a. Presentation,discussion,andpossibleaction toconsideradoptionofOrdinance2013-39forremovalofSTOP
signsonSpringDriveattheintersectionwithWinterWay,firstreading. \[AronKulhavy,DirectorofCommunity
andEconomicDevelopment\]
AronKulhavy, DirectorofCommunityandEconomicDevelopment, saidtheCityhadreceivedarequestforreviewin
responsetocomplaintsaboutthestopsignsbeingrun. HesaidtheCityperformedathoroughengineeringreviewand
ManualonUniformTrafficControlDevices (MUTCD, fromtheFederalHighwayAdministration) guidelinereviewand
foundthesignsdidnotmeetwarrantsatthecurrentvolumeoftrafficandexistingsightdistances,andthatthereforethe
staffwasrecommendingremovalofthesigns. Mr.KulhavyconfirmedCouncilmember’squestionthattheCouncilcould
choosetoleavethesignandtheMayor’s notethatstopsignswerenotprofessionallytobeviewedastrafficcontrol
devices,eventhoughtheymayactinthatmanner.
CouncilmemberJohnsonaskedabouttheCity’sliabilityifunwarrantedsignswereleftinplace. CityManagerMattBenoit
saidhisexperiencehadbeenthatsignsthatdidnotmeetwarrantswerehabituallyrunandcreatedafalsesenseof
security. CouncilmemberJohnsonaskedifthestaffcouldbetaskedtoconsideryieldsignsorothersolutions.

CityAttorneyLeonardSchneidernotedtheeasementwasnotpermanentandthattherewereconditionsthatwould
terminateaccess. CouncilmemberEmmettexpressedconcernabouttheeasementinrelationtotheUnrestricted
Reserve.
Themotionpassedunanimously, 7-0.

CouncilmemberAllensignedaConflictofInterestformanddidnotparticipateinthisdiscussionorvote.) Councilmember
Humphrey movedtoadopt Resolution2013-17 andwassecondedbyCouncilmemberMontgomery. MayorWoodward
movedtoamend theResolutionbystrikingSection8andwassecondedbyCouncilmemberMontgomery. The
amendmenttotheResolutionwasunanimouslyapproved, 6-0. TheResolution,asamended, wasadoptedunanimously,
6-0.

KateBarrRossPark.

CouncilmemberHumphreyencouragedcitizenstosignupforThisWeekinHuntsville, andnotedtheincreasedpublic
participationinCouncilitemsandsupportingeachotherandlocalbusiness.
10. EXECUTIVESESSION

withcounselonlegalmatterspertainingtoattorney/clientprivilegeinvolvingwrittencommunications. \[Mayor

11. RECONVENE
a. Presentation,discussion,andpossibleaction toauthorizethewaiverofattorney/clientprivilegeonmemorandum
datedMarch7,2013,ontreetrimmingbytheCityAttorney. \[MayorWoodward\]
MayorWoodwardannouncedacitizenhadcalledhimandtheCityManagerandaskediftheCityhadalegalorfiduciary
responsibilitytocontrolEntergy’stree-cuttingpolicies. TheMayorsaidhehadaskedtheCityAttorneyforanopinionand
receivedanAttorney-Clientprivilegedemailinresponse. Indiscussion,theMayoraddedhehadcontactedEntergy
representativeStanFoley,whohadacontractorvisitwiththecitizen,notingthattheysuccessfullyworkedtogetheronthe
cuttingoftrees.
MayorWoodwardmovedthattheCouncilallowthereleaseoftheemailandwassecondedbyCouncilmemberAllen. The
motionwasunanimouslyapproved, 7-0.
