MINUTES CITY COUNCIL REGULAR MEETING OCTOBER 15, 2020 6:30 PM City Council Present: Joe Hollarn, Mayor; Rick DePriest, Place 1; Mike Kidd, Place 2; Angela Nichols, Place 3; Robert Purdom, Place 4; Jerry Moore, Place 5; and Scott Kimble, Place 6. City Council Absent: None City Staff Present: Josh Jones, City Manager; Mike Peacock, Asst. City Manager; Aaron Maldonado, Development Services Director; Terry Welch, City Attorney; and Alice Holloway, City Secretary. City facilities are closed to the public in response to a health emergency specifically Coronavirus Disease (COVID-19). This meeting is available via live stream. CALL TO ORDER AND ANNOUNCE A QUORUM PRESENT Mayor Hollarn announced a quorum and called the meeting to order at 6:33 p.m. B. WORK SESSION 1. Review and discuss questions related to the budget report and financial statement for September 2020. (Staff Resource: J. Jones) City Manager Jones presented the budget report and financial statement for September 2020. 2. Discuss and give direction to staff regarding a petition filed asking the City to serve as the applicant to re-zone Little Brook Estates. (Staff Resource: J. Jones) City Manager Jones presented a petition to the City Council asking the City Council to act as the applicant to rezone the Little Brook Estates. Mr. Jones stated that the majority of the citizens in the estate have signed the petition.  Staff was given direction to reach out to the property owners that did not sign the petition and discuss the topic with them and report back to the City Council at the next meeting. 3. Discuss and review the 2020 Availability of Internet Services Report. (Staff Resource: M. Peacock) Asst. City Manager Peacock presented a 2020 Availability of Internet Services Report. 4. Questions regarding Regular Session agenda items. There were no questions regarding the Regular Session agenda items. D. PUBLIC FORUM, PRESENTATIONS AND RECOGNATION: The City Council invites citizens to speak on any topic. However, unless the item is specifically noted on this agenda, the City Council is required under the Texas Open Meetings Act to limit its response to responding with a statement of specific factual information, reciting the City’s existing policy, or directing the person making the inquiry to visit with City Staff about the issue. No Council deliberation is permitted. Each person will have 3 minutes to speak. NA E. CONSENT AGENDA 1. Consider approval of minutes from the City Council Meeting held on September 17, 2020. (Staff Resource: A. Holloway) Councilmember Kimble moved to approve the Consent Agenda. Councilmember Moore seconded the motion. The motion passed unanimously. F. REGULAR AGENDA 1. Public hearing on repealing Article 10.02, “Subdivision Ordinance,” of Chapter 10, “Subdivision Regulation,” of the Code of Ordinances and replacing it with a new Article 10.02, “Subdivision Ordinance,” of Chapter 10, “Subdivision Regulation,” of the Code of Ordinances. Mayor Hollarn opened the public hearing at 6:51 pm regarding repealing Article 10.02, “Subdivision Ordinance,” of Chapter 10, “Subdivision Regulation,” of the Code of Ordinances and replacing it with a new Article 10.02, “Subdivision Ordinance,” of Chapter 10, “Subdivision Regulation,” of the Code of Ordinances. No questions or comments made from the public. Mayor Hollarn closed the public hearing at 6:52 pm. 2. Discuss, consider, and possible action on approving an Ordinance repealing Article 10.02, “Subdivision Ordinance,” of Chapter 10, “Subdivision Regulation,” of the Code of Ordinances and replacing it with a new Article 10.02, “Subdivision Ordinance,” of Chapter 10, “Subdivision Regulation,” of the Code of Ordinances. Councilmember Moore moved to approve an Ordinance repealing Article 10.02, “Subdivision Ordinance,” of Chapter 10, “Subdivision Regulation,” of the Code of Ordinances and replacing it with a new Article 10.02, “Subdivision Ordinance,” of Chapter 10, “Subdivision Regulation,” of the Code of Ordinances. Councilmember Purdom seconded the motion. The motion passed unanimously. 3. Discuss, consider, and possible action on a resolution supporting the passage of legislation during the 87th Regular session of the Texas Legislature (2021), to allow for the expenditure of Municipal Hotel Occupancy Tax Revenue by the City for construction of improvements in Municipal Parks. (Staff Resource: J. Jones)  Councilmember Moore moved to approve a resolution supporting the passage of legislation during the 87th Regular session of the Texas Legislature (2021), to allow for the expenditure of Municipal Hotel Occupancy Tax Revenue by the City for construction of improvements in Municipal Parks. Councilmember DePriest seconded the motion. The motion passed unanimously. 4. Discuss, consider, and possible action on an Interlocal Agreement between JCSUD and City of Joshua for Water Utilities Facilities Relocation and Maintenance regarding Mockingbird Hill Phase 1. (Staff Resource: M. Peacock) Councilmember Moore moved to approve an Interlocal Agreement between JCSUD and City of Joshua for Water Utilities Facilities Relocation and Maintenance regarding Mockingbird Hill Phase 1. Councilmember Purdom seconded the motion. The motion passed unanimously. 5. Discuss, consider, and possible action on an Interlocal Agreement with Johnson County for Brushcutting on Forrest Lane. (Staff Resource: M. Peacock) Councilmember Kimble moved to approve an Interlocal Agreement with Johnson County for Brushcutting on Forrest Lane. Councilmember DePriest seconded the motion. The motion passed unanimously. 6. Discuss, consider, and take action on an Amendment to Chapter 380 Agreement Partnership Agreement with The Retail Connection. (Staff Resource: J. Jones) Councilmember DePriest moved to approve an Amendment to Chapter 380 Agreement Partnership Agreement with The Retail Connection. Councilmember Nichols seconded the motion. The motion passed unanimously. G. STAFF REPORT September 2020 1. Police Department Report 2. Fire Department Report 3. Municipal Court Report 4. Public Works Report 5. Parks Report 6. Development Services Report 7. City Secretary Report Staff was asked to place on the utility report the total amount outstanding each month. H. EXECUTIVE SESSION: Pursuant to Texas Government Code, Chapter 551, Subchapter D, the City Council will recess into Executive Session (closed meeting) to discuss the following: (a) Section § 551.074 (a)(1) of the Texas Government Code to deliberate the employment or evaluation of a public officer or employee, to-wit: City Manager. Mayor Hollarn recessed the meeting into Executive Session pursuant to the provisions of Chapter 551, Subchapter D, Texas Government Code at 7:15 pm. I. RECONVENE INTO OPEN SESSION: In accordance with Texas Government Code, Section 551, the City Council will reconvene into regular session.  Mayor Hollarn reconvened the meeting into regular session at 7:52 pm. No Action taken as the result of Executive Session. J. FUTURE AGENDA ITEMS/REQUESTS BY COUNCILMEMBERS TO BE ON NEXT AGENDA Councilmembers shall not comment upon, deliberate, or discuss any item that is not on the agenda.
