SPECIAL BOARD OF PUBLIC WORKS AND SAFETY MINUTES April 28, 2017 Special Session: The Board of Public Works and Safety met in special session on Friday, April 28, 2017 at 3:30 p.m. in the Common Council Chambers. Members present were: Gary Henriott, Cindy Murray, Ron Shriner and Norm Childress. Absent: Dawn Ross Jacque Chosnek, 1st Deputy City Attorney, was also present. President Henriott called the meeting to order. The Pledge of Allegiance was given to the flag of our Country. NEW BUSINESS Legal Counsel Resolution 04-2017-A Resolution of the Board of Public Works and safety of Lafayette, Indiana to Designate Certain Areas as Strictly for Underground Utilities or Buried Utilities Mrs. Chosnek presented to the Board and recommended approval of Resolution 04-2017 A Resolution of the Board of Public Works and Safety to Designate Certain Areas as Strictly for Underground Utilities or Buried Utilities. Mrs. Chosnek stated that this resolution is a result of SEA 213 which was one of the last pieces of legislation passed this session. It made changes to Indiana law concerning the local permitting of small cell facilities, which are smaller supplementary towers to help boost coverage in density areas. The new legislation grants the municipalities the ability to prohibit or restrict the installation of the new small cell facilities in areas that the City of Lafayette designates by May 1, 2017. Mrs. Chosnek stated that it is important for the City of Lafayette to be able to maintain local control over the installation in the right of ways especially in the downtown and Sagamore Parkway areas. The resolution designates all of the right of way within Lafayette as strictly for underground or buried utilities so the City of Lafayette maintains local control. There are a few acceptations in the Indiana law regarding local control. The City of Lafayette has to permit co-location on existing poles and the replacement of existing poles. There has to be a procedure in place to authorize new facilities within the designated areas. The Engineering department had previously developed standards for the small cell facilities and the city will be reviewing those standards to see if any adjustments need to be made in light of the new legislation. Mrs. Chosnek answered questions from the Board. Mr. Shriner moved for approval. Mrs. Murray seconded. Passed.
