243 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, AUGUST 27, 2024 The City Council of the City of Hueytown, Alabama, met at 5: 30P. M. in the Council Chamber meeting room at the City of Hueytown, City Hall, on Tuesday, August 27, 2024. President Wright called the meeting to order with Council Members Zinnerman and Hurliman and Jacks present. Mayor Stephen Ware and City Attorney, Pickens, Wayne Morse, of Waldrep Stewart & Kendrick, LLP were also present. There were six individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, AUGUST 27, 2024 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber meeting room at the Hueytown City Hall on Tuesday, August 27, 2024. 1. CALL TO ORDER: at 6: 03P. M. with The meeting was called to order by Council President Wright approximately twenty- four individuals present in the audience. 2. INVOCATION: The invocation was given by Council Member Pickens. 3. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Council Member Pickens. 4. ROLL CALL Upon Roll Call, Council Members Zinnerman, Pickens, Hurliman, Wright and Jacks being present. Mayor Stephen Ware and City Attorney Wayne Morse of Waldrep Stewart and Kendrick, LLP were Present. 5. MEDIA RECOGNITION: Kalah Hegler of the Western Star was present. 6. APPROVAL OF MINUTES Council Member Pickens made a motion followed by a second to the motion by Council Member Jacks to approve the August 15, 2024, Council Meeting minutes as previously received and thereby dispensing with reading of the minutes. Pickens, Upon roll call vote, President Wright and Council Members Zinnerman, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the minutes approved. 7. ADOPT AGENDA FOR THE MEETING: Council Member Pickens made a motion to adopt the meeting agenda as published followed by a second to the motion by Council Member Zinnerman. President Wright and Council Members Zinnerman, Pickens, Upon roll call vote, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the meeting agenda adopted. August 27, 2024 Council Meeting Minutes Page 1 Of 14 244 The Mayor welcomed everyone present at the meeting and extended an invitation to other to attend future meetings. He encouraged attendees to bring up any concerns and stay informed about ongoing developments within the City. The Mayor provided and update on the status of the Nature Park grant, which the City has successfully received. Further details regarding its implementation will follow. The Mayor also updated attendees on the preparation work currently being _ undertaken at the Hueytown Family Activity Center, highlighting the progress made so far. 9. STANDING COMMITTEE REPORTS a) Finance Committee: Council Member Zinnerman, no report. b) Planning and Development Committee: Council Member Pickens, reports a re -zoning matter is on tonight' s meeting agenda. c) Public Safety Committee: Council Member Hurliman, no report. d) Public Works and Parks Committee: Council Member Jacks, gave an update the progress being made at the Hueytown Family Recreation Center. 10. OFFICERS REPORT a) Police Department: Chief Yarbrough - reports the two new Patrol Cars are expected to be ready for the City to pickup in two more weeks. Also expects License Plate Readers " LPRs" in a couple weeks. _ b) Fire Department: Chief Sullivan - reports the new Fire Truck which was ordered two years ago is expected to be delivered to the City next month. c) Public Works/ Street and Parks Department: Public Works Director Gant - no report. d) Building and Zoning Department: Inspector Humphries - reports construction has begun on the Wendy' s restaurant located next to Sonic on Allison Bonnett Memorial Drive. Also reporting the department has received plans for a new subdivision and construction is nearing completion in the Virginia Ridge subdivision. 11. GREAT THINGS HAPPENING IN HUEYTOWN a) Hueytown Chamber of Commerce Jamie Gilmore, Reports: i. The Chamber has received a record number of applications for the Junior Ambassadors program. ii. Paint the town purple is scheduled for the Hueytown High School Homecoming for the week of September 16 - 20, 2024. iii. The sixth annual Paw Palooza and Wiener Dog Race is scheduled for September 21, 2024, from 9: OOAM to 12noon. iv. Breast 5, 2024. Cancer Brunch event is being scheduled for Saturday, October v. Fall Fest event is scheduled for Saturday, October 26, 2024 from 11: OOAM to 1: OOPM. vi. Remember to Shop Local! b) Hueytown Library, Jessica Hayes Reports: i. Announced Program. the completion of a very successful Summer Reading August 27, 2024 Council Meeting Minutes Page 2 Of 14 245 ii. Announced the Library Board is working on updating its Policy and Procedures manual due in Montgomery by September 30, 2024 to qualify for State Aid. c) Arts Council, Jay Jacks, Reports: i. Announced in October an interactive movie being shown titled Hocus Pocus held at the new Hueytown Family Activity Center. ii. Announced in November the Candy Cane Lane, a mini Christmas Village, event being held at the Hueytown Family Activity Center. iii. Completing a grant application to fund future Arts Council Events. iv. Information can be obtained from the Hueytown Arts Council Facebook page at https:// www. facebook. com/ hueytownArts/ d) Hueytown Parks and Recreation Board, Tammy Pickens, Board President: i. The Youth baseball, softball and soccer programs have completed their registrations with the soccer league reporting record participation for this coming fall soccer season. ii. The Youth Football program kicks -off next week at home at the Hueytown High School Facility. iii. Thanks the City Council for the newly installed LED Lighting at the baseball and softball field lights with the Board assessing security needs at the Ball Fields. iv. Reports the City Parks Restrooms will be open from 7: OOAM to 7: OOPM due to persistent vandalism occurring in the facilities. v. Announced to have a meeting with the City Council at the September 03, 2024 Work Session meeting. vi. Additional information can be found on the Park 8s Recreation website at www. hueytownparks. com 12. CORRESPONDENCE a) There was no correspondence received to report. 13. BILLS FOR APPROVAL Council Member Zinnerman presented a list of bills totaling $ 353, 266. 40 and made a motion to approve the list of bills which were presented for payment followed by a second to the motion by Council Member Jacks. RESOLUTIONS: a) Resolution 6851 Resolution 6851 was presented to the Council as a Public Hearing regarding a declared Public Nuisance on the property located at 3200 Virginia Drive. Sharon and Bill McMurry addressed the Mayor and City Council regarding the nuisance matter requesting additional time to abate the nuisance. A motion by Council Member Pickens was made to adopt Resolution Number 6851 which is granting additional time to abate the nuisance and requests the McMurry' s August 27, 2024 Council Meeting Minutes Page 3 Of 14 to report at the September 24, 2024 Council meeting to provide an update of their progress to resolve the issue, followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting The motion carried yes. unanimously. b) Resolution 6852 Resolution 6852 was presented to the Council to confirm the report of costs to abate a Public Nuisance and to create a Public Nuisance Lien on the property located at 105 Merrimont Drive, Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6852 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. c) Resolution 6853 Resolution 6853 was presented to the Council to confirm the report of costs to abate a Public Nuisance and to create a Public Nuisance Lien on the property located at 112 Vann Street, Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6853 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. Mr. Brian Presnell at Presnell Engineering located 1703 McConnell Lane, Mount Olive, Alabama 35117, spoke for the proposed business being considered to be built on the location. Mr. Pressenll spoke about egress and size of the business. After no other person came forward to address the Mayor and Council of the proposed Ordinance 24- 0813- 01, A motion by Council Member Zinnerman was made to close the public hearing, President Wright Closed the Public Hearing. EXTEND THE FLOOR TO THE PUBLIC Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a) Ms. Kalah Hegler at 2709 Emerald Avenue, Hueytown addressed the Mayor and Council regarding the lease with the Jefferson County Board of Education and the City of Hueytown. b) Ms. Holly Garrett at 145 Midway Drive addressed the Mayor and Council regarding tall grass and weeds at 143 Midway Drive which is causing an issue with pests and rodents. Ms. Garrett also spoke of speeding on Midway Drive with Chief Yarbrough addressing the concern. c) Terry Killough at 4816 15' Street Road addressed the Mayor and Council regarding tall grass and weeds in the rear yard at 4812 15' Street Road, also a structure issue with the rear deck of the home. 17.
