STATUTORYAGENDA a. Presentation,discussion,andpossibleaction toconsideradoptionofOrdinance2013-39forremovalofSTOP signsonSpringDriveattheintersectionwithWinterWay,firstreading. \[AronKulhavy,DirectorofCommunity andEconomicDevelopment\] AronKulhavy, DirectorofCommunityandEconomicDevelopment, saidtheCityhadreceivedarequestforreviewin responsetocomplaintsaboutthestopsignsbeingrun. HesaidtheCityperformedathoroughengineeringreviewand ManualonUniformTrafficControlDevices (MUTCD, fromtheFederalHighwayAdministration) guidelinereviewand foundthesignsdidnotmeetwarrantsatthecurrentvolumeoftrafficandexistingsightdistances,andthatthereforethe staffwasrecommendingremovalofthesigns. Mr.KulhavyconfirmedCouncilmember’squestionthattheCouncilcould choosetoleavethesignandtheMayor’s notethatstopsignswerenotprofessionallytobeviewedastrafficcontrol devices,eventhoughtheymayactinthatmanner. CouncilmemberJohnsonaskedabouttheCity’sliabilityifunwarrantedsignswereleftinplace. CityManagerMattBenoit saidhisexperiencehadbeenthatsignsthatdidnotmeetwarrantswerehabituallyrunandcreatedafalsesenseof security. CouncilmemberJohnsonaskedifthestaffcouldbetaskedtoconsideryieldsignsorothersolutions. b. Councilmember Humphrey movedtoadopt Resolution2013-17 andwassecondedbyCouncilmemberMontgomery. MayorWoodward movedtoamend theResolutionbystrikingSection8andwassecondedbyCouncilmemberMontgomery. The amendmenttotheResolutionwasunanimouslyapproved, 6-0. TheResolution,asamended, wasadoptedunanimously, 6-0. 6. MAYOR/CITYCOUNCIL/CITYMANAGERANDCITYATTORNEY REPORT a. Presentation,discussion,andpossibleaction toadoptOrdinance2013-38callingaspecialelectionforthe purposeofvotingontheadoptionorrejectionofproposedamendmentstotheexistingCityCharter. \[Mayor Woodward\] CouncilmemberJohnson movedtoapproveOrdinance2013-38, andwassecondedbyCouncilmemberOlson.The motionpassedunanimously, 7-0. b. MattLumpkins,DirectorofParksandLeisure, discussedabidonimprovementsat KateBarrRossPark. 7. PUBLICCOMMENT Therewerenopubliccomments. 8. MEDIAINQUIRIESRELATEDTOMATTERSONTHEAGENDA Therewerenomediainquiries. 9. ITEMSOFCOMMUNITYINTEREST HearannouncementsconcerningitemsofcommunityinterestfromtheMayor, Councilmembers, andCitystaffforwhichno actionwillbediscussedortaken.) TheMayorremindedthepublictosignupforThisWeekinHuntsville andabouttheneedforphotoIDattheupcoming election. CarolReed,DirectorofPublicWorks, confirmedtheCitywasstillinStage1withvoluntaryrestrictions. CouncilmemberHumphreyencouragedcitizenstosignupforThisWeekinHuntsville, andnotedtheincreasedpublic participationinCouncilitemsandsupportingeachotherandlocalbusiness. 10. EXECUTIVESESSION a. CityCouncilwillconveneinclosedsessionasauthorizedbyTexasGovernmentCode,551.071 –consultation withcounselonlegalmatterspertainingtoattorney/clientprivilegeinvolvingwrittencommunications. \[Mayor Woodward\] MayorWoodwardadjournedtheCouncilintoExecutiveSessionat8:04p.m. TheCouncilreconvenedat8:27p.m. 11. RECONVENE a. Presentation,discussion,andpossibleaction toauthorizethewaiverofattorney/clientprivilegeonmemorandum datedMarch7,2013,ontreetrimmingbytheCityAttorney. \[MayorWoodward\] MayorWoodwardannouncedacitizenhadcalledhimandtheCityManagerandaskediftheCityhadalegalorfiduciary responsibilitytocontrolEntergy’stree-cuttingpolicies. TheMayorsaidhehadaskedtheCityAttorneyforanopinionand receivedanAttorney-Clientprivilegedemailinresponse. Indiscussion,theMayoraddedhehadcontactedEntergy representativeStanFoley,whohadacontractorvisitwiththecitizen,notingthattheysuccessfullyworkedtogetheronthe cuttingoftrees. MayorWoodwardmovedthattheCouncilallowthereleaseoftheemailandwassecondedbyCouncilmemberAllen. The motionwasunanimouslyapproved, 7-0. b.
