223 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, JUNE 25, 2024 The City Council of the City of Hueytown, Alabama, met at 5: 30P.M. in the Council Chamber meeting room at the City of Hueytown, City Hall, on Tuesday, June 25, 2024. President Wright called the meeting to order with Council Members Zinnerman and Mayor Pickens present. Council Members Hurliman and Jacks were absent. Stephen Ware and City Attorney, Charlie Waldrep, of Waldrep Stewart & Kendrick, LLP were also present. There were eight individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, JUNE 25, 2024 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber meeting room at the Hueytown City Hall on Tuesday, June 25, 2024. 1. CALL TO ORDER: with The meeting was called to order by Council President Wright at 6: 02P. M. approximately nineteen individuals present in the audience. 2. INVOCATION: The invocation was given by Council Member Pickens. 3. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Council Member Pickens. 4.ROLL CALL Upon Roll Call, Council Members Zinnerman, Pickens and Wright being present and Council Members Hurliman and Jacks being absent. Mayor Stephen Ware and City Attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP were Present. 5. MEDIA RECOGNITION: There was no members of the media present. 6. APPROVAL OF MINUTES Council Member Pickens made a motion followed by a second to the motion by Council Member Zinnerman to approve the June 11, 2024, Pre -Council and Council Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon roll call vote, President Wright and Council Members Zinnerman and Pickens There were no nay votes. President Wright declared the minutes voting yes. approved. 7. ADOPT AGENDA FOR THE MEETING: Council Member Pickens made a motion to adopt the meeting agenda as published with the addition of Resolution Number 6824 as item 14G followed by a second to the motion by Council Member Zinnerman. President Wright declared the meeting agenda adopted. 8. MAYORS REPORT The Mayor welcomed everyone present and invites others to attend to address any concerns they may have and become aware of whats happening in the City. The Mayor announced the City' s first July 4' Independence Day Celebration Event will be held on July 3, 2024. The Mayor also announced the Little League Football registration is underway as well as the High School football program starting. 9. STANDING COMMITTEE REPORTS a) Finance Committee: Council Member Zinnerman, no report. b) Planning and Development Committee: Council Member Pickens, no report. c) Public Safety Committee: Council Member Hurliman, absent. d) Public Works and Parks Committee: Council Member Jacks, absent. 10. OFFICERS REPORT a) Police Department: Chief Yarbrough - reports the bomb threat at Walgreens was a county - wide matter and the appropriate response measures to the threat have been taken. b) Fire Department: Chief Sullivan - no report. c) Public Works/ Street and Parks Department: Public Works Director Gant - no report. d) Building and Zoning Department: Inspector Humphries - no report. 11. GREAT THINGS HAPPENING IN HUEYTOWN a) Hueytown Library, Carroll Rector Reports: i. Announced the Summer Reading Program was held in the month of June each Wednesday with approximately eighty attendees. ii. Announced the Tutored Reading Program begins in July held every Tuesday, Wednesday and Thursday for the month. b) Arts Council, Jake Ware, Reports: i. Announced there will be Movie In The Park July 26, 2024. ii. Announced the City Fest Event that was held on June 8, 2024 was a success with approximately 5, 000 attendees. Jake thanks the City for the support provided to the event. iii. Announced Art In The Park was held on June 20th with another planned for July 18, 2024. Registration can be made online at www. hueytownarts. org website. iv. Hubert The Snake continues in the Park. v. Information can be obtained from the Hueytown Arts Council Facebook page at https: / / www.facebook. com/ hueytownArts/ c) Hueytown Parks and Recreation Board, Tammy Pickens, President i. Baseball, Soccer and Softball programs have ended with a good -- showing ii. Football registration is underway. iii. The Board is evaluating the City' s Pocket Parks for facilities updating. iv. The Board will be updating the MLK and Bessemer Gardens park Swing -sets. v. Information can be obtained from the Hueytown Parks and Recreation website at https: / / www. hueytownparks. com 12. BILLS FOR APPROVAL Council Member Zinnerman presented a list of bills totaling $ 352, 215. 45 and made a motion to approve the list of bills which were presented for payment followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman and Pickens voting yes. There were no nay votes. The motion carried unanimously. RESOLUTIONS: a) Resolution 6818 Resolution 6818 was presented to the City Council to declare a Public Nuisance and order the abatement of weeds, trash and/ or inoperable vehicle located at 2835 Novel Drive, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6818 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman and Pickens voting yes. The motion carried unanimously. b) Resolution 6819 Resolution 6819 was presented to the City Council to declare a Public Nuisance and order the abatement of weeds, trash and/ or inoperable vehicle located at 401 Willow Lane, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6819 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman and Pickens voting yes. The motion carried unanimously. c) Resolution 6820 Resolution 6820 was presented to the City Council to declare a Public Nuisance and order the abatement of weeds, trash and/ or inoperable vehicle located at 106 Cedar Street, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6820 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman and Pickens voting yes. The motion carried unanimously. d) Resolution 6821 June 25, 2024 City Council Meeting Minutes Page 3 Of 5 226 Resolution 6821 was presented to the City Council to declare a Public Nuisance and order the abatement of weeds, trash and/ or inoperable vehicle located 2005 High School Road, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6821 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman and Pickens voting yes. The motion carried unanimously. e) Resolution 6822 Resolution 6822 was presented to the City Council to declare a Public Nuisance and order the abatement of weeds, trash and/ or inoperable vehicle located at 116 Cypress Street, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6822 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman and Pickens voting yes. The motion carried unanimously. 0 Resolution 6823 Resolution 6823 was presented to the City Council to order the abatement of a Public Nuisance of an unsafe structure for the property located at 5661 Johns Road, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6823 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman and Pickens voting yes. The motion carried unanimously. g) Resolution 6824 Resolution 6824 was presented to the City Council to grant an additional paid holiday for the City employees on July 5, 2024. A motion by Council Member Pickens was made to adopt Resolution Number 6824 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman and Pickens voting yes. The motion carried unanimously. 15. ORDINANCES: a) 24- 0611- 01 Ordinance 24- 0611- 01 was presented to the City Council to amend Chapter 82 of the City Of Hueytown Code entitled " Garbage Collection Fee Policies Regarding Income -based Exemptions, Alternate Disposal Exemptions, and Penalties", to align with the published Federal Poverty Guidelines. This Ordinance had its first reading at the June 11, 2024 City Council Meeting. A motion by Council Member Zinnerman was made to adopt Ordinance 24- 0611- 01 with the intent that the proposed Ordinance would not change the current Senior' s Exemption Rules followed by a second to the motion from Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman and Pickens voting yes. The motion carried. 16. EXTEND THE FLOOR TO THE PUBLIC Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. June 25, 2024 City Council Meeting Minutes Page 4 Of 5  227 a) Bertha Snider at 120 Mimosa Drive addressed the Mayor and Council regarding a ditch behind her property. Ms. Snider states she has lived at that address since 1959. The Mayor states he will meet with the City's engineer. The City attorney also supplied information to Ms. Snider regarding her concern. Ms. Snider also submitted a complaint on the house behind her address on Memory Lane that has many vehicles with poor upkeep of the property. b) Phil Smitherman at 6823 Johns Road addressed the Mayor and Council regarding the declared public nuisance matter of an unsafe structure agenda item 14F) located at 5661 Johns Road. Mr. Smitherman is seeking an additional 90 days extension. Mr. Smitherman states the mobilization of heavy equipment is on the site by Southern Welding and Excavation & Supply. The Council did not extend the time for the property to be in compliance. 17. ADJOURNMENT With no further business to come before the Council Meeting, Council Member Pickens made a motion to adjourn.
