CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING NOVEMBER 22, 2016 7:00 P.M. – 7:04 P.M. REGULAR CITY COUNCIL MEETING - CITY HALL - #1 MUNICIPAL DRIVE The City Council of the City of Jacksonville, Arkansas met in regular session on November 22, 2016 at the regular meeting place of the City Council. Alderman Bolden delivered the invocation and Mayor Fletcher led a standing audience in the “Pledge of Allegiance” to the flag. ROLL CALL: Aldermen: Elliott, Bolden, McCleary, Sansing, Ray, Mashburn, Traylor, Twitty, and Howard answered ROLL CALL. Mayor Fletcher also answered ROLL CALL declaring a quorum. PRESENT NINE (9), ABSENT (1). Aldermen Smith was absent. Others present for the meeting were: City Attorney Robert Bamburg, Director of Administration Jim Durham, City Engineer Jay Whisker, Police Chief Kenny Boyd, IT Director Scott Rothlisberger, Park and Recreation Director Kevin House, Alderman Elect Les Collins and daughter, interested citizens, and members of the press. PRESENTATION OF MINUTES: APPROVAL AND/OR CORRECTION OF MINUTES: CONSENT AGENDA: WASTEWATER DEPARTMENTS: WATER DEPARTMENT: FIRE DEPARTMENT: POLICE DEPARTMENT: PUBLIC HEARING ORDINANCE 1561 (#21-2016) AN ORDINANCE CREATING AND CERTIFYING TAX LIENS AGAINST REAL PROPERTIES AT VARIOUS LOCATIONS WITHIN THE CITY FOR BALANCES DUE FROM SERVICES RENDERED BY AND/OR ON BEHALF OF THE CITY OF JACKSONVILLE, ARKANSAS; AND, FOR OTHER PURPOSES. Mayor Fletcher opened the public hearing at approximately 7:02 p.m. City Attorney Bamburg related that Ordinance 1561 is the annual tax lien ordinance to certify liens for properties regarding services rendered by the City crews. He stated that exhibit A list includes the properties, owners, and amounts owed to the City. He explained that the liens will be filed with the assessor and collector’s office and will be assessed against the properties for the 2017 taxes collected for 2016. With no one from the audiences wishing to address Ordinance 1561, Mayor Fletcher closed the public hearing at approximately 7:04 p.m. Alderman Elliott moved, seconded by Alderman Bolden that Ordinance 1561 be placed on FIRST READING. ROLL CALL: Alderman Elliott, Bolden, McCleary, Sansing, Ray, Mashburn, Traylor, Twitty, and Howard voted AYE. NAY (0). MOTION CARRIED. Whereupon City Attorney Bamburg read the heading of Ordinance 1561. 1 CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING NOVEMBER 3, 2016 7:00 P.M. – 7:33 P.M. Alderman Bolden moved, seconded by Alderman Twitty to APPROVE Ordinance 1561 on FIRST READING and suspend the rules and place Ordinance 1561 on SECOND READING. ROLL CALL: Alderman Elliott, Sansing, Ray, Mashburn, Traylor, Twitty, Smith, and Howard voted AYE. NAY (0). MOTION CARRIED. Whereupon City Attorney Bamburg read the heading of Ordinance 1561. Alderman Bolden moved, seconded by Alderman Twitty to further suspend the rules and place Ordinance 1561 on THIRD and FINAL READING. ROLL CALL: Alderman Elliott, Sansing, Ray, Mashburn, Traylor, Twitty, and Howard voted AYE. NAY (0). MOTION CARRIED. Whereupon City Attorney Bamburg read the heading of Ordinance 1561. Alderman Mashburn moved, seconded by Alderman Bolden that Ordinance 1561 be APPROVED and ADOPTED. ROLL CALL: Alderman Elliott, Sansing, Ray, Mashburn, Traylor, Twitty, and Howard voted AYE. NAY (0). MOTION CARRIED. ORDINANCE 1561 (#21-2016) APPROVED AND ADOPTED THIS 3RD DAY OF NOVEMBER, 2016. A list of said property owners, parcel numbers, property addresses, and amounts owed are attached hereto and incorporated herewith as Exl-libitA; WHEREAS,despite extensive notices and repeated demands, said property owners have not paid the amounts due the City for services rendered and/or performed as detailed on Exhibit A; and, WHERHS, pursuant to Arkansas law, tax liens should be created and certified for these real properties and record property owners listed on Exhibit A. Further, the lien amounts should be certified for inclusion in the annual real estate tax statements prepared by the Pulaski County Treasurer's Office until paid in full. NOW, THEREFOR6 BE IT ORDAINED B Y T M CITYCOUNCIL OF T M CITY OFJACKSONVILLi, A R M NSAS: SECTION ONE: I n accordance with the authority granted under ACA 514- 54-904, the Jacksonville City Council hereby authorizes the Mayor and/or the City Clerk to certify the list of real properties and record property owners included on the attached Exhibit A to the Pulaski County Treasurer's Office for inclusion as tax liens on annual real property tax statements for 2016. SECTION TWO: Should any part(s) of this Ordinance be declared invalid for any reason, no other part(s) of the Ordinance shall be affected thereby. SECTION THREE: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION FOUR: This Ordinance shall take effect immediately upon passage and publication, as provided by and subject to the requirements of applicable law.
