233 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, JULY 23, 2024 The City Council of the City of Hueytown, Alabama, met at 5: 30P. M. in the Council Chamber meeting room at the City of Hueytown, City Hall, on Tuesday, July 23, 2024. President Wright called the meeting to order with Council Members Zinnerman and Pickens present. Council Members Hurliman and Jacks were absent. Mayor Stephen Ware and City Attorney, Charlie Waldrep, of Waldrep Stewart 8s Kendrick, LLP were also present. There were four individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, JULY 23, 2024 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber meeting room at the Hueytown City Hall on Tuesday, July 23, 2024. 1. CALL TO ORDER: The meeting was called to order by Council President Wright at 6: 07P. M. with approximately twelve individuals present in the audience. 2. INVOCATION: The invocation was given by Council Member Hurliman. 3. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Council Member Hurliman. 4. ROLL CALL Upon Roll Call, Council Members Zinnerman, Pickens, Hurliman, Wright and Jacks being present. Mayor Stephen Ware and City Attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP were Present. 5. MEDIA RECOGNITION: There was no members of the media present. 6. APPROVAL OF MINUTES Council Member Pickens made a motion followed by a second to the motion by Council Member Pickens to approve the July 09, 2024, Pre -Council and Council Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the minutes approved. 7. ADOPT AGENDA FOR THE MEETING: Council Member Pickens made a motion to adopt the meeting agenda as published with the addition of Resolution Number 6850 as item 14S followed by a second to the motion by Council Member Hurliman. President Wright declared the meeting agenda adopted. 8. MAYORS REPORT The Mayor welcomed everyone present and invites others to attend to address any concerns they may have and become aware of whats happening in the City. The Mayor announced the City has received a Grant for the Nature Park. The Mayor also announced the construction next to Sonic is for Wendy' s Restaurant. The Mayor Read a Proclamation recognizing National Night Out which was presented to Lt. Shupe. PROCLAMATION WHEREAS, the Hueytown Police, City of Hueytown and Hueytown Chamber of Commerce sponsors a national community -building campaign on Tuesday, August 6, 2024, entitled " National Night Out"; and WHEREAS, the National Night Out campaign provides an opportunity for neighbors in your city to join over 38 million neighbors across 17 thousand communities from all 50 states, U. S. territories and military bases worldwide; and WHEREAS, National Night Out is an annual community -building campaign that promotes strong police -community partnerships and neighborhood camaraderie to make our neighborhoods safer, more caring places to live and work; and WHEREAS, neighbors in your city assist the local law enforcement agency through joint community - building efforts and support National Night Out 2024; and WHEREAS, it is essential that all neighbors of our city come together with police and work together to build a safer, more caring community; and NOW, THEREFORE I, Mayor Steve Ware, do hereby call upon all neighbors of our city to join us in support for National Night Out on Tuesday, August 6, 2024. STANDING COMMITTEE REPORTS a) Finance Committee: Council Member Zinnerman, reports the June finance report has been received and distributed to the Council in preparation for the upcoming Council Work Session. b) Planning and Development Committee: Council Member Pickens, absent. c) Public Safety Committee: Council Member Hurliman, no report. d) Public Works and Parks Committee: Council Member Jacks, reports the Parks and Recreation Board met this past Tuesday. Also, the new ball field lighting has been completed at the Girls Ball Park with new ball field lighting being installed at the Boys Ball Park August 11, 2024. The Parks 8v Recreation Board is addressing the cleanliness issues with the Restrooms at the Martin Luther King, Jr. and Brooklane Parks. Mr. Jacks reports follow-up with concerns of MLK Community Center use stating all is working as supposed to be. 10. OFFICERS REPORT a) Police Department: Chief Yarbrough - no report. GREAT THINGS HAPPENING IN HUEYTOWN a) Hueytown Chamber of Commerce Catherine Verciglio, Vice President Reports: i. The Chamber is accepting applications for the Junior Ambassadors program. ii. Family Fun Bingo Game Night is scheduled for 6: OOPM, July 25, 2024 at Speedy' s. A portion of the event proceeds are to benefit the Junior Ambassador Program. iii. Announced the National Night Out scheduled for August 6, 2024 from 6: OOPM to 7: 30PM at the City Center Park. iv. Paint the town purple is scheduled for the Hueytown High School Homecoming for the week of September 16, 2024. v. The sixth annual Paw Palooza and Wiener Dog Race is scheduled for September 21, 2024. vi. Munch and Mingle business after hours is coming soon. vii. Remember to Shop Local! b) Hueytown Library, Carroll Rector Reports: i. Announced the Summer Reading Program was held in the month of June each Wednesday with a total of 275 in attendance. Thanks to the local Day Care centers for their support of the program. ii. Announced reading classes are now with 22 applicants for tutors. iii. The Library continues to have computer issues with the County System. iv. Thanks to the Hueytown Public Works Department for cleaning outside of the building. c) Arts Council, Michelle McClinton, Reports: i. Announced there will be Movie In The Park July 26, 2024 with another movie being scheduled for August. ii. Announced the Arts Council is working on another mural at the MLK Park. iii. Announced the United Worship event being scheduled for September 15, 2024 with the proceeds benefiting Youth Towers. iv. Fall Canvas Painting, online auction and Candy Cane Lane Market are upcoming events being planned for September, October and November. v. Hubert The Snake continues in the Park. vi. BILLS FOR APPROVAL Council Member Zinnerman presented a list of bills totaling $ 208, 814. 93 and made a motion to approve the list of bills which were presented for payment followed by a second to the motion by Council Member Jacks. RESOLUTIONS: a) Resolution 6832 Resolution 6832 was presented to the Council to confirm the report of costs to abate a Public Nuisance and to create a Public Nuisance Lien on the property located at 206 Pinewood Avenue, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6832 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. b) Resolution 6833 Resolution 6833 was presented to the Council to confirm the report of costs to abate a Public Nuisance and to create a Public Nuisance Lien on the property located at 216 Pinewood Avenue, Hueytown. — A motion by Council Member Zinnerman was made to adopt Resolution Number 6833 followed by a second to the motion by Council Member Hurliman. A motion by Council Member Pickens was made to adopt Resolution Number 6837 followed by a second to the motion by Council Member Zinnerman. The motion carried unanimously. g) Resolution 6838 Resolution 6838 was presented to the City Council to declare a Public Nuisance and order the abatement of weeds, trash and/ or inoperable vehicle located at 208 Forest Road, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6838 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. h) Resolution 6839 Resolution 6839 was presented to the City Council to declare a Public Nuisance and order the abatement of weeds, trash and/ or inoperable vehicle located at 212 Mimosa Circle, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6839 followed by a second to the motion by Council Member Pickens. The motion carried unanimously. i) Resolution 6840 Resolution 6840 was presented to the City Council to declare a Public Nuisance and order the abatement of weeds, trash and/ or inoperable vehicle located at 225 Woodland Drive, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6840 followed by a second to the motion by Council Member Pickens. A motion by Council Member Hurliman was made to adopt Resolution Number 6845 followed by a second to the motion by Council Member Pickens. The motion carried unanimously. o) Resolution 6846 Resolution 6846 was presented to the City Council to declare a Public Nuisance and order the abatement of weeds, trash and/ or inoperable vehicle located at 3200 Virginia Drive, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6846 followed by a second to the motion by Council Member Pickens. The motion carried unanimously. p) Resolution 6847 Resolution 6847 was presented to the City Council to declare a Public Nuisance of an unsafe structure located at 1017 Broad Street, Hueytown. The motion carried unanimously. q) Resolution 6848 Resolution 6848 was presented to the City Council to declare a Public Nuisance of an unsafe structure located at 1919 26th Avenue North, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6848 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. r) Resolution 6849 Resolution 6849 was presented to the City Council to consider the ratification of the Master Services Agreement and authorize the Information Technology support services agreement. A motion by Council Member Pickens was made to adopt Resolution Number 6849 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. s) Resolution 6850 Resolution 6850 was presented to the City Council to consider amending the fiscal year 2023- 2024 budget for the purchase of a 2024 Knuckle Boom Truck. A motion by Council Member Hurliman was made to adopt Resolution Number 6850 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. 15. ORDINANCES: a) 24- 0709- 01 Ordinance 24- 0709- 01 was presented to amend the City of Hueytown code to provide for the disposition of unclaimed funds, property confiscated or taken as evidence, and for the disposition of contraband found with in the corporate limits of the City. The first reading to consider this Ordinance was at the July 9, 2024 regularly scheduled Council Meeting. A motion by Council Member Zinnerman was made to adopt Ordinance 24- 0709- 01 followed by a second to the motion from Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. b) 24- 0723- 01 Ordinance 24- 0723- 01 was presented to the Council as the first reading to consider the annexation of certain real property located at 236 Crossway Drive, Hueytown which is contiguous to the City. After no person came forward to address the Mayor and Council of the proposed Ordinance 24- 0723- 01, A motion by Council Member Pickens was made to close the public hearing, President Wright Closed the Public Hearing. EXTEND THE FLOOR TO THE PUBLIC Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a) Mary Meyer at 502 Saddleridge addressed the Mayor and Council seeking additional information about the IT Support item and unclaimed funds with the Mayor responding to Ms. Myers questions. Ms. Meyer had questions about the traffic lights on Allison Bonnett Memorial Drive with the Mayor informing Ms. Meyer that is a Jefferson County maintained road and to contact the County Roads and Transportation Department. b) Barry Humphries at 3848 Virginia Drive addressed the Mayor and Council about Ordinance 24- 0709- 01 regarding where does the unclaimed funds _ go with Lt. Shupe responding to Mr. Humphries question. 17. ADJOURNMENT With no further business to come before the Council Meeting, Council Member Pickens made a motion to adjourn.
