MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, SEPTEMBER 27, 2022 The City Council of the City of Hueytown met at 5: 30P. M. in the Council Chamber meeting room at the City of Hueytown City Hall on Tuesday, September 27, 2022. The meeting was called to order with Council Members Zinnerman, Pickens, Hurliman, Wright and Jacks present. The Mayor was absent and City attorney Charlie Waldrep, of Waldrep Stewart & Kendrick, LLP was present. There were approximately nine individuals in the audience. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, SEPTEMBER 27, 2022 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber of Hueytown City Hall on Tuesday, September 27, 2022. 1. CALL TO ORDER, INVOCATION, ROLL CALL AND MEDIA RECOGNITION The meeting was called to order at 6: 30P. M. with approximately fifty- three individuals in the audience. The invocation was given by Council President Pickens followed by the Pledge of Allegiance. Upon roll call, Council Members Pickens, Zinnerman, Hurliman, Wright and Jacks being present. Council President Pickens presided over the meeting. Mayor Ware was absent and the City Attorney, Charlie Waldrep, of Waldrep Stewart 8s Kendrick, LLP was present. Media Recognition: Kailah Hegler present from the Western Star. 2. APPROVAL OF MINUTES Council Member Wright made a motion followed by a second to the motion by Council Member Hurliman to approve the September 13, 2022 Council Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. President Pickens declared the minutes approved. 3. MAYORS REPORT The Mayor was absent from the meeting. 4. STANDING COMMITTEE REPORTS a. Finance Committee: Council Member Zinnerman, no report. b. Planning and Development: Council Member Jacks, no report. c. Public Safety: Council Member Wright, no report. d. Public Works and Parks: Council Member Hurliman, no report. 5. OFFICERS REPORT a. Police Chief, Mike Yarbrough: Chief Yarbrough, no report. b. Fire Chief, Scotty Morris: Chief Morris, no report. c. Mike Butts, Public Works and Parks Director: No Report. d. Barry Humphries, Building and Zoning Inspector: Absent. September 27, 2022 Council Meeting Minutes Page 1 of 5 6. GREAT THINGS HAPPENING IN HUEYTOWN ( LOCAL ORGANIZATIONS AND CHAMBER OF COMMERCE) a. Debbie Kiker, Executive Director for the Hueytown Chamber of Commerce reports the following: i. The September Cash Mob was held September 24, 2022 at DayDreams Boutique. ii. The Munch and Mingle event is scheduled for September 29, 2022 with Just like Mom' s Homemade BBQ Sauce catering the event from 6: OOP. M. to 7: 30P. M. at Venue 3131. iii. The Hueytown High School is seeking volunteers to help students apply for College during the second period classes ( 9: OOA. M. to 10: 16A. M.) on Tuesday, October 18, 2022 and Friday, October 21, 2022. iv. The Hueytown High School Alumni Association BBQ is scheduled for Saturday, October 15, 2022. v. The Breast Cancer Awareness Event " Hueytown Tackle Breast Cancer" is scheduled for Saturday, October 15, 2022. Breakfast is at First United Methodist Church at 8: OOA. M. to 9: OOA. M. followed by a " Pink out Parade" starting 9: OOA. M. at First United Methodist Church to Stadium Park. There is also an awareness Walk at 10: 00A. M. to 11: OOA. M.. The October 71h Hueytown High School football game will be a " Pink Out" game. There will be six pole banners recognizing Breast Cancer Awareness. Proceeds to benefit local ladies in need of for mammograms and gas to Princeton ( Baptist Health Foundation) those without insurance. vi. Saturday, October 29, 2022 is going to be a " Fun Day In Hueytown". Hueytown Arts Council sponsoring a 5K Zombie Fun Run. Halloween Parade is at 4: OOP. M. starting at the Hueytown Library. It' s Fall Y' all Fest at 4: 30P. M. to 7: OOP. M. vii. Reminds Everyone to Shop Local to support the City' s Local Businesses. b. Michelle McClinton of the Hueytown Arts Council: i. Christmas Dinner, December 1, 2022 at the North Highlands Baptist Church. ii. Gospel Music Event fundraiser at North Highland Baptist Church scheduled for November 10, 2022 for the Mt. Moriah Church. iii. Zombie 5K/ 1 mile fun run/ walk scheduled for October 29, 2022. iv. November 24, 2022 City Tree Lighting Event. 7. CITY BOARDS REPORT: a. Carol Rector, Interim Director of the Hueytown Library reports the following: Rector i. Story -time for preschoolers with Ms. Beth was last Thursday. states there were six children plus their parents attending. The size of the group did not change the dedication of the storyteller as Ms. Beth is very animated as she acts out the stories rather than just reading the story aloud. The next Story -time will be Thursday, October 6, 2022 at 11: OOA. M. September 19, 2022 with the ii. Reading Buddies was held on Monday, next date set for October 3, 2022 at 3: 30P. M. iii. The after school Tutored Reading Classes held Monday through Friday at 3: 30P. M. and 4: 45P. M. have begun for children who are in the second through fourth grades. The teachers for the classes are seventeen students who are in the eleventh and twelfth grades at the Hueytown High School and the Jefferson County IB High School. The classes are a result of the grant received by the Library from the American Library Association. iv. Notary services at the Library are picking up. Director Rector reports the Library provides for free availability of public computers, WIFI availability 24/ 7, Notary Services, downloadable books and magazines, books and dvd' s that can be checked out. vi. Director Rector promoted the Library T- shirt which states " LIBRARIES" The Heart of Every Community! The Library Board and Director Rector definitely want the Hueytown Library to be that for the Hueytown Community. vii. The Library hours of operation are Monday through Friday from 10: 00A. M. until 6: OOP. M.. b. Parks 8v Recreation Board President, Michael Merritt, was unable to attend the meeting but supplied the board' s meeting minutes and finance report to the Mayor and Council. 8. CORRESPONDENCE: Nothing. 9. BILLS FOR APPROVAL: Council Member Zinnerman moved followed by a second to the motion by Council Member Wright that the list of bills be approved totaling the amount of $ 624, 842. 30. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. RESOLUTION 6360: Resolution 6360 was presented to the Council to consider confirming the report of costs and create a public nuisance lien on the property located at 2005 High School Road. A motion by Council Member Zinnerman was made to adopt Resolution Number 6360 followed by a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 11. RESOLUTION 6361: Resolution 6361 was presented to the Council to consider confirming the report of costs and create a public nuisance lien on the property located at 2935 Allison-Bonnett Memorial Drive. A Motion by Council Member Zinnerman to adopt Resolution Number 6361 was made with a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 12. RESOLUTION 6362 Resolution 6362 was presented to the Council to consider appropriating funds for the purchase of two Police Department Patrol Vehicles. A Motion by Council Member Jacks to adopt Resolution Number 6362 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 13. RESOLUTION 6339: Resolution 6339 was presented to the Council to consider adopting the Fiscal Year 2022- 2023 City Budget. A Motion by Council Member Zinnerman to adopt Resolution Number 6339 was made with a second to the motion by Council Member Wright. Upon a roll call vote, President Pickens and Council Members Zinnerman, Wright and Jacks voting yes September 27, 2022 Council Meeting Minutes Page 3 of 5  291 with Council Member Hurliman voting no. There were four yea votes and one nay vote. The motion carried. 14. RESOLUTION 6363: Resolution 6363 was presented to the Council to consider authorizing the Mayor to execute a new lease between the City of Hueytown and the Jefferson County Board of Education for use of the Baseball and Softball Field Facilities. A Motion by Council Member Hurliman to table Resolution Number 6363 was made with a second to the motion by Council Member Jacks. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 15. RESOLUTION 6364: Resolution 6364 was presented to the Council to consider awarding the Solid Waste collection and disposal services/ Garbage contract. A Motion by Council Member Zinnerman to adopt Resolution Number 6364 was made with the addition of a thirty (30) day break -clause with a second to the motion by Council Member Jacks. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 16. RESOLUTION 6365: Resolution 6365 was presented to the Council to consider a one- time lump sum employee salary supplement. A motion by Council Member Zinnerman to adopt Resolution Number 6365 was made with a second to the motion by Council Member Jacks. Upon a roll call vote, President Pickens and Council Members Zinnerman and Jacks voting yes and Council Members Hurliman and Wright voting no. There were three yea votes and two nay votes. The motion carried. 17. RESOLUTION 6366: Resolution 6366 was presented to the Council to consider authorizing the Mayor to execute a new lease between the City of Hueytown and the Jefferson County Board of Education for use of the Hueytown High School Athletic Facilities. A Motion by Council Member Zinnerman to adopt Resolution Number 6366 was made with a second to the motion by Council Member Jacks. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 18. Ordinance 22- 0913- 01: Ordinance 22- 0913- 01 was presented to the Council to consider amending the City' s Zoning Map for the property located at 3395 Carrie Road from PUD to AG classification. A motion by Council Member Wright to adopt Ordinance 22- 0913- 01 was made with a second to the motion by Council Member Jacks. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 19. Ordinance 22- 0913- 02:Ordinance 22- 0913- 02 was presented to the Council to consider amending the City' s Zoning Map for the property located at 63 Johnson Drive from R5 to R2 classification. A motion by Council Member Jacks to adopt Ordinance 22- 0913- 02 was made with a second to the motion by Council Member Hurliman. Upon a roll call vote, President Pickens and Council Members Zinnerman, Hurliman, Wright and Jacks voting yes. There were no nay votes. The motion unanimously carried. 20. EXTEND FLOOR TO THE PUBLIC: Prior to the extension of the floor to the public, President Pickens reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. September 27, 2022 Council Meeting Minutes Page 4 of 5 292 a. Fire Chief Scotty Morris addressed the Council by recognizing past and present City employees in the audience. b. Charlie Pearson at 3514 Highland Avenue states he attended the Citizens Police Academy sponsored by the Hueytown Police Department. Parson states through that program he became aware of what First Responders do and appreciates all that they do. c. Mary Myers at 502 Saddleridge asked about item 18 on the agenda about what is a PUD with Council President responding to Ms. Myers question. d. Libby Rich at 142 Lindberg Road addressed the Council about tree limbs falling from trees at a neighboring property and the condition of the property in the neighborhood. Public Works Director Mike Butts supplied information of a tree scheduled to be removed which is in the City's Rite -of -Way. e. Eddie Stewart at 3516 Sharon Lane addressed the City Council regarding City employee salaries. f. Eric Frey at 2845 Brooklane Drive from American Legion to present a container to store damaged/ discontinued flags which need to be properly retired. Mr. Frey recognized City Attorney for all that he has done to assist the American Legion. g. Chuck Hurliman at 3501 Sharon Lane expressed his appreciation for the City' s First Responders and having ambulance service. h. Anders Lars Thompson at 122 Wickstead Road supplied an update of the condition of his yard which was a nuisance matter. The Council was informed Mr. Thompson nuisance matter is now compliant. 21. ADJOURNMENT: With no further business to come before the Council Meeting; a motion by Council Member Zinnerman was made to adjourn the meeting.
