20 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, SEPTEMBER 26, 2023 The City Council of the City of Hueytown, Alabama, met at 5: 30P. M. in the Council Chamber meeting room at the City of Hueytown, City Hall, on Tuesday, September 26, 2023. President Wright called the meeting to order with Council Members Zinnerman, Pickens, Hurliman and Jacks present. Also present was Mayor Stephen Ware, City Attorney, Charlie Waldrep, of Waldrep Stewart & Kendrick, LLP. There were Six individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, SEPTEMBER 26, 2023 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber meeting room at the Hueytown City Hall on Tuesday, September 26, 2023. 1. CALL TO ORDER: The meeting was called to order by Council President Wright at 6: 06P. M. with approximately Thirty -Four individuals present in the audience. 2. INVOCATION: The invocation was given by Council Member Pickens, followed by the Pledge of Allegiance. 3. PLEDGE OF ALLEGIANCE: 4. ROLL CALL Upon Roll Call, Council Members Wright, Zinnerman, Pickens, Hurliman and Jacks being present. President Wright presided over the meeting. Mayor Stephen Ware was present. Present. City Attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP was 5. MEDIA RECOGNITION: Kailah Hegler from the Western Star was identified at the meeting. 6. APPROVAL OF MINUTES Council Member Hurliman made a motion followed by a second to the motion by Council Member Zinnerman to approve the September 12, 2023 Pre -Council and Council Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the minutes approved. 7. ADOPT AGENDA FOR THE MEETING: Council Member Zinnerman made a motion to adopt the meeting agenda as published with the addition of Resolution Number 6682 and the removal of September 26, 2023 City Council Meeting Minutes Page 1 Of 7  21 Resolution Number 6670 followed by a second to the motion by Council Member Hurliman. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the meeting agenda adopted. 8. MAYORS REPORT The Mayor welcomes everyone attending and taking time out of their schedules to attend the Council meeting and to voice any concerns they may have. The Mayor is proud to announce the Kiwanis Club is a new organization in the City. The Mayor was glad to announce the Golden Gophers won their home coming game with the stands full of spectators. The Mayor also informs everyone the Hueytown little league teams are playing this coming Saturday. 9. STANDING COMMITTEE REPORTS a) Finance Committee: Council Member Zinnerman, reports the City' s fiscal year 2024 budget is on the meeting agenda for consideration to approve. b) Planning and Development Committee: Council Member Pickens, no report. c) Public Safety Committee: Council Member Hurliman, no report. d) Public Works and Parks Committee: Council Member Jacks, no report. 10. OFFICERS REPORT a) Police Department: Chief Yarbrough - no report. b) Fire Department: Chief Sullivan - no report. c) Public Works/ Street and Parks Department: Director Butts - no report. absent. d) Building and Zoning Department: Inspector Humphries - 11. GREAT THINGS HAPPENING IN HUEYTOWN a) Hueytown Chamber of Commerce: i. Absent. b) Hueytown Library, Carroll Rector Reporting: i. The computer systems are operational with limited services. Hopefully will be fully functioning soon. ii. The reading buddies program continues. iii. There is a new story teller starting this coming Thursday. iv. Announced staff changes at the Library. v. Reminds everyone the Library is ready to serve, all one needs to do is ask. c) Hueytown Parks 8v Recreation: i. No Report. d) Hueytown Arts Council, Jake Ware Reporting: i. The last Movies In The Park event for this year is scheduled for September 29th and will be held in the New City Center Park on Forest Road starting at 7: OOPM. 2023 at ii. The Worship Fest event is being planned for November 9t'', North Highlands Baptist Church with the events proceeds benefiting the Neighborhood Bridges program. iii. The Arts Fest Event is being planned for March 2024. iv. Additional information can be obtained from the Hueytown Arts Council' s Website, https:// hueytownarts. org/ and Facebook page. 12. CORRESPONDENCE a) The City received a thank you letter from the Library. The City also received resignation letters from Michael Merritt from the Hueytown Parks & Board and from the Special Health Care Facilities Recreation also Financing Authority of the City of Hueytown. RESOLUTIONS: a) Public Hearing: Rev. Charles Winston addressed the Mayor and City Council to consider the waiver of permitting fees for the reconstruction of the Church located at 330 Marsh Avenue, Hueytown. Reverend Winston and seven Church members spoke of the many programs the Church provides serving the community. Upon no further discussion, Council President Wright closed the Public Hearing. b) Public Hearing regarding property at 3743 Virginia Drive, Hueytown. Resolution 3473 was presented to the City Council with Mr. Philip Arthurs representing Iron City Developers addressing the Mayor and Council regarding this matter. Mr. Arthurs request they abate the Public Nuisance and not the City. A motion by Council Member Zinnerman was made to close the Public Hearing followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. A motion by Council Member Pickens was made to extend the time to the November 14, 2023 Council Meeting to show progress to abate the Public Nuisance followed by a second to the motion by Council Member Zinnerman. The motion carried unanimously. c) Public Hearing regarding the property located at 3481 Virginia Drive, Hueytown. Mr. Philip Arthurs representing Iron City Developers addressed the Mayor and Council regarding this matter. Mr. Arthurs request they abate the Public Nuisance and not the City. A motion by Council Member Zinnerman was made to close the Public Hearing followed by a second to the motion by Council Member Hurliman. A motion by Council Member Pickens was made to adopt Resolution Number 6668 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Pickens, Hurliman and Jacks voting yes. Council Member Zinnerman abstained from the vote. The motion carried. e) RESOLUTION 6669 Resolution 6669 was presented to the City Council to confirm the report of costs to abate a declared Public Nuisance and to create a special assessment lien on the property located at 113 Vail Avenue, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6669 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. A motion by Council Member Pickens was made to adopt Resolution Number 6672 followed by a second to the motion by Council Member Hurliman. A motion by Council Member Pickens was made to adopt Resolution Number 6674 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. k) RESOLUTION 6675 Resolution 6675 was presented to the City Council to confirm the report of costs to abate a declared Public Nuisance and to create a special assessment lien on the property located at 1000 Old Warrior River Road, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6675 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 1) RESOLUTION 6676 Resolution 6676 was omitted from the meeting agenda. m) RESOLUTION 6677 Resolution 6677 was presented to the City Council to confirm the report of costs to abate a declared Public Nuisance and to create a special assessment lien on the property located at 3522 Coke Oven Drive, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6677 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. n) RESOLUTION 6678 Resolution 6678 was presented to the City Council to confirm the report of costs to abate a declared Public Nuisance and to create a special assessment lien on the property located at 6300 Donaldson Drive, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6678 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. o) RESOLUTION 6679 Resolution 6679 was presented to the City Council to consider the ABC License application for the business located at 1921 27th Avenue North, Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6679 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. q) RESOLUTION 6681 Resolution 6681 was presented to the City Council to authorize the purchase of a Pumper Fire Truck with the anticipated delivery date of thirty-six to forty months. A motion by Council Member Hurliman was made to adopt Resolution Number 6681 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. r) RESOLUTION 6682 Resolution 6682 was presented to the City Council to appropriate funds from the Fiscal Year 2022- 2023 City Budget and to authorize the purchase of equipment in the Public Works Department. A motion by Council Member Pickens was made to adopt Resolution Number 6682 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 15. ORDINANCES: a) ORDINANCE 23- 0912- 01 Ordinance 23- 0912- 01 was presented to the City Council to consider the rezoning of property located at 2945 Allison Bonnett Memorial Drive from R2 to B 1. A motion by Council Member Pickens was made to DENY the rezoning on Ordinance Number 23- 0912- 01 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. b) ORDINANCE 23- 0912- 02 Ordinance 23- 0912- 02 was presented to the City Council to consider the rezoning of the property located at 3781 Virginia Drive, Hueytown from R2 to B 1. A motion by Council Member Pickens was made to adopt Ordinance Number 23- 0912- 02 followed by a second to the motion by Council Member Hurliman. September 26, 2023 City Council Meeting Minutes Page 6 Of 7 m d) ORDINANCE 23- 0812- 01 Ordinance 23- 0812- 01 was presented as a first reading to the City Council to consider the adoption of the 2021 Edition of International Building Code, 2021 Edition of International Fire Code, 2021 Edition of International Residential Code, 2021 Edition of International Existing Building Code, 2021 Edition of International Plumbing Code, 2021 Edition of International Mechanical Code, 2021 Edition of International Fuel Gas Code, 2020 Edition of National Electric Code/ NFPA 70, Continued adoption of the 2015 International Energy Conservation Code, and the 1998Property Maintenance Code with some City specific amendments and amending the Inspection Department Fee Schedule. 16. EXTEND THE FLOOR TO THE PUBLIC Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a) Ms. Jennifer Harris of 111 Holly Street addressed the Mayor and Council stating of a potential buyer for the property. Council President advised Ms. Harris to continue with the communications City' s Inspections Department. b) Reverend Charles Winston at 330 Marsh Avenue addressed the expressing a shared appreciation to the Mayor and Council for working with the Church through the difficult times rebuilding the facility. c) Paul at 2040 Edenwood Drive addressed the Mayor and Council to introduce Robert Howard of Howard Holdings. d) Robert Howard of Howard Holdings addressed the Mayor and Council with information of the company revitalizes stressed properties and rebuilds communities. e) Malissa Stritikus at 2700 Chesapeake Drive with other folks from the Virginia Ridge Subdivision addressed the Mayor and Council about the condition of the roads in the subdivision. The Mayor addressed their concerns stating previous City administration released the roads being completed without the final pavement top -coat being applied. The Mayor states the City is working on a plan to address the conditions of the roads in the subdivision. fl Constance Singleton at 5658 Victoria Drive also spoke of the road conditions in the Virginia Ridge Subdivision. Ms. Singleton also states the Kiwanis club is now chartered in the City of Hueytown with Ms. Singleton as the club' s president. 17.
