285 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, NOVEMBER 12, 2024 The City Council of the City of Hueytown, Alabama, met at 5: 30P. M. in the Council Chamber meeting room at the City of Hueytown, City Hall, on Tuesday, November 12, 2024. President Wright called the meeting to order with Council Members Zinnerman, Pickens, Hurliman and Jacks present. Mayor Stephen Ware was present with City Attorney, Charlie Waldrep, of Waldrep Stewart 8v Kendrick, LLP was also present. There were six individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, NOVEMBER 12, 2024 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber meeting room at the Hueytown City Hall on Tuesday, November 12, 2024. 1. CALL TO ORDER: The meeting was called to order by Council President Wright at 6: 03 p. m., with approximately 22 individuals present in the audience. President Wright announced the removal of the following items from the published meeting agenda: Item 6: Annual Election of Council President Item 7: Annual Election of Council Pro- Tempore 2. INVOCATION: The invocation was given by Council Member Pickens. 3. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Council Member Pickens. 4. ROLL CALL Upon Roll Call, Council Members Zinnerman, Pickens, Hurliman, Wright and Jacks being present. Mayor Stephen Ware and City Attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP were Present. 5. MEDIA RECOGNITION: There was no media present. 6. APPROVAL OF MINUTES Council Member Pickens made a motion, seconded by Council Member Hurliman, to approve the minutes of the following meetings as previously received, thereby dispensing with the reading of the minutes: October 22, 2024: Pre -Council and Council Meetings November 4, 2024: Work Session Meeting November 12, 2024 Council Meeting Minutes Page 1 Of 8 i• Upon roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman, and Jacks voted in favor. There were no opposing votes. President Wright declared the minutes approved. 7. ADOPT AGENDA FOR THE MEETING: Council Member Pickens made a motion to adopt the meeting's amended agenda as published, with the following additional amendments: a) Remove Item 14A - Resolution 6954. b) Amend Item 14Q - Resolution 6970 to include December 23, 2024. c) Amend Item 14T - Resolution 6973 to remove Items 04 and 05 from the list. The motion was seconded by Council Member Hurliman. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman, and Jacks voted in favor. There were no opposing votes. 8. MAYORS REPORT The Mayor welcomed everyone in attendance and encouraged community members to participate in future meetings to address any concerns and stay informed about developments within the City. The Mayor asks everyone to keep the Allison family in their prayers as Bobby Allison had passed a few days ago with the funeral service being held in North Carolina and a private internment service in Hueytown. The Mayor presented a Proclamation to Debbie Kiker, representing the Hueytown Chamber of Commerce, to recognize Small Business Saturday PROCLAMATION Whereas, the City of Hueytown, Alabama, celebrates our local small businesses and the contributions they make to our local economy and community; and Whereas, according to the United States Small Business Administration, there are 34. 7 million small businesses in the United States, small businesses represent 99. 7% of firms with paid employees, small businesses are responsible for 61. 1% of net new jobs created since 1995, and small businesses employ 45. 9% of the employees in the private sector in the United States, and Whereas, 68 cents of every dollar spent at a small business in the U. S. stays in the local community and every dollar spent at small businesses creates an additional 48 cents in local business activity as a result of employees and local businesses purchasing local goods and services; and Whereas, 59% of U. S. consumers aware of Small Business Saturday shopped or ate at a small, independently owned retailer or restaurant on Small Business Saturday 2023; and Whereas, the City of Hueytown, Alabama, supports our local businesses that create jobs, boost our local economy, and preserve our communities; and Whereas, advocacy groups, as well as public and private organizations, across the country have endorsed the Saturday after Thanksgiving as Small Business Saturday. Now, Therefore, I, Stephen Ware, Mayor of The City of Hueytown, Alabama, do hereby proclaim, November 30, 2024, as SMALL BUSINESS SATURDAY and urge the residents of our community, and communities across the country, to support November 12, 2024 Council Meeting Minutes Page 2 Of 8  287 small businesses and merchants on Small Business Saturday - celebrating its 15th year in 2024 - and Shop Small throughout the year. Stephen M. Ware, Mayor The Mayor presented a donation check of $ 2, 500. 00 on behalf of the City to Jamie Gilmore from the Boys and Girls Club of Central Alabama. 9. STANDING COMMITTEE REPORTS a) Finance Committee: Council Member Zinnerman, no report. b) Planning and Development Committee: Council Member Pickens - no report with a Planning 8v Zoning Commission meeting next week. c) Public Safety Committee: Council Member Hurliman - reports there is an increase in calls for service with an increase of 39% responding to accidents and reminds folks to be attentive while driving. d) Public Works and Parks Committee: Council Member Jacks - no report. 10. OFFICERS REPORT a) Police Department: Chief Yarbrough - reports an increase in accidents. Additionally, there were forty reported crimes last month, the majority of which being private. b) Fire Department: Chief Sullivan - reports the new Fire Truck has been delivered to the City this week and expects to have in it service within two to three weeks. c) Public Works/ Street and Parks Department: Public Works Director Gant - no report. d) Building and Zoning Department: Inspector Humphries - no report. 11. GREAT THINGS HAPPENING IN HUEYTOWN a) Hueytown Chamber of Commerce Debbie Kiker, Executive Director Reports: i. The 36' annual Christmas Parade beginning from 1: OOp. m. to about 3: OOp. m.. ii. Christmas Tree Lighting is scheduled for December 7, 2024 from 4: OOp. m. to 6: OOp. m. at the City Center Park. iii. Supper with Santa event is scheduled for Thursday, December 12, 2024. iv. RESOLUTIONS: a) Resolution 6954 Resolution 6954 was presented to the Council as a Public Hearing regarding Public Nuisances on the property located at 6112 and 6116 Pruitt Drive, Hueytown. Resolution 6954 was omitted from the meeting agenda. b) Resolution 6955 Resolution 6955 was presented to the Council as a Public Hearing regarding a Public Nuisance on the property located at 427 Wren Avenue, Hueytown. Zendra Crosby at 427 McNear Avenue - addressed the Mayor and Council stating they have been boarding up the property and it continues to be vandalized. Inspections Officer spoke to the matter of the structure being dilapidated condition and in an unsafe condition. Ms. Crosby is seeking additional time to abate the unsafe structure. A motion by Council Member Zinnerman to close the Public Hearing, with Council President Wright closing the Public Hearing. This matter is to come before the Council at the January 14, 2025 meeting for an update of progress. c) Resolution 6956 Resolution 6956 was presented to the Council as a Public Hearing regarding a Special Assessment Lien on the property located at 103 Virginia Drive, Hueytown. Ms. Nadia Wallace at 103 Virginia Drive addressed the Mayor and Council regarding the lien being assessed on the property. The City attorney states Ms. Wallace needs to address this matter with the seller and the Title Insurance company. A motion by Council Member Zinnerman to close the Public Hearing, with Council President Wright closing the Public Hearing. d) Resolution 6957 November 12, 2024 Council Meeting Minutes Page 4 Of 8 Resolution 6957 was presented to the Council to declare a Public Nuisance and order the abatement of Weeds, Trash and/ or Inoperable Vehicle on the property located at 124 Gwin Avenue, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6957 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. e) Resolution 6958 Resolution 6958 was presented to the Council to declare a Public Nuisance and order the abatement of Weeds, Trash and/ or Inoperable Vehicle on the property located at 137 Sterling Drive, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6958 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. fl Resolution 6959 Resolution 6959 was presented to the Council to declare a Public Nuisance and order the abatement of Weeds, Trash and/ or Inoperable Vehicle on the property located at 2909 Post Circle, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6959 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. g) Resolution 6960 Resolution 6960 was presented to the Council to declare a Public Nuisance and order the abatement of Weeds, Trash and/ or Inoperable Vehicle on the property located at 3034 Lone Oak Road, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6960 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. h) Resolution 6961 Resolution 6961 was presented to the Council to order the abatement of a Public Nuisance of an unsafe structure located on 230 Knight Avenue, Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6961 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. i) Resolution 6962 Resolution 6962 was presented to the Council to order the abatement of a Public Nuisance of an unsafe structure located on 427 Wren Avenue, Hueytown. A motion by Council Member Pickens was made to TABLE to a later date Resolution Number 6962 followed by a second to the motion by Council Member Hurliman. The motion carried unanimously. 1) Resolution 6965 Resolution 6965 was presented to the Council to confirm the report of costs and create a special assessment Lien on the property located at 127 Mahone Avenue, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6965 followed by a second to the motion by Council Member Jacks. A motion by Council Member Hurliman was made to adopt Resolution Number 6966 followed by a second to the motion by Council Member Jacks. The motion carried unanimously. p) Resolution 6969 Resolution 6969 was presented to the Council to confirm the report of costs and create a special assessment Lien on the property located at 3030 Briarcliff Road, Hueytown. A motion by Council Member Hurliman was made to adopt Resolution Number 6969 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. q) Resolution 6970 Resolution 6970 was presented to the Council to set the Council meeting dates for the 2024 Holiday Season and announce the City Hall closures. A motion by Council Member Pickens was made to adopt Resolution Number 6970 with the addition of December 23, 2024 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. r) Resolution 6971 Resolution 6971 was presented to the Council to approve the Capital Improvements funding. A motion by Council Member Zinnerman was made to adopt Resolution Number 6971 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. s) Resolution 6972 Resolution 6972 was presented to the Council to amend the fiscal year 2024- 2025 budget for the additional appropriation of funds to C1asTran. A motion by Council Member Hurliman was made to adopt Resolution Number 6972 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. t) Resolution 6973 Resolution 6973 was presented to the Council to award the bid and authorize the contract for demolition and clearance of the Public Nuisances of Unsafe Structures. Council Member Zinnerman made a motion to adopt Resolution 6973, with the omission of bid items 04 and 05, for an award amount of $ 60, 000. 00. The motion was seconded by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman, and Jacks voted in favor. The motion carried unanimously. 15. EXTEND THE FLOOR TO THE PUBLIC Before opening the floor to public comments, President Wright reminded attendees of the following guidelines: Individuals wishing to address the Council must state their name and address. Speakers must be residents of Hueytown. Comments are limited to three minutes per person. a) Mary Meyer, of 502 Saddleridge, sought clarification regarding the term pro -rated" in Resolution 6956. She also requested confirmation about the change in the December Council meeting date. b) Council Member Zinnerman provided clarification regarding the omission of Resolution 6964 from the meeting agenda, citing recent information received as the basis for this decision. c) Sharon Jones inquired about properties at 6116, 6112, and 6108 Pruitt Drive and questioned why 6120 Pruitt Drive was not omitted. The Council clarified that 6120 Pruitt Drive remains on the Public Nuisance Abatement list. d) Turner Rees, of 229 Highland Drive, addressed the Mayor and Council regarding the paving of Highland Drive. The Mayor informed Mr. Rees that this road is included on the list of streets to be paved, as initiated by Resolution 6971 during tonight's meeting. e) Judy Maxwell, residing at 100 Viola Avenue, addressed the Mayor and Council regarding concerns about speeding vehicles near Hueytown Village. She also reported an incident during Classic Weekend where a neighbor hosted a large party with loud music, resulting in a blocked road. The Mayor advised Ms. Maxwell to report such incidents to the Police Department. Additionally, Ms. Maxwell raised concerns about a neighbor' s driveway construction, which appears to be impairing drainage. The Mayor directed the Public Works Department to investigate the issue and provide a report. 17.
