322 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, DECEMBER 20, 2022 The City Council of the City of Hueytown, Alabama, met at 5: 30P. M. in the Pre - Council Chamber meeting room at the City of Hueytown City Hall on Tuesday, December 20, 2022. The Meeting was called to order with Council Members Zinnerman, Pickens, Wright and Jacks present. Council Member Hurliman was absent. Mayor Ware, City Attorney, Charlie Waldrep, of Waldrep Stewart & Kendrick, LLP were present at the meeting. There were two individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, DECEMBER 20, 2022 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber of Hueytown City Hall on Tuesday, December 20, 2022. 1. CALL TO ORDER, INVOCATION, ROLL CALL AND MEDIA RECOGNITION The meeting was called to order by Council President Wright at 6: 02P. M. with approximately seven individuals in the audience. The invocation was given by Council President Wright followed by the Pledge of Allegiance. Upon Roll Call, Council Members Zinnerman, Pickens, Wright and Jacks being Present. Council Member Hurliman was absent. City Attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP was present. Kailah Hegler from the Western Star was also present. 2. APPROVAL OF MINUTES Council Member Jacks made a motion followed by a second to the motion by Council Member Zinnerman to approve the December 13, 2022 Council Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens and Jacks voting yes. There were no nay votes. President Wright declared the minutes approved. A Motion to amend the meeting agenda to add Resolution Number 6406 by Council Member Pickens followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens and Jacks voting yes. There were no nay votes. The motion carried unanimously. 3. MAYORS REPORT The Mayor welcomed everyone present and thanks them for taking time out of their busy schedules to learn what' s happening in the City. The Mayor wishes everyone a Merry Christmas. _ 4. STANDING COMMITTEE REPORTS a) Finance Committee: Council Member Zinnerman, no report. b) Planning and Development Committee: Council Member Pickens, no report. c) Public Safety Committee: Council Member Hurliman, absent. d) Public Works and Parks Committee: Council Member Jacks, no report. 5. GREAT THINGS HAPPENING IN HUEYTOWN a) Debbie Kiker, Executive Director for the Hueytown Chamber of Commerce reports: i. Absent 7. CITY BOARDS REPORT a) Michel Merritt, President of the Hueytown Parks and Recreation Board reminds everyone of the various leagues are preparing to start their spring program registrations. 8. CORRESPONDENCE There was no correspondence to report. 9. BILLS FOR APPROVAL Council Member Zinnerman presented a list of bills totaling $ 233, 288. 97 and made a motion to approve the list of bills presented for payment. Council Member Jacks made a second to the motion. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens and Jacks voting yes. There were no nay votes. The motion carried unanimously. RESOLUTION 6400 Resolution 6400 was presented to the Council as a Public Hearing for the property owner located at 102 Walker Avenue regarding a Citation issued case number 2212- 0607 as an inoperable vehicle. Mr. 8s Mrs. Johnson addressed the Mayor and Council to request additional time for the removal of the cited inoperable vehicle from the property. A motion by Council Member Zinnerman was made to adopt Resolution Number 6400 with the stipulation of the vehicle being removed from the property by January 10, 2023 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens and Jacks voting yes. There were no nay votes. The motion carried unanimously. 11. RESOLUTION 6401 Resolution 6401 was presented to the Council to consider confirming the report of costs and create a Special Assessment Lien on the property located at 130 Wickstead Road. A motion by Council Member Pickens was made to adopt Resolution Number 6401 followed by a second to the motion by Council Member Jacks. There were no nay votes, the motion carried unanimously. 12. RESOLUTION 6402 Resolution 6402 was presented to the Council to consider authorizing the Services of Kibelka Landscape Architecture, LLC. A motion by Council Member Pickens was made to adopt Resolution Number 6402 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Pickens and Jacks voting yes and Council Member Zinnerman abstaining from the vote. There were three yes and one abstention to the vote, the motion carried. 13. RESOLUTION 6403 Resolution 6403 was presented to the Council to consider authorizing the one year Remote Support Plan Agreement with CRI. A motion by Council Member Pickens to adopt Resolution Number 6403 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens and Jacks voting yes. There were no nay votes, the motion carried unanimously. 14. RESOLUTION 6404 Resolution 6404 was presented to the Council to consider authorizing the Mayor to negotiate the cost of the nuisance abatement for the structure demolition located at 2009 271h Avenue North. A motion by Council Member Zinnerman to adopt Resolution Number 6404 was made with a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens and Jacks voting yes. There were no nay votes. The motion carried unanimously. 15. RESOLUTION 6405 Resolution 6405 was presented to the Council to acknowledge receipt of funds from State Senator Merika Coleman for the benefit of the Hueytown Arts Council. A motion by Council Member Zinnerman to adopt Resolution Number 6405 was made with a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens and Jacks voting yes. There were no nay votes. The motion carried unanimously. 16. ORDINANCE 22- 1213- 01 Ordinance 22- 1213- 01 was presented to the Council to consider the repeal, amend and supplement Chapter 18 Entitled " Businesses and Business Regulations", Article VI, Entitled " Massage Parlors", Division 1 Entitled " Generally", Sections 18- 111 through 18- 130 of the Code of Ordinances of the City of Hueytown, Alabama. A motion by Council Member Pickens to adopt Ordinance 22- 1213- 01 was made with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens and Jacks voting yes. There were no nay votes. The motion carried unanimously. 17. RESOLUTION 6406 Resolution 6406 was presented to the Council to consider authorizing the City Clerk and Treasurer as contact to collect Unclaimed Property on behalf of the City of Hueytown. A motion by Council Member Zinnerman to adopt Resolution Number 6406 was made with a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens and Jacks voting yes. There were no nay votes, the motion carried unanimously. 18. EXTEND THE FLOOR TO THE PUBLIC December 20, 2022 City Council Meeting Minutes Page 3 Of 4  325 Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a) No one present was identified for public comment. 19. ADJOURNMENT With no further business to come before the Council Meeting; a motion by Council Member Jacks was made to adjourn the meeting.
