COUNCIL MINUTES February 5, 2024 The City Council of Knoxville, Iowa, convened in regular session on Monday, February 5, 2024, at 6:15 p.m. at the Knoxville Municipal Building Council Chambers. Mayor Hatch presided, and the following Council Members were present: Megan Day, John Gotta, Dylan Morse, Dawn Rankin, and Bridget Mohler. Staff present were City Manager Heather Ussery, City Clerk Jodie Wyman, Fire Chief Cal Wyman, Police Chief Aaron Fuller, Water Reclamation Supervisor Patrick Murphy, and Planning and Zoning Director Nathan Parch. Motion by Gotta, seconded by Rankin, to approve the consent agenda; all ayes. 1. Approve City Council Minutes from January 15, 2024 2. Accept Library Board Meeting Minutes from January 16, 2024 3. Approve December 2023 Financials 4. Approve Class E Retail Alcohol License for Kline’s Quick Time 5. Resolution to Approve Tax Abatement Application for the New Construction of a Single-Family Dwelling at 501 S Sixth Street in Knoxville, Iowa 6. Approve Change Order #8 from C.L. Carroll for the Water Reclamation UV Disinfectant Project Mayor Hatch administered the Oath of Office to Officer Jordan Babcock. Mayor Hatch administered the Oath of Office to Deputy Chief Trenton Bacus. Mayor Hatch announced now was the time and place for a public hearing to approve the contract, bonds, and certificate of insurance for the 2023 Street Improvement Project. The hearing was opened at 6:22 p.m., and an affidavit of publication was filed on January 26, 2024. There were no written or oral comments or objections. Motion by Rankin, seconded by Mohler, to close the hearing at 6:24 p.m.; all ayes. Motion by Gotta, seconded by Rankin, to approve a resolution accepting the bid, awarding the contract, and approving the certificate of insurance from Sternquist Construction, Inc. for $3,061,650.50 for the 2023 Street Improvement Project. The motion passed all ayes. Motion by Day, seconded by Morse, to approve a service contract between the City of Knoxville, Iowa, and Veenstra and Kimm, Inc. for building inspection services. The motion passed all ayes. Motion by Day, seconded by Morse, to approve a resolution accepting easements for Terrace View Knoxville, LLC, in the City of Knoxville, Iowa. The motion passed with all ayes. Motion by Morse, seconded by Day, to approve the first consideration, waive second and third considerations, and adopt an ordinance amending the Code of Ordinances of the City of Knoxville, Iowa, by amending provisions pertaining to the speed limit on Attica Road. The motion passed all ayes. Motion by Morse, seconded by Gotta, to approve the demolition bid for 314 W Robinson from Cushman Excavation for $11,300. The motion passed all ayes. Motion by Morse, seconded by Rankin, to approve a resolution approving the union contract. The motion passed with all ayes. City Manager Heather Ussery presented the Administration, Planning and Zoning, and Fire Department Fiscal Year 2024-2025 Recommended Budgets to the Council. Department leaders were in attendance and answered Council Member questions. No action was taken by Council. City Manager Ussery: Knoxville has been announced as an overnight town for this year’s Ragbrai. We are trying to get information out to the community through the Chamber’s Office as it becomes available. The staff has been meeting with Wendel bi-weekly during the schematic design phase of the new public safety building. Happy Birthday to Mayor Hatch. Fire Chief Wyman: Today was a bittersweet day at the fire station. While we celebrate the promotion of Deputy Chief Bacus, we also celebrate the retirement of Battalion Chief Justin Smith today. Police Chief Fuller: Testing is scheduled for February 17th. We received fifteen applications this round and have invited twelve to test for the two open positions at the Knoxville Police Department. Planning & Zoning Director Parch: The Board of Adjustment met on January 24, 2024, to approve the requested variances needed to construct the new suite tower at the Sprint Car Hall of Fame. The process can now proceed with architectural design planning. The Planning and Zoning Commission met last week to review the proposed amendments for the Commercial District Code Sections. With the continued progress, the hope is to bring the code section to the Council for review and approval in March. Motion by Day, seconded by Gotta, to adjourn to closed session according to Section 21.5(c) Litigation of the Iowa Code at 7:14 p.m.; all ayes. Motion by Rankin, seconded by Mohler, to reconvene in an open session at 7:46 p.m. Motion by Day, seconded by Rankin, to direct staff to proceed with a breach of contract notice to C.L. Carroll. The motion passed with all ayes.
