MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, AUGUST 09, 2022 The City Council of the City of Hueytown met at 5: 30P. M. in the Pre -Council Chamber meeting room at the City of Hueytown City Hall on Tuesday, August 09, 2022. The meeting was called to order with Council Members Zinnerman, Pickens, Hurliman, Wright and Jacks present. The Mayor and City attorney Charlie Waldrep, _ of Waldrep Stewart 8v Kendrick, LLP was present. There were approximately thirty- one individuals in the audience. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, AUGUST 09, 2022 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber of Hueytown City Hall on Tuesday, August 09, 2022. 1. CALL TO ORDER, INVOCATION, ROLL CALL AND MEDIA RECOGNITION The meeting was called to order at 6: 02P. M. with approximately thirty-three individuals in the audience. The invocation was given by Council President Pickens followed by the Pledge of Allegiance. Upon roll call, Council Members Pickens, Zinnerman, Hurliman, Wright and Jacks being present. Council President Pickens presided over the meeting. Mayor Ware and the City Attorney, Charlie Waldrep, of Waldrep Stewart & Kendrick, LLP were present. Kailah Hegler was also present from the Western Star. 2. APPROVAL OF MINUTES Council Member Jacks made a motion followed by a second to the motion by Council Member Zinnerman to approve the July 26, 2022 Council Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. President Pickens declared the minutes approved. 3. MAYORS REPORT The Mayor welcomes everyone present and taking the time from their busy schedules to attend the meeting to learn what' s happening in the City. The Mayor expressed thanks to the City' s Public Works, Fire and Police Departments for their response attending from issues created from the recent storms last week. There were trees and flooding as the storms moved through the City. The Mayor gave an update on the work being done at the Storm Shelter Site. The Mayor also supplied an update of the grant regarding the Sidewalk Project, stating everything is completed and cleared with the engineering and now waiting for the Alabama Department of Transportation to supply an Environmental Clearance for the project. 4. STANDING COMMITTEE REPORTS a. Finance Committee: Council Member Zinnerman, no report. b. Planning and Development: Council Member Jacks, no report. c. Public Safety: Council Member Wright, no report. d. Public Works and Parks: Council Member Hurliman, no report. 5. OFFICERS REPORT August 09, 2022 Council Meeting Minutes Page 1 of 5  267 a. Police Chief, Mike Yarbrough: reports the homicide/ suicide incident which occurred this morning was a domestic matter and was no danger to the public. b. Fire Chief, Scotty Morris: reports thank you, to the Mayor and Council for supplying the needed tools and supplies for the department to do it' s job with a special Thank You to the Police Department for it's assistance at the Mt. Moriah Baptist Church fire last week. Morris also recognized many retirees in the audience that got the City to where it is today. c. Mike Butts, Public Works and Parks Director: reports the Valley Creek Cleanup event is this coming Saturday. d. Barry Humphries, Building and Zoning Inspector: reports the construction site next to Huddle House is Fast Pace Medical facility being built. 6. GREAT THINGS HAPPENING IN HUEYTOWN ( LOCAL ORGANIZATIONS AND CHAMBER OF COMMERCE) a. Regina Evans representing the Hueytown Harvest Farmers Barrentine, Market 8s the Hueytown Chamber of Commerce reports the following: i. Announced Paint the Town Purple from August 29' through September 2, 2022. Paw Palooza 8s Wiener Dog Races scheduled for ii. Announced the September 10, 2022. iii. The Farmers Market is every Saturday through August at Stadium Park from 8: OOA. M. to Noon. There are three remaining markets for this year. iv. Announced the Local Social Event is first Friday each month except for the month of September due to Homecoming. v. Thanks everybody for supporting the Farmers Market and Local Social Events. vi. Reminds Everyone to Shop Local to support the City' s Local Businesses. 7. CITY BOARDS REPORT: of the Hueytown the a. Carol Rector, Interim Director Library reports following: i. The summer reading program ended July 28'' with very, very positive feedback from the childrens parents and grandparents. ii. Applications are being accepted for the next session of the Reading Program starting in September. Reading Buddies" program iii. The " continues with trained dogs provided by the Greater Birmingham Humane Society. iv. Reports the Concord Fire Department participated with the last Story Time event which the topic was Fireman and Fire Trucks. The City' s Fire Department supplied fire hats which were distributed to the participants. v. Chicks with Sticks, a knitting group meets every Monday from 10: 00AM to Noon. vi. Notary services are now available at the Library. vii. Ms. Rector expressed her thanks to the ladies at the library and really appreciates all that they do. 8. CORRESPONDENCE: A letter from Ms. Verby Burton was received and distributed to the Mayor and Council. 9. BILLS FOR APPROVAL: Council Member Zinnerman moved followed by a second to the motion by Council Member Jacks that the list of bills be approved totaling the amount of $ 572, 918. 43. RESOLUTION 6304: Resolution 6304 was presented to the Council to consider amending the Fiscal Year 2022 budget to fund a Retiree longevity bonus as authorized by the Alabama Legislative Act 202- 229. A motion by Council Member Hurliman was made to adopt Resolution Number 6304 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Pickens No Vote, and Council Members Zinnerman Yes Vote, Hurliman Yes Vote, Wright No Vote and Jacks Yes Vote. There were three yea votes and two nay votes. The motion carried. 11. RESOLUTION 6305: Resolution 6305 was presented to the Council to consider the authorization of the Community Grant Program with the Jefferson County Commission to assist with operational costs of the Hueytown Senior Center. A Motion by Council Member Jacks to adopt Resolution Number 6305 was made with a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 12. RESOLUTION 6306: Resolution 6306 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement of an unsafe structure for the property located at 2935 Allison- Bonnett Memorial Drive. After an historical update from Inspector Humphries about this matter, a Motion by Council Member Jacks to adopt Resolution Number 6306 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 13. RESOLUTION 6307: Resolution 6307 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement of an unsafe structure for the property located at 120 Mahone Avenue. A Motion by Council Member Jacks to adopt Resolution Number 6307 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 14. RESOLUTION 6308: Resolution 6308 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 100 Highland Avenue. A Motion by Council Member Zinnerman to adopt Resolution Number 6308 was made with a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 15. RESOLUTION 6309: Resolution 6309 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 2017 291h Avenue North. RESOLUTION 6310: Resolution 6310 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 2114 29" Avenue North. A motion by Council Member Wright to adopt Resolution Number 6310 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 17. RESOLUTION 6311: Resolution 6311 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 139 Wickstead Road. A Motion by Council Member Wright to adopt Resolution Number 6311 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 18. RESOLUTION 6312: Resolution 6312 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 130 Wickstead Road. A Motion by Council Member Wright to adopt Resolution Number 6312 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 19. RESOLUTION 6312: Resolution 6312 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 121 Wickstead Road. A Motion by Council Member Wright to adopt Resolution Number 6312 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 20. RESOLUTION 6314: Resolution 6314 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 122 Wickstead Road. A Motion by Council Member Zinnerman to adopt Resolution Number 6314 was made with a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 21. RESOLUTION 6315: Resolution 6315 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 130 Lindberg Road. A Motion by Council Member Zinnerman to adopt Resolution Number 6315 was made with a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 22. RESOLUTION 6316: Resolution 6316 was presented to the Council to consider the declaration of a Public Nuisance and order the abatement for the property located at 121 Lindberg Road. A Motion by Council Member Zinnerman to adopt Resolution Number 6316 was made with a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. RESOLUTION 6317: Resolution 6317 was presented to the Council to consider amending the Fiscal Year 2022 Budget to authorize City Park Facilities improvements. A Motion by Council Member Wright to adopt Resolution Number 6317 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 24. EXTEND FLOOR TO THE PUBLIC: Prior to the extension of the floor to the public, President Pickens reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a. Joe Stroud at 6530 Letson Lake Road addressed the Mayor and Council about criminal littering occurring on the road in his neighborhood. Mr. Stroud has been cleaning trash along the street for the past 13 years and is seeking information about what a citizen can do to help with the enforcement of no littering/ dumping and to actually issue a Citation and/ or prosecute persons responsible for littering. The City Attorney, Mayor and Police Chief Yarbrough addressed Mr. Stroud' s concerns. b. Verby Burton thanks the Mayor and Council for the approval of the Retirees' bonus payment. c. Michelle from the Hueytown Arts Council reports of another Wall Mural being completed at the Hueytown Primary School with requests from the Concord and Hueytown Intermediate Schools asking to have a Mural. The Arts Council is getting ready for the Christmas festivities and continues to seek others to become involved in the Arts Council. d. Eric Frey 2845 Brooklane Drive from the American Legion Post 128 addressed the Mayor and Council to follow- up with the request for directional signage being placed within the City's rite -of -way at the end of Neighbors Avenue. The Mayor and Inspector Humphries addressed Mr. Frey about this matter. e. Regina Evans Barrentine at 919 Pinehaven Drive, representing the Hueytown Harvest Farmers Market stating the Hueytown Harvest Farmers Market is a Certified Alabama Farmers Market with all participants selling produce are certified in which the farmer grows the product being sold. f. Council Member Zinnerman spoke about the Mt. Moriah Baptist Church fire which occurred last Friday. Zinnerman thanks the Citizens of Hueytown for the decisions made; especially about the City' s purchase of the Ladder Fire Truck. Zinnerman states the City is blessed for a City the size of Hueytown to have the equipment it has. Zinnerman is proud of the Mayor and the employees of the City. Zinnerman also expressed thanks to the City of Bessemer Fire Department of its assistance in response to the fire. 25. ADJOURNMENT: With no further business to come before the Council Meeting; a motion by Council Member Hurliman was made to adjourn the meeting.
