TO o• MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, MARCH 12, 2024 The City Council of the City of Hueytown, Alabama, met at 5: 30P. M. in the Council Chamber meeting room at the City of Hueytown, City Hall, on Tuesday, March 12, 2024. President Wright called the meeting to order with Council Members Zinnerman, Pickens, Hurliman and Jacks present. Mayor Stephen Ware and City Attorney, Charlie Waldrep, of Waldrep Stewart 8s Kendrick, LLP were also present. There were five individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, MARCH 12, 2024 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber meeting room at the Hueytown City Hall on Tuesday, March 12, 2024. 1. CALL TO ORDER: The meeting was called to order by Council President Wright at 6: OOP. M. with approximately eleven individuals present in the audience. 2. INVOCATION: The invocation was given by Council Member Hurliman. 3. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was lead by Council Member Hurliman. 4. ROLL CALL Upon Roll Call, Council Members Wright, Zinnerman, Pickens, Hurliman and Jacks being present. Mayor Stephen Ware and City Attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP were Present. 5. MEDIA RECOGNITION: There were no individuals present representing the Media. 6. APPROVAL OF MINUTES Council Member Zinnerman made a motion followed by a second to the motion by Council Member Hurliman to approve the February 27, 2024 Pre -Council and Council Meeting and the March 11, 2024 Work Session Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the minutes approved. 7. ADOPT AGENDA FOR THE MEETING: Council Member Pickens made a motion to adopt the meeting agenda as published with the omission of item " L" which was a Public Hearing regarding 111 Holly Street March 12, 2024 City Council Meeting Minutes Page 1 Of 6 and the addition of items 14M Resolution 6775, 14N Resolution 6776, and 140 Resolution 6777, followed by a second to the motion by Council Member Zinnerman. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the meeting agenda adopted. 8. MAYORS REPORT The Mayor welcomes each and everyone present and invites others to attend for any concerns they may have with the City. Mayor states there are huge Arts Council events coming up. Little league is starting and encourages everyone to attend to support the youth sports programs. 9. STANDING COMMITTEE REPORTS a) Finance Committee: Council Member Zinnerman, reports the February 2024 Finance Report was distributed to the Council and questions regarding the report should be directed to the Finance Committee and/ or the City Clerk/ Treasurer. b) Planning and Development Committee: Council Member Pickens, reports there are three Ordinances on tonight' s meeting agenda to consider. c) Public Safety Committee: Council Member Hurliman, reports EMS calls for the past few weeks have come down. d) Public Works and Parks Committee: Council Member Jacks, no report. 10. OFFICERS REPORT a) Police Department: Chief Yarbrough - reports the department continues with safety checks in all parts of the City. b) Fire Department: Chief Sullivan - no report. c) Public Works/ Street and Parks Department: Public Works Director Gant - no report. no report. d) Building and Zoning Department: Inspector Humphries - 11. GREAT THINGS HAPPENING IN HUEYTOWN a) Hueytown Chamber of Commerce, Debbie Kiker Reports: i. The March Business Member of the month is Salon JuNa. ii. The Women In Business Luncheon was held March 8, 2024 at 11: 30AM at Venue 3131 with sixty-five plus women and twelve Junior Ambassadors attending the event. iii. The Chamber Awards Celebration event is scheduled for March 15, 2024 at Venue 3131. iv. The Hueytown Chamber Chat Podcast is up and running. v. The Easter Egg Drop event is scheduled for March 30, 2024. vi. The indoor Spring market is scheduled for Saturday, April 6, 2024 at Venue 3131. vii. Mark Your Calendars for City Fest scheduled for June 8, 2024. viii. The Hometown Hero Banner Sale continues. ix. Shop Local. x. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. RESOLUTIONS: a) Resolution 6764 Resolution 6764 was presented to the City Council to appoint the voting delegate representing the City of Hueytown for the Alabama League of Municipalities Annual Convention Business Meeting being held in Huntsville, Alabama on May 15, 2024 through May 18, 2024. A motion by Council Member Pickens was made to adopt Resolution Number 6764 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. b) Resolution 6765 Resolution 6765 was presented to the City Council to declare a Public Nuisance of weeds, trash and/ or inoperable vehicle located at 105 Merrimont Drive, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6765 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. c) Resolution 6766 Resolution 6766 was presented to the City Council to declare a Public Nuisance of weeds, trash and/ or inoperable vehicle located at 112 Vann Street, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6766 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. d) Resolution 6767 Resolution 6767 was presented to the City Council to declare a Public Nuisance and order the abatement of Weed, Trash and/ or inoperable vehicle located at 114 Dabbs Avenue, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6767 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. A motion by Council Member Hurliman was made to adopt Resolution Number 6768 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. f) Resolution 6769 Resolution 6769 was presented to the City Council to declare a Public Nuisance and order the abatement of Weed, Trash and/ or inoperable vehicle located at 5645 Johns Road, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6769 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. g) Resolution 6770 Resolution 6770 was presented to the City Council to declare a Public Nuisance and order the abatement of Weed, Trash and/ or inoperable vehicle located at 5671 Johns Road, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6770 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. h) Resolution 6771 Resolution 6771 was presented to the City Council to declare a Public Nuisance or an unsafe structure located at 102 Wickstead Road, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6771 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. I) Resolution 6772 Resolution 6772 was presented to the City Council to declare a Public Nuisance or an unsafe structure located at 5661 Johns Road, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6772 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. j) Resolution 6773 Resolution 6773 was presented to the City Council to declare a Public Nuisance and order the abatement of Weed, Trash and/ or inoperable vehicle located at 110 Cypress Street, Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6773 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. k) Resolution 6774 Resolution 6774 was presented to the City Council to declare a Public Nuisance and order the abatement of Weed, Trash and/ or inoperable vehicle located at 105 McNear Street, Hueytown. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. 1) Public Hearing regarding 111 Holly Street. Item " I" was removed from the meeting agenda. m) Resolution 6775 Resolution 6775 was presented to the City Council to authorize the installation of exterior lights at the Activity Center Facility located at 1343 Hueytown Road. A motion by Council Member Hurliman was made to adopt Resolution Number 6775 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. n) Resolution 6776 Resolution 6776 was presented to the City Council to authorize a partial refund of permit fees paid regarding property located at 105 Prospect Drive, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6776 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. o) Resolution 6777 Resolution 6777 was presented to the City Council to declare a Public Nuisance of an unsafe structure located at 111 Holly Street, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6777 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. 15. ORDINANCES: a) Ordinance 24- 0312- 01 Ordinance 24- 0312- 01 was presented to the Council as a First Reading/ Public Hearing for the rezoning of property located at 4963 15t' Street Road, Hueytown, from MR to AG. After no individual came forward to speak either for or against the proposed Ordinance, President Wright closed the Public Hearing. b) Ordinance 24- 0312- 02 Ordinance 24- 0312- 02 was presented to the Council as a First Reading/ Public Hearing for the rezoning of property located at 4957 15th Street Road, Hueytown, from MR to AG. After no individual came forward to speak either for or against the proposed Ordinance, President Wright closed the Public Hearing. c) Ordinance 24- 0312- 03 Ordinance 24- 0312- 03 was presented to the Council as a First Reading/ Public Hearing for the rezoning of property located at 1474 Hueytown Road, Hueytown from March 12, 2024 City Council Meeting Minutes Page 5 Of 6  91 B2 to M 1 contingent upon the applicant following the buffer requirements as required by the Hueytown Zoning Ordinance. Mr. David Sears on Bunchie Street was identified to speak on the proposed Ordinance 24- 0312- 03 requesting the traffic from the property use Hueytown Road for incoming and exiting and not use Bunchie Street and North Parkell. The Mayor requests the Building Inspector to request the City's Engineer to address the aforementioned concerns. Mr. Dorsey Adams, Jr. at 1482 Hueytown Road spoke about the proposed Ordinance 24- 0312- 03 with concerns about the " Buffer Zone" requesting he would like to see a privacy fence installed. After no other individuals came forward to speak either for or against the proposed Ordinance, a motion was made by Council Member Pickens to close the Public Hearing; President Wright closed the Public Hearing. 16. EXTEND THE FLOOR TO THE PUBLIC Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a) Ms. Shanise Hooks at 111 Hart Avenue, a new resident, spoke about the ditch beside her residence. The Ditch is full of trash and debris with water standing in the ditch. Ms. Cook is concerned of structural issues developing in her home. Ms. Cook inquired if the City has an Easement to maintain the drainage ditch. The Mayor spoke about this matter and referred this matter to the City' s Public Works Director to contact the City Engineer to present a solution to the Mayor. Ms. Cook also spoke of trash and inoperable vehicle at 109 Hart Avenue. b) Ms. Mary Meyer at 502 Saddlebridge informed the Mayor and Council of an interfaith meeting tonight at the Hueytown Library. Ms. Meyer inquired the why the road to the Senior Center was blocked yesterday afternoon; Mayor and the Fire Chief informed Ms. Meyer there was a natural gas leak and for safety reasons, Brooklane Drive was closed for a short period of time in the afternoon. Ms. Meyer also inquired about the Finance Report with Council Member Zinnerman responding to this matter. Ms. Meyer also inquired what is the sales tax percentage the City receives when purchasing local, with the response of four percent. 17. ADJOURNMENT With no further business to come before the Council Meeting, Council Member Pickens made a motion to adjourn. Council President Wright declared the meeting adjourned at 6: 45P. M..
