272 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, OCTOBER 08, 2024 The City Council of the City of Hueytown, Alabama, met at 5: 30P.M. in the Council Chamber meeting room at the City of Hueytown, City Hall, on Tuesday, October 08, 2024. President Wright called the meeting to order with Council Members Zinnerman, Pickens, Hurliman and Jacks present. Mayor Stephen Ware was present with City _ Attorney, Charlie Waldrep, of Waldrep Stewart &, Kendrick, LLP were also present via speakerphone. There were seven individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, OCTOBER 08, 2024 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber meeting room at the Hueytown City Hall on Tuesday, October 08, 2024. 1. CALL TO ORDER: The meeting was called to order by Council President Wright at 6: 03P. M. with approximately thirty individuals present in the audience. 2. INVOCATION: The invocation was given by Council Member Pickens. 3. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Council Member Pickens. 4. ROLL CALL Upon Roll Call, Council Members Zinnerman, Pickens, Hurliman, Wright and Jacks being present. Mayor Stephen Ware and City Attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP were Present. 5. MEDIA RECOGNITION: Kailah Hegler representing the Western Star and Jacob Stewart representing Community Engagement Associates, LLC were present. 6. APPROVAL OF MINUTES Council Member Pickens made a motion followed by a second to the motion by Council Member Jacks to approve the September 24, 2024, Pre -Council and Council Meeting minutes and the October 01, 2024 Work Session minutes as previously received and thereby dispensing with reading of the minutes. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the minutes approved. 7. ADOPT AGENDA FOR THE MEETING: Council Member Pickens made a motion to adopt the meeting agenda as published with moving agenda item number eight to the end of the meeting followed by a second to the motion by Council Member Pickens. President Wright declared the meeting agenda adopted. 8. MAYORS REPORT The Mayor welcomed everyone present and invites others to attend to address any concerns they may have and become aware of what' s happening in the City. Council Member Zinnerman expressed sincere thanks to the Mayor, fellow council members, and department heads for their diligent efforts in closing the 2024 budget year better than anticipated. The Mayor responded, acknowledging that the City had a successful year and extended his gratitude to everyone who contributed, especially those working behind the scenes, making Hueytown a great place to live. Since Mr. Hubbard was unable to attend the meeting, the Mayor presented the plaque to Fire Chief Sullivan on his behalf. The Mayor read a proclamation for Breast Cancer Awareness month. BREAST CANCER AWARENESS MONTH PROCLAMATION OCTOBER 2024 WHEREAS, while considerable progress has been made in the fight against breast cancer, it remains the most diagnosed cancer and the second leading cause of death among women in the United States; and WHEREAS, each year it is estimated that 220, 000 women in the United States will be diagnosed with breast cancer and more than 40, 000 will pass away as a result of the disease; and WHEREAS, October is Breast Cancer Awareness Month, an annual campaign to increase awareness about the disease; and WHEREAS, during this month, we reaffirm our commitment to support breast cancer research and educate all citizens about its risk factors, detection, and treatment; and WHEREAS, we display pink ribbons and wear pink clothing to raise awareness, we also support those courageously fighting breast cancer and honor the lives of those lost to the disease; and October 08, 2024Council Meeting Minutes Page 2 Of 6 274 WHEREAS, this October we recognize breast cancer survivors, those battling the disease, their families and friends who are a tireless source of love and encouragement, and applaud the efforts of our medical professionals and researchers working to find a cure for this deadly disease; and WHEREAS, Breast Cancer Awareness Month is an opportunity to unite all citizens in our community to prevent breast cancer deaths through increased education and regular screening; NOW, THEREFORE, I Stephen M. Ware, Mayor of the City of Hueytown, do hereby proclaim the month of October 2024 as BREAST CANCER AWARENESS MONTH in the City of Hueytown. ._ Stephen M. Ware, Mayor 9. STANDING COMMITTEE REPORTS a) Finance Committee: Council Member Zinnerman, no report. b) Planning and Development Committee: Council Member Pickens - no report stating there is a meeting next Tuesday. c) Public Safety Committee: Council Member Hurliman - no report. d) Public Works and Parks Committee: Council Member Jacks - no report but states there is a meeting next Tuesday. 10. OFFICERS REPORT a) Police Department: Chief Yarbrough - reports the department has taken _ delivery of the two patrol cars and expects to have them in service by this coming Friday. b) Fire Department: Chief Sullivan - reports the department is expecting delivery of the new Fire Engine at the end of November 2024. c) Public Works/ Street and Parks Department: Public Works Director Gant - no report. d) Building and Zoning Department: Inspector Humphries - no report. 11. GREAT THINGS HAPPENING IN HUEYTOWN a) Hueytown Chamber of Commerce Debbie Kiker, Director Reports: i. Breast Cancer Brunch event was held on Saturday, October 5, 2024 with over 170 individuals in attendance. Special thanks to North Highlands Baptist Church for hosting and all sponsors for making this event a great success. ii. It's Fall Ya'll Fall Fest event is scheduled for Saturday, October 26, 2024 from 11: OOAM to 1: OOPM. iii. The Hometown Banners are scheduled to be installed November 31, 2024. iv. The Chamber Chili Cook -off is scheduled for November 9, 2024 from 11: OOAM to 3; OOPM. v. One Big Day December 7, of Holiday Cheer event is scheduled for Saturday, 2024 starting with the 36th annual Christmas Parade beginning from 1: 00PM to about 3: OOPM. vi. Christmas Tree Lighting is scheduled to for December 7, 2024 from 4: OOPM to 6: OOPM at the City Center Park. vii. Supper with Santa event is scheduled for Thursday, December 12, 2024. BILLS FOR APPROVAL Council Member Zinnerman presented a list of bills totaling $ 546, 139. 49 and made a motion to approve the list of bills which were presented for payment followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. RESOLUTIONS: a) Resolution 6936 Resolution 6936 was presented to the Council as a Public Hearing regarding a declared Public Nuisance of an unsafe structure located at 1314 Hueytown Road, Hueytown. Attorney Clinton Richie spoke to the Mayor and Council on behalf of the property owners seeking an additional forty- five ( 45) days as he anticipates the property to be sold with the prospective owner planning to repair the structure. A motion was made by Council Member Pickens to close the Public Hearing followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. b) Resolution 6937 Resolution 6937 was presented to the Council to order the abatement of a Public Nuisance of an unsafe structure located at 1314 Hueytown Road, Hueytown. A motion by Council Member Pickens was made to table Resolution Number 6937 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. c) Resolution 6938 Resolution 6938 was presented to the Council to order the abatement of a Public Nuisance of an unsafe structure located at 2518 16t' Street North, Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6938 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. The motion carried unanimously. e) Resolution 6940 Resolution 6940 was presented to the Council to declare a Public Nuisance and order the abatement of weeds, trash and/ or inoperable vehicle located at 106 Springdale Avenue, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6940 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. fl Resolution 6941 Resolution 6941 was presented to the Council to declare a Public Nuisance and order the abatement of weeds, trash and/ or inoperable vehicle located at 238 Crossway Drive, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6941 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks — voting yes. The motion carried unanimously. g) Resolution 6942 Resolution 6942 was presented to the Council to declare a Public Nuisance and order the abatement of weeds, trash and/ or inoperable vehicle located at 3051 Allison Bonnett Memorial Drive, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6942 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. 15. ORDINANCES: a) 24- 1008- 01 Ordinance 24- 1008- 01 was presented to the Council as the first reading to consider amending the City' s Zoning Map for certain real property located at 2885 Allison Bonnett Memorial Drive, Hueytown from B 1 to B3. After no person came forward to address the Mayor and Council of the proposed Ordinance 24- 1008- 01, A motion by Council Member Pickens was made to close the public hearing followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. President Wright closed the Public Hearing. A motion was made by Council Member Pickens to suspend the rules followed by a second to the motion by Council Member Hurliman. The motion carried unanimously. A motion was made by Council Member Pickens to adopt Ordinance Number 24- 1008- 01 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. A motion was made by Council Member Pickens to return to regular session followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. 16. EXTEND THE FLOOR TO THE PUBLIC Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a) Holly Garrett, 145 Midway Drive, addressed the Mayor and Council, stating that the neighborhood had recently held a meeting and expressed their gratitude to the Police Department. She noted that the efforts being made in the neighborhood are making a positive difference. b) Turner Dees, 249 Highland Drive, addressed the Mayor and Council as a follow- up for an update from the last meeting and expressed concern about the narrowing of the road leading up to his residence. The Mayor directed the question to Public Works Director Gant, who stated that the City' s Engineer will inspect the road and submit a report back to the Mayor. c) Terry Killough, 4816 16th Street Road, addressed the Mayor and Council regarding the Nuisance Abatement Process. Mr. Killough stated that the property at 4812 16th Street Road continues to be a nuisance due to overgrown weeds and accumulated trash. 17. ADJOURNMENT With no further business to come before the Council Meeting, Council Member Pickens made a motion to adjourn. Council President Wright declared the meeting adjourned at 7: OOP. M..
