433 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, APRIL 25, 2023 The City Council of the City of Hueytown, Alabama, met at 5: 32P. M. in the Pre - Council Chamber meeting room at the City of Hueytown, City Hall, on Tuesday, April 25, 2023. President Wright called the meeting to order with Council Members Zinnerman, Pickens, Hurliman, Wright and Jacks and City Attorney, Charlie Waldrep, of Waldrep Stewart 8s Kendrick, LLP present. Mayor Ware was absent. There were four individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, APRIL 25, 2023 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber meeting room at the Hueytown City Hall on Tuesday, April 25, 2023. 1. CALL TO ORDER, INVOCATION, ROLL CALL AND MEDIA RECOGNITION The meeting was called to order by Council President Wright at 6: OOP. M. with approximately twenty individuals in the audience. The invocation was given by Council Member Pickens followed by the Pledge of Allegiance. Upon Roll Call, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks were present. City attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP was present. Kailah Hegler from the Western Star was also present. 2. APPROVAL OF MINUTES Council Member Hurliman made a motion followed by a second to the motion by Council Member Pickens to approve the April 11, 2023 Pre -Council and Council Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the minutes approved. 3. MAYORS REPORT The Mayor was absent from the meeting. President Wright read two Proclamations; this first recognizing National Library Week and the second recognizing the fifty- fourth annual Professional Municipal Clerks Week. PROCLAMATION National Library Week 2023 April 23- 29, 2023 WHEREAS, the theme for National Library Week 2023, " There is More to the Story," promotes the idea that libraries are full of stories in a number of formats. OFFICERS REPORT a) Police Department: Chief Yarbrough - no report. b) Fire Department: Chief Sullivan - no report. c) Public Works/ Street and Parks Department: Director Butts - no report. d) Inspector Humphries - reports the Building and Zoning Department: preliminaries for the City' s Storm Water is completed in preparation for the MS4 Phase 1 permit being issued to the City by the Alabama Department Of Environmental Management, " ADEM". The preliminary Storm Water Plan is posted on the City' s website and at the Bulletin board at City Hall for the Public' s review. 6. GREAT THINGS HAPPENING IN HUEYTOWN a) Lisa Kriegal, Chamber President spoke for Debbie Kiker, Executive Director for the Hueytown Chamber of Commerce reports: i. Thank You to the Mayor and Council Members Jacks, Zinnerman and Wright for attending the Chamber Scholarship reception. ii. The Chamber Study Club Blood Drive was held on Saturday, April 22, 2023. iii. The first Podcast is scheduled for May with Mayor Ware being the first guest. 2023 at the iv. The Mayor's Community Breakfast is Thursday, May 4, North Highlands Baptist Church with Siran Stacy as the Keynote Speaker. v. The Hometown Hero Banners Commemorating Ceremony is scheduled for Sunday, May 7, 2023 at the City Center Park. vi. The Girls Night Out fashion show is scheduled for Thursday, May 11, 2023 at Venue 3131. vii. Shop Local! 7. CITY BOARDS REPORT: a) Parks And Recreation Board: Michael Merritt, President reports: April 25, 2023 City Council Meeting Minutes Page 3 Of 7 436 i. The Board is having a work session to review and revise the security policy for the rental of the Community Centers. ii. Bookings for the Community Centers continue to be strong with bookings completed through August. iii. Thanks the Mayor and Council for the funds received for the cleaning of the stadium after football games at the High School. iv. Thanks to the City for the funds received for the Martin Luther King, Jr. Community Center repairs, Soccer Field concession stand roof repairs and playground equipment. v. The playground equipment which has been on order for many months is scheduled for delivery late May or June. vi. Baseball program attended a clinic at Rickwood Field and Miles College. vii. Softball Program at Allison Bonnett park hosted a tournament which exceeded expectations. Thanks to the City for the field repairs which allowed for a successful tournament. viii. Closing ceremony is being planned to be held in late May. ix. There are four vacancies on the Park Board which the board encourages the Council to appoint individuals willing to serve on the board. x. Thanks the Mayor and Council for the appropriation of funds for repairs to the ball fields to get the program started for a successful year. xi. The Soccer Program starts April 1, 2023. b) Library Board, Carroll Rector, Director Reports: i. Thank You to Mayor Ware for the Proclamation in honor of National Library Week. ii. Storytime is scheduled with two monthly programs; meeting the second and last Thursday of each month. iii. Reading Buddies is scheduled with two monthly programs; meeting the first and third Monday at 3: 30P. M. each month. The library is in partnership with the Greater Birmingham Humane Society with this program. iv. The Summer Reading Program is scheduled for the month of June. v. The Summer Reading Classes will be offered each Tuesday, Wednesday and Thursday for the month of July. vi. The Book Club held a meeting last month with Dr. Andrew Duxbury as the speaker. vii. The Chicks With Sticks knitting and crocheting group meets each Monday, 10: 00A. M. to 12: OOP. M.. viii. All the above programs are free to attend. ix. Reminder the Library and Staff Members are to be a service to the community and remember the slogan, " When In Doubt, Go To The Library". 8. CORRESPONDENCE a) There was no correspondence to report. 9. BILLS FOR APPROVAL Council Member Zinnerman presented a list of bills totaling $ 813, 671. 38 and made a motion to approve the list of bills which were presented for payment. Council Member Pickens made a second to the motion. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. RESOLUTION 6534 Resolution 6534 was presented to the Council to authorize the maintenance agreements for the City' s emergency electrical generation equipment. A motion by Council Member Hurliman was made to adopt Resolution Number 6534 followed by a second to the motion by Council Member Zinnerman. Upon a rol call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes.There were no nay votes. The motion carried unanimously. 11. RESOLUTION 6535 Resolution 6535 was presented to the Council to declare a Public Nuisance of an unsafe structure located at 45 Johnson Drive,Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6535 followed by a second to the motion by Council Member Hurliman. Upon a rol call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes.There were no nay votes. The motion carried unanimously. 12. RESOLUTION 6536 Resolution 6536 was presented to the Council to order the abatement of a Public Nuisance of an unsafe structure located at 209 Tyree Street (formerly 154 Johnson Drive), Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6536 followed by a second to the motion by Council Member Hurliman. Upon a rol call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes.There were no nay votes. The motion carried unanimously. 13. RESOLUTION 6537 Resolution 6537 was presented to the Council to order the abatement of a Public Nuisance of an unsafe structure located at 110 Erie Avenue, Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6537followed by a second to the motion by Council Member Hurliman. Upon a rol call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes.There were no nay votes. The motion carried unanimously. 14. RESOLUTION 6538 Resolution 6538 was presented to the Council to acknowledge the receipt of funds from Alabama State Legislator Representative Patrick Sellers for the benefit of the Youth Football Program. A motion by Council Member Zinnerman was made to adopt Resolution Number 6538 followed by a second to the motion by Council Member Pickens. Upon a rol call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes.There were no nay votes. The motion carried unanimously. 15. RESOLUTION 6539 Resolution 6539 was presented to the Council to appoint a voting delegate to the Alabama Municipal Insurance Corporation Annual Membership Business Meeting being held on May 11, 2023 in Birmingham, Alabama. A motion by Council Member Hurliman was made to adopt Resolution Number 6539 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Pickens, Hurliman and Jacks voting yes. Council Member Zinnerman abstained from the vote. There were four yes votes and one abstention vote.The motion carried. 16. RESOLUTION 6540 Resolution 6540 was presented to the Council to declare a Public Nuisance and order the abatement of Weeds, Trash and/ or Inoperable Vehicle at the property located at 121 East Crest Road, Hueytown. RESOLUTION 6541 Resolution 6541 was presented to the Council to declare a Public Nuisance and order the abatement of Weeds, Trash and/ or Inoperable Vehicle at the property located at 3046 Allison Bonnett Memorial Drive, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6541 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 18. RESOLUTION 6542 Resolution 6542 was presented to the Council to declare a Public Nuisance and order the abatement of Weeds, Trash and/ or Inoperable Vehicle at the property located at 1314 Hueytown Road, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6542 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 19. RESOLUTION 6543 Resolution 6543 was presented to the Council to authorize the purchase of revenue bonds of the Special Care Facilities Financing Authority of the City of Hueytown, Alabama. A motion by Council Member Hurliman was made to adopt Resolution Number 6543 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Pickens, Hurliman and Jacks voting yes and Council Member Zinnerman voting no. There were four yea votes and one nay vote. The motion carried. 20. ORDINANCE 23- 0425- 01 Ordinance 23- 0425- 01 was presented to the Council as a First Reading/ Public Hearing to consider the annexation of property located at 220 Woodward Drive, Hueytown. A motion by Council Member Pickens was made to suspend the rules to consider the adoption of Ordinance 23- 0425- 01 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. A motion by Council Member Pickens was made to adopt Ordinance 23- 0425- 01 followed by a second to the motion by Council Member Hurliman. EXTEND THE FLOOR TO THE PUBLIC Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a) Dennis Wilson at 1105 25t' Avenue addressed the Council of complaint of the property located at 1101 25t'' Avenue of storing and selling wood at ,the location. Inspections Officer Humphries informed the Council the City's Code Enforcement Officer has issued a Citation to the resident at the April 25, 2023 City Council Meeting Minutes Page 6 Of 7  439 address and is due in court. Fire Chief Sullivan has also contacted the Jefferson County Health Department which informed Chief Sullivan states the Health Department sent a representative to the address to investigate. 22.
