Village of Kohler Village Board Meeting August 21, 2023 Village President Thomas Schnettler called the meeting to order at 6:00 p.m. Roll call was taken: Tom Schnettler, John Winter, Mike Zimmermann, John Ewert, Jason Kwacz, Michael Wandschneider (by phone) and Brett Edgerle were present. Staff members present: Mike Kitzerow and Laurie Lindow. Items of Concern Regarding the Agenda, Including Public Comment – None. Approve Meeting Minutes from July 17 and August 14, 2023 – Motion by Mike Zimmermann, second by John Winter to approve meeting minutes from July 17 and August 14, 2023. Motion carried. Business 1. Appointment of Samuel Melei as Municipal Court Judge for City of Sheboygan/Village of Kohler – The City of Sheboygan Human Resources Department handled the hiring process for a Municipal Court Judge. Attorney Bauer and Shawn Splivalo represented the Village in the process. Motion by Tom Schnettler, second by Brett Edgerle to approve the appointment of Samuel Melei as Municipal Court Judge for the City of Sheboygan/Village of Kohler. Motion carried. 2. Discuss and take action on waiver application – Restricted Number of Dog or Cats for Joyce Rindt, 849 Briarwood Court – An application was filed by Joyce Rindt, 849 Briarwood Court to allow three dogs at her residence. Motion by Tom Schnettler, second by Jason Kwacz to approve the waiver application. Brett understood that all adjacent neighbors had to approve of the waiver in order to have the Village Board take action. The prior ordinance requested neighbor’s approval prior to Village Board consideration. The ordinance was changed so that neighbors were notified of application and the opportunity to voice concerns at the Village Board meeting when the application was considered. Motion carried, but not unanimously. 3. Discuss and take action on waiver application – Restricted Number of Dog or Cats for Tom and Anna Teaters, 212 E. Park Lane – Tom Teaters attended the meeting an indicated that one of their dogs is in bad health and granting the variance would be a moot point. Motion by Tom Schnettler, second by Brett Edgerle to table the waiver application. Motion carried. 4. The Finance Committee recommends the Village Board take action on the following: a. Temporary Class B beer license for Kohler Police Athletic League for Oktoberfest Beer Run on September 9, 2023 – Motion by John Ewert, second by Jason Kwacz to approve Temporary Class B beer license for Kohler Police Athletic League for Oktoberfest Beer Run on September 9, 2023. Motion carried. b. Ordinance No. 2023-6, An Ordinance Amending Section 11.18.010 F1. Of the Municipal Code of the Village of Kohler, Sheboygan County, Wisconsin, To Expand 15 MPH Speed Restriction Zone – Motion by John Ewert, second by John Winter to approve Ordinance No. 2023-6, An Ordinance Amending Section 11.18.010 F1. Of the Municipal Code of the Village of Kohler, Sheboygan County, Wisconsin, To Expand 15 MPH Speed Restriction Zone. A roll call vote was taken: John Winter – aye, Mike Zimmermann – aye, John Ewert – aye, Jason Kwacz – aye, Mike Wandschneider – aye, Brett Edgerle – aye. Motion carried.  c. Memorandum of Understanding Between the Kohler Police Association Local 316, Labor Association of Wisconsin and Village of Kohler – Motion by John Ewert, second by John Winter to approve Memorandum of Understanding Between the Kohler Police Association Local 316, Labor Association of Wisconsin and Village of Kohler. Motion carried. d. Installation of fiber and data at Memorial Hall at a cost of $2,982.50 – Motion by John Ewert, second by Mike Zimmermann to approve installation of fiber and data at Memorial Hall by Specht Electric at a cost of $2,982.50. Motion carried. e. Implement residential permit parking for Church St. (School St. to Orchard Rd.) and School St. (E. Park Ln. to Church St.) – The new school parking lot was designed to handle all drop off/pick up traffic on the north side of the school. Parents continue to drop off/pick up on School and Church Streets causing unsafe conditions. To increase safety on School Street and Church Street around school, signs would be posted making the area a no parking zone stating “no standing, stopping or parking during school hours of 7:30-3:30”. This would also address resident concerns in this zone and residents would be issued parking permits to park in this zone. A resident’s visitors could also be permitted by contacting the Police Department. Tom Schnettler is concerned that the parking restrictions may need to be extended to Orchard Court, School Street to Highland and Church Street south of School Street. Chief Splivalo has the authority by police action to make street areas no parking zones. These changes need to be implemented prior to the beginning of the school year, announced in the Kohler Villager and formalized by ordinance. Motion by Jason Kwacz to table, the motion died due to no second. Motion by John Ewert, second by John Winter to approve implementing residential permit parking for Church Street and School Street as Chief Splivalo directs. Motion carried, but not unanimously. f. Approve appointment of Shawn Deiter, Green Bay Insurance Center as agent for employee benefits for the Village of Kohler – Motion by John Ewert, second by Michael Wandschneider to approve appointment of Shawn Deiter, Green Bay Insurance Center as agent for employee benefits for the Village of Kohler. Motion carried. g. July Revenue & Expense reports, bank reconciliations and journal entries – Motion by John Ewert, second by Michael Wandschneider to approve July Revenue & Expense report, bank reconciliations and journal entries. Motion carried. h. Fill Open Police Officer position – Motion by John Ewert, second by John Winter to approve filling open police officer position. Motion carried. 5. The Property Committee recommends the Village Board take action on the following: a. Quote from Gerhartz Decorating for painting in the Village Hall for $14,167 – Motion by Jason Kwacz, second by Mike Zimmermann to approve quote from Gerhartz Decorating for painting in the Village Hall for $14,167. Motion carried, Tom Schnettler abstained. b. Five-year trash and recycling contract with Waste Management of Wisconsin,  Inc. – Motion by Jason Kwacz, second by John Winter to approve five-year trash and recycling contract with Waste Management of Wisconsin, Inc. A recycling grant is received annual for approximately $7,500. Tom Schnettler asked about the liability of mixed garbage/recyclables picked up. The vendor is responsible for contents disposed of. An article should be included in the Kohler Villager to remind residents to recycle. Motion carried. c. Reimbursement for Randall and Judith Hake, 221 Woodlake Road, the cost for changing address stone, cost not to exceed $1,185 – Four residents on Woodlake Road were assigned 200 block house numbers out of sequence during the ‘90s. The Clearings subdivision also had 200 block house numbers assigned and we have four duplicate addresses. The resident at 221 Woodlake Road had an address stone and has been asked to change their address. Motion by Jason Kwacz, second by John Winter to approve reimbursement for Randall and Judith Hake, 221 Woodlake Road, the cost for changing address stone, cost not to exceed $1,185. Motion carried, not unanimously. 6. Update on Pool Renovation Project – Mike reported that the renovation of the locker rooms is 95% complete. After Labor Day weekend, phase II consisting of repair of the roof structure will begin. The pool structure will need to be weather-tight by November 23 with completion of phase II by May 2024. 7. The Tourism Promotion & Development Committee recommends the Village Board take action on the following: a. 2023 Kohler Villager for Destination Kohler - $5,400 b. 2022 Community Christmas Tree - $5,000 c. Village Fireworks and Fourth of July Celebration, July 4, 2023 - $23,995 d. 2023 Kohler Classic 5K/1 mile run/walk - $3,191.50 e. 2023 Kohler Holiday Arts & Crafts Fair - $6,500 f. Replacement of American flags and poles - $6,270 g. Purchase metal picnic tables - $5,520 h. 2023 Kohler Food & Wine - $100,000 i. 2023 Destination Kohler media plan – Not to exceed $700,000 The total of the proposed Tourism projects is $855,876.50. Motion by Tom Schnettler, second by Brett Edgerle to approve proposed projects for $855,876.50. Motion carried. 8. Discussion of a four-way stop at Church Street and School Street – The school district superintendent and a parent representative requested that a four-way stop be added at Church and School Streets for enhanced safety. Motion by Jason Kwacz, second by Mike Zimmermann refer to Finance Committee to draft an ordinance. Motion carried, but not unanimously. 9. The Village Board may convene into closed session pursuant to Wis. Stat. Sec. 19.85 (1) (g) to confer with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved – Motion by Tom Schnettler, second by Mike Zimmermann to convene into closed session pursuant to Wis. The Village Board  convened into closed session at 6:42. 10. The Village Board will reconvene into open session for possible Village Board action to authorize a cross-appeal to the Wisconsin State Board of Assessors – Motion by Mike Zimmermann, second by Jason Kwacz to reconvene into open session at 6:55. Motion by Tom Schnettler, second by Brett Edgerle to approve Resolution No. 2023-17 authorizing the Village Attorney to cross-appeal personal property tax objections. Motion carried.
