BOARD OF PUBLIC WORKS AND SAFETY MINUTES June 1, 2021 Regular Session: The Board of Public Works and Safety met in regular session on Tuesday, June 1, 2021 at 9:00 a.m. in the Common Council Chambers. Members present were: Gary Henriott, Cindy Murray, Amy Moulton and Norm Childress. Absent: Ron Shriner Jacque Chosnek, City Attorney, was also present. President Henriott called the meeting to order. The Pledge of Allegiance was given to the flag of our Country. MINUTES Mrs. Moulton moved for approval of the minutes from the May 25, 2021 regular meeting. Mrs. Murray seconded. Passed. BID OPENING S. 9th Street Sidewalk Reconstruction Project This being the time set to open bids for the S. 9th Street Sidewalk Reconstruction Project and the following bids were received and opened: Dixon Construction Lafayette, Indiana Base Bid: $113,760.00 Milestone Contractors Lafayette, Indiana Base Bid: $120,500.00 Heartland Contractors, Inc Lafayette, Indiana Base Bid: $97,575.00 Rieth-Riley Construction Lafayette, Indiana Base Bid: $147,850.00 Mr. Childress moved to take the bids under advisement for further review. Mrs. Moulton seconded. Passed. Board of Public Works and Safety June 1, 2021 Page 2 NEW BUSINESS Engineering Acceptance for Maintenance-Hickory Ridge Subdivision, Phase 3, Section 3 Dave Griffee, Engineering, presented to the Board and recommended approval of an Acceptance for Maintenance for Hickory Ridge Subdivision, Phase 3, Section 3. This project is located on the west aide of Concord Road just south of CR 450 S and adds 35 single-family residential lots to the existing subdivision. The testing, as-builts and 3-year maintenance bond have been submitted. Mrs. Moulton moved for approval. Mrs. Murray seconded. Passed. Economic Development Historic Demolition Permit-1436 South Street (Garage Only) John Collier, Economic Development, presented to the Board and recommended approval of a Historic Demolition Permit for 1436 South Street-Garage Only. The property is within the St. Mary’s National Historic District and has been reviewed by the Lafayette Historic Preservation Officer, Dann Keiser. Mr. Collier stated that Mr. Keiser determined that the loss of the garage would not adversely affect the historic district and recommended that the 60-day waiting period be waived. Mr. Collier agreed with Mr. Keiser’s recommendation. Mr. Childress moved to waive the 60-day waiting period. Mrs. Moulton seconded. Passed. Permanent Supportive Housing Rental Assistance Contract Adam Murphy, Economic Development, presented to the Board and recommended approval of the Permanent Supportive Housing Rental Assistance Contract with Indiana Housing and Community Development Authority (IHCDA). The contract will provide continuance assistance for 28 persons who are certified as chronically homeless with a co-existing disability, such as mental illness, substance abuse and/or HIV/AIDS. The contract includes rental assistance in the amount of $250,831.00 and administrative funding in the amount of $12,816.00. Discussion ensued. Mrs. Murray moved for approval. Mr. Childress seconded. Passed. Fire Department Affiliation Agreement with Greater Lafayette Career Academy and Lafayette Fire Training Center Chief Richard Doyle, Lafayette Fire, presented to the Board and recommended approval of the Affiliation Agreement with Greater Lafayette Career Academy and Lafayette Fire Training Center. The agreement states that Lafayette Fire will provide the facility and all the equipment for classroom session and training. The instructor will be located at the Career Academy. The agreement breaks down the responsibilities of each entity. Chief Doyle gave a brief description of the program, outreach, success rates, and hiring practices. Mrs. Moulton moved for approval. Mr. Childress seconded. Passed. Board of Public Works and Safety June 1, 2021 Page 3 Park Department Change Order #3-Memorial Island Phase 3 Claudine Laufman, Parks Superintendent, presented to the Board and recommended approval of Change Order #3 for the Memorial Island Phase 3 Project with J.R. Kelly Corporation. This change order changes the completion date from June 4, 2021 to June 23, 2021 due to additional time required to remediate unsuitable soils that were encountered at the shoreline of the lagoon. There is no price change to the contract with this change order. Mr. Childress moved for approval. Mrs. Murray seconded. Passed. Change Order #4-Memorial Island Phase 3 Mrs. Laufman presented to the Board and recommended approval of Change Order #4 for the Memorial Island Phase 3 Project with J.R. Kelly Corporation. This change order includes additional stone backfill needed for shoreline remediation, light pole location adjustments, security system electrical rough-in; and dewatering due to lengthy soil remediation. The change order in an additional $27,475.75 bringing the revised contract amount to $6,540,809.75. Mrs. Murray moved for approval. Mr. Childress seconded. Passed. CLAIMS Jeremy Diehl, Deputy Controller, presented for Board approval, Claims in the amount of $728,838.40. President Henriott asked a question on Page 9/10 regarding invoices for John Sanders. Mr. Diehl stated that is for work begin done by Lafayette Lawn Works for irrigation. Mr. Childress asked a question on Page 11 regarding Outlaw Motorcycle Gang Per Diem. Mayor Roswarski stated that is for Lafayette Police Training. Mrs. Murray moved for approval. Mr. Childress seconded. Passed. MISCELLANEOUS Special Event Request-St. Boniface Corpus Christi Eucharistic Procession Tammy Lavdicina, Event Representative, presented to the Board and recommended approval of a Special Event Request for the St. Boniface Church Corpus Christi Eucharistic Procession to be held on June 6, 2021 from 7:30pm-8:00pm located on the streets surrounding St. Boniface Church. Mrs. Moulton moved for approval. Mrs. Murray seconded. Passed. Time: 9:27 a.m. President Henriott stated that the Animal Control Appeal Hearing will start is a few minutes. Board of Public Works and Safety June 1, 2021 Page 4 BOARD OF PUBLIC WORKS AND SAFETY ANIMAL APPEAL MINUTES June 1, 2021 Appeal Hearing: The Board of Public Works and Safety met on Tuesday, June 1, 2021 at 9:35 a.m. in the Common Council Chambers. Members present were: Gary Henriott, Cindy Murray, Amy Moulton and Norm Childress. Absent: Ron Shriner Jacque Chosnek, City Attorney, was also present. President Henriott called the meeting to order. Animal Control Appeal Hearing-Caesar Mrs. Chosnek verified that Cheyenne Chandler-Mata was present at the hearing. The appeal is for the return of Caesar. Josh Klumpe, Animal Control Officer (ACO), stated that on May 24, 2021 he was called for two black and white pit bull mix dogs running all over the north side of Lafayette near 52/Schuyler and around the Tippecanoe Jail. ACO Klumpe stated that there were 5-6 calls on just those two dogs for citing and issues. One of those calls was a result of a cat being killed in Cor-Dale Court behind the jail. The cat was recovered and people living there stated that they saw the two dogs kill the cat. ACO Klumpe stated that he searched for the dogs again but could not find them due to the large amount of area to cover. ACO Klumpe stated that he received a call around noon that day that the dogs were laying under a tree in Cor-Dale Court at which time ACO Klumpe captured both dogs Caesar and Mambo. ACO Klumpe tried to contact the owner via the microchip information but that was a dead-end. The dogs were taken to Almost Home Humane Society (AHHS) at that time. ACO Klumpe did some research to found out who the owners of the dogs were and noticed that there is a vast problem with both of these dogs running at large for quite some time. Mrs. Chosnek confirmed with ACO Klumpe that there is indeed several calls and situations where the dogs were found running at large from August 2020 and May 2021. ACO Klumpe stated that this was correct. ACO Klumpe noted that in the last ACO call for these dogs denotes that the next time running at large, the dogs should be removed and habitual offender citations issued. Mrs. Chosnek confirmed with ACO Klumpe that there were previous citations issued in the past for both dogs. ACO Klumpe stated that was correct and also confirmed that those citations have not been paid to date. Both Caesar and Mambo were ceased on May 24, 2021 and are currently at AHHS. ACO Sara Goans stated that both dogs have been running at large multiple times. The owner and owner’s family that live at the N. 20th Street address have been given multiple chances to fix the fence and put tie-outs in the yard. The family has been working to resolve the issues that but the dogs are still getting out. ACO Goans stated that there has been little improvement on the fence, gate and yard. Mrs. Murray asked about the dogs’ behavior. ACO Goans stated that Caesar has been aggressive towards other animals but not humans. Mr. Childress confirmed with the ACO’s that only one of the dogs, Caesar, is being asked to be returned. ACO Goans confirmed that only Caesar is wanted back. Mrs. Murray confirmed that there is no Dangerous Animal Agreement with these dogs. ACO Goans confirmed there is not because neither of the two dogs have actively attacked another dog or human. Cheyenne Chandler-Mata, Caesar’s owner, stated that she has had Caesar for four years and has been living with her mother at the N. 20th Street address. Ms. Chandler-Mata stated that she has recently relocated to Kokomo Indiana (1109 E. Southway Blvd) where she has signed a lease and currently works. Ms. Chandler-Mata wants her dog back so she can relocated the dog to Kokomo with her. Ms. Chandler-Mata explained that the landlord had taken down an old garage that left part of the yard open. Ms. Chandler stated that she has never seen Caesar Board of Public Works and Safety June 1, 2021 Page 5 act aggressive but lives with other dogs that are mean and aggressive. Ms. Chandler-Mata stated that she doesn’t have the money to pay all the citations and get her dog released from AHHS. Mrs. Chosnek asked ACO Klumpe that when he was called on May 24, 2021 about the killed cat if there was any indication that Caesar was the one that did it. ACO Klumpe said that the caller did not clarify which dog killed the cat. Mrs. Chosnek stated that there are $850.00 outstanding fines related to Caesar. President Henriott asked Ms. Chandler-Mata if she is prepared to pay the fines. Ms. Chandler-Mata stated that she doesn’t have the money to pay the fines. Mrs. Murray stated that she is ok with sending Caesar back with Ms. Chandler-Mata to Kokomo with her. Mrs. Chosnek stated that the most recently citation that was issued on May 24, 2021 is not due until July 26, 2021. The other citations are past due. Discussion ensued regarding fine collection in general. Mrs. Moulton suggested a payment plan for these fines. Mr. Childress stated that he is not in favor of returning Caesar to Ms. Chandler-Mata. President Henriott agreed with Mr. Childress on not returning the dog. Mrs. Moulton stated that she is not in favor of returning the dog. Mrs. Moulton moved for denial of the appeal and to not return the dog to the owner. Mr. Childress seconded. Mrs. Murray opposed. Passed and Appeal Denied.
