SPECIAL EVENTS: 1) Application # 2015-0049, Library/WOW Trail New: Walk to Promote Library & WOW Trail Usage K. Dunleavy said this is a walk to promote awareness for the Library. They walk from the Library to the Goss Reading Room and usually have less than 100 people. Bathrooms are available inside. This is on May 16, at 10 am. Roffo seconded and all voted in favor of approval, 7-0. 2) Application # 2015-0053, 208 Lakeside, Fishing Derby Renewal: Weigh Station for Fishing Derby The proposal is the same as last year. All voted in favor of approval, 7-0. 3) Application # 2015-0055, 264 Lakeside, Tower Hill Renewal: Wrestling Show S. Saunders pointed out that the event has already happened. M. We will check with Nancy Brown on a traffic order. K. Dunleavy said there could be a potential issue with the route with the current traffic pattern on Main St. John Moriarity said an order was done with Little League and Ken Erickson said he will contact the applicant regarding the route. Dunleavy moved to approve Application # 2015-0066, adding the condition that the traffic order will be submitted if required. C. Roffo seconded and all voted in favor of approval, 7-0. 5) Application # 2015-0057, Main St Parking Lot Renewal: Farmers Market 6/4 – 9/24 C. Roffo said that the application will need Scott Myer’s signature. K. Snow will take care of that. J. Rogato asked if the proposal only includes this location or other locations in the area of Pleasant and Main Streets. He asked if this includes any entertainment and John Moriarity said they had no real entertainment last year. J. Rogato said if they have entertainment they need a loudspeaker permit and J. Moriarity said then they will have no entertainment this year. K. Dunleavy asked if there could be potential issues with the parking lot being utilized with the new businesses here this year. S. Saunders asked J. Moriarity if the entire parking lot is used and he said they use about a third of the parking for the market. They have already reached out to abutters. They are ending the market at 6 pm this year to accommodate them. The rest of the parking lot remains open. S. Saunders asked if the new business owner have any issues with the market and J. Saunders asked if this is a new proposal and Pastor John Sanborn said this will be their 6th year for the event. They already have permission from Parks and Rec per K. Dunleavy. Roffo. All voted in favor of approval, 7-0. 7) Application # 2015-0079, 1182 Union Ave, Cactus Jack’s New: Two Vendors for Promotion Jay Bolduc appeared and said this is a new request. This is a promotional event with Bullitt Bourbon. They will have a trailer and want to put up 2 tents. S. Saunders reminded him they need an extension of their liquor license and J. Bolduc said they have working with the liquor commission on this already. S. Saunders asked about any parking issues and J. Bolduc said they don’t anticipate any. This is an extension of their business with entertainment. H. Young said they got their loudspeaker license. Public: No one from the public spoke for or against the proposal. Motion: M. If the applicant does not attend that meeting, the application will be considered withdrawn for the year 2015. Kristine Snow is to notify the applicant of what has occurred. It was decided to take the applicants who are in attendance at the meeting next. Those are applications # 19, 20 (Lobster Pound), 21 (38 Endicott N), 23 (8 Lakeside), 24 (Donna Jean’s) and 25 (Drive In). The fire house is still in use. We will need a new plan for next year. He said to move them to the grass area. Public: No one from the public spoke for or against the proposal. Motion: M. Canfield moved to approve Application # 2015-0068 with the same conditions and adding that a new plan should be submitted. S. Steve McCusker asked if the issue with the food vendor had been resolved and was told that the City Council determined that they had no control over this. All voted in favor of approval, 7-0. 18) Application # 2015-0070, 13 Andrews Ave Renewal: Parking, Up to 50 The proposal is for parking and is the same as in the past. All voted in favor, 7-0. 19) Application # 2015-0071, 97 Endicott N, Lobster Pound Renewal: Parking The proposal is the same as last year, per Bob Wilson, with no changes. K, Dunleavy asked about the temporary RV sites. Are these all self-contained units or is there sewer? He was told they are self-contained and removal is available daily. They have water and electricity. S. Saunders said that some of these sit on the property all year. B. Wilson said one is for use during Bike Week by someone who comes up from Florida and the other is his personal one which he stays in during Bike Week. S. Saunders reminded him that ordinance says they have to be screened or removed. She explained fencing or plantings. He said that moving them would entail leveling but he would see that something is done. 20) Application # 2015-0072, 70 Endicott St N, Lobster Pound Renewal: Vendors, 70 Bob Wilson appeared for the application and said this is the same as last year. He was asked if he is aware of the drive in’s proposal and said yes. He was asked if they were going to have the “jumping pillow” again this year and said no. He said he forgot to check the box for the dyno-tuner but they are coming back. That is usually in the back area; last year it was in spot 56. This year they are moving to spot 59 because of pedestrian access. K. Erickson asked if that is adjacent to Route 3 and was told it will start along Route 3 and go up through 59, 60, and 61. The neighbor parks cars during the event so there should be no noise issues as they should stop by 8 or 9. K. Erickson said he parks next door until closing but if there are any issues to go see them. S. McCusker asked about vendor 60. Last year the trailer backed right up to the panel, and he was told they are making that area a bit wider, which should leave a 10 ft space. C. Roffo said, on the upper property, this is dovetailing with the concert, so they may need to coordinate here. Vehicles could be tight here. He was told that by site 38 they are widening the area by 10 ft and are going to tar that area. # 52 will move as well. 21) Application # 2015-0073, 38 Endicott N Renewal: 65 Vendors Mike Trainor and Jon Rokeh appeared. This is a completely new plan. J. Rokeh said this is the old Wide Open Saloon site, which has been all cleaned up. The site is now flat and level. Vendors # 1-19 will back up to the theater entrance and will vend into site. All will be internal. He was asked about the width on V62 and said it was more than 22’. The only vehicles entering the site will be for trash pickup and to empty the porto-potties and that will be done during off- hours. The larger tents will be placed up front with all sites having a 5 ft gap between the sites to run cords. That area will not be open to pedestrians; it is just for utilities. Gary Nowicki will be running the site this year. K. Erickson asked if the site is being brought up to grade and was told yes, they are working on it now, levelling it now. K. Erickson said it looks nice. S. Saunders asked about fencing and J. Rokeh said he thinks that Pat Baldi is doing that but if not, Al Mitchell is going to. He said it is supposedly done now, chain link. Plantings are all gone. There is straight access to the sidewalk so the 22’ wide is not the actual in/out. People could potentially walk straight in by 60, 61, and 62 could walk straight in and possibly by toilets, so they could do some sort of fencing to keep people out. Those 3 can vend towards the street. They are 3 sided, vending is forward, and you can’t get through at all. S. Saunders said maybe they could ask the vendors to open up or would it make sense to funnel them. K. Erickson asked about vending here, and M. Canfield said that the Lobster Pound does this now, as well as the water slide. J. Rogato said these are not right on the sidewalk, probably at least 10’ back. S. Young said she took a call from a vendor saying he was doing 2 food spots; is this all food? J. Rokeh said no and that Gary Nowicki is handling the vendors but they all know that all of the proper permits need to be in place. Public: Charlie St Clair said he spoke with Al Mitchell and he said that he is going to be putting up the fence, not Pat Baldi. J. Rokeh said one way or the other fencing will be in place. Motion: M. Canfield moved to approve Application # 2015-0073, with all of the standard conditions of approval as well as adding requirements that the solid waste and sanitary sewer contracts must be submitted by June 1, as well as the escrow agreement with the City. WE will also add that events can be held from Saturday, June 13 – Saturday June 20. The final signed/engineered plans will be submitted to the City by Friday, May 8, 2015. K. Dunleavy seconded and all voted in favor of granting temporary approval, 7-0. 22) Application # 2015-0077, 691 Endicott, Tamarack Renewal: Parking, up to 50 The proposal for parking is the same as in the past. Public: No one from the public spoke for or against the proposal. Motion: C. Roffo moved to approve Application # 2015-0077 with the same conditions as previous. M. Canfield seconded with all voting in favor of approval, 7-0. REVISED: 23) Application # 2015-0062, 8 Lakeside (Water Slide) Revised: Up to 50 Vendors, Up to 100 Vehicles (Parking) Larry Chesley appeared. He said this is his first time handling the site, but he has been food vending for years. This is identical to what was done before. They are not using the interior. He asked if they could put an office trailer at the top, where the site is flat, and S. Saunders said she didn’t think that was an issue. She asked if the electricity is temporary up there and was told it is permanent in that area. They will hook up to that. There is no restroom in the trailer and porto-potties are on site. Parking at the top of the site. K. Erickson said there have been issues with private parking on this site. He said the Hell’s Angels park on the top of the hill and tell others they can’t park there. L. Chesley said he was not aware of that and will deal with it. S. Saunders said electrical cords used to be an issue and L. Chesley said he has already had boxes made and they will be all hooked up; Brian Weeks is handling that. They will have specific hookups. S McCusker asked where lower area is powered from and was told from behind the pink building. He reminded L. Chesley not to use the second floor and L. Chesley said he is having that looked at that, and said they might have to use some but hopefully not. S. McCusker said he will do an inspection. They plan to use just the just downstairs on the 200 amp. C. Roffo asked about property owner signature and K. Snow let the members know she has an e-mail in the file. C. roffo seconded and all voted in favor, 7-0. 24) Application # 2015-0054, 1208 Weirs, Donna Jeans Revised: 5 Vendors, Parking Under 50 Allan Milliard appeared and said that the plan is for parking and vendors. This will be paid parking, the same as usual. S. Saunders asked if the restaurant will be open and was told yes. She said that the patrons of the restaurant park for free. She asked about the dumpster and was told it is off to the right side of the building. S. Saunders asked about the parking area in the rear, will someone be attending the site so they know where to park? She was told yes. She asked about speakers in the back and said that they currently exist and are used now to pipe music in. Erickson said he doesn’t feel this is regulated by the loudspeaker ordinance as this is more like a stereo system. He said they can discuss this more at Licensing and make sure if all are in agreement. This plan reverts to a layout like they used some time in the past. There were no issues with that. NEW: 25) Application # 2015-0063, 76 Endicott, Drive-In New: Up to 50 Vendors; Parking, Over 50 Boxing; Concerts Mike Trainor appeared along with Jon Rokeh. He said while these are revised plans they are not the final ones; those are in process now and he expects them today/tomorrow. J. Rokeh said he just did the changes this morning and that he and Jeff Murphy have been in discussions on this for a while now. S. Saunders asked where the emergency exits are and J. Rokeh showed them on the plans. They will have the one by Thurston’s and are trying to nail down the exact location, but it will be near beer tub # 10. He showed the breaks in the fence where people will man exits. They spoke to Don Thurston, and to Rich from the Lobster Pound. These are just gates for public safety and ER access per K. Erickson, to remove people quickly if needed. S. Saunders asked if the egress to Thurston’s may require land upgrades and was told there are no busses coming in at all. Limos will come in, one way, and they are leaving two lanes for that; there is a VIP route. M. Canfield showed an area where he wants another temporary access. J. Rokeh asked if that is for public or ER access. M. Trainor said said there will be at least a 20 ft opening, so people can get out the VIP if needed. 25-30 ft is approximated. There will be on site security and they will get copies of the contracts after this get approved. M. Canfield said when revising the plans to show fencing that runs from stage to production. He was told it was already there and J. Rokeh showed how it will run. S. Saunders asked who the security company is and M. Trainor said he is not sure yet, they use a few different ones. M. Canfield said we need that by June 1, latest, along with their credential system. S. Saunders asked if they have been in touch with the liquor commission and M. Trainor said not yet. They will do after this approval. They will talk with LPD on that, too. Schedule at this point is Thursday, Friday, Saturday. Thursday they estimate between 10-15 thousand. Friday was boxing, but there is a training issue, so possibly another concert, up to 20 thousand. Saturday is the big one, and they expect about 30 thousand people. He wants to do Wednesday but the investors are saying no at this point. S. Saunders said go ahead and approve now and if they don’t do it, that is fine. Coming back after could cause issues. M. Canfield said again, we need an answer by June 1. K. Erickson asked if they plan to do pre-ticket sales and was told yes. Hopefully that will be done by June 1. After they get through this process they will finish up contracts with bands, which allows about 3 weeks for sales. K. Erickson asked about tickets at the gate and was told they plan to hold a few back but do think the big one will sell out that night and let people know in advance. K. Erickson asked if that would be via text or e-mails and was told it would be in real time. They can do traffic alerts as well. 2 ticket booths are shown, and they are going to check bags as well. S. Saunders asked if 2 booths are sufficient without queuing to the street and beyond and M. Trainor said he feels it will be enough as each booth will have 2-4 people. They will probably already have their ticket so they can move right through. There will be no dogs, no bags, and no backpacks allowed in. S. McCusker about turnstiles and was told no. K. Erickson asked if these are hard numbers from Jeff Murphy and was told yes, they are estimates but they are trying to get even closer. They said it is an option if the land is just sitting there. It would be on the pavement since nothing would be going on. The vendors would be open the entire time. The ones inside will be open during the event only. H. Young said she will need the permit. M. Trainor said there will be no going in/out of venue, so if want food they would have to purchase inside here. K. Erickson asked about liquor, as he thought that a certain amount of the liquor sales have to be food and M. Trainor said never had to do that. C. Roffo said that the Lobster Pound extends theirs off their regular license but there is no restaurant here to extend. H. Young asked about the ATM’s. Are they theirs or vendors and M. Trainor said he was not sure yet. He will check in with H. Young when he finalizes that. S. Saunders asked what type of fence and was told chain link, heavy duty. She asked if they don’t care if people can see in and was told just where the dressing rooms are. That will be slotted. C. Roffo asked about vendors 1-20 and said he needs to see the engineered plans. Right now that has an egress capacity of 5 thousand; that is why the engineer is involved. S. Saunders said we need the final plan or we can go ahead and approve this today with contingencies. J. Rokeh said they are close now; it might be tomorrow, but definitely within the next few days. It was determined they will submit the final plans by Friday. M. Canfield said he needs this ASAP. K. Erickson said he feels we can make the approval today contingent upon the anticipated plans and if don’t get them, we just revoke this. K. Erickson said he has been working with Mike Trainor behind the scenes for 2 months. He said he doesn’t know him but he has done everything he has said he would so far. M. Canfield said he is good with that. C. Roffo said that the exit going across the Lobster Pound property needs to be calculated the entire way to Endicott St N and to show that on the plan. S. Saunders asked about contracts with the city on police coverage and M. Canfield said they had discussed that. M. Trainor said the investors will pay 50% now and 50% the first day so it will be paid in full before the event. We need that contaract by June 1. C. Roffo said that Jeff Murphy knows the plan has to bear his stamp. K. Erickson said he spoke with the property owners and they are waiting on this approval. They will have bus routes set up as well as parking areas. S. Saunders said we can do one more meeting and get the coordinated plan to get everyone on board. She asked if we can do this by June 1? We will have all of the contracts and the escrow by then. C. Roffo asked where Baldi’s house is on the map and was told that the 30 x 90 structure is his. The residents will have access to the property. (J. Rogato left the meeting at 1 pm) S. Saunders asked about having temporary lighting at the exits and at the porto-potties, too. She was told if there is an emergency the stage lights will light this entire area up. We will also put at egress through the Lobster Pound. There are diesel fueled generators. S. McCusker said they are self-contained. Public: Charlie St Clair asked about the Wednesday night event. If they want a band in there the first Saturday is that covered by this approval and was told no. M. Trainor asked if he can ask for the entire week now and was told yes. He will ask for Saturday through Saturday, which will simplify the request. He said he should know the final details before June 1 and will use that as a cut off. C. Roffo asked if that will cause an adjustment to the escrow and M. Canfield said he should be ok. K. Erickson asked C. St Clair a question on fireworks during bike week. C. St Clair said he thinks he put in for Wednesday with a rain date of Thursday, then Friday. The time is 10 pm. The permit is in his car to be signed so that will be done soon. Bands will be done at 12 or before. She asked who the bands are and was told they cannot tell yet but they are large, national bands. Jeff Murphy is the fire protection engineer with SFC Engineering. Larry Chesley mentioned the length of licensing for food vendors here and H. Young said that all vending is done by 12:30. L. Chesley said he was told they had to close at midnight, and had issues in the past. L. Chesley said he thinks that time should be extended; people leave this event, have been drinking and need food. K. Erickson said that is a good point. M. Canfield said the ordinance states this and S. Saunders said the City Council would have to extend that. G. Ober asked how long they anticipate it will take for a routine night to empty of 30 thousand people and was told that the bands will stagger, food vendors will stagger. The new plans will show that. L. Chesley asked how they can extend the vending hours and was told they have to go to City Council. He asked if we can get that done just for Bike Week and S. Saunders said that we would have to do this quickly. K. Erickson let M. Trainor that there are no pyrotechnics allowed for the bands and M. Trainor said they don’t want them. Motion: M. Canfield moved to approve the application, with all of the usual conditions of approval, and adding that the revised, stamped plan must be submitted by May 8. The contracts for porto-potties, and waste pickup will be submitted by June 1, along with the escrow agreement. A final meeting will be determined. K. Saunders let the committee know that this just came in this morning for Motorcycle Week. The proposal is the same as past years, for parking. This is pretty set back. They are also applying for fireworks, class c. K. Erickson said he is good to go. H. Young asked who we consider an exhibitor and was told not class c. K. Erickson said class c can go without a permit. H. Young said if they don’t require a firework permit she will return the money to Lyman’s. Motion: K. Erickson moved to approve the loudspeaker with M. Erickson seconded with both voting in favor of approval, 2-0. Edward Jones Downtown: They want to do door to door financial services. M. Canfield said they will need to do background checks, and they need a license. H. Young asked if there are any other questions to ask them and was told to let them know they need to have a visible ID, and wear a shirt stating the business. Make sure they get their itinerant license and have adequate ID’s. Taxi driver: Daniel Carroll got arrested for DWI with kids in his car. H. Young asked if we should pull his taxi license. The chapter says you have to be convicted. M. Canfield said he feels we should wait for a conviction. K. Erickson said this is all hear-say at this point. He needs a job in order to get help so he feels we should wait. Craigs Taxi: H. Young said we have had complaints. They have only one vehicle, but that insurance isup to date. If you see them in any other vehicle, it has no insurance. H. Young let the members know that the Pawnbroker Ordinance was approved by the City Council. K. Butler said that 18 shops are now being regulated. K. Erickson wondered if we are giving them a time frame to come into compliance? He said he felt we should. K. Butler said he wants to have a few of the part time summer people go in and talk to the businesses to explain and also do a press release. H. Young said she will need a copy of the list and who is going to contact them. M. Canfield said will put K. Butler in touch with H. Young. K. Erickson said fees can be pro-rated. We will do a form letter and send out. H. Young asked if this should be done by June 1 or July 1 and M. Canfield said July 1. He will talk to K. Butler on this.
