10 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, SEPTEMBER 12, 2023 The City Council of the City of Hueytown, Alabama, met at 5: 30P.M. in the Council Chamber meeting room at the City of Hueytown, City Hall, on Tuesday, September 12, 2023. President Wright called the meeting to order with Council Members Zinnerman, Pickens, Hurliman and Jacks present. Also present was Mayor Stephen Ware, City Attorney, Charlie Waldrep, of Waldrep Stewart &, Kendrick, LLP. Council Member Pickens was absent. There were Six individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. Executive Session was declared by the City Attorney stating the topic meets the criteria of the Open Meetings Act of Alabama. The Council was in executive session from 5: 43PM to 5: 55PM. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, SEPTEMBER 12, 2023 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber meeting room at the Hueytown City Hall on Tuesday, September 12, 2023. 1. CALL TO ORDER: The meeting was called to order by Council President Wright at 6: 09P.M. with y approximately Fifty individuals present in the audience. 2. INVOCATION: The invocation was given by Council Member Hurliman, followed by the Pledge of Allegiance. 3. PLEDGE OF ALLEGIANCE: 4. ROLL CALL Upon Roll Call, Council Members Wright, Zinnerman, Pickens, Hurliman and Jacks being present. President Wright presided over the meeting. Mayor Stephen Ware was present. City Attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP was absent. 5. MEDIA RECOGNITION: Kailah Hegler from the Western Star was identified at the meeting. 6. APPROVAL OF MINUTES Council Member Pickens made a motion followed by a second to the motion by Council Member Hurliman to approve the August 22, 2023 Pre -Council and Council Meeting and the September 05, 2023 Work Session Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the minutes approved. ADOPT AGENDA FOR THE MEETING: Council Member Zinnerman made a motion to adopt the meeting agenda as published followed by a second to the motion by Council Member Pickens. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the meeting agenda adopted. 8. MAYORS REPORT The Mayor welcomes everyone attending and taking time out of their schedules to attend the Council meeting. The Mayor read a Proclamation recognizing September 2023 as Sickle Cell Awareness Month and presented the Proclamation to Council President Wright. The Mayor thanks everyone present for allowing him the privilege to be the Mayor. The Mayor thanks the City Council and being able to work as a team with the City' s employees to be able to give back to the community. The Mayor presented checks on behalf of the City to the Hueytown Youth Softball, Youth Baseball, Youth Soccer, Youth Football sports programs, Hueytown Parks and Recreation Board, Hueytown and the High School Football Program. The Mayor also presented checks on behalf of the City to the Hueytown Library, Hueytown Area Chamber of Commerce, Hueytown Arts Council, and the Hueytown Area Schools ( Hueytown Primary School, Hueytown Intermediate School, Hueytown Middle School, Hueytown High School, Concord Elementary School, Brighton School). PROCLAMATION WHEREAS: Sickle cell disease ( SCD) is the most common inherited blood disorder in the United States. group of inherited hemoglobin disorders, SCD affects over 100, 000 people in the U. S.; and WHEREAS: Sickle cell disease affects nearly 5, 000 people in Alabama and an estimated 1 in every 11 Black or African American child is born with sickle cell trait ( carriers of the SCD gene abnormality). SCD can result in multiorgan dysfunction, significant pain and early death; and WHEREAS: Sickle cell disease is an inherited blood cell disorder that is present at birth when both parents pass down the sickle cell gene. If only one parent possesses the sickle cell gene, that child will be a carrier of the gene and will be able to live a normal life. However, they will be carriers and can pass the gene on to their children; and WHEREAS: Sickle cell disease is diagnosed with a simple blood test. In the United States, all Because children are tested for SCD at birth during routine newborn screening tests at the hospital. children with the disease are at an increased risk of infections and other health problems, early diagnosis and treatment are essential; and WHEREAS: It is of utmost importance that individuals who carry sickle cell trait, and their families, receive appropriate genetic counseling and education to inform them of their risk of having a child with sickle cell disease. More individuals are living longer with sickle cell disease which increases the numbers of those affected by both sickle cell disease and those who carry sickle cell trait; and WHEREAS; Sickle cell disease is chronic but treatable. Treatment options are different for each person depending on their symptoms and complications. Acute pain episodes, called " crisis" are a common manifestation of SCD and should be considered a medical emergency and treated appropriately in the emergency department setting. WHEREAS; In partnership with the Comprehensive Sickle Cell Center housed on the campuses of the University of Alabama at Birmingham and Children' s Hospital, the City of Hueytown hopes to make a difference by bringing awareness to others through education, research and improved treatments in an effort to one day find a cure; now THEREFORE; I, Stephen M. Ware, Mayor of the City of Hueytown, do hereby proclaim September 2023 as SICKLE CELL AWARENESS MONTH in Hueytown, Alabama. Stephen M. Fitness In Park starts August 19th at 9: OOAM with Kim Dabbs, a certified instructor with thirty-four years of nursing experience and certifications. RESOLUTIONS: a) Resolution 6665 Resolution 6665 was presented to the City Council as a request of a Public Hearing regarding a declared Public Nuisance of an Unsafe Structure located at 1006 Old Warrior River Road, Hueytown. Mr. Charles Dillard addressed this matter with the Mayor and City Council. The City Inspections Officer also addressed the Mayor and City Council about about this matter. The Inspections Officer states the structure can be in compliance if secured within seven ( 7) days to prevent vagrant entry into the structure. A motion by Council Member Zinnerman was made to close the Public Hearing followed by a second to the motion by Council Member Pickens. The motion carried unanimously. b) RESOLUTION 6666 Resolution 6666 was presented to the City Council as followup of a Public Hearing to a declared Public Nuisance of an unsafe structure located at 3100 201h Street North, Hueytown. Mr. Trott and Mr. Beckman spoke about the property and their plans to abate the Public Nuisance. The City Inspections Officer addressed the Mayor and Council of the current condition of the property. A motion by Council Member Pickens was made to close the Public Hearing followed with a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. A motion by Council Member Pickens was made to adopt Resolution Number 6666 to extend the time to the October 10, 2023 Council Meeting to show progress to secure the building followed by a second to the motion by Council Member Zinnerman. Ms. Janice Speight on behalf of her business, Intimate Settings, spoke before the Mayor and City Council regarding this matter. The neighboring motorcycle shop spoke about having no issues with Intimate Settings. The Mayor spoke of stipulations for the City Council to consider which are to have an APOST Certified Officer on the premise when alcohol is being served and to close business activity by 11: 00P. M.. A motion by Council Member Pickens was made to close the Public Hearing followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. A motion by Council Member Jacks to adopt Resolution Number 6639 be considered with the stipulations of having an APOST Certified Police Officer on premise when alcohol is being served and business activity will be terminated at 11: 00P. The motion carried unanimously. bb) RESOLUTION 6663 Resolution 6663 was presented to the City Council to consider the order to demolish an unsafe structure as a Public Nuisance on the property located at 304 Marsh Avenue, Hueytown. The structure was declared unsafe and is Public Nuisance at the July 25, 2023 Council Meeting by Resolution Number 6606. A motion by Council Member Jacks was made to adopt Resolution Number 6663 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. cc) RESOLUTION 6664 Resolution 6664 was presented to the City Council to consider the order to demolish an unsafe structure as a Public Nuisance on the property located at 2941 Allison Bonnett Memorial Drive, Hueytown. The structure was declared unsafe and is Public Nuisance at the July 25, 2023 Council Meeting by Resolution Number 6596. A motion by Council Member Jacks was made to adopt Resolution Number 6664 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 15. A motion by Council Member Hurliman was made to adopt Ordinance Number 23- 0822- 02 followed by a second to the motion by Council Member Zinnerman. Mr. Eulogio Miguel spoke to the Mayor and Council about the proposed rezoning. After no other person came forward to either speak for or against the proposed Ordinance, a motion from Council Member Pickens was made to close the Public Hearing followed by a second to the motion by Council Member Hurliman. EXTEND THE FLOOR TO THE PUBLIC Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a) Mr. Harold Core addressed the Mayor and City Council regarding the property located at 2007 271h Avenue North, Hueytown.
