271 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, AUGUST 23, 2022 The City Council of the City of Hueytown met at 5: 30P. M. in the Council Chamber meeting room at the City of Hueytown City Hall on Tuesday, August 23, 2022. The meeting was called to order with Council Members Zinnerman, Pickens, Hurliman, Wright and Jacks present. The Mayor and City attorney Charlie Waldrep, of Waldrep Stewart 8s Kendrick, LLP was present. There were approximately twenty- one individuals in the audience. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, AUGUST 23, 2022 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber of Hueytown City Hall on Tuesday, August 23, 2022. 1. CALL TO ORDER, INVOCATION, ROLL CALL AND MEDIA RECOGNITION The meeting was called to order at 6: OOP. M. with approximately thirty individuals in the audience. The invocation was given by Council Member Jacks followed by the Pledge of Allegiance. Upon roll call, Council Members Pickens, Zinnerman, Hurliman, Wright and Jacks being present. Council President Pickens presided over the meeting. Mayor Ware and the City Attorney, Charlie Waldrep, of Waldrep Stewart 8s Kendrick, LLP were present. 2. APPROVAL OF MINUTES Council Member Jacks made a motion followed by a second to the motion by Council Member Zinnerman to approve the August 09, 2022 Council Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. President Pickens declared the minutes approved. A motion by Council Member Zinnerman was made to amend the meeting agenda with the addition of item 9a as a Nuisance Public Hearing, item 24 as Resolution 6332, item 25 as Resolution 6333 and item 26 as Resolution 6334 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. President Pickens declared the meeting agenda amended. 3. MAYORS REPORT The Mayor welcomes everyone present and taking the time from their busy schedules to attend the meeting to learn what' s happening in the City. The Mayor took a moment to clear up a premature press release regarding the City' s recent purchase of Property from the University of Alabama. The Mayor presented three Proclamations to recognize a) Alopecia Areatha Awareness, b) Faith Theros, c) Gynecologic Cancer Awareness and d) Charles Lawrence Farmer. Ms. Sharon Syx addressed the Elected Officials and the audience about Gynecologic Cancer. Ms. Lee Contorno addressed the Elected Officials and the audience of the accomplishments Mr. Farmer has had in his racing career which has not ended. Also, Mr. Allen Farley, former Alabama State House Representative presented a Proclamation from the Alabama State Legislature recognizing Mr. Farmer. CITY BOARDS REPORT: a. Carol Rector, Interim Director of the Hueytown Library reports the following: i. The fall reading classes will continue as an extension from the summer reading program. Something new are Home Schooling groups coming into the Library two to three times a week. Using the Library' s free wife service. iii. Story Time this Thursday with the theme of " Froggy Fun" followed by Reading Buddies Dogs. iv. CORRESPONDENCE: A letter was received from the Library Interim Director which was distributed to the Mayor and Council. 9. BILLS FOR APPROVAL: Council Member Zinnerman moved followed by a second to the motion by Council Member Hurliman that the list of bills be approved totaling the amount of 397, 485. 77. Nuisance Public Hearing: Mr. Andres Thompson of 122 Wickstead Road addressed the Mayor and Council regarding the Nuisance that was declared on his property. Mr. Thompson is seeking guidance on how to deal with the Kudzu. The City Attorney supplied information to the Mayor and Council on this matter and City Inspector Humphries supplied historical information of the nuisance. The Mayor directed Mr. Thompson to meet with the City Inspector Humphries to arrive at a resolution to the issues. A motion by Council Member Zinnerman to carry this matter over to the next council meeting was made with a second to the motion by Council Member Hurliman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 10. RESOLUTION 6318: Resolution 6318 was presented to the Council to consider amending the City of Hueytown Employee Handbook section 5. 2 to designate Juneteenth as a City paid holiday. A motion by Council Member Jacks was made to adopt Resolution Number 6318 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 11. RESOLUTION 6319: Resolution 6319 was presented to the Council to consider ordering the abatement of an unsafe structure located at 2009 27th Avenue North. A Motion by Council Member Hurliman to adopt Resolution Number 6319 was made with a second to the motion by Council Member Wright. RESOLUTION 6332: Resolution 6332 was presented to the Council to consider the declaration of a curfew during the week of the Hueytown High School Homecoming. RESOLUTION 6333: Resolution 6333 was presented to the Council to consider the waiver of the event license fee and the donation of four -hundred dollars 400. 00) for the Martin Luther King, Jr. " Saints" day. A Motion by Council Member Zinnerman to adopt Resolution Number 6333 was made with a second to the motion by Council Member Hurliman. RESOLUTION 6334: Resolution 6334 was presented to the Council to consider the donation of a vehicle from the Jefferson County Emergency Management Agency. A Motion by Council Member Wright to adopt Resolution Number 6334 was made with a second to the motion by Council Member Hurliman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 27. EXTEND FLOOR TO THE PUBLIC: Prior to the extension of the floor to the public, President Pickens reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. August 23, 2022 Council Meeting Minutes Page 8 of 9  a. Libby Rich at 142 Lindberg Road has been before the Council before and thanks for being respectful and courteous. Ms. Rich states the City's Inspector Humphries has been kind and courteous with past issues. Ms. Rich states the Lindberg Farmhouse ( 130 Lindberg Road) has had three large trees fall from the recent storms and blocks the road and presents safety concerns. Ms. Rich seeks the Council' s help to enforce nuisance issues. City Inspector Humphries informed the Mayor and Council that 130 Lindberg Road was declared a public nuisance at the August 9t' Council Meeting and is going through the Nuisance abatement process. The City attorney and Mayor spoke to the issue of the City not able to enter private property and/ or use taxpayer funds on private property as there is a legal process which could allow such action which has to be followed. b. Valerie Winston at 35 Merry Mark Road stating a stop sign was replaced at the intersection of Merry Mark and Wabash causing a safety concern. Ms. Winston also states drivers continually run the stop sign. The Mayor directed the Stop Sign matter to Lt. Shupe to look into this matter. c. Jennifer Clements Secretary for the Beautification Board spoke of vehicles speeding on Walker Avenue. There is also an issue of Street Signs being knocked down. The Mayor directed Ms. Clements to Lt. Shupe to discuss in detail. 28. ADJOURNMENT: With no further business to come before the Council Meeting; a motion by Council Member Zinnerman was made to adjourn the meeting.
