Texas Flag Councilmember Purdom led the Pledge of Allegiance. C. INVOCATION Councilmember Kimble gave the invocation. D. WORK SESSION 1. Review and discuss questions related to the budget report and financial statement for January 2021. (Staff Resource: M. Peacock)  City Manager Peacock presented the budget report and financial statement for January 2021. There were no comments from the council. 2. Discussion regarding the set speed limit for Clubhouse Drive. 3. Discuss and receive update regarding the February 2021 disaster regarding the Snow Storm, Power Outage, Water Shortage, and Waste Collection. City Manager Peacock gave a brief update regarding the recent storm. Mr. Peacock stated that staff is working on a few concerns. City Manager Peacock stated that he has met with the fire department, public works, and police department and started the discussion on what was the city’s strengths and weaknesses. Mr. Peacock stated that we did not open up warming stations because of COVID and rolling blackouts. Mayor Hollarn stated that the City of Burleson offered assistance wherever we needed it. Councilmember Kidd stated that the City needs to come up with procedures for different issues. Councilmember Kimble stated that the procedures need to have a plan for fuel. Councilmember Fleming asked if we activated the EOC. City Manager Peacock stated no. City Manager Peacock stated that the procedures will be presented to the City Council once completed. 4. Questions regarding Regular Session agenda items. NA E. PUBLIC FORUM, PRESENTATIONS AND RECOGNATION: The City Council invites citizens to speak on any topic. However, unless the item is specifically noted on this agenda, the City Council is required under the Texas Open Meetings Act to limit its response to responding with a statement of specific factual information, reciting the City’s existing policy, or directing the person making the inquiry to visit with City Staff about the issue. No Council deliberation is permitted. Each person will have 3 minutes to speak. 1. Proclamation expressing appreciation to Carla Bonham for her 19-year career with the City of Joshua. Mayor Hollarn stated that Carla Bonham has changed her mind and will remain an employee with the City of Joshua. F. CONSENT AGENDA 1. Consider acceptance of the 2020 Racial Profiling Report submitted by the Chief of Police. (Staff Resource: S. Short) Councilmember Kimble moved to approve the Consent Agenda. Councilmember Fleming seconded the motion. The motion passed unanimously. G. REGULAR AGENDA 1. Discuss, consider, and possible action on Ordinance abandoning and vacating certain prescriptive alleyway as reflected on the February 11, 1914, plat of Redeker’s Addition to Joshua. (Staff Resource: M. Peacock)  Councilmember Fleming moved to approve an Ordinance abandoning and vacating certain prescriptive alleyway as reflected on the February 11, 1914, plat of Redeker’s Addition to Joshua. Councilmember Kidd seconded the motion. The motion passed unanimously. 2. Discuss, consider, and possible action on an Ordinance repealing existing Article 3.03, “Substandard and Dangerous Buildings,” of Chapter 3, Building Regulations,” of the Code of Ordinances and replacing it with a new article 3.03, “Substandard and Dangerous Building”. Peacock) Councilmember Purdom moved to approve an Ordinance repealing existing Article 3.03, “Substandard and Dangerous Buildings,” of Chapter 3, Building Regulations,” of the Code of Ordinances and replacing it with a new article 3.03, “Substandard and Dangerous Building”. Councilmember Kimble seconded the motion. The motion passed. Councilmember Fleming and DePriest voted against. 3. Discuss, consider, and possible action on an Ordinance changing the name of a public road or street in the City of Joshua from Mountainaire Road to Plum Street. (Staff Resource: M. Peacock) Councilmember Kidd moved to approve an Ordinance changing the name of a public road or street in the City of Joshua from Mountainaire Road to Plum Street. Councilmember Kimble seconded the motion. The motion passed unanimously. 4. Discuss, consider, and possible action on an Ordinance amending Article A7.007, “Alcoholic Beverage Permit Fees” of Appendix A, “Fee Schedule” to the City’s Code of Ordinances and replace it with a new Article A7.000, “Alcoholic Beverage Permit Fees to bring in compliance with state law. Holloway) Councilmember Fleming moved to approve an Ordinance amending Article A7.007, “Alcoholic Beverage Permit Fees” of Appendix A, “Fee Schedule” to the City’s Code of Ordinances and replace it with a new Article A7.000, “Alcoholic Beverage Permit Fees to bring in compliance with state law. Councilmember Kidd seconded the motion. The motion passed unanimously. 5. Discuss, consider, and possible action to approve the sale of certain real property acquired at a delinquent tax foreclosure sale; Cause No. T201500028, Lots 1, 2 & 3, Block 16, Original Town Joshua. Holloway) Councilmember Kidd moved to approve the sale of certain real property acquired at a delinquent tax foreclosure sale; Cause No. T201500028, Lots 1, 2 & 3, Block 16, Original Town Joshua. Councilmember Nichols seconded the motion. The motion passed unanimously. 6. Discuss, consider, and possible action on a resolution requesting the Johnson County Constable to sell property to the highest bidder to satisfy delinquent taxes owed to the City of Joshua, Joshua ISD, Hill College, and Johnson County; Cause No. T201400364, 1.35 Acres, J Minett Survey, Abstract 547. (Staff Resource: A. Holloway) Councilmember Purdom moved to approve a resolution requesting the Johnson County Constable to sell property to the highest bidder to satisfy delinquent taxes owed to the City of Joshua, Joshua ISD, Hill College, and Johnson County; Cause No. T201400364, 1.35 Acres, J Minett Survey, Abstract 547. Councilmember DePriest seconded the motion. The motion passed unanimously. 7. Discuss, consider, and possible action on a resolution expressing support of House Bill 1030 in the regular session of the 87th Legislature regarding alternative public notice provisions.  Councilmember Kidd moved to approve a resolution expressing support of House Bill 1030 in the regular session of the 87th Legislature regarding alternative public notice provisions. Councilmember Kimble seconded the motion. The motion passed unanimously. 8. Discuss, consider, and possible action on a resolution expressing support of Senate Bill 131 in the regular session of the 87th Legislative regarding future election dates. Councilmember Purdom moved to approve a resolution expressing support of Senate Bill 131 in the regular session of the 87th Legislative regarding future election dates. Councilmember DePriest seconded the motion. The motion passed unanimously. 9. Discuss, re-consider, and possible action on a Gas Well Setback Waiver Packet and Application filed by Scott Sandlin on October 28, 2019. (Staff Resource: M. Peacock) Councilmember Purdom moved to approve a Gas Well Setback Waiver request and application filed by Scott Sandlin on October 28, 2019. Councilmember Nichols seconded the motion. The motion passed unanimously. 10. Discuss, consider, and possible action on award of bid for the SH 174 Deceleration, Acceleration and Left Turn Lanes for the purpose of furnishing all plants, labor, materials and equipment and the performance of all work required in the construction. Councilmember Kidd moved to award bid and give notice to proceed for the SH 174 Deceleration, Acceleration and Left Turn Lanes for the purpose of furnishing all plants, labor, materials and equipment and the performance of all work required in the construction to Texas Materials Group, dba Texas Bit. Councilmember Kimble seconded the motion. The motion passed unanimously. 11. Discuss, consider, and possible action on board appointments. Councilmember Fleming moved to appoint Kristoffer Maddox to the Heritage Preservation Committee. Councilmember DePriest seconded the motion. The motion passed unanimously. H. EXECUTIVE SESSION The City Council of the City of Joshua will recess into Executive Session (Closed Meeting) pursuant to the provisions of chapter 551, Subchapter D, Texas Government Code, to discuss the following: 1. 1. In Pursuant to Section 551.071, consultation with the City Attorney regarding legal issues associated with agreements pursuant to Chapter 43 of the Texas Local Government Code, and all matters incident and related thereto. J. RECONVENE INTO REGULAR SESSION In accordance with Texas Government Code, Section 551, the City Council will reconvene into regular session and consider action, if any, on matters discussed in executive session.
