CALLTOORDERANDANNOUNCEAQUORUM PRESENT Mayor Pro-Tem Moore called the meeting to order at 6:30 pm. B INVOCATION Councilmember Kidd led the lnvocation C. PLEDGE OF ALLEGIANCE Councilmember Purdom led the Pledge of Allegiance. D. WORK SESSION 1 Review and discuss questions related to the budget report and financial statement for October 2019. (Staff Resource: J. Jones) No comments or questions. 2 Review and discuss questions related to the EPA Drainage Grant Project Update. (Staff Resource: M. Peacock) Asst. City Manager Mike Peacock reported on the status of the EPA Grant proiect, including a tentative schedule for bid opening (Jan. 6, 2020) and beginning of construction (est. than March 2020). J Questions regarding Regular Session agenda items. No comments or questions. 4. Requests for future reports and agenda items. No requests. E REGULAR SESSION F PROCLAMATIONS & PRESENTATONS N/A G. PUBLIC FORUM The City Council invites citizens to speak on any topic. However, unless the item is specifically noted on this agenda, the City Council is required under the Texas Open Meetings Act to limit its response to responding with a statement of specific factual information, reciting the City's existing policy, or directing the person making the inquiry to visit with City Staff about the issue. No Council deliberation is permitted. Each person will have 3 minutes to speak. Mr. Lee Oldhan of 408 Grayson Court, Joshua, TX, addressed to Council with regard to drainage issues at his residence believed to be caused by the development of a neighboring propefty - Heritage ll. City staff were instructed to communicate the contact information of the developer to Mr. Oldhan so that he may contact him directly. Mr. Craig Hundley of 7835 CR 385, Grandview, TX, addressed the Council to advocate for specilic candidates for the 2020-2021 Johnson County Appraisal Board election. H. CONSENTAGENDA . Approval of minutes from the meeting dated November 14,2019. 1 Councilmember Kmble made a motion to approve the minutes as presented. Seconded by Councilmember Purdom. Motion canied unanimously, 6-0 t. APPOINTMENT TO BOARDS, COMMISSIONS. AND COMMITTEES 1 Discuss, consider and act regarding possible appointments/re-appointments to the Planning & Zoning Commission, Zoning Board of Adjustment, Type A EDC Board, Type B EDC & Parks Board, Heritage Preservation Committee, Library Board, and the Animal Control Advisory Board. (Staff Resource: J. Jones) N/A J. REPORTS & ACTION ITEMS FROM THE PLANNING & ZONING COMMISSION N/A K. GENERAL ACTION ITEMS 1 Discuss, consider and take action on a Gas Well Setback Waiver Application as submitted by Scott Sandlin with Joshua Development Company, Ltd. (Staff Resource: J Jones) Councilmember Kmble made a motion to approve the gas well setback waiver request from Mr. Sandlin of 135', from 600'to 435'. Seconded by Mayor Pro Tem Moore. Motion failed due to a tie/lack of majority vote; 3-3. Mr. Sandlin was encouraged to reapply for the waiver with a different plan. 2. Discuss, consider and take action on a Resolution of the City Council of the City of Joshua, Texas, establishing a public newspaper of general circulation as the Cleburne Times Review to be the official newspaper for the City of Joshua; and providing for an immediate effective date. (Staff Resource: J. Jones) Councilmember Kidd made a motion to adopt the Resolution. Seconded by Councilmember Nichols. Motion canied unanimously, 6-0. 3 Discuss, consider and take action on a Resolution of the City Council of the City of Joshua, Texas, affirming the casting of vote in lhe 2020-2021 election of the Board of Directors for the Central Appraisal District of Johnson County, Texas. (Staff Resource: J. Jones) Councilmember Kimble made a motion to cast by Resolution the City's 54 votes evenly between Mr. Toby Ford (27) and Ms. Amy Lingo (27). Seconded by Councilmember Kidd. Motion canied 4-l (Moore), with one abstention (Nichols). 4. Discuss, consider and take action on a Resolution of the City Council of the City of Joshua, Texas, establishing the City's intention to reimburse itself for the prior lawful expenditure of funds relating to constructing various city improvements from the proceeds of tax-exempt obligations to be issued by the City for authorized purposes; authorizing other matters incident and related thereto; and providing an effective date. Councilmember Nichols made a motion to adopt the Resolution. Seconded by Councilmember Purdom. Motion carried unanimously, 6-0. E Discuss, consider and take action on an Ordinance of the City Council of the City of Joshua, Texas, amending subpart (2) of subsection (c), "Well Setbacks", of Section 4.06.010 "Technical Regulations," of Article 4.06, "Gas Wells", of Chapter 4, "Business Regulations," of the Code of Ordinances by removing all provisions related to written notarized waivers of surrounding property owners. (Staff Resource: T. Welch) Councilmember Kidd made a motion to adopt the Ordinance Amendment. Seconded by Councilmem ber Nichols. Motion canied unanimously, 6-0. L. EXECUTIVE SESSION The City Council shall convene in Closed Session in accordance with Texas Government Code: Pursuant to Section 551.071 of the Texas Government Code, consultation with the City Attorney regarding legal issues associated with executive session privileges and all mafters incident and related thereto. Mayor Pro-Tem Moore recessed into Executive Session at 7:15 p.m M. RECONVENE IN OPEN SESSION The City Council shall convene in Open Session and may take any action related to discussion in Executive Session.
