CALL TO ORDER AND ANNOUNCE A QUORUM PRESENT Mayor Kimble announced a quorum and called the meeting to order at 6:31 pm. B. PLEDGE OF ALLEGIANCE 1. United States of America 2. Review and discuss questions related to the budget report and financial statement for July 2024. City Manager Peacock presented the budget report and financial statement for July 2024. 2. E. UPDATES FROM MAYOR AND COUNCIL MEMBERS, UPDATES FROM CITY STAFF MEMBERS: Pursuant to Texas Government Code Section 551.0415, the Mayor and Members of the City Council may report on the following items of community interest, including (1) expressions of thanks, congratulations, or condolences; (2) information about holiday schedules, (3) recognition of individuals; (4) reminders about upcoming City Council events; (5) information about community events; and (6) announcements involving any imminent threat to public health and safety. Staff Updates will address operational issues in various City departments. No deliberation is authorized under the Texas Open Meetings Act. Mayor Kimble stated that he attended the Johnson County Settlers Festival and it was great seeing one of our firemen and police officers being honored. Councilmember Kidd gave a brief update regarding the Animal Control Advisory Board. Councilmember Kidd stated that the current staff gave a great update on the status of the shelter. F. PUBLIC FORUM, PRESENTATION, AND RECOGNITION: The City Council invites citizens to speak on any topic. However, unless the item is specifically noted on this agenda, the City Council is required under the Texas Open Meetings Act to limit its response to responding with a statement of specific factual information, reciting the City's existing policy, or directing the person making the inquiry to visit with City Staff about the issue. Therefore, no Council deliberation is permitted. Each person will have 3 minutes to speak. Badge Pinning Ceremony was conducted for Newly Pointed Fire Chief Jay White. Interim Chief Fullagar introduced two new police officers, Officer Dylan Mansell, and Erick Villalobos. 1. Proclamation recognizing September 17-23, 2024, as Constitution Week. Mayor Kimble read out loud and presented Betsy Ruffin with a proclamation regarding Constitution Week. 2. Proclamation of appreciation to Brookshire’s Grocery Store for their Community Support and Generosity. Mayor Kimble read out loud and presented Michael Morrison with a proclamation acknowledging Brookshires for their donations to the City. 3. Presentation on the Johnson County's Transportation Bond. Johnson County Public Works representatives gave a brief presentation regarding Johnson County's Transportation Bond. The following topics were discussed:  Overview of the Bond Proposal: Key objectives and planned initiatives.  Financial Breakdown: Costs, funding potential, and economic impact.  Implementation Timeline: Expected milestones and project phases. G. CONSENT AGENDA 1. Discuss, consider, and possible action on the August 15, 2024, meeting minutes. Motion made by Councilmember Waldrip to approve the minutes as presented. REGULAR AGENDA 1. Discuss, consider, and possible action on an Ordinance approving the annual budget for the fiscal year beginning October 1, 2024, and ending September 30, 2025. (Staff Resource: M. Peacock) City Manager Peacock presented a handout with corrections to the budget in the packet. Mr. Peacock stated that the handout includes the proposed rates for other Johnson County cities. Motion made by Councilmember Kidd moved to approve an Ordinance adopting the annual budget for fiscal year 24-25. Seconded by Councilmember Marshall. Voting Yea: Mayor Kimble, Councilmember Waldrip, Councilmember Kidd, Councilmember Nichols, Councilmember Breitenstein, Councilmember Marshall, Councilmember Anderson 2. Discuss, consider, and possible action on ratifying the property tax increase in the budget for fiscal year (FY) 2024-2025. (Staff Resource: M. Peacock) Motion made by Councilmember Waldrip to ratify the property tax increase. Seconded by Councilmember Kidd. Public hearing on a proposal to adopt the Ad Valorem Property Tax Rate for Tax Year 2024. (Staff Resource: M. Peacock) Mayor Kimble opened the public hearing at 7:32 pm. No comments were made from the public. Mayor Kimble closed the public hearing at 7:33 pm. 4. Discuss, consider, and possible action on an Ordinance adopting the City of Joshua 2024 Ad Valorum Property Tax Rate. (Staff Resource: M. Peacock) Motion made by Councilmember Anderson to approve an Ordinance adopting the 2024 Ad Valorum Property Tax Rate. Seconded by Councilmember Marshall. Discuss, consider, and possible action on an Ordinance amending the FY 2024 budget. (Staff Resource: M. Public hearing on a request for a Conditional Use Permit regarding approximately .62 acres of land in the E.H. Eddleman Subdivision, County of Johnson, Texas, located at 109 Oak Street, to allow for the construction of an accessory dwelling. (Staff Resource: A. Maldonado) Mayor Kimble opened the public hearing at 7:35 pm. The Planning & Zoning Board recommended approval with the following stipulations at the September 3rd meeting. Said accessory dwelling unit shall be subject to the following terms and conditions: 1. The accessory dwelling unit must be used by the same person or persons of the immediate family as the main dwelling. 2. The accessory dwelling unit must be constructed to the rear of the main dwelling, separate from the main dwelling. 3. The accessory dwelling unit may be constructed only with the issuance of a Building Permit and shall be constructed out of the same material as the main dwelling. 4. The accessory dwelling unit may not be sold separately from the sale of the entire property, including the main dwelling, shall not have a separate electric meter, and shall not be sublet or otherwise utilized as a short-term rental. 5. dwelling. EXECUTIVE SESSION The City Council of the City of Joshua will recess into Executive Session (Closed Meeting) pursuant to the provisions of Chapter 551, Subchapter D, Texas Government Code, to discuss the following: 1. Pursuant to the Texas Government Code, Section 551.071, consultation with the City Attorney regarding legal advice and issues associated with the Emergency Services District and all matters incident and related thereto. 2. Pursuant to the Texas Government Code, Section 551.071, consultation with the City Attorney regarding legal advice and issues associated with the Johnson County Special Utility District and all matters incident and related thereto. Mayor Kimble announced recessing into the Executive Session at 7:53 pm. K. RECONVENE INTO REGULAR SESSION In accordance with Texas Government Code, Section 551, the City Council will reconvene into regular session and consider action, if any, on matters discussed in executive session. Mayor Kimble reconvened into Regular Session at 8:36 pm. No action taken. Mayor Kimble returned to item H12. L. FUTURE AGENDA ITEMS/REQUESTS BY COUNCIL MEMBERS TO BE ON THE NEXT AGENDA Councilmembers shall not comment upon, deliberate, or discuss any item that is not on the agenda.
