39 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, NOVEMBER 14, 2023 The City Council of the City of Hueytown, Alabama, met at 5: 30P. M. in the Council Chamber meeting room at the City of Hueytown, City : Hall, on Tuesday, November 14, 2023. President Wright called the meeting to order with Council Members Zinnerman, Pickens, Hurliman and Jacks present. Mayor Stephen Ware and City Attorney, Charlie Waldrep, of Waldrep Stewart & Kendrick, LLP were also present. There were five individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, NOVEMBER 14, 2023 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber meeting room at the Hueytown City Hall on Tuesday, November 14, 2023. 1. CALL TO ORDER: The meeting was called to order by Mayor Stephen Ware at 6: 06P. M. with approximately twenty- one individuals present in the audience. 2. INVOCATION: The invocation was given by Council Member Hurliman. W 3. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was lead by Council Member Wright. 4. ROLL CALL Upon Roll Call, Council Members Wright, Zinnerman, Pickens, Hurliman and Jacks being present. Mayor Stephen Ware presided over the meeting for the Council to elect its presiding officer. City Attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP was Present. 5. Nominations for Council President. a) Nomination by Council Member Hurliman for Council Member Wright. b) Nomination by Council Member Pickens for Council Member Zinnerman. Upon Vote for Council Member Wright for Council President was taken with Wright, Pickens and Hurliman voting yes. Mayor Ware declared Council Member Wright as the Council President. President Wright retired Mayor Ware from presiding over the meeting. 6. Nominations for Council Pro Tempore. a) Nomination by Council Member Jacks for Council Member Hurliman. b) Nomination by Council Member Hurliman for Council Member Pickens. Upon Vote for Council Member Pickens for Council Pro Tempore was taken with Wright, Zinnerman, Pickens, Hurliman voting Yes. Council President declared Council member Pickens for Council Pro Tempore. APPROVAL OF MINUTES Council Member Hurliman made a motion followed by a second to the motion by Council Member Jacks to approve the October 24, 2023 Pre - Council and Council Meeting and the November 07, 2023 Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the minutes approved. 9. ADOPT AGENDA FOR THE MEETING: Council Member Pickens made a motion to adopt the meeting agenda as published followed by a second to the motion by Council Member Hurliman. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the meeting agenda adopted. 10. MAYORS REPORT The Mayor welcomed everyone present for taking time from their schedule to attend the Council Meeting to learn what' s happening in the City and to bring concerns to the Mayor and Council. The Mayor announced there was tremendous participation with the Unity Choir event planned by the Hueytown Arts Council and is looking forward to next year' s event. The Mayor announced the Golden Gophers High School football team is traveling to Alexander City this week. The Mayor read a Proclamation recognizing Alabama Farm City Week. PROCLAMATION ALABAMA FARM -CITY WEEK - 2023 WHEREAS, for nearly 65 years, the American people have honed together during Thanksgiving week to observe Farm -City Week, a time set aside to express gratitude for the bounty with which God has blessed our land. Throughout the week, Americans recognize the hard work and achievements of the farmers, rural townspeople, and city residents who make our nation' s agricultural production and distribution system so successful. This cooperation between rural and city dwellers for mutual benefit truly helps to ensure our country' s well- being. WHEREAS, America's farmers have provided nutritious food and fiber to sustain our people through many decades of progress. Farmers' productivity has increased steadily, thanks largely to their initiative in supporting and adopting science - based methods and materials. Because of this productivity, American farmers are able to meet the needs of our nation and growing world, WHEREAS, American agriculture and the many service industries that depend upon it; is a story of extraordinary labor creating extraordinary abundance. The American farmer has an impact on every aspect of life, from big cities to small towns and all the routes in between. At this time of year, it is only fitting that all Americans offer a special sign of thanks to those who grow, harvest, and bring the fruits of sun, seed, and soil to our nation' s tables. NOW, THEREFORE, I, Stephen M. Ware, Mayor, of the City of Hueytown by virtue of the authority vested in me do hereby, proclaim the week of November 17t' November 14, 2023 City Council Meeting Minutes Page 2 Of 7  a through November 23, 2023, as Alabama Farm - City Week. I call upon all citizens in rural and cities alike to join in recognizing the accomplishments of our productive farmers and of our urban residents, who cooperate to create abundance, wealth, and strength for our nation. GREAT THINGS HAPPENING IN HUEYTOWN a) Hueytown Chamber of Commerce, Debbie Kiker Reports: i. Business of the month is Food Giant. ii. Twenty- seven Home -Town Pole Banners have been installed for the Month of November. iii. Announced the Pink Friday 8v Saturday, November 17t' and 18t'' with nine businesses participating. iv. Announced the Hueytown Fire 8v Rescue are selling Christmas Shirts with the proceeds benefiting Neighborhood Bridges. v. Announced the Chamber is selling Christmas Ornaments. vi. Supper with Santa event is scheduled for November 30, 2023 at Venue 3131. The event is sold out with 224 people planning to attend. vii. Tree Lighting event is scheduled for December 1, 2023 at 6: OOPM at the City Center Park. viii. The 36t' annual Christmas Parade is scheduled for December 9, 2023 at 10: 00A. M. ix. Movies in the park scheduled to show Elf on December 15, 2023 beginning at 6: 30P. M. and the City Center Park. iii. Announced the Arts Council is selling Christmas Tshirts. iv. BILLS FOR APPROVAL Council Member Zinnerman presented a list of bills totaling $ 537, 440. 16 and made a motion to approve the list of bills which were presented for payment followed by second to the motion by Council Member Pickens. RESOLUTIONS: a) Resolution 6704 Resolution 6704 was presented to the City Council to confirm the report of costs to abate a declared Public Nuisance and to create a special assessment lien on the property located at 2009 27th Avenue North, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6704 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Pickens, Hurliman and Jacks voting yes. Council Member Zinnerman abstained from the vote. A motion by Council Member Hurliman was made to adopt Resolution Number 6706 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Pickens, Hurliman and Jacks voting yes. Council Member Zinnerman abstained from the vote. The motion carried. A motion by Council Member Zinnerman was made to adopt Resolution Number 6696 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Pickens, Hurliman and Jacks voting yes. Council Member Zinnerman abstained from the vote. The motion carried. e) RESOLUTION 6708 Resolution 6708 was presented to the City Council to authorize and employee one- time lump sum salary supplement for prospective services to be performed. A motion by Council Member Pickens was made to adopt Resolution Number 6708 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. 0 RESOLUTION 6709 Resolution 6709 was presented to the City Council to waive the Special Events fee for the Hueytown Youth Baseball League for October through December 2023. A motion by Council Member Zinnerman was made to adopt Resolution Number 6709 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. g) RESOLUTION 6710 Resolution 6710 was presented to the City Council to authorize the Alabama Power Company Pole Attachments agreement for the Holiday Decorations and Banners or Flags. A motion by Council Member Jacks was made to adopt Resolution Number 6710 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. h) RESOLUTION 6691 Resolution 6691 was presented to the City Council as a final reading to adopt a Reserve Funds Policy. A motion by Council Member Zinnerman was made to adopt Resolution Number 6691 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. i) RESOLUTION 6711 Resolution 6711 was presented to the City Council to authorize the purchase of the Pleasant Ridge Baptist Church family life center. A motion by Council Member Jacks was made to adopt Resolution Number 6711 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. ORDINANCES: a) ORDINANCE 23- 1114- 01 Ordinance 23- 1114- 01 was introduced as a First Reading Public Hearing which prohibits putting glass, cans, leaves, grdass clippings, etc on Street or Public Right - Of -Way. After no person came forward either for against the proposed Ordinance, Council _ Member Hurliman made a motion to close the Public Hearing. A motion was made by Council Member Pickens to suspend the rules to move Ordinance 23- 1114- 01 to a vote followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. The motion carried unanimously. b) ORDINANCE 23- 1114- 02 Ordinance 23- 1114- 02 was introduced as a First Reading Public Hearing which is an amendment to Section 22 which sets out license classification codes and section 23 which sets out license fee schedules of Ordinance 07- 0814- 1 which determines charges for licensing Business, Occupations and Professions. After no person came forward either for against the proposed Ordinance, Council Member Hurliman made a motion to close the Public Hearing. A motion was made by Council Member Hurliman to suspend the rules to move Ordinance 23- 1114- 02 to a vote followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. The motion carried unanimously. c) ORDINANCE 23- 0822- 01 Ordinance 23- 0822- 01 was introduced to adopt regarding an Ordinance to adopt for the City of Hueytown and its police jurisdiction the 2021 edition of the International Building Code; the 2021 edition of the International Fire Code; the 2021 edition of International Residential Code; the 2021 edition of the International existing building code; the 2021 edition of the International Plumbing Code; the 2021 edition of International Mechanical Code; the 2021 edition of the International Fuel Gas November 14, 2023 City Council Meeting Minutes Page 6 Of 7  45 Code; the 2020 edition of the National Electric Code/ NFPA 70; and the continued adoption of the 2015 International Energy Conservation Code and the 1998 Property Maintenance Code; the 2015 Alabama Residential Energy Code as adopted by the Alabama Energy and Residential Energy Code Board, as amended; the 2015 Alabama Commercial Energy Code, as adopted by the Alabama Energy and Residential Code Board, as amended. EXTEND THE FLOOR TO THE PUBLIC Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three : minutes. a) Constance Singleton at 6658 Victoria Drive; states the Kiwanis club, in conjunction of the Hueytown Primary and Hueytown Intermediate school are collecting canned goods with drop- off also at the YMCA. The collected canned goods will be distributed on November 16, 2023 at the " Y". 19.
