303 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, NOVEMBER 08, 2022 The City Council of the City of Hueytown, Alabama, met at 5: 30P. M. in the Pre - Council Chamber meeting room at the City of Hueytown City Hall on Tuesday, November 08, 2022. The Meeting was called to order with Council Members Zinnerman, Pickens, Hurliman, Wright and Jacks present. Mayor Ware, City Attorney, Charlie Waldrep, of Waldrep Stewart 8s Kendrick, LLP were present at the meeting. There were ten individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, NOVEMBER 08, 2022 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber of Hueytown City Hall on Tuesday, November 08, 2022. 1. CALL TO ORDER, INVOCATION, ROLL CALL AND MEDIA RECOGNITION The meeting was called to order by Mayor Ware at 6: OOP. M. with approximately fourteen individuals in the audience. The invocation was given by Council Member Pickens followed by the Pledge of Allegiance. This meeting begins with the annual election for the Council President. Upon Roll Call, Council Members Pickens, Zinnerman, Hurliman, Wright and Jacks being Present. City attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP was present. Kailah Hegler from the Western Star was also present. 2. ANNUAL ELECTION FOR COUNCIL PRESIDENT The Mayor opened the meeting seeking nominations for Council President. Council Member Jay Jacks nominates Fran Zinnerman as Council President and Council Member Charles Hurliman nominates Anthony Wright as Council President. Upon roll call vote for Fran Zinnerman as Council President with Pickens, Hurliman and Wright voting no and Council Members Zinnerman and Jacks voting yes. Upon Roll Call vote for Anthony Wright as Council President with Pickens, Hurliman and Wright Voting yes and Council Members Zinnerman and Jacks voting no. Mayor Ware congratulated Council Member Wright as the Council President who moved to the Council President's position on the Bench. Council President Wright continued the meeting seeking nominations for Council Pro- tempore. Council Member Zinnerman nominated Jay Jacks. With no other nominations presented, a motion by Council Member Hurliman to close nominations was made with a second to the motion my Council Member Pickens. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens,Hurliman and Jacks voting yes. There were no nay votes. motion The unanimously carried. President Wright declares Council Member Jay Jacks as Council Pro- tempore. 3. APPROVAL OF MINUTES Council Member Pickens made a motion followed by a second to the motion by Council Member Hurliman to approve the October 25, 2022 Council Meeting and the November 01, 2022 Works Session Meeting minutes as previously received and thereby dispensing with reading of the minutes. President Wright declared the minutes approved. 4. MAYORS REPORT The Mayor welcomed everyone present at the meeting being conscious of the election polls closing within the hour. a) The Mayor read a Proclamation which recognizes Alabama Farm City Week. For nearly 65 years, the American people have joined together during Thanksgiving week to observe Farm -City Week, a time set aside to express gratitude for the bounty with which God has blessed our land. Throughout the week, Americans recognize the hard work and achievements of the farmers, rural townspeople, and city residents who make our nation' s agricultural production and distribution system so successful. This cooperation between rural and city dwellers for mutual benefit truly helps to ensure our country' s well- being. America' s farmers have provided nutritious food and fiber to sustain our people through many decades of progress. Partners' productivity has increased steadily, thanks largely to their initiative in supporting and adopting science -based methods and materials. Because of this productivity, American farmers are able to meet the needs of our nation and a growing world. American agriculture - and the many service industries that depend upon it -is a story of extraordinary labor creating extraordinary abundance. The American farmer has an impact on every aspect of life, from big cities to small towns and all of the routes in between. At this time of year, it is only fitting that all Americans offer a special sign of thanks to those who grow, harvest, and bring the fruits of sun, seed, and soil to our nation' s tables. November 08, 2022 City Council Meeting Minutes Page 2 Of 8  305 PROCLAMATION Whereas, the government of, Hueytown, Alabama celebrates our local small businesses and the contributions they make to our local economy and community; and Whereas, according to the United States Small Business Administration, there are 32. 5 million small businesses in the United States, small businesses represent 99, 7% of firms with paid employees, small businesses are responsible for 62% of net new jobs created since 1995, and small businesses employ 46. 8% of the employees in the private sector in the United States, and Whereas, 79% of consumers understand the importance of supporting the small businesses in their community on Small Business Saturday*, 701/ o report the day makes them want to encourage others to Shop Small", independently -owned retailers, and 66% report that the day makes them want to Shop Small all year long; and Whereas, 58% of shoppers reported they shopped online with a small business and 54% reported they dined or ordered takeout from a small restaurant, bar, or caf6 on Small Business Saturday in 2021; and Whereas, Hueyt•own, Alabama supports our local businesses that create jobs, boost our local economy, and preserve our communities; and Whereas, advocacy groups, as well as public and private organ'izations, across the country have endorsed the Saturday after Thanksgiving as Small Business Saturday. Ware Mayor c) The Mayor presented a Proclamation to John Michael Pickens which recognizes his achievements and success on the baseball field and for his future. PROCLAMATION John Michael Pickens WHEREAS, the Hueytown High School' s Baseball team finished the season with a 28-12 record. They were 151 in their region in 6A Area 8 and made it to the Elite 8 in the State playoffs; and WHEREAS, John Michael faced 228 batters while only allowing 7 runs. He had 103 strikeouts for the season with an Earned Run Average of. 831. This is his second high school season in a row with an ERA under 1; and WHEREAS, John Michael, along with teammates Aron Wallace, Levi Weaver and Zach Hill were selected to the Jefferson County School' s Coaches Association All -County Baseball Team during this 2021- 2022 season; and WHEREAS, John Michael was selected the Alabama Sports Writers Association First Team All -State in 6A. There have only been 17 other Gophers given that honor; and WHEREAS, John Michael was also selected by the Jefferson County School' s Coaches Association as Pitcher of the year 2021- 2022. He is the first player to be awarded that honor at Hueytown High School; and WHEREAS, John Michael has had several college scholarship offers and at this time is committed to playing college baseball for Shelton State in Tuscaloosa, Alabama; and NOW THEREFORE, 1, Stephen. STANDING COM IT E REPORTS a) Finance Commit ee: Council Member Zinnerman, no report. b)Planning and Development Committee: Council Member Jacks, no report but there is a meeting next week. c) Public Safety Committee: Council Member Wright, no report. d)Public Works and Parks Committee: Council Member Hurliman, no report. 6.OFFICERS REPORT a) Police Department, Chief Mike Yarbrough: Chief Yarbrough reports the two new recently purchased Dodge patrol vehicles have been stripped and expect to have them placed into service early next month. b) Fire Department, Chief Scotty Morris: Chief Morris reports taking on a project in cooperation with the Chamber of Commerce sel ing Christmas Fire Department T-shirts with the proceeds going to benefit the local Neighborhood Bridges program. c) Public Works 8s Parks Department, Director Mike Butts: Director Butts reports the recently held City Wide cleanup was a success with another cleanup being planned for the spring time next year. The department is working the next couple weeks with the instal ation of the holiday season decorations throughout the City.d)Building and Zoning Department, Inspector Barry Humphries: Inspector Humphries reports of receiving many inquires of the wide road construction going up the hill off of 15t' Street before King Street; Humphries states this is for the construction of the new water tower being constructed by Bessemer Utilities. A second to the motion was made by Council Member Jacks. Upon a roll call vote, Council President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the meeting agenda amended. 7. GREAT THINGS HAPPENING IN HUEYTOWN a) Debbie Kiker, Executive Director for the Hueytown Chamber of Commerce reports: i. It' s Fall Ya' ll Fest event held on October 29, 2022 was a great success with approximately 2, 400 in attendance. A big shout -out to thank the Public Works and Police Departments for their assistance to make the event a great success. ii. The November Business Of The Month is Craft Connection. iii. A Ribbon Cutting for FastPace Health Doctors office is scheduled for Monday, November 28, 2022 at 8: OOA. M.. iv. Pink is the new black is to promote Shop Small Business Campaign starting November 18t' which is the week before Black Friday. There are nine businesses participating with the Chamber giving away two - 250. 00 cash prizes for " Shopping Small". The Hueytown High School TV Production Class will be doing a Facebook Video of the event. v. Christmas Tree Lighting is scheduled for Tuesday, November 29, 2022 at at the New City Center Park. There will be life sized 6: OOP. M. Christmas Ornaments with snow for pictures, life sized Santa Sleigh, Grinch, Buddy the Elf, Mr. and Mrs. Santa, Entertainment, Live Nativity with Hank the Camel, reading of the Christmas Story, nine Food Trucks, Train Ride and ten Churches/ Organizations with Craft Booths. vi. Christmas Parade is scheduled for Saturday, December 10, 2022 at 10: 00A. M.. vii. Remember to Shop Local! 8. CITY BOARDS REPORT a) Carol Rector, Director of the Hueytown Library reports: i. Thanks to the Beautification Board for cleaning the flowerbed at the Library and for taking on the continued maintenance. ii. Reading Buddies was held this past Monday afternoon with four children in attendance. The trainer and pups will return on Monday, November 21, 2022 at 3: 30P. M.. iii. Story Time with Ms. Beth will be at the Library on Thursday, November 10, 2022 at 11: OOA. M. with the theme " Gobble Til You Wobble". At the last program the children dressed up in their Halloween Costumes. With the Christmas Holiday, December 8, 2022 will be the last program date for 2022. iv. The Schedule for Reading Buddies and Story Time for January, February and March 2023 will be posted on the Library Facebook page before Christmas. v. The Reading Classes have ended which was funded by a grant the Library received. The classes were held in July and again in September and October. The Library is unsure if the classes can continue next year, but if possible, will be in July 2023. The remainder of the grant money will be used to purchase books, DVD' s and recorded books. vi. The Literacy Night event at the Hueytown Primary School is next Tuesday, November 15, 2022 at 5: 30P. M. to 7: 30P. M. The Library will be participating and plan to advertise getting a Library Card is free and how it can be a service. November 08, 2022 City Council Meeting Minutes Page 5 Of 8 16 • vii. The Library offers services such as the use of free computers, sending faxes and scan documents to a fax number, Notary Services, free WiFi while sitting in your car in the parking lot. These services do not require having a library card. Having a Library Card does give access to the full catalog of items that can be checked out from any library in Jefferson County and have them delivered to a Library most convenient. viii. The Hueytown Library hours Monday through are Friday, 10: 00A. M. to 6: OOP. M.. b) Jake Ware, representing the Hueytown Arts Council reports: i. The Gospel Fest event is scheduled for Thursday, November 10, 2022 with the doors opening at 6: OOP. M. at the North Highlands Baptist Church. The events proceeds are to benefit the Mt. Moriah Baptist Church which was recently lost to a structure fire. ii. The Christmas Dinner event is scheduled for December 1, 2022 at the North Highland Baptist Church with the doors opening at 6: OOP. M. Proceeds from the event are to benefit the Arts Council Scholarship Program. 9. CORRESPONDENCE There was no correspondence to report. 10. BILLS FOR APPROVAL A motion by Council Member Zinnerman list of bills presented a totaling 143, 957. 60 and made a motion to approve the list of bills presented for payment excluding item number 15. Council Member Jacks made a second to the motion. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. RESOLUTION 6384 Resolution 6384 was presented to the Council to consider awarding the Wrecker Service and Storage Bid to Classic Towing and Recovery, LLC. A motion by Council Member Hurliman to adopt Resolution Number 6384 was made with a second to the motion by Council Member Pickens. A motion by Council Member Zinnerman to adopt Resolution Number 6385 was made with a second to the motion by Council Member Hurliman. Upon a roll call vote, Council President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 16. RESOLUTION 6378 Resolution Number 6378 was presented to the Council to consider a one- time lump sum salary supplement for prospective services to be performed. A motion by Council Member Jacks to adopt Resolution Number 6378 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, Council President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 17. RESOLUTION 6386 Resolution Number 6386 was presented to the Council to consider amending the Fiscal Year 2023 Budget for an additional appropriation of funds to C1asTran. A motion by Council Member Hurliman to adopt Resolution Number 6386 was made with a second to the motion from Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 18. RESOLUTION 6387 Resolution Number 6387 was presented to the Council to consider declaring a Public Nuisance and order the abatement of Weeds, Trash and/ or Inoperable Vehicle at 632 Sunrise Boulevard. A motion by Council Member Pickens to adopt Resolution Number 6387 was made with a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 19. RESOLUTION 6388 Resolution Number 6388 was presented to the Council to consider declaring a Public Nuisance and order the abatement of Weeds, Trash and/ or Inoperable Vehicle at 1301 25th Avenue North. A motion by Council Member Zinnerman to adopt Resolution Number 6388 was made with a second to the motion by Council Member Pickens. RESOLUTION 6389 Resolution Number 6389 was presented to the Council to consider authorizing the donation of funds to the Hueytown High School Varsity Football Program and to the Hueytown Band Association. A motion by Council Member Jacks to adopt Resolution Number 6389 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, Council President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 21. EXTEND THE FLOOR TO THE PUBLIC Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a) Desmond Wilson at 1105 25' Avenue North addressed the Mayor and Council requesting an update of the neighboring property located at 1101 November 08, 2022 City Council Meeting Minutes Page 7 Of 8 310 25t' Avenue North regarding the abatement of the declared Public Nuisance. Inspector Humphries and Police Chief Yarbrough updated the Mayor and Council with the issues attempting to abate the nuisance. 22. ADJOURNMENT With no further business to come before the Council Meeting; a motion by Council Member Zinnerman was made to adjourn the meeting.
