441 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, MAY 09, 2023 The City Council of the City of Hueytown, Alabama, met at 5: 30P. M. in the Pre - Council Chamber meeting room at the City of Hueytown, City Hall, on Tuesday, May 9, 2023. President Wright called the meeting to order with Council Members Zinnerman, Pickens, Hurliman, Wright and Jacks, Mayor Stephen Ware and City Attorney, Charlie Waldrep, of Waldrep Stewart 8s Kendrick, LLP present. There were five individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, MAY 09, 2023 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber meeting room at the Hueytown City Hall on Tuesday, May 9, 2023. 1. CALL TO ORDER, INVOCATION, ROLL CALL AND MEDIA RECOGNITION The meeting was called to order by Council President Wright at 6: 04P. M. with approximately fourteen individuals in the audience. The invocation was given by Council Member Jacks followed by the Pledge of Allegiance. Upon Roll Call, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks being present. Mayor Stephen Ware and City Attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP were present. Kailah Hegler from the Western Star was also present. 2. APPROVAL OF MINUTES Council Member Pickens made a motion followed by a second to the motion by Council Member Hurliman to approve the April 25, 2023 Pre - Council and Council Meeting and the May 2, 2023 Work Session meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the minutes approved. A motion by Council Member Pickens to amend the meeting agenda for the addition of Resolution Numbers 6549 and 6550 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, There were no nay votes. The motion carried Hurliman and Jacks voting yes. unanimously. 3. MAYORS REPORT The Mayor welcomes everyone attending the meeting. The Mayor reports the ceremony recognizing the Hometown Hero' s was a success and be on the lookout of the banners placed at various locations throughout the City which recognize Hueytown' s Veterans. The Mayor reports the second annual Mayor' s Breakfast held on May 4` h was a great success. The Mayor read and then presented a Proclamation to Police Chief Yarbrough recognizing National Police Week. Proclamation May 09, 2023 City Council Meeting Minutes Page 1 Of 5 442 National Police Week May 15- 19, 2023 To recognize National Police Week 2023 and to honor the service and sacrifice of those police officers killed in the line of duty while protecting our communities and safeguarding our democracy. WHEREAS, the Congress and President of the United States have declared May 15 as Peace Officers Memorial Day, and the week in which it falls as Police Week; WHEREAS, the International of Chiefs of Police has declared police officer safety and wellness a top priority, and the IACP' s Center for Officer Safety and Wellness promotes the importance of individual, agency, family, and community safety and wellness awareness; and WHEREAS, the members of the police department of the City of Hueytown play an essential role in safeguarding the rights and freedoms of the citizens of our community; and WHEREAS, it is important that all citizens know and understand the problems, duties and responsibilities of their police department, and that members of our police department recognize their duty to serve the people by safeguarding life and property, by protecting them against violence disorder, and by protecting the innocent against deception and the weak against oppression or intimidation; and WHEREAS, the men and women of the police department of the City of Hueytown unceasingly provide a vital public service; NOW, THEREFORE, I, Mayor Stephen M. Ware call upon all citizens of the City of Hueytown and upon all patriotic, civil and educational organizations to observe the week of May 15- May 19, 2023, as Police Week in which our community may join in commemorating police officers, past and present, who by their faithful and loyal devotion to their responsibilities have rendered a dedicated to service their communities and, in doing so, have established for themselves a reputation for preserving the rights and security of all citizens. I15,FURTHER 2023, call upon all citizens of the City of Hueytown, Alabama to observe May as Peace Officers Memorial Day to honor those Peace officers who, through their courageous deeds, have lost their lives or have become disabled in the performance of duty. OFFICERS REPORT a) Police Department: Chief Yarbrough - reports the vehicles ordered last month plan to be received first part of June. Chief Yarbrough also reports that 9 1 % of the cases being investigated have been closed. b) Fire Department: Chief Sullivan - no report. c) Public Works/ Street and Parks Department: Director Butts - no report. d) Building and Zoning Department: Inspector Humphries - no report. 6. June 10, 2023 is City Fest which will be held in the City Center Park on Forest Road. Additional information can be obtained from the Hueytown Arts Council Website, https:// hueVtownarts. org/ and Facebook page. 7. CORRESPONDENCE a) There was no correspondence to report. 8. BILLS FOR APPROVAL Council Member Zinnerman presented a list of bills totaling $ 481, 307. 41 and made a motion to approve the list of bills which were presented for payment followed by second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. RESOLUTION 6544 Resolution 6544 was presented to the Council as a Public Hearing regarding a declared Public Nuisance for the property located at 213 Forest Road, Hueytown. City Inspector Humphries spoke to this matter as did the property owner. A motion by Council Member Jacks was made to adopt Resolution Number 6544, with the stipulation to extend the date when compliance is to be completed, with a progress report to the Council at the June 13, 2023 Council Meeting for the Council to consider giving additional time or to proceed to order the abatement of the Nuisance, followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 10. RESOLUTION 6545 Resolution 6545 was presented to the Council to declare a Public Nuisance and order the abatement for the property located at 1101 25`' Avenue North, Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6545 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. RESOLUTION 6546 Resolution 6546 was presented to the Council to confirm the report of costs and create a Special Assessment Lien on the property located at 158 21' t Street Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6546 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 12. RESOLUTION 6547 Resolution 6547 was presented to the Council to adopt the policy guidelines in assigning City -owned vehicles to individual officers through a Vehicle Take -Home Policy. A motion by Council Member Hurliman was made to adopt Resolution Number 6547 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright abstained with Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There was one abstain vote, four yea votes and no nay votes. The motion carried. 13. ORDINANCE 23- 0509- 01 Ordinance 23- 0509- 01 was presented to the Council as a First Reading/ Public Hearing to repeal Chapter 94, entitled " Traffic and Vehicles" Article III entitled Parking", Sections 94- 46 through 94- 51 of the Code Of Ordinances of the City of Hueytown, Alabama. After no individual came forward to speak for or against Ordinance 23- 0509- 01, Council President Wright closed the Pubic Hearing. 14. ORDINANCE 23- 0509- 02 Ordinance 23- 0509- 02 was presented to the Council as a first reading/ Public Hearing to repeal Division 2 entitled " Rules Of Procedure" of chapter 2 entitled Administration" Article II entitled " City Council" of the Code of Ordinances of the City of Hueytown, Alabama and enact new Division 2 entitled " Rules of Procedure" of Chapter 2 entitled " Administration" Article II entitled " City Council' of the Code of Ordinances of the City of Hueytown, Alabama. After no individual came forward to speak for or against Ordinance 23- 0509- 02, Council President Wright closed the Pubic Hearing. 15. ORDINANCE 23- 0509- 03 Ordinance 23- 0509- 03 was presented to the Council as a first reading/ Public Hearing to repeal Chapter 86 entitled " Streets, Sidewalks and Other Public Places" ArticleIII entitled " Excavations", Sections 86- 51 through 86- 71 of the Code of Ordinances of the City of Hueytown, Alabama and enact new Chapter 86 entitled Streets, Sidewalks and Other Public Places", Article III entitled " Ground Disturbance of Public Property", Sections 86- 51 through 86- 68 of the Code of Ordinances of the City of Hueytown, Alabama. After no individual came forward to speak for or against Ordinance 23- 0509- 03, Council President Wright closed the Pubic Hearing. 16. RESOLUTION 6548 Resolution 6548 was presented to the Council to award the Contract For Demolition And Clearance bid. A motion by Council Member Pickens was made to adopt Resolution Number 6548 followed by a second to the motion by Council Member Hurliman. The motion carried unanimously. 17. RESOLUTION 6549 Resolution 6549 was presented to the Council to authorize the City Attorney to file eminent domain lawsuits as relates to the State of Alabama Project STPBH- 7021( 600). A motion by Council Member Pickens was made to adopt Resolution Number 6549 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 18. RESOLUTION 6550 Resolution 6550 was presented to the Council to authorize the Mayor to execute the City of Hueytown Storm Water Management Program Plan for the 2023 calendar year. A motion by Council Member Hurliman was made to adopt Resolution Number 6550 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. Council Member Pickens departed the meeting at this time to attend a school function with his son. A motion was made by Council Member Zinnerman to suspend the rules to consider an issue related to a Nuisance Matter at 3100 20t'' Street North for an extension of 35 days for compliance of the Nuisance, followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 19. EXTEND THE FLOOR TO THE PUBLIC Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a) Ms. Wilson at 1105 251'' Avenue North addressed the Council of complaint of the property located at 1101 25t' Avenue North seeking an update with the continued Nuisance. b) Mary Meyer at 502 Saddleridge inquired about the Scholarship Awards with Council Member Jacks responding. c) Bernard Cook at 596 Yellow Bird comments about the Hometown Hero' s recognition. d) Charleen Glenn from the Bethlehem Methodist Church will have a 2051'' year celebration on May 21, 2023 and invites everyone to the celebration. e) Emma White, Hueytown Beautification Board President, reports of a cleanup being planned on May 20, 2023 beginning at 10: 00AM. Registration for the event begins at 9: 30A. M.. 20. ADJOURNMENT With no further business to come before the Council Meeting, Council President Wright declared the meeting adjourned at 6: 53P.
