317 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, DECEMBER 13, 2022 The City Council of the City of Hueytown, Alabama, met at 5: 30P. M. in the Pre - Council Chamber meeting room at the City of Hueytown City Hall on Tuesday, December 13, 2022. The Meeting was called to order with Council Members Zinnerman, Pickens, Hurliman, Wright and Jacks present. Mayor Ware, City Attorney, Charlie Waldrep, of Waldrep Stewart 8s Kendrick, LLP were present at the meeting. There were six individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, DECEMBER 13, 2022 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber of Hueytown City Hall on Tuesday, December 13, 2022. 1. CALL TO ORDER, INVOCATION, ROLL CALL AND MEDIA RECOGNITION with The meeting was called to order by Council President Wright at 6: 01P. M. approximately thirty-four individuals in the audience. The invocation was given by Council President Wright followed by the Pledge of Allegiance. Upon Roll Call, Council Members Zinnerman, Pickens, Hurliman, Wright and Jacks being Present. City attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP was present. Kailah Hegler from the Western Star was also present. 2. APPROVAL OF MINUTES Council Member Pickens made a motion followed by a second to the motion by Council Member Zinnerman to approve the November 22, 2022 Council Meeting and the December 12, 2022 Work Session Meeting minutes as previously received and thereby dispensing with reading of the minutes. Pickens, Upon roll call vote, President Wright and Council Members Zinnerman, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the minutes approved. 3. MAYORS REPORT The Mayor welcomed everyone present and thanks them for taking time out of their busy schedules to learn what's happening in the City. The Mayor reports the Tree Lighting Event was a great success and thanks to everyone that worked to make the event possible. The Mayor also reported the passing of Police Officer McAdory and introduced Police Lt. Shupe as being a graduate of the FBI Academy. The Mayor introduced Jonica Smith from the Jefferson County Department of Health who presented an award plaque to the Hueytown Public Works department from the Ms. People Against Litter " PAL' s" program. Smith states the City's Public Works Department was instrumental for the Valley Creek cleanup. Ms. Smith states that out of eleven sites participating in this years cleanup event, the Hueytown Public Works Department was able to secure 130 volunteers which was the largest site. Special thanks to the Public Works department to being able to manage a cleanup crew of this size and keeping them safe during the cleanup event. A Motion to amend the meeting agenda to add Resolution Numbers 6397 and 6399 by Council Member Pickens followed by a second to the motion by Council Member Hurliman. The motion carried unanimously. 4. STANDING COMMITTEE REPORTS a) Finance Committee: Council Member Zinnerman, no report. b) Planning and Development Committee: Council Member Pickens, no report. c) Public Safety Committee: Council Member Hurliman, reminds everyone to stay focused driving during the holiday season. d) Public Works and Parks Committee: Council Member Jacks, no report. 5. OFFICERS REPORT a) Police Department, Chief Mike Yarbrough: Lt. Shupe, no report. b) Fire Department, Chief Scotty Morris: Chief Morris reminds everyone present of the Fire Department T- shirt sale with the proceeds going to benefit the local Neighborhood Bridges program. c) Public Works & Parks Department, Director Mike Butts: Director Butts reports with the holiday events ending; the departments focus will be moving back to leaf cleanup and drainage issues. d) Building and Zoning Department, Inspector Barry Humphries: no report. 6. GREAT THINGS HAPPENING IN HUEYTOWN a) Debbie Kiker, Executive Director for the Hueytown Chamber of Commerce reports: i. The December Business of the month is The Mercedes Man. ii. The Christmas Store Front Decorating contest winner will be announced December 16, 2022. iii. Thanks to everyone for the Christmas Tree making Lighting & Christmas Parade events a great success, as it took a village to make these events possible. iv. Already working on planning the 2023 Chamber events. v. Remember to Shop Local! 7. CITY BOARDS REPORT a) Carroll Rector, Director of the Hueytown Library reports: i. Story time with Ms. Beth was last Thursday. This is the last session for this year with the next Story -time scheduled for January 12, 2023 at 11: OOA. M. ii. Reading Buddies has completed their program for the year and at this time do not know if the program will continue in 2023. iii. The Tutored Reading Class program which was funded from a grant received ends this year. The program is able to continue in 2023 due to a sponsor for next year' s classes to begin in July 2023. iv. The Library had a table at the Literacy Night at the Primary School event. v. Announced the Summer Reading Program which will be every Wednesday for the month of June 2023. vi. Holiday hours for the Library are: a) December 23, 2022, 10: 00A. M. to 2: OOP. M. b) December 27, 2022, Closed c) December 30, 2022, Closed d) January 2, 2023, Closed vii. The Hueytown Library regular hours are Monday through Friday, 10: 00A. M. to 6: OOP. M.. viii. Wishes everyone a Merry Christmas from the Library staff and Library for all. Arts Council members presented a $ 5, 160. 00 to Pastor Winston of the New Mt. Moriah Baptist Church. The funds are proceeds from the Gospel Fest event sponsored by the Arts Council as a fundraising event for the Church. ii. Taking Scholarship Applications. iii. The Arts Show In April. iv. The Arts Council is busy planning the 2023 events. v. Council Member Zinnerman presented a check from Alabama State Senator, Merika Coleman to the Hueytown Arts Council for the amount of $ 5, 981. 00. 8. CORRESPONDENCE There was no correspondence to report. 9. BILLS FOR APPROVAL Council Member Zinnerman presented a list of bills totaling A motion by 322, 754. 20 and made a motion to approve the list of bills presented for payment. A motion by Council Member Hurliman was made to adopt Pickens. Resolution Number 6392 Upon a roll call followed by a second to the motion by Council Member vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. RESOLUTION 6393 Resolution 6393 was presented to the Council to consider the appointment of a board member to the Hueytown Special Care Facilities Financing Authority. A motion by Council Member Pickens was made to adopt Resolution Number 6393 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Pickens, Hurliman and Jacks voting yes and Council Member Zinnerman voting no. There were four yes and one no vote, the motion carried. 12. RESOLUTION 6394 Resolution 6394 was presented to the Council to consider the appointment of a board member to the Hueytown Special Care Facilities Financing Authority. A motion by Council Member Pickens was made to adoptHurliman. ResolutionUpon Number 6394 a roll call followed by a second to the motion by Council Member vote, President Wright and Council Members Pickens, Hurliman and Jacks voting yes and Council Member Zinnerman voting no. RESOLUTION 6395 Resolution 6395 was presented to the Council to consider the appointment of a board member to the Hueytown Special Care Facilities Financing Authority. A motion by Council Member Hurliman to adopt Resolution Number 6395 was made with a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Pickens, Hurliman and Jacks voting yes and Council Member Zinnerman voting no. There were four yes and one no vote, the motion carried. 14. RESOLUTION 6396 Resolution 6396 was presented to the Council to consider the re -appointment of a board member to the City of Hueytown Public Parks and Recreation Board. A motion by Council Member Jacks to adopt Resolution Number 6396 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 15. ORDINANCE 22- 1213- 01 Ordinance 22- 1213- 01 was presented to the Council as a first reading. After no person came forward to speak either for or against the proposed Ordinance, a motion by Council Member. Pickens to close the Public Hearing was made with a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 16. RESOLUTION 6397 Resolution 6397 was presented to the Council to consider approving an application to incorporate a Special Care Facilities Financing Authority under the provisions of the Code of Alabama 1975 §§ 11- 62- 1 through 11- 62- 21, inclusive, and authorizing the persons filing said application to proceed to form such corporation. A motion by Council Member Hurliman to adopt Resolution Number 6397 was made with a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Pickens, Hurliman and Jacks voting yes and Council Member Zinnerman voting no. There were four yes and one no vote, the motion carried. 17. RESOLUTION 6398 Resolution 6398 was presented to the Council to consider authorizing the consulting agreement with Simple Grants. A motion by Council Member Pickens to adopt Resolution Number 6398 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 18. RESOLUTION 6399 Resolution 6399 was presented to the Council to consider authorizing the purchase of Municode Meetings and Municode Meetings Board management programs. A motion by Council Member Zinnerman to adopt Resolution Number 6399 was made with a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 19. EXTEND THE FLOOR TO THE PUBLIC Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. December 13, 2022 City Council Meeting Minutes Page 4 Of 5  321 a) Lynn Mullens at 142 Forest Road questioned the Mayor and Council about a rent matter at his residence. The City Attorney advised Mr. Mullens the issue discussed is a civil matter. b) Eric Frey at 2845 Brooklane Drive, representing the American Legion thanks the City and the Chamber of Commerce for the help with the Toys for Tots program. The Legion is wrapping up the 2022 Toys for Tots program being able to collect toys to fill two sixteen foot trailers and two pickup trucks for delivery. Mr. Frey thanks the City and the Chamber for including the Legion with events in the City. Mr. Frey wishes everyone a Merry Christmas and a Happy New Year! c) City Attorney Spoke about the " Challenge Coin" the City officials received from the Police Department and it' s purpose. 20. ADJOURNMENT With no further business to come before the Council Meeting; a motion by Council Member Zinnerman was made to adjourn the meeting.
