MINUTES CITY OF JEFFERSON COMMON COUNCIL TUESDAY, SEPTEMBER 4, 2018 The Tuesday, September 4, 2018 meeting of the City of Jefferson Common Council was called to order at 7:00 p.m. by Mayor Oppermann. Members present were: Ald. Peachey, Ald. Miller, Ald. Beyer, Ald. Horn, Ald. Brandel, Ald. Tully, Ald. Krause and Ald. Lares. Also present were: City Administrator Freitag, City Engineer Pinnow, City Attorney Rogers and City Clerk\Deputy Treasurer Kuehl. PUBLIC PARTICIPATION None. TOMORROW’S HOPE UPDATE Barb Endl with Tomorrow’s Hope was present and thanked everyone for their support of Hope Fest 2018. She explained all of the challenges with the changes this year and the feedback she received. She indicated that she has already picked up a special event permit application for next year. CITIZEN LIFESAVER AWARDS Police Chief Pileggi presented a Citizen Letter of Recognition to Laura Lueck for her life saving efforts that played a vital role in saving a man’s life at an accident that occurred on June 20, 2018. Tyler Parpart was not present, but was also recognized for his part in the life saving efforts. PUBLIC WORKS UPDATE Engineer Pinnow explained that the fill material that has been placed at the former County Highway Shop site will be used for the grading needed for the joint City-County park at this location. City Administrator Freitag also gave an update on the anticipated flood levels. Street closures are anticipated on Dane Street and Riverview Drive. The City departments have begun to plan for a flood situation. Right now sandbags are available on a self-serve basis. The next step will be to deliver sandbags to property owners that are in need. WARRIORS & WIZARDS FESTIVAL PRESENTATION Scott Cramer with HP Fans, Inc. gave an update on the Warriors & Wizards festival. He showed a commercial that is currently being aired. He also listed the event locations and explained the simplified bus routes. He explained the events at the Kidz Activity Center, Technology Building, VFW, Rotary Park, Tensfeldt Park and the Lighted Parade. He also explained the proposed street closures and stated that wristbands can be purchased at River’s Edge, Piggly Wiggly, Chamber of Commerce, Jefferson City Hall or online. PROPOSED ORDINANCE #6-18 TO AMEND SECTION 25-4 OF THE MUNICIPAL CODE CONCERNING THE DUTIES OF THE PRESIDING OFFICER Ald. Brandel introduced Proposed Ordinance #6-18 for its second reading. CITY OF JEFFERSON ORDINANCE # 6-18 The Common Council of the City of Jefferson, Wisconsin hereby ordains as follows: Section 1: Section 25-4 of the City of Jefferson Municipal Code relating to the duties of the presiding officer is hereby repealed and restated as follows: (A) The Mayor shall preserve order and decide all questions, subject to an appeal of the Council; announce the business before the Council in the order in which it is to be acted upon; receive and submit in proper manner all motions and propositions presented; put to a vote all questions which are regularly moved or which necessarily arise in the course of proceedings and announce the result; and authenticate by his signature, when necessary, all acts, orders, and proceedings of the Council. (B) In addition to the aforementioned duties, the Mayor, after consulting with the City Administrator, shall be responsible for the creation, preparation and publication of the agenda for all meetings of the Common Council as well as the agenda for all meetings of any standing committees of the City. Section 2: This ordinance shall take effect after passage, publication, and attestation as required by law. Ald. Brandel, seconded by Ald. Krause moved to approve Ordinance #6-18. Motion carried unanimously on call of the roll. CONSENT AGENDA Ald. Tully introduced Resolution No. 47. CITY OF JEFFERSON RESOLUTION NO. 47 BE IT RESOLVED, by the Common Council of the City of Jefferson, Wisconsin that the consent agenda for September 4, 2018 is hereby adopted. A. Vouchers Payable for September, 2018 in the amount of $159,835.63. Payroll Summary for August 31, 2018 in the amount of $165,466.16. B. Council Minutes from the August 21, 2018 Meetings of the Common Council. C. Gemuetlichkeit Days 2018 Subsidy. D. Licenses as Approved by the Regulatory Committee. 1. Operator’s Licenses 2. Special Class B Licenses Ald. Tully seconded by Ald. Beyer moved to approve Resolution No. 43. On call of the roll, motion carried unanimously. RESOLUTION AUTHORIZING THE TEMPORARY CLOSURE OF CITY RIGHT-OF-WAY TO ROCK BOTTOM EXPRESS Ald. Beyer introduced Resolution No. 48.  CITY OF JEFFERSON RESOLUTION NO. 48 WHEREAS, Vince Krause with Rock Bottom Express is looking to close off South Gardner Avenue from West Milwaukee Street to the entrance of the tenant parking lot located adjacent to Northwest Apartments. Mr. Krause is asking that this portion of South Gardner Avenue is closed Sunday, September 16, 2018 from 8:00 a.m. to 8:00 p.m. WHEREAS, Section 240-8 of the City of Jefferson Municipal Code refers to the City’s regulations regarding the temporary closure of public right-of-way. BE IT RESOLVED, by the Common Council of the City of Jefferson, Wisconsin that South Gardner Avenue from West Milwaukee Street to the entrance of the tenant parking lot located adjacent to Northwest Apartments is hereby temporarily closed on September 16, 2018 from 8:00 a.m. to 8:00 p.m., and BE IT FURTHER RESOLVED, that said right-of-way is hereby leased to Rock Bottom Express in the sum of $50.00 for said time-frame. Ald. Beyer, seconded by Ald. Tully moved to approve Resolution No. 48. Motion carried unanimously on call of the roll with Ald. Krause abstaining. RESOLUTION AUTHORIZING THE SALE OF GOODS IN CITY RIGHT-OF-WAY TO VENDORS FOR THE WARRIORS AND WIZARDS FESTIVAL Ald. Lares introduced Resolution No. 49. CITY OF JEFFERSON RESOLUTION NO. 49 BE IT RESOLVED by the Common Council of the City of Jefferson, Wisconsin that the listed vendors (attached) are hereby allowed to sell goods and/or services in City right-of-way during the Warriors and Wizards Festival on October 19 – 21, 2018. Ald. Lares, seconded by Ald. Brandel moved to approve Resolution No. 49. Motion carried unanimously on call of the roll. RESOLUTION AUTHORIZING THE SALE OF TWO IMPOUNDED VEHICLES BY THE POLICE DEPARTMENT Ald. Peachey introduced Resolution No. 50. CITY OF JEFFERSON RESOLUTION NO. 50 WHEREAS, staff of the Jefferson Police Department did locate several abandoned/unregistered vehicles of which two (2) vehicle owners failed to comply after receiving notices pursuant to Jefferson City Ordinance 219.6-A to bring said vehicles into compliance with City Ordinance;  WHEREAS, after legally required notifications pursuant to Jefferson City Ordinance 219 said two (2) vehicles were not brought into compliance with City Ordinance 219, and as such were removed and impounded by staff of the Jefferson Police Department, pursuant to City of Jefferson Ordinance 219.6-B and stored at the secured lot behind the Police/Utilities Building at 425 Collins Road; WHEREAS, after attempting to notify the owners of said vehicles of their right to reclaim said vehicles, pursuant to Wisconsin Statute 342.20, said owners failed to retrieve their vehicles, who were notified to retrieve these vehicles and that failing to do so would be treated as their waiver of all right, title, and ownership of said vehicle(s), within the ten (10) days required from the date of the notice; NOW, THEREFORE BE IT RESOLVED, by the Common Council of the City of Jefferson, Wisconsin that it herein declares said two (2) motor vehicles surplus property and authorizes the Chief of Police to sell same through Wisconsin Surplus Auction Services. Motion was made by Ald. Peachey, seconded by Ald. Lares to Resolution No. 50. Motion carried unanimously on call of the roll. Adjourn to Closed Session Pursuant to Section 19.85(c) of the Wisconsin State Statutes to Consider Hiring a Police Department Full-time Dispatcher. Ald. Lares seconded by Ald. Peachey moved to adjourn to Closed Session. On call of the roll, motion carried unanimously. Motion was made by Ald. Brandel, seconded by Ald. Miller to reconvene to open session. Motion carried unanimously on a voice vote. RESOLUTION TO AUTHORIZE THE HIRE OF A FULL-TIME DISPATCHER FOR THE CITY OF JEFFERSON POLICE DEPARTMENT Ald. Miller introduced Resolution No. 51. CITY OF JEFFERSON RESOLUTION NO. 51 WHEREAS, Police Chief Pileggi has taken steps to fill a vacant position in the Police Department for a full-time dispatcher; and WHEREAS, the open position was publicly advertised and interviews were conducted with potential candidates; and WHEREAS, Police Chief Pileggi is recommending that Kayce Board be hired by the City of Jefferson to fill the vacant position; and WHEREAS, the Personnel Committee having reviewed the qualifications of Kayce Board and the recommendation of Chief Pileggi is also recommending the hire of Kayce Board to the Common Council; and WHEREAS, the Chief of Police has full-time funds allocated in his 2018 approved operating budget and that this full-time dispatcher position is to fill a recent full-time vacancy in  NOW, THEREFORE BE IT RESOLVED, by the Common Council of the City of Jefferson, Wisconsin that it herein authorizes the Police Chief to hire Kayce Board at a starting wage rate of $19.15 per hour, Grade 5, Step 2 of the City of Jefferson Compensation Plan and be given 9 days of PTO, Year 1 of Service on the City of Jefferson Paid-Time Off schedule on the first day of employment. Employment shall commence no later than September 17th, 2018. Ald. Miller, seconded by Ald. Tully moved to approve Resolution No. 51. Motion carried unanimously on call of the roll. Ald. Peachey, seconded by Ald. Miller moved to adjourn the September 4, 2018 meeting of the Common Council at 7:48 p.m. On a voice vote, motion carried unanimously. The minutes of the September 4, 2018 meeting of the Common Council are uncorrected. Any corrections made thereto will be noted in the proceedings at which time the minutes are approved and referenced above.
