CITY OF LACONIA PLANNING BOARD 6:30 PM City Hall - Armand A. Bolduc Council Chamber Draft Minutes 9/3/2024 - Minutes 1. CALL TO ORDER C. St Clair called the meeting to order at 6:31pm. 2. ROLL CALL The following members were in attendance; Brian Wolf, Gail Ober, Rich MacNeill, Councilor Bruce Cheney, Mike DellaVecchia, Chairman Charlie St. Clair, and Amy Lovisek. 3. Ober motions to accept the minutes from the previous meeting, A. Lovisek seconds. All in favor, passed unanimously. 5.I. Planning Board August 6, 2024 Minutes 6. CONTINUED PUBLIC HEARINGS, CONSIDERATION, AND POSSIBLE VOTE 6.I. PL2024-0070; 1921 Parade Rd (290-155-9) A. Lovisek motions to accept application PL2024-0070, seconded by G. Ober. All in favor. S. Whearty from Dubois & King and Louis Tomasello were present to summarize the application. There was discussion about the Snowmobile trail that is on the property. The public hearing started at 6:56pm. Mary & Jim Labonty came to speak as a testimonial abutter and expressed concerns about drainage issues. the snowmobile trail easement and the fence proposed. The public hearing was closed at 7:06pm. S. Whearty came back up to propose ways to help with the concerns from neighbors. T. Carmichael and R. Mora explained that the applicant has met the requirements for the site plan and subdivision regulations for storm water management. T. Carmichael read the following staff- recommended conditions of approval: PRECONSTRUCTION REQUIREMENTS All conditions in this section must be completed at least two weeks prior to commencing any work on- site. 1.1. Plan Revisions. Plans must be revised and submitted to the Planning Department in accordance with the following: 1.1.1. All leading zeros must be removed from all lot numbers. 1.1.2. Details of the fence to be constructed along Parade Road must be provided and include the 1.1. Plan Revisions. The existing sewer service must be inspected via camera from the house to as far downstream as possible. During the inspection, the sewer line must be marked out on the ground. If the camera cannot reach the sewer main, then the service must be inspected from the sewer main to as far as possible upstream. 1.3. Sewer Service Disconnect. The Applicant must disconnect the existing sewer service as close to the sewer main as possible. The Department of Public Works must approve the service disconnection plan prior to disconnection. 1.4. Water Service Disconnect. The Applicant must disconnect the existing water service at the water main. The Water Department must approve the service disconnection plan prior to disconnection. 1.5. Erosion Controls. Erosion controls must be in place and inspected and approved by the Planning Department. The Planning Department will perform regular inspections to ensure erosion controls are installed and maintained correctly. 1.6. Site Security. The Applicant must submit a performance guarantee for site improvement and restoration security in an amount equal to 11% of the total estimated cost for all sitework. This guarantee must be submitted to and approved by the Planning Department. This performance guarantee will be returned to the Applicant once the project is complete. Bonds will not be accepted to satisfy this requirement. 1.7. Landscape Security. The Applicant must submit a performance guarantee for site landscaping and restoration security in an amount equal to 11% of the total estimated cost for all landscaping or a minimum of $500, whichever is greater. This guarantee must be submitted to and approved by the Planning Department. This performance guarantee will be returned to the Applicant after two growing seasons following the completion of the project. Bonds will not be accepted to satisfy this requirement. 1.8. Permits and Approvals. The Applicant must possess all required permits and approvals granted by other municipal, state, and federal boards or agencies. All permits and approvals must be in place prior to the signing and recording of the final plans and mylar. Should any permit or approval be revoked at any time during the project, all work must cease until a new permit or approval is obtained. Copies of all permits and approvals must be provided by the Applicant to the Planning Department upon request. 1.9. Final Plans and Mylar. Four final plan sets and a mylar plan must be submitted to, reviewed, and approved by the Planning Department. The mylar plan must be recorded at the Belknap County Register of Deeds in accordance with RSA 478:1-a at the Applicant’s expense CONSTRUCTION REQUIREMENTS All conditions in this section must be met during the construction of the project. Parade Road Setback. No structure may be built within 100 feet of Parade Road. 2.2. Lot Access. No lot may be accessed from Parade Road. All lots must be accessed from Clover Lane. 2.3. Water Specifications. All specifications for municipal water service required by the Water Department apply to all construction. POST-CONSTRUCTION REQUIREMENTS All conditions in this section must be met prior to the issuance of any Certificate of Occupancy. 3.1. Private Sewer Agreement. A private sewer agreement must be in place between each development and those serviced by the sewer downstream. Evidence of the in-force agreement must be presented to the Department of Public Works. 3.2. Road Ownership. Clover Lane will remain a private road to be owned and maintained by the South Down Recreation Association. 3.3. HOA Membership. Each house must be included in the existing HOA. HOA documents for each house must be provided to the Planning Department. 3.4. Impact Fees. Impact Fees in the amount of $3,814.80 per new single-family dwelling unit must be paid to the Planning Department. In accordance with RSA 674:39, the Applicant is exempt from any changes to impact fee rates for 5 years from the approval date. Should the project not be completed during the exemption period, the Applicant must pay any and all increases to impact fees regardless of vestment status. 3.5. Monumentation. A statement from a licensed land surveyor must be submitted to the Planning Department confirming the proposed monumentation was installed according to the approved plan. 3.6. As-Built Design. An as-built design, application, and fee for each dwelling unit must be submitted to the Planning Department for review and approval. COMPLETION DATE The project and all associated conditions must be completed by no later than August 6, 2026. If all conditions are not met, nor any extension application filed with the Laconia Planning Department, by the completion date, this approval is null and void. G. PB2025-010; 17 Bay St (450-13-43) Sal Hubbard from Lakes Region Community Developers was present to summarize the application. G. Ober motions to accept the application. R. MacNeill seconds. All in favor, none opposed. C. St. Clair asked with the private trash removal if there was going to be recycling as well. There was further discussion about how to financially proceed with trash and recycling. The applicant is going to do more research for the recycling aspect of removal. The public hearing was opened at 7:30pm. No abutters were present, the public hearing was closed at 7:31pm. T. Carmichael read the following staff recommended conditions of approval Amend prior approval to require private solid waste collection method preferred by the private solid waste collection service. All solid waste receptacles must be screened and all other conditions from the November 6, 2023, approval apply. M. DellaVecchia motioned to approve application PB2025-010 for 17 Bay St. with the conditions of approval presented in the Staff Report. R. MacNeill seconds. 5 in favor and 1 in opposition. The motion passed. 7.II. PB2025-007; 92 Pine St (443-184-75) B. Cheney motioned to accept application PB2025-006 for 92 Pine St. as complete with the findings of fact as presented in the Staff Report. G. Ober seconds. All in favor. Tom LaBree was present to summarize the application. There was discussion about it being a two-family but it to be constructed later and be a mulit-family. The public hearing was opened at 7:36pm due to no one speaking up the public hearing was closed at 7:37pm. T. A Knox Box must be installed to prevent damage in the event an emergency entrance is needed. 2.5. Smoke/CO Detectors. The sewer service must be cleaned and inspected via CCTV. A certified inspection report must be submitted to the Department of Public Works for review and approval. 2.8. Water Meter and Meter Horn. A meter horn with a double check valve can be used in lieu of a testable backflow device. The Laconia Water Department must reinstall the water meter once the meter horn is installed. Both the meter horn and the water meter must be in a heated and accessible location. 2.9. Water Specifications. All specifications for municipal water service required by the Water Department apply to all construction. POST-CONSTRUCTION REQUIREMENTS All conditions in this section must be met prior to the issuance of any Certificate of Occupancy. 3.7. Construction and Maintenance Assessment Fees. Nick King and De Hsieh were present to summarize the application for 30 Winter St. There was discussion about the parkin ordinance and the requirements for this property. The public hearing was opened at 7:47pm and closed 7:48pm due to no abutters being present. T. There was further discussion about the variances that were previously approved by the Zoning Board. R. Mora added that there was a state law that passed regarding parking spots and there was discussion about that. M. DellaVecchia motioned to approve application PB2025-008 for 30 Winter Street with the conditions of approval presented in the Staff Report. G. Ober seconded. All in favor, passed unanimously. 7.IV. Zoning Ordinance Amendment; Article XIII, § 235-81 R. Mora summarized the rewrite of the Zoning Ordinance. There was discussion about prior approvals and moving forward with the new wording. The public comment was opened at 8:01pm. The public comment was closed at 8:02pm. G. Ober motions to recommend the proposed language of the Ordinance to City Council. R. MacNeill seconds. 5 in favor and 1 abstention. Motion passed. 8. PRESENTATIONS 9. PLANNING DEPARTMENT REPORT 9.I. Planning Department Monthly Report R. Mora summarized the Planning Dept monthly report. There was discussion about getting members for the Master Plan committee. The board discussed grants that the Planning Board had applied for. The Planning Board approval was needed for the HOP Grant. B. Cheney motioned to approve; A. Lovisek seconded. All in favor. T. Carmichael spoke about the Housing Champion program. R. Mora summarized the Planning Dept monthly report. There was discussion about getting members for the Master Plan committee. The board discussed grants that the Planning Board had applied for. The Planning Board approval was needed for the HOP Grant. B. Cheney motioned to approve; A. Lovisek seconded. All in favor. T. Carmichael spoke about the Housing Champion program. 10. LIAISON REPORTS 11. CITY COUNCIL B. Cheney encouraged the Planning Dept to investigate Performance Zoning. The council also reacted positively to the Monthly report being provided as well as the TRC agendas. 12. LAKES REGION PLANNING COMMISSION Meetings will start up again this fall. 13. CONSERVATION COMMISSION G. Ober summarized what has been going on at the Conservation Commission. 14. HISTORIC DISTRICT COMMISSION No updates yet. 15. OTHER BUSINESS 15.I. Appointment of Capital Improvements Committee Members Charlie St. Clair, Brian Wolf, and Rich MacNeill volunteered to be on the Capital Improvements Committee. The meetings should start in October. Staff will get that distributed. 16. ADJOURNMENT Meeting was adjourned at 8:24pm.
