462 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, JULY 11, 2023 The City Council of the City of Hueytown, Alabama, met at 5: 30P. M. in the Pre - Council Chamber meeting room at the City of Hueytown, City Hall, on Tuesday, July 11, 2023. President Wright called the meeting to order with Council Members Zinnerman, Pickens, and Hurliman present and Council Member Jacks absent. Mayor Stephen Ware and City Attorney, Charlie Waldrep, of Waldrep Stewart & Kendrick, LLP were present. There were seven individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, JULY 11, 2023 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber meeting room at the Hueytown City Hall on Tuesday, July 11, 2023. 1. CALL TO ORDER: The meeting was called to order by Council President Wright at 6: 07P. M. with approximately thirty- three individuals in the audience. 2. INVOCATION: The invocation was given by Council Member Hurliman followed by the Pledge of Allegiance. 3. PLEDGE OF ALLEGIANCE: 4. ROLL CALL Upon Roll Call, Council Members Wright, Zinnerman, Pickens and Hurliman being present. Council Member Jacks was absent. President Wright presided over the meeting. Mayor Stephen Ware and City Attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP were present. S. MEDIA RECOGNITION: Kailah Hegler from the Western Star was present. 6. APPROVAL OF MINUTES Council Member Hurliman made a motion followed by a second to the motion by Council Member Pickens to approve the June 27, 2023 Pre -Council and Council Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens and Hurliman voting yes. There were no nay votes. President Wright declared the minutes approved. 7. ADOPT AGENDA FOR THE MEETING: Council Member Hurliman made a motion followed by a second to the motion by Council Member Pickens to adopt the meeting agenda as published with the addition of item " 14h" titled Resolution Number 6586. July 11, 2023 City Council Meeting Minutes Page 1 Of 6  463 Upon roll call vote, President Wright and Council Members Zinnerman, Pickens and Hurliman voting yes. There were no nay votes. President Wright declared the meeting agenda adopted. 8. MAYORS REPORT The Mayor welcomes everyone attending the meeting. The Mayor reports there is a larger drainage pipe being installed in Forest Road in front of the Primary School followed by raising the roadbed. This will prevent the road from flooding during rain events since the construction of the Primary School. The Mayor reports there is new playground equipment being installed at the playground areas at Brooklane, Martin Luther King, Jr. and City Center Parks. The Mayor reports there will be Movies In The Park this coming weekend at the City Center Park. 9. STANDING COMMITTEE REPORTS a) Finance Committee: Council Member Zinnerman, no report. b) Planning and Development Committee: Council Member Pickens, no report with the Planning and Zoning meeting scheduled for next Tuesday. c) Public Safety Committee: Council Member Hurliman, no report. d) Public Works and Parks Committee: Council Member Jacks, absent. 10. OFFICERS REPORT a) Police Department: Lt. Coram - No Report. b) Fire Department: Chief Sullivan - No Report. No Report. c) Public Works/ Street and Parks Department: Director Butts - d) Building and Zoning Department: Inspector Humphries - No Report. 11. GREAT THINGS HAPPENING IN HUEYTOWN a) Debbie Kiker, Executive Director for the Hueytown Chamber of Commerce: i. Congratulations to Dr. Brent Church of Church Family Dental for one year being in business. ii. The next Munch and Mingle business after- hours which celebrates the Chambers thirty-fifth anniversary is scheduled for August 17, 2023 at Venue 3131, Hueytown. iii. National Night Out with the Hueytown Police, Fire and Public Works Departments is scheduled for August 1, 2023 at the new City Center Park. iv. The second annual Health and Wellness Expo is scheduled for August 18, 2023. v. Shop Local! b) Hueytown Arts Council, Jake Ware: i. The upcoming Movies In The Park is July 141'' and will be held in the City Center Park on Forest Road. The next Movies In The Park event will be August 11, 2023. RESOLUTIONS: a) Resolution 6579 Resolution 6579 was presented to the Council as a Public Hearing regarding a declared Public Nuisance located at 303 Hill Avenue, Hueytown. Ms. Laurie Baggett Fields addressed the Mayor and City Council and produced pictures of the property in question. Ms. Fields states there has been many issues with the neighbor. After discussion, a motion by Council Member Zinnerman was made to remove Resolution Number 6579 from the agenda regarding the Public Nuisance subject to the City's Inspection Officer' s inspection of the property followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens and Hurliman voting yes. There were no nay votes. The motion carried unanimously. b) RESOLUTION 6580 Resolution 6580 was presented to the Council to declare a Public Nuisance and order abatement of weed, trash and/ or inoperable vehicle located at 200 Love Street, Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6580 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens and Hurliman voting yes. There were no nay votes. The motion carried unanimously. c) RESOLUTION 6581 Resolution 6581 was presented to the Council to declare a Public Nuisance and order abatement of weed, trash and/ or inoperable vehicle located at 1543 271h Avenue North, Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6581 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens and Hurliman voting yes. There were no nay votes. The motion carried unanimously. d) RESOLUTION 6582 Resolution 6582 was presented to the Council to declare a Public Nuisance and order abatement of weed, trash and/ or inoperable vehicle located at 1549 27' Avenue North, Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6582 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens and Hurliman voting yes. There were no nay votes. The motion carried unanimously. A motion by Council Member Zinnerman was made to adopt Resolution Number 6583 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens and Hurliman voting yes. There were no nay votes. The motion carried unanimously. fl RESOLUTION 6584 Resolution 6584 was presented to the Council to order the abatement of a Public Nuisance of an unsafe structure located at 111 Holly Street, Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6584 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens and Hurliman voting yes. There were no nay votes. The motion carried unanimously. g) RESOLUTION 6585 Resolution 6585 was presented to the Council to appoint Tammy Pickens to the Hueytown Parks and Recreation Board. A motion by Council Member Hurliman was made to adopt Resolution Number 6585 followed by a second to the motion by Council President Wright. Upon a roll call vote, President Wright and Council Member Hurliman voting yes and Council Member Zinnerman voting no and Council Member Pickens abstain. There were two yes votes, one no vote and one abstention. The motion carried. h) RESOLUTION 6586 Resolution 6586 was presented to the Council to amend Council Resolution Number 6586 related to Fire Station II Repairs and Maintenance for the purchase of an Ice Machine. A motion by Council Member Hurliman was made to adopt Resolution Number 6586 Upon a roll call followed by a second to the motion by Council Member Pickens. vote, President Wright and Council Members Zinnerman, Pickens and Hurliman voting yes. There were no nay votes. The motion carried unanimously. 15. ORDINANCES: a) ORDINANCE 23- 0711- 01 Ordinance 23- 0711- 01 was presented to the Council as a first reading/ public hearing to consider the annexation of property located at 3781 Virginia Drive, Hueytown. Inspector Humphreys addressed the Mayor and Council about the proposed Ordinance 23- 0711- 01. After no person present spoke either for or against the proposed Ordinance, A motion by Council Member Hurliman was made to close the public hearing followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright with Council Members Zinnerman, Pickens and Hurliman voting yes. There no nay votes. The motion carried. A motion by Council Member Hurliman was made to suspend the rules and adopt Ordinance 23- 0711- 01 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright with Council Members Zinnerman, Pickens and Hurliman voting yes. There no nay votes. The motion carried. b) ORDINANCE 23- 0711- 02 July 11, 2023 City Council Meeting Minutes Page 4 Of 6 W Ordinance 23- 0509- 02 was presented to the Council as a first reading/ public hearing to consider the annexation of property located at 3791 Virginia Drive, Hueytown. Inspector Humphreys addressed the Mayor and Council proposed about the Ordinance 23- 0711- 02. After no person present spoke either for or against the proposed Ordinance, A motion by Council Member Hurliman was made to close the public hearing followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright with Council Members Zinnerman, Pickens and Hurliman voting yes. There no nay votes. The motion carried. A motion by Council Member Hurliman was made to suspend the rules and adopt Ordinance 23- 0711- 01 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright with Council Members Zinnerman, Pickens and Hurliman voting yes. There no nay votes. The motion carried. A motion by Council Member Pickens was made to go back into regular session followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright with Council Members Zinnerman, Pickens and Hurliman voting yes. There no nay votes. The motion carried. c) ORDINANCE 23- 0627- 01 Ordinance 23- 0509- 02 was presented to the Council to consider rezoning the property located at 220 Woodward Drive, Hueytown from MR to R2. A motion by Council Member Hurliman was made to adopt Ordinance 23- 0627- 01 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright with Council Members Zinnerman, Pickens and Hurliman voting yes. There no nay votes. The motion carried. d) ORDINANCE 23- 0627- 02 Ordinance 23- 0509- 02 was presented to the Council to consider rezoning the property located at 3387 Davey Allison Boulevard, Hueytown. A motion by Council Member Hurliman was made to adopt Ordinance 23- 0627- 02 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright with Council Members Zinnerman, Pickens and Hurliman voting yes. There no nay votes. The motion carried. 16. EXTEND THE FLOOR TO THE PUBLIC Prior to the extension of the floor to the public, President Pro Tempore Jacks reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a) Jim Crego at JBS Mental Health Authority supplied a handout to the Mayor and Council followed by addressing the Mayor and Council of the services JBS offers to the Community and Law Enforcement Agencies. Mr. Crego is seeking the City to appropriate $ 2, 000. 00 in the Fiscal 2023- 2024 Budget. b) Libby Rich at 142 Lindberg Road thanks the Hueytown Fire Department for the quick response time to a person falling out of a tree. Ms. Rich addressed the Mayor and Council of a group of individuals who have moved into the neighborhood, shouts obscenities in the neighborhood and requests the Police Department to create a file of the issue. Ms. Rich also thanked Council Member Zinnerman of taking interest in " standing up for the Citizens" and states that issues should be worked -out privately. 17.
