ON MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, MARCH 26, 2024 The City Council of the City of Hueytown, Alabama, met at 5: 30P. M. in the Council Chamber meeting room at the City of Hueytown, City Hall, on Tuesday, March 26, 2024. President Wright called the meeting to order with Council Members Zinnerman, and Jacks present. Council Members Pickens and Hurliman were absent. Mayor Stephen Ware and City Attorney, Charlie Waldrep, of Waldrep Stewart 8v Kendrick, LLP were also present. There were five individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, MARCH 26, 2024 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber meeting room at the Hueytown City Hall on Tuesday, March 26, 2024. 1. CALL TO ORDER: with The meeting was called to order by Council President Wright at 6: OOP. M. approximately twenty individuals present in the audience. 2. INVOCATION: The invocation was given by Council Member Jacks. 3. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was lead by Council Member Jacks. 4. ROLL CALL Upon Roll Call, Council Members Wright, Zinnerman and Jacks being present and Council Members Pickens and Hurliman being absent. Mayor Stephen Ware and City Attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP were Present. 5. MEDIA RECOGNITION: There was no media present at the meeting. 6. APPROVAL OF MINUTES Council Member Zinnerman made a motion followed by a second to the motion by Council Member Jacks to approve the March 12, 2024 Pre -Council and Council Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon roll call vote, President Wright and Council Members Zinnerman and Jacks voting yes. There were no nay votes. President Wright declared the minutes approved. 7. ADOPT AGENDA FOR THE MEETING: Council Member Jacks made a motion to adopt the meeting agenda as published with the addition of Resolution Number 6781 as item 14D and a Public Hearing as item 14E followed by a second to the motion by Council Member Zinnerman. March 26, 2024 City Council Meeting Minutes Page 1 Of 5 93 Upon roll call vote, President Wright and Council Members Zinnerman and Jacks voting yes. There were no nay votes. President Wright declared the meeting agenda adopted. 8. MAYORS REPORT The Mayor welcomed everyone present and invites others to attend for any concerns they may have with the City. The Mayor reports the Sidewalk Project is wrapping up and will try for another Sidewalk Grant in the future. The Mayor announced the Community Wide Cleanup event being scheduled for April 20, 2024 with the dumpsters being located at the same locations as in prior years. The Mayor also announced the spring youth sports programs are going -on and suggests the community get out and attend the events for community support. 9. STANDING COMMITTEE REPORTS a) Finance Committee: Council Member Zinnerman, no report. b) Planning and Development Committee: Council Member Pickens, absent. c) Public Safety Committee: Council Member Hurliman, absent. d) Public Works and Parks Committee: Council Member Jacks, reports the Parks & Recreation Board had a meeting the past Tuesday and reports the Board is reviewing the Bessemer Gardens Pocket Park Facilities and the swing -set at the Martin Luther King, Jr. park. Jacks also reports the Martin Luther King, Jr. park has just received a landscaping update with the Brooklane Park receiving it's upgrade last year. 10. OFFICERS REPORT a) Police Department: Chief Yarbrough - no report. b) Fire Department: Chief Sullivan - no report. c) Public Works/ Street and Parks Department: Public Works Director Gant - no report. d) Building and Zoning Department: Inspector Humphries - no report. 11. GREAT THINGS HAPPENING IN HUEYTOWN a) Hueytown Chamber of Commerce, Debbie Kiker Reports: i. The Chamber Awards Celebration was held March 15, 2024 at Venue 3131 with congratulations to all the winners. ii. The Easter Egg Drop is scheduled for March 30, 2024 at 11: OOA. M to 1: OOP. M. at the new City Center Park. There will be 6, 000 Easter Eggs, Face Painting, Easter Bunny, Church Booths and Food Trucks at the event. iii. The Indoor Spring Market is scheduled for April 6, 2024 at Venue 3131 at 10: 00A. M. to 4: OOP. M.. iv. Shop Local. v. Information can be obtained from the Hueytown Area Chamber of Commerce website, https: / / hueytownchamber. com and Facebook page. b) Library, Carroll Rector, Director, Reports: i. Spoke about the upcoming event, Sean of the South scheduled for April 13, 2024 at the North Highlands Baptist Church with the sale of tickets closing mid -night April 07, 2024. Tickets can be purchased through www. eventbrite. com ii. Additional information of activities at the Library can be obtained from the Hueytown Library' s website at https: / / www. hueytownlibrary. or c) Arts Council, Jake Ware, Reports: March 26, 2024 City Council Meeting Minutes Page 2 Of 5 i. The Arts Show which was held last week was a complete success with over 300 people attending and/ or participating. ii. The newly painted Mural at Martin Luther King, Jr. Park. iii. Announced planning continues for the upcoming City Fest event scheduled to be on June 08, 2024. iv. Information can be obtained from the Hueytown Arts Council Facebook page at https:// www. facebook. com/ huevtownArts/ 12. CORRESPONDENCE a) There was no correspondence to report. Council Member Hurliman arrived at the Council Meeting at this time of the meeting, 6: 09PM. 13. BILLS FOR APPROVAL Council Member Zinnerman presented a list of bills totaling $ 921, 584. 56 and made a motion to approve the list of bills which were presented for payment followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. RESOLUTIONS: a) Resolution 6778 Resolution 6778 was presented to the City Council to schedule a Public Hearing date regarding an application for a Temporary Trailer Use Certificate located at 7001 Valley Bridge Road, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6778 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Hurliman and Jacks voting yes. The motion carried unanimously. b) Resolution 6779 Resolution 6779 was presented to the City Council to consider the approval of an Alcohol License for Wings Heaven located at 817 Allison Bonnett Memorial Drive, Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6779 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Hurliman and Jacks voting yes. The motion carried unanimously. c) Resolution 6780 Resolution 6780 was presented to the City Council to authorize the purchase of a Digital Multi -function Copier/ Network Printer/ Scanner. A motion by Council Member Zinnerman was made to adopt Resolution Number 6780 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, March 26, 2024 City Council Meeting Minutes Page 3 Of 5 95 President Wright and Council Members Zinnerman, Hurliman and Jacks voting yes. The motion carried unanimously. d) Resolution 6781 Resolution 6781 was presented to the City Council for the amending of Resolution 6776 which was adopted at the March 12, 2024 Council Meeting. A motion by Council Member Pickens was made to adopt Resolution Number 6781 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Hurliman and Jacks voting yes and with Council Member Zinnerman voting NO. The motion carried. e) Public Hearing Public Hearing was conducted by the property owner request regarding the City Council' s Declared Public Nuisance for the property located at 5645, 5661 and 5671 Johns Road. Mr. Philip Smitherman addressed the Mayor and Council regarding the Public Nuisance and is seeking a 120 days extension to allow Mr. Smitherman time to abate the Nuisance. Mr. Smitherman spoke of the parcel as being part of an eighty acre tract of land and wishes to keep as one parcel. The City' s Building Inspector addressed the Mayor and Council about the condition of the Structure and Trash/ Debris which are on the Parcel. With no other persons addressing the Mayor and Council about this matter Council Member Jacks made a motion to close the Public Hearing followed by a second to the motion by Council Member Hurliman. President Wright closed the Public Hearing. A motion by Council Member Zinnerman was made to give Mr. Smitherman a ninety 90) day extension to abate the declared Public Nuisance followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Hurliman and Jacks voting yes. The motion carried unanimously. 15. ORDINANCES: a) 24- 0312- 01 Ordinance 24- 0312- 01 was presented to the City Council as the final reading to consider amending the City' s zoning map for the property located at 4963 15t'' Street Road, Hueytown from MR to AG. A motion by Council Member Jacks was made to adopt Ordinance 24- 0312- 01 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Hurliman and Jacks voting yes. The motion carried unanimously. b) 24- 0312- 02 Ordinance 24- 0312- 02 was presented to the City Council as the final reading to consider amending the City' s zoning map for the property located at 4957 15t' Street Road, Hueytown from MR to AG. A motion by Council Member Jacks was made to adopt Ordinance 24- 0312- 02 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Hurliman and Jacks voting yes. The motion carried unanimously. c) 24- 0312- 03 March 26, 2024 City Council Meeting Minutes Page 4 Of 5 Ordinance 24- 0312- 03 was presented to the City Council as the final reading to consider amending the City' s zoning map for the property located at 1474 Hueytown Road, Hueytown from B2 to MI. A motion by Council Member Hurliman was made to adopt Ordinance 24- 0312- 03 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Hurliman and Jacks voting yes. The motion carried unanimously. 16. EXTEND THE FLOOR TO THE PUBLIC Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a) Ms. Shanise Hooks at 111 Hart Avenue addressed the Mayor and Council seeking an update to the drainage matter presented to the Council at the March 12, 2024 meeting. The Mayor supplied Ms. Hooks with an update stating the City Engineer is researching the matter. Ms. Hooks also spoke about the trash at the neighboring property with the Mayor supplying an update. City Attorney addressed the Mayor and City Council requesting an executive session regarding a legal matter. A motion by Council Member Jacks was made for the Council to enter into an executive session followed by a second by Council Member Zinnerman. Attorney Waldrep made the statement that the subject matter for the meeting conforms with the State of Alabama Open Meeting Act and the meeting is expected to last fifteen to thirty minutes. Upon a roll call vote, President Wright and Council Members Zinnerman, Hurliman and Jacks voting yes. The motion carried unanimously. The Mayor and Council exited the Council meeting room at approximately 6: 36PM. The Mayor and Council re- entered the meeting room at 7: 08PM and with a motion made by Council Member Zinnerman to exit the Executive Session followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Hurliman and Jacks voting yes. The motion carried unanimously. 17. ADJOURNMENT With no further business to come before the Council Meeting, Council Member Zinnerman made a motion to adjourn Council President Wright declared the meeting adjourned at 7: 09P. M..
