254 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, JULY 12, 2022 The City Council of the City of Hueytown met at 5: 30P. M. in the Pre -Council Chamber meeting room at the City of Hueytown City Hall on Tuesday, July 12, 2022. The meeting was called to order with Council Members Zinnerman, Pickens, Hurliman, Wright and Jacks present. The Mayor was absent and City attorney .— Charlie Waldrep, of Waldrep Stewart 8v Kendrick, LLP was present. There was one individual in the audience. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, JULY 12 2022 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber of Hueytown City Hall on Tuesday, July 12, 2022. 1. CALL TO ORDER, INVOCATION, ROLL CALL AND MEDIA RECOGNITION The meeting was called to order at 6: 05P. M. with approximately twenty- four individuals in the audience. The invocation was given by Pastor Winston, the City Chaplin, followed by the Pledge of Allegiance. Upon roll call, Council Members Pickens, Hurliman, Zinnerman, Wright and Jacks being present. Council President Pickens presided over the meeting. Mayor Ware was absent and the City Attorney, Charlie Waldrep, of Waldrep Stewart 8s Kendrick, LLP. was present. Kailah Hegler was also present from the Western Star. 2. APPROVAL OF MINUTES Council Member Jacks made a motion followed by a second to the motion by Council Member Wright to approve the June 28, 2022 Pre -Council Meeting and Council Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. President Pickens declared the minutes approved. 3. MAYORS REPORT The Mayor was absent from the meeting. A motion by Council Member Hurliman to amend the meeting agenda was made to remove item 10 and move item 26 into the former item 10 slot and add item 27 Resolution 6292, and item 28 Resolution 6293,with Public Comments becoming item 29 and adjourn, as item 30. A second to the motion was made by Council Member Zinnerman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks Voting yes. There were no nay votes. President Pickens declared the Meeting Agenda amended. 4. STANDING COMMITTEE REPORTS a. Finance Committee: Council Member Zinnerman, reports the June 2022 City Profit 8. Loss Statement has been received and distributed to the Council. Zinnerman reports that for all General Fund accounts are positive. Zinnerman further reports the General Fund has received July 12, 2022 Council Meeting Minutes Page 1 of 6  255 14, 251, 479. 59 and expenses of $ 11, 519, 638. 29 for a profit of 2, 731, 841. 30 for the fiscal year to date through June 2022. b. Planning and Development: Council Member Jacks, no report. c. Public Safety: Council Member Wright, no report. d. Public Works and Parks: Council Member Hurliman, no report. 5. OFFICERS REPORT a. Police Chief, Mike Yarbrough: reports two of the six recently purchased Patrol Vehicles are now in service. The accessories have now been received for the remaining four vehicles and will be placed in service once the equipment is installed. Yarbrough also reports there are two vacant Police Officer positions. b. Fire Chief, Scotty Morris: No report. c. Mike Butts, Public Works and Parks Director: Absent. d. Barry Humphries, Building and Zoning Inspector: No Report. 6. GREAT THINGS HAPPENING IN HUEYTOWN ( LOCAL ORGANIZATIONS AND CHAMBER OF COMMERCE) a. Debbie Kiker, Executive Director of the Hueytown Chamber of Commerce reports the following: i. Introduced Patrick Coyne who is the Career Tech Teacher. Mr. Coyne introduced Faith Theros who is a Hueytown High School student who won seventh in the Nation in the Skills USA Customer Service Competition. ii. Announced Speedy' s Mexican Restaurant as the July Hueytown Chamber of Commerce Business Of The Month iii. Announced the Chambers First Ribbon -TYING event. This event is tying the community Churches, Businesses, City and Chamber together. iv. Recognized " People Of Hueytown" as Mrs. Joann Logan. v. Announced A Health & Wellness Expo scheduled for Tuesday, July 19, 2022 from 8: 30A. M. to 11: 30A. M. at the Hueytown Intermediate School. vi. The Farmers Market is every Saturday through August at Stadium Park from 8: OOA. M. to Noon. vii. Announced August 29' through September 2nd is " Paint The Town Purple" for the week of Homecoming. viii. Announced September 10' is the " Paw Palooza & Wiener Dog Races" Event. ix. Announced October 15t' is Cancer Awareness Event. x. Announced October 29t' " It' s Fall Y' all Fest" Event. xi. Reminds Everyone to Shop Local to support the City' s Local Businesses. b. Michele McKlinton representing the Hueytown Arts Council reports the following: i. Announced the first time ever Art and Author expo July 19t' to coincide with the Chamber' s Health Expo. At the Hueytown Intermediate School. c. Carol Rector, Director of the Hueytown Library reports the following: i. Ms. Rector gave an update about the planned use of the Grant Funds which was recently awarded to the Library. Currently have 17 students and 7 tutors scheduled to participate in the program. ii. Reports the Story Time program with Beth Rock continues to be a complete success. iii. Reports the Story Time event continues with Beth Rock as the story teller. iv. Reports the Library continues to receive positive comments of the mural which was recently painted on the building. 7. CORRESPONDENCE: a. President Pickens announced the upcoming Sales Tax Holiday for related school supplies. 8. BILLS FOR APPROVAL: Council Member Zinnerman moved followed by a second to the motion by Council Member Hurliman that the list of bills be approved totaling the amount of 358, 825. 12. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. RESOLUTION 6276: Resolution 6276 was presented as a Public Hearing request regarding a declared Public Nuisance at 237 Mimosa Drive. Mr. Dewey Kennedy addressed the Council stating the property has been foreclosed and is set for auction July 25, 2022. Mr. Kennedy states the yard has been mowed to which Inspector Humphries states he will revisit the property. Upon no other discussion regarding this topic, President Pickens closed the Public Hearing. A motion by Council Member Zinnerman was made for an extension to July 26, 2022 to allow additional time for the property owner to abate the Public Nuisance and the City Inspector to report back; a second to the motion made by Council Member Hurliman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 10. RESOLUTION 6291: Resolution 6291 was presented as a Public Hearing request regarding a declared Public Nuisance at 35 Cambridge Road. Mr. McCoy addressed the Council seeking an additional thirty ( 30) days to allow time to bring the property into compliance. A Motion by Council Member Wright to adopt Resolution Number 6291 was made and to grant an additional thirty ( 30) days extension to bring the property into compliance with a second to the motion by Council Member Hurliman Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 11. RESOLUTION 6277: Resolution 6277 was presented to the Council to consider setting a public hearing for the issuance of a Temporary Trailer Use Certificate for the location of 585A Owen Circle. A Motion by Council Member Hurliman to adopt Resolution Number 6277 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 12. RESOLUTION 6278: Resolution 6278 was presented to the Council to consider a tax revenue enhancement agreement, business license discovery/ recovery administration agreement with Avenue Insights and Analytics, LLC. A Motion by Council Member Wright to adopt Resolution Number 6278 was made with a second to the motion by Council Member Hurliman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. RESOLUTION 6279: Resolution 6279 was presented to the Council to consider the order to abate a declared Public Nuisance of an unsafe structure at 608 Yellowbird Lane. A Motion by Council Member Hurliman to adopt Resolution Number 6279 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 14. RESOLUTION 6280: Resolution 6280 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 215 Chapel Drive. A Motion by Council Member Zinnerman to adopt Resolution Number 6280 was made with a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 15. RESOLUTION 6281: Resolution 6281was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 111 East Crest Road. A Motion by Council Member Zinnerman to adopt Resolution Number 6281 was made with a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 16. RESOLUTION 6282: Resolution 6282 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 2080 Cherry Avenue. A Motion by Council Member Zinnerman to adopt Resolution Number 6282 was made with a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 17. RESOLUTION 6283: Resolution 6283 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 3248 Larabee Lane. A Motion by Council Member Zinnerman to adopt Resolution Number 6283 was made with a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 18. RESOLUTION 6284: Resolution 6284 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 1310 26" Avenue North. A Motion by Council Member Zinnerman to adopt Resolution Number 6284 was made with a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 19. RESOLUTION 6285: Resolution 6285 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 2009 27' Avenue North. A Motion by Council Member Zinnerman to adopt Resolution Number 6285 was made with a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 20. RESOLUTION 6286: Resolution 6286 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 2900 Circle Drive. RESOLUTION 6287: Resolution 6287 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 921 26' Avenue North. A Motion by Council Member Zinnerman to adopt Resolution Number 6287 was made with a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 22. RESOLUTION 6288: Resolution 6288 was presented to the Council to consider the declaration of a Public Nuisance of an unsafe structure for the property located at 2009 27th Avenue North. A Motion by Council Member Zinnerman to adopt Resolution Number 6288 was made with a second to the motion by Council Member Hurliman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 23. RESOLUTION 6289: A motion by Council Member Zinnerman to remove Resolution 6289 from the agenda as item 23 with a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 24. RESOLUTION 6290: Resolution 6290 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 1802 28t'' Avenue North. A Motion by Council Member Wright to adopt Resolution Number 6290 was made with a second to the motion by Council Member Hurliman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 25. ORDINANCE 22- 0714- 01: Ordinance 22- 0714- 01 was presented to the Council as a First Reading/ Public Hearing to consider amending the City Zoning Map for the property located at 3037 Allison Bonnett Memorial Drive from MR to R2. Upon no person coming forward to speak either for or against the zoning change, President Pickens closed the Public Hearing. 26. RESOLUTION 6291: This item was moved to item Ten on the agenda. 27. RESOLUTION 6292 Resolution 6292 was presented to the Council to consider the declaration of certain real property to be surplus and no longer needed for public purpose and to authorize its sale. The property location is at 117 Forest Road. A Motion by Council Member Zinnerman to adopt Resolution Number 6292 was made with a second to the motion by Council Member Hurliman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 28. RESOLUTION 6293: Resolution 6293 was presented to the Council to consider amending the fiscal year 2021- 2022 General Fund budget for the purchase of Safety Surfacing Material for some of the City' s Playgrounds. A Motion by Council Member Hurliman to adopt Resolution Number 6293 was made with a second to the motion by Council Member Jacks. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. EXTEND FLOOR TO THE PUBLIC: Prior to the extension of the floor to the public, President Pickens reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a. Harold Coram at 3586 1" Street South addressed the Council about a flooding condition on his property. City attorney Waldrep spoke to this matter followed by Mr. Pickens deferring this matter to the Mayor for follow- up. b. Mary Meyer at 502 Saddleridge addressed the Council with questions about the Sales Tax Holiday. President Pickens responded to Ms. Meyer' s questions. c. Eric Frey at 2845 Brooklane Drive addressed the Council with information about the proper placement of the US Flag in the meeting room. With no further business to come before the Council Meeting; a motion by Council Member Zinnerman was made to adjourn the meeting. Council President Pickens declared the meeting adjourned at 6: 56P.
