- 01 was presented to consider amending the City's Zoning map for the property located at 2109 Windcroft Road from R1 to AG. The first reading/ public hearing for Ordinance 22- 0614- 01 was held at the June 14, 2022 Council Meeting. A Motion by Council Member Wright to adopt Ordinance Number 22- 0614- 01 was made with a second to the motion by Council Member Hurliman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 33. ORDINANCE 22- 0614- 02: Ordinance 22- 0614- 02 was presented to amend the City Code Section 82. 4 entitled Waste Collection. The first reading/ public hearing for Ordinance 22- 0614- 02 was held at the June 14, 2022 Council Meeting. A Motion by Council Member Wright to adopt Ordinance Number 22- 0614- 02 was made with a second to the motion by Council Member Hurliman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman and Wright voting YES and Council Member Jacks Voting NO. There were four yes votes and one no vote. The motion carried. 34. EXTEND FLOOR TO THE PUBLIC: Prior to the extension of the floor to the public, President Pickens reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a. Liz Nelson at 315 Harlem Avenue addressed the Mayor and Council of an ongoing problem. How does a nuisance get on the Council' s agenda. Council President Pickens advised Ms. Nelson of the process. b. Terry Killow at 2816 15' Street Road commends the Council on the letters sent out regarding nuisance matters. c. Mary Meyer residing at 502 Saddleridge still trying to understand the nuisance abatement process. Ms. Myer also spoke to the placement of the flags. Mr. Frey at the American Legion spoke to this topic along with the Mayor stating the flags are properly placed. d. Eric Frey 2845 Brooklane Drive, has been absent the past few meetings attending the Hueytown Citizens Police Academy. Mr. Frey spoke of services the Legion is available to assist and/ or participate in. Mr. Frey is seeking June 28, 2022 Council Meeting Minutes Page 6 of 7  LAWFALWA assistance with the City' s Public Works department with a lift truck to complete the repairs on the ball field concession stand/ field- house. Mr. Frey thanks the City for supporting the Legion by offering a place to participate and speak. Mr. Frey also spoke to the request for the directional signs which was sent to the Mayor and Council. e. Michael Merritt at 3030 LeAnne Drive spoke about the traffic issues at the Hueytown Intermediate School. Chief Yarbrough, President Pickens and the Mayor spoke to this concern. 35. ADJOURNMENT: With no further business to come before the Council Meeting; a motion by Council Member Zinnerman was made to adjourn the meeting.
