M. in the Pre - Council Chamber meeting room at the City of Hueytown, City Hall, on Tuesday, May 23, 2023. President Wright called the meeting to order with Council Members Zinnerman, Pickens, Hurliman, Wright and Jacks, Mayor Stephen Ware and City Attorney, Charlie Waldrep, of Waldrep Stewart & Kendrick, LLP present. There were seven _ individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, MAY 23, 2023 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber meeting room at the Hueytown City Hall on Tuesday, May 23, 2023. 1. CALL TO ORDER, INVOCATION, ROLL CALL AND MEDIA RECOGNITION The meeting was called to order by Council President Wright at 6: 07P. M. with approximately eighteen individuals in the audience. The invocation was given by Council Member Hurliman followed by the Pledge of Allegiance. Upon Roll Call, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks being present. Mayor Stephen Ware and City Attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP were present. Kailah Hegler from the Western Star was also present. 2. APPROVAL OF MINUTES Council Member Pickens made a motion followed by a second to the motion by Council Member Zinnerman to approve the May 9, 2023 Pre -Council and Council Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the minutes approved. A motion by Council Member Jacks to amend the meeting agenda for the addition of Resolution Numbers 6561 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 3. MAYORS REPORT The Mayor welcomes everyone attending the meeting. There has been lots going on the past couple weeks. Last Friday Movies In The Park which had perfect weather and attendance in excess of two -hundred. Saturday was litter cleanup with meeting at Storm Shelter along Brooklane Drive and some side streets which went through twelve - noon. STANDING COMMITTEE REPORTS a) Finance Committee: Council Member Zinnerman, no report. b) Planning and Development Committee: Council Member Pickens, reports the Planning and Zoning Commission are reviewing current Ordinances and looking at neighboring communities for possible updates to the City' s code. Pickens also reports Liens that have been authorized by the City Council have been uploaded to the Jefferson County Tax Collector. c) Public Safety Committee: Council Member Hurliman, no report. d) Public Works and Parks Committee: Council Member Jacks, no report. 5. OFFICERS REPORT a) Police Department: Chief Yarbrough - No Report. b) Fire Department: Chief Sullivan - No Report. c) Public Works/ Street and Parks Department: Director Butts - Absent. d) Building and Zoning Department: Inspector Humphries - Reports approved nuisance abatement liens have been recorded at the Jefferson County Judge of Probate with some property owners reimbursing the City of the Liens filed with the Court. 6. GREAT THINGS HAPPENING IN HUEYTOWN a) Michael Cashall, Jr., Board Member reports for the Hueytown Chamber of Commerce: i. Hueytown Mattress Outlet is the May Business Of The Month. ii. Congratulations To Speedy' s Mexican Restaurant for having been in the City conducting business for fifty- five years. iii. The Camber Chat Podcast launches on May 30, 2023. iv. The next Munch and Mingle business after- hours which celebrates the Chambers thirty- fifth anniversary is scheduled for August 17, 2023 at Venue 3131, Hueytown. v. National Night Out with the Hueytown Police, Fire and Public Works Departments is scheduled for August 1, 2023 at the New City Center Park. vi. The second annual Health and Wellness Expo is scheduled for August 18, 2023. vii. The Hometown Hero Pole Flags is open for orders through September, 2023. viii. Shop Local! 7. CITY BOARD REPORTS a) Hueytown Arts Council, Michelle: i. The May 19th Movies In The Park which will be held in the City Center Park on Forest Road was a great night. The next Movies In The Park event will be July. Additional information can be obtained from the Hueytown Arts Council Website, https:// hueytownarts. org/ and Facebook page. ii. June 10, 2023 is City Fest which will be held in the City Center Park on Forest Road. Additional information can be obtained from the Hueytown Arts Council Website, https:// hueytownarts. org/ and Facebook page. b) Park & Recreation Board, Michael Merritt, President: i. The Baseball and Softball season has ended. ii. The Youth Football program is accepting sign- up applications now. iii. Thanks to the Mayor and Council and all others for the support given to the Parks and Recreation Board. c) Library Board, Jessica Hayes, Board Member: i. The tutored classes start July 5" for the month on Tuesdays, Wednesdays and Thursdays. 8. CORRESPONDENCE a) There was correspondence from the Hueytown Middle School Basketball and Volleyball teams for the Mayor and Council to review. 9. BILLS FOR APPROVAL Council Member Zinnerman presented a list of bills totaling $ 324, 300. 24 and made a motion to approve the list of bills which were presented for payment followed by second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. RESOLUTION 6551 Resolution 6551 was presented to the Council to declare a Public Nuisance and order abatement of weed, trash and/ or inoperable vehicle located at 114 East Jones Court, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6551 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 11. RESOLUTION 6552 Resolution 6552 was presented to the Council to declare a Public Nuisance and order abatement of weed, trash and/ or inoperable vehicle located at 137 Mabelon Drive, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6552 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 12. RESOLUTION 6553 Resolution 6553 was presented to the Council to declare a Public Nuisance and order abatement of weed, trash and/ or inoperable vehicle located at 213 Pine Street, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6553 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 13. A motion by Council Member Hurliman was made to adopt Resolution Number 6554 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright abstained with Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There was one abstain vote, four yea votes and no nay votes. The motion carried. 14. RESOLUTION 6555 Resolution 6555 was presented to the Council to declare a Public Nuisance and order abatement of weed, trash and/ or inoperable vehicle located at 1444 Hueytown Road, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6555 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright abstained with Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There was one abstain vote, four yea votes and no nay votes. The motion carried. 15. RESOLUTION 6556 Resolution 6556 was presented to the Council to declare a Public Nuisance and order abatement of weed, trash and/ or inoperable vehicle located at 2017 29`h Avenue North, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6556 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright abstained with Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There was one abstain vote, four yea votes and no nay votes. The motion carried. 16. RESOLUTION 6557 Resolution 6557 was presented to the Council to declare a Public Nuisance and order abatement of weed, trash and/ or inoperable vehicle located at 2022 281h Avenue North, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6557 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright abstained with Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There was one abstain vote, four yea votes and no nay votes. The motion carried. 17. RESOLUTION 6558 Resolution 6558 was presented to the Council to declare a Public Nuisance and order abatement of weed, trash and/ or inoperable vehicle located at 2030 High School Road, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6558 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright abstained with Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There was one abstain vote, four yea votes and no nay votes. The motion carried. 18. RESOLUTION 6559 Resolution 6559 was presented to the Council to declare a Public Nuisance and order abatement of weed, trash and/ or inoperable vehicle located at 3522 Coke Oven Drive, Hueytown. Upon a roll call vote, President Wright abstained with Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There was one abstain vote, four yea votes and no nay votes. The motion carried. 19. RESOLUTION 6560 Resolution 6560 was presented to the Council to declare and deem certain Municipal personal property surplus and not needed for public purposes and to authorize the disposal thereof. A motion by Council Member Pickens was made to adopt Resolution Number 6560 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright abstained with Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There w.&s one abstain vote, four yea votes and no nay votes. The motion carried. 20. RESOLUTION 6561 Resolution 6561 was presented to the Council to extend the time to abate a declared structural Public Nuisance at 3100 20th Street North, Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6561 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright abstained with Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There was one abstain vote, four yea votes and no nay votes. The motion carried. 21. ORDINANCE 23- 0509- 01 Ordinance 23- 0509- 01 was presented to the Council to repeal Chapter 94, entitled Traffic and Vehicles" Article III entitled " Parking", Sections 94- 46 through 94- 51 of the Code Of Ordinances of the City of Hueytown, Alabama. A motion by Council Member Zinnerman was made to adopt Ordinance Number 23- 0509- 01 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright with Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were five yea votes and no nay votes. The motion carried. 22. ORDINANCE 23- 0509- 02 Ordinance 23- 0509- 02 was presented to the Council to repeal Division 2 entitled Rules Of Procedure" of chapter 2 entitled " Administration" Article II entitled " City Council" of the Code of Ordinances of the City of Hueytown, Alabama and enact new Division 2 entitled " Rules of Procedure" of Chapter 2 entitled " Administration" Article II entitled " City Council" of the Code of Ordinances of the City of Hueytown, Alabama. A motion by Council Member Pickens was made to adopt Ordinance Number 23- 0509- 02 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright with Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were five yea votes and no nay votes. The motion carried. 23. ORDINANCE 23- 0509- 03 Ordinance 23- 0509- 03 was presented to the Council to repeal Chapter 86 entitled Streets, Sidewalks and Other Public Places" Article III entitled " Excavations", Sections 86- 51 through 86- 71 of the Code of Ordinances of the City of Hueytown, Alabama and enact new Chapter 86 entitled " Streets, Sidewalks and Other Public Places", Article III entitled " Ground Disturbance of Public Property", Sections 86- 51 through 86- 68 of the Code of Ordinances of the City of Hueytown, Alabama. Upon a roll call vote, President Wright with Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were five yea votes and no nay votes. The motion carried. 24. EXTEND THE FLOOR TO THE PUBLIC Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a) Charleen Glenn spoke about a stop sign be installed at the exit of Fitness 1440 parking lot as entering onto Owens Circle. Patrons exiting the facility are not stopping as they enter the roadway. Ms. Glenn also informed the Mayor and Council the vegetation along Allison Bonnett Memorial Boulevard in front of Fast Pace Clinic need to be mowed as the grass is very tall. The Mayor informed Ms. Glenn he would contact Jefferson County about her concern as the road is a county maintained road. b) Terry Headley at 1593 Virginia Lane expressed concerns to the Mayor and Council of speeding by the Valley Creek Church. Also, the ditch at this location is stopped -up causing concerns of storm water from the hill causing flooding onto the road and property. The Mayor informed Jerry that he would notify the City' s Public Works Department to investigate this concern. c) Sharon Syx at 3805 Sharon Lane states the Dog Park and the new City Center Park are magnificent. Ms. Syx also spoke about attending the Alabama Home Games and the good comments about Mr. Roydell Williams. d) Gloria Bowen at 127 Vann Street inquired about the City' s Noise Ordinance and the barking dogs at the Vet Clinic. Ms. Bowen states the dogs typically start barking at 7: OOAM to 11: 00AM and from 1: OOPM to 6: 30PM in the afternoon/ early evening. The Mayor responded to Ms. Bowen comment stating the Police Department went to the area with a noise meter which gave a reading of 70. 4. 25. ADJOURNMENT With no further business to come before the Council Meeting, Council Member Pickens moved to adjourn the meeting. Council President Wright declared the meeting adjourned at 6: 50P. M..
