46161 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, SEPTEMBER 13, 2022 The City Council of the City of Hueytown met at 5: 30P. M. in the Council Chamber meeting room at the City of Hueytown City Hall on Tuesday, September 13, 2022. The meeting was called to order with Council Members Zinnerman, Pickens, Wright and Jacks present. Council Member Hurliman was absent. The Mayor and City attorney Charlie Waldrep, of Waldrep Stewart 8v Kendrick, LLP was present. There were approximately twenty- one individuals in the audience. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, SEPTEMBER 13, 2022 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber of Hueytown City Hall on Tuesday, September 13, 2022. 1. CALL TO ORDER, INVOCATION, ROLL CALL AND MEDIA RECOGNITION The meeting was called to order at 6: OOP. M. with approximately Forty individuals in the audience. The invocation was given by the Boy Scout Troop 247 from Concord followed by the Pledge of Allegiance. Upon roll call, Council Members Pickens, Zinnerman, Wright and Jacks being present. Council Member Hurliman was absent. Council President Pickens presided over the meeting. Mayor Ware and the City Attorney, Charlie Waldrep, of Waldrep Stewart 8, Kendrick, LLP were present. Media Recognition: Kailah Hegler present from the Western Star. 2. APPROVAL OF MINUTES Council Member Jacks made a motion followed by a second to the motion by Council Member Zinnerman to approve the August 23, 2022 Council Meeting minutes and the September 06, 2022 Work Session Meeting Minutes as previously received and thereby dispensing with reading of the minutes. Upon a roll call vote, President Pickens and Council Members Zinnerman, Wright and Jacks voting yes. There were no nay votes. President Pickens declared the minutes approved. 3. MAYORS REPORT The Mayor welcomes everyone present with it great seeing a full room. Let' s continue to support the Golden Gophers football team with a game this weekend at Bessemer City. 4. STANDING COMMITTEE REPORTS a. Finance Committee: Council Member Zinnerman, made a motion to remove agenda Item Number 14, Resolution Number from the meeting6339 agenda for further discussion followed with a second by Council Member Jacks. Upon roll call vote, President Pickens, Zinnerman, Wright and Jacks voting yes. There were no nay votes. President Pickens declared item 14 Resolution 6339 removed from the meeting agenda. b. Planning and Development: Council Member Jacks, no report. c. Public Safety: Council Member Wright, no report. d. Public Works and Parks: Council Member Hurliman, absent. 5. OFFICERS REPORT September 13, 2022 Council Meeting Minutes Page 1 of 7  a. Police Chief, Mike Yarbrough: Chief Yarbrough reports several employees in the Police Department have retired. Yarbrough announced the promotion of David McIntosh as Sergeant, Greg Coram as Lieutenant, Tracey Williams as Sergeant and Stepfarne Gray as Corporal. b. Fire Chief, Scotty Morris: Assistant Fire Chief Danny Sullivan Attending, No Report. c. Mike Butts, Public Works and Parks Director: No Report. d. Barry Humphries, Building and Zoning Inspector: No Report. 6. GREAT THINGS HAPPENING IN HUEYTOWN ( LOCAL ORGANIZATIONS AND CHAMBER OF COMMERCE) a. Debbie Kiker, Executive Director for the Hueytown Chamber of Commerce reports the following: i. Business Of the Month is State Farm Marietta Wicks. ii. Paint the Town Purple winners are the North Highlands Baptist Church and Self Skilled Nursing Home. There were thirty- two participants this year. iii. The fourth annual Paw Palooza and Weiner Dog Races was held September 10, 2022 with just under one -thousand in attendance. Thanks to the City' s Street Department for all they did to make this event possible. iv. September Cash Mob is scheduled for September 24, 2022 at 11: OOA. M. at Day Dreams Boutique. v. Munch and Mingle is scheduled for September 29, 2022 from 6: OOP. M. to 7: 30P. M. with Homemade BBQ Sauce catering the event. vi. The Hueytown Tackle Breast Cancer event is scheduled for October 15, 2022 with a " Pink out Parade" starting at the First United Methodist Church to Stadium Park at 9: 30A. M. with a breakfast at First United Methodist Church from 8: OOA. M. to 9: OOA. M. The City has installed six pole banners advertising this Breast Cancer Awareness Events. The Hueytown High School has a " Pink Out" game scheduled for October 7, 2022. vii.The Halloween parade is scheduled for October 29, 2022 at 4: OOP. M. It's Fall Ya' ll Fest is from 4: 30P. M to 7: OOP. M. viii. Speaking for Regina Evans Barrentine for the Hueytown Farmers Market to Thank everyone at the City for all the City does to support the Farmers Market. ix. Reminds Everyone to Shop Local to support the City' s Local Businesses. b. Jake Ware representing the Hueytown Arts Council: i. Christmas Dinner, December 1, 2022 at the North Highlands Baptist Church. ii. Gospel Music Event fundraiser at North Highland Baptist Church scheduled for November 10, 2022 for the Mt. Moriah Church. iii. Zombie 5K/ 1 mile fun run/ walk scheduled for October 29, 2022. 7. CITY BOARDS REPORT: a. Carol Rector, Interim Director of the Hueytown Library reports the following: i. Story -time with Ms. Beth was last Thursday. Rector states the children always enjoy Beth because she is very animated as she acts out the stories rather than just reading the story aloud. Story -time is the second and last Thursday each month at 11: 00A. M. ii. Reading Buddies will now be coming to the Library the first and third Monday of each month at 3: 30P.M. iii. The after school Tutored Reading Classes are held Monday through Friday at 3: 30P.M. and 4: 45P. M. have begun for children who are in the second through fourth grades. The teachers for the classes are September 13, 2022 Council Meeting Minutes Page 2 of 7  283 students who are in the eleventh and twelfth grades at the Hueytown High School and the Jefferson County IB High School. The classes are a result of the grant received by the Library from the American Library Association. iv. Notary services at the Library are picking up. v. The Library staff thanks the City for the abatement of the unsafe structure that was next door to the Library. vi. The Library staff appreciate the Library Board who volunteer their time to meet eight months of the year. The Board does not meet during the months of June, July, August and December. The summer break has ended with the next Library Board meeting scheduled for Monday, September 19, 2022 at 4: OOP. M. at the Library. vii. The Library hours of operation are Monday through Friday from 10: 00A. M. until 6: OOP. M.. 8. CORRESPONDENCE: Nothing. 9. RESOLUTION 6359: Resolution 6359 was presented to the Council to consider authorizing repairs to a 2015 Ford F- 450 vehicle in the Public Works Department. Upon a roll call vote, President Pickens and Council Members Zinnerman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 35. Ordinance 22- 0913- 01: Ordinance 22- 0913- 01 was presented to the Council as a First Reading/ Public Hearing to consider amending the City' s Zoning Map for the property located at 3395 Carrie Road from PUD to AG classification. Council President Pickens opened the meeting to a Public Hearing regarding this matter. After no one came forward to speak for or against the Ordinance, a motion by Council Member Zinnerman to close the Public Hearing was made with a second to the motion by Council Member Wright. 36. Ordinance 22- 0913- 02: Ordinance 22- 0913- 02 was presented to the Council as a First Reading/ Public Hearing to consider amending the City' s Zoning Map for the property located at 63 Johnson Drive from R5 to R2 classification. Council President Pickens opened the meeting to a Public Hearing regarding this matter. After no one came forward to speak for or against the Ordinance, a motion September 13, 2022 Council Meeting Minutes Page 6 of 7  287 by Council Member Zinnerman to close the Public Hearing was made with a second to the motion by Council Member Jacks. 37. EXTEND FLOOR TO THE PUBLIC: Prior to the extension of the floor to the public, President Pickens reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a. Mary Myers at 502 Saddleridge states she was incorrect about the placement of the flags in the Council Meeting Chambers. b. Libby Rich at 142 Lindberg Road and Lucius Brandidge at 137 Lindberg Road spoke to the Mayor and Council of trees down in the neighborhood. They seek the City to cut the dead standing trees down off personal property before they damage structures. City attorney Waldrep spoke to this request stating; the City can spend tax payer money on private property if the trees were to look like they would fall on the road but not just to cut them down because that would be improving private property. Attorney Waldrep and the Mayor requests Public Works director to go look at the suspect trees and report back to determine if the City should hire an Arborist. c. Mr. and Mrs. Wilson at 1105 25'' Avenue North requests an update on the nuisance matter for the property located at 1101 25th Avenue North along with another neighbor. The Mayor asked the City' s Building Inspector, Humphries for an update. Humphries informed the Mayor the nuisance abatement is on the list waiting for a contractor to bid on the City' s list of abatements. d. Pastor Charles Winston at Mt. Moriah Baptist Church thanked the City for helping the Church find another location to hold services after the total loss of the congregation' s facility due to a fire. Pastor Winston reports the services are currently being held at 917 Old Warrior River Road, the former Garywood Baptist Church. 38. ADJOURNMENT: With no further business to come before the Council Meeting; a motion by Council Member Zinnerman was made to adjourn the meeting.
