BOARD OF PUBLIC WORKS AND SAFETY MINUTES April 11, 2023 Regular Session: The Board of Public Works and Safety met in regular session on Tuesday, April 11, 2023 at 9:00 a.m. in the Common Council Chambers. Members present were Gary Henriott, Cindy Murray, Amy Moulton, and Norm Childress. Absent: Ron Shriner Jacque Chosnek, City Attorney, was also present. President Henriott called the meeting to order. The Pledge of Allegiance was given to the flag of our Country. MINUTES Mrs. Moulton moved for approval of the minutes from the April 4, 2023 regular meeting. Mrs. Murray seconded. Passed. NEW BUSINESS Engineering Permission to Advertise-5th Street Garage Repair Project Jeromy Grenard, Public Works Director, presented to the Board and recommended approval of Permission to Advertise for the 5th Street Garage Repair Project. The publications are set to run on April 14 & 21, 2023 with the bid opening on May 16, 2023. Mr. Grenard stated that the project has now been value engineered and hopes to receive more and tighter bids this time around. Mr. Childress moved for approval. Mrs. Moulton seconded. Passed. Task Order #2-9th & Kossuth Survey and Conceptual Engineering Mr. Grenard presented to the Board and recommended approval of Task Order #2 for the 9th & Kossuth Survey and Conceptual Engineering with VS Engineering. The scope for conceptual engineering includes civil engineering and land surveying professional services necessary to evaluate alternative options for: (1) the reconstruction of the 9th & Kossuth Streets intersection, (2) storm sewer solutions and routes to drain said intersection, (3) determine sidewalk replacement considerations along the west side of 9th Street between said intersection and South Street. The conceptual engineering is in the amount of $10,000.00 and the land surveying is in the amount of $49,100.00. Both amounts are hourly not-to-exceed. Discussion ensued. Mrs. Moulton moved for approval. Mrs. Murray seconded. Passed. Amendment #1-Sagamore Parkway Trail-Design Revisions Mr. Grenard presented to the Board and recommended approval of Amendment #1 for the Sagamore Parkway Trail-Design Revisions with Kimley-Horn and Associates, Inc. The design of this trail is part of the Next Level Trails Grant. The amendment will cover several different additional design items and value engineering ideas to reduce the height of the retaining wall. Mr. Grenard gave the Board a brief description of the project. The amendment is in the amount of $84,558.00. Discussion ensued. Mr. Childress moved for approval. Mrs. Murray seconded. Passed. Board of Public Works and Safety April 11, 2023 Page 2 Purchasing Declaration of Surplus Property-Police Department (3 Vehicles) Dave Payne, Purchasing Director, presented to the Board and recommended approval of a Declaration of Surplus Property for the Police Department that includes a Black 2013 Dodge Charger VIN#2C3DXAG1DH546379 City ID#13-214, a Black 2016 Ford Explorer VIN#1FM5K8AR0GGB64857 City ID#16-22, and a Black 2017 Ford Explorer VIN#1FM5K8AR5HGB33363 City ID#17-1. Mr. Payne stated that these vehicles will be traded in on an upcoming purchase of 3 new vehicles. Mrs. Moulton moved for approval. Mr. Childress seconded. Passed. Declaration of Surplus Property-Police Department (1 Camera) Mr. Payne presented to the Board and recommended approval of a Declaration of Surplus Property for the Police Department that includes a Nikon Camera Model: Coolpix S550 Serial Number:32179469. Mr. Payne stated that this item will be listed for sale on PropertyRoom.com. Mrs. Murray moved for approval. Mrs. Moulton seconded. Passed. CLAIMS Jeremy Diehl, Controller, presented for Board approval, Claims in the amount of $4,177,817.20. President Henriott asked if there were any further questions and there were none. Mr. Childress moved for approval. Mrs. Moulton seconded. Passed. MISCELLANEOUS Special Event Request-Tree Lafayette Celebrates Earth Day Shirley Sterling, Event Representative, presented to the Board and recommended approval of Special Event Request for Tree Lafayette Celebrating Earth Day to be held on April 21, 2023 from 9:00am-2:00pm near the center median at 2200 Sagamore Parkway North. Mrs. Murray moved for approval. Mr. Childress seconded. Passed. Banner Request-Food Finders Food Bank President Henriott presented to the Board and recommended approval of a Banner Request for Food Finders Food Bank to hang a banner on Columbia Street from May 2- May 16, 2023. Mr. Childress moved for approval. Mrs. Moulton seconded. Passed. Proclamation-Fair Housing Month Mrs. Murray read the following proclamation: WHEREAS The Fair Housing Act, enacted on April 11, 1968, enshrined into federal law the goal of eliminating racial segregation and ending housing discrimination in the United States; and WHEREAS The Fair Housing Act prohibits discrimination in housing based on race, color, religion, sex, familial status, national origin, and disability, and commits recipients of federal funding to affirmatively further fair housing in their communities; and Board of Public Works and Safety April 11, 2023 Page 3 WHEREAS The City of Lafayette is committed to the mission and intent of Congress to provide fair and equal housing opportunities for all; and WHEREAS Our social fabric, the economy, health, and environment are strengthened in diverse, inclusive communities; and WHEREAS More than fifty years after the passage of the Fair Housing Act, discrimination persists, and many communities remain segregated; and WHEREAS Acts of housing discrimination and barriers to equal housing opportunity are repugnant to a common sense of decency and fairness. NOW THEREFORE BE IT RESOLVED, that I, Cindy Murray on behalf of Mayor Tony Roswarski, do hereby declare the month of April, 2023, as FAIR HOUSING MONTH in the City of Lafayette as an inclusive community committed to fair housing and to promoting appropriate activities by private and public entities to provide, and advocate for, equal housing opportunities for all residents and prospective residents of the City of Lafayette. Proclamation-Community Development Week Mrs. Murray read the following proclamation: WHEREAS The week of April 10-14, 2023, has been designated as National Community Development Week to celebrate the Community Development Block Grant (CDBG) and the HOME Investment Partnerships (HOME) programs; and WHEREAS The CDBG and HOME programs provide annual funding and flexibility to local communities to provide decent, safe, and affordable housing, a suitable living environment, and economic opportunities to low- and moderate-income people; and WHEREAS In the last five years, Lafayette has received over eleven million dollars in CDBG, HOME, CARES Act CDBG-CV and HOME American Rescue Plan funding for a variety of projects that directly benefit our citizens and neighborhoods; and NOW, THEREFORE BE IT RESOLVED, that I, Cindy Murray on behalf of Mayor Tony Roswarski, designate the week of April 10-14, 2023, as COMMUNITY DEVELOPMENT WEEK in the City of Lafayette, Indiana in support of these valuable programs that have made tremendous contributions to the viability of the housing stock, infrastructure, public services, and the economic well-being of our community. Valerie Oakley, Project Manager with Lafayette Housing Authority, gave the Board a brief overview of where the funding for their projects is being directed within the community. President Henriott stated that the meeting is adjourned and will reconvene in 5 minutes for the Animal Appeal Hearing. Time: 9:21 a.m. Board of Public Works and Safety April 11, 2023 Page 4 BOARD OF PUBLIC WORKS AND SAFETY ANIMAL APPEAL MINUTES April 11, 2023 Appeal Hearing: The Board of Public Works and Safety met on Tuesday, April 11, 2023 at 9:26 a.m. in the Common Council Chambers. Members present were: Gary Henriott, Cindy Murray, Amy Moulton and Norm Childress. Absent: Ron Shriner Jacque Chosnek, City Attorney, was also present. President Henriott called the meeting to order. Animal Control Appeal Hearing-Cynthia Sanders Ms. Chosnek gave a brief description of the procedure for this hearing. Ms. Chosnek stated that the Board has received copies of incident reports by both LPD and Animal Control Officer (ACO)’s, the appeal letter from both Macy’s owner. Ms. Chosnek stated that the owner of Macy is Cynthia Sanders. Ms. Chosnek stated that the dog was impounded and taken to Almost Home Humane Society (AHHS) at which point Ms. Sanders did submit a letter of appeal to the Clerk’s Office. Animal Control Officer (ACO) Sarah Goans stated that on April 4, 2023 the ACO’s received a call that a black/white pitbull had been found and the person that found Macy held her over night incase the owner came looking for her. The ACO’s picked up Macy the next morning and scanned her for a chip and realized that the dog was Macy. ACO Goans stated that Macy already has a Nuisance Animal Agreement (NAA) issued on September 28, 2022 because of the frequency at which Macy gets out of the yard. ACO Goans made contact at the house where Macy lives and spoke to who they thought was Cynthia Sanders. Then asked if the dog was home the answer was ‘no’ and that Macy got out sometime yesterday. ACO Goans stated that the owners of Macy did not go looking for the dog at all after Macy had gone missing out of the yard. ACO Goans told Ms. Sanders that Macy would be seized at this point due to the violation of the NAA. The NAA stems from Macy being loose two days in a row. Ms. Sanders was notified at that time about the specifics of the agreement and the rules that go along with that agreement. ACO Goans stated that she went and got the intake report for Macy from the AHHS where is stated that Macy was dropped off by people that have pickup her up running loose on January 9. 2021, February 10, 2022 and also on May 8, 2022 without that ACO intervention. ACO Goans stated that along with the NAA on Macy a citation in the amount of $250.00 was issued. Ms. Chosnek stated that the Clerk’s Office has not received payment for that citation to date. Ms. Chosnek asked the ACO’s if there is history with the owner and the address in question. ACO Goans stated that Ms. Sanders has had two other dogs Lilly (Pitbull) and Hudson (Husky) in the past that both have a history of getting out of the yard on several occasions. Hudson ended up at AHHS where he was never claimed by Ms. Sanders and a citation for that abandonment was issued at that time in the amount of $$250.00. Ms. Chosnek stated that the Clerk’s Office has not received payment for that citation to date. ACO Goans recommended denying the appeal and not returning Macy to Ms. Sanders. ACO Goans stated that Macy is a fun loving dog and it will have no trouble getting adopted out to another family. Discussion ensued. Cynthis Sanders stated that she had holes in her fence that she has gotten fixed and this was the reason Macy kept getting out of the yard. Ms. Sanders stated that her daughter tried to get ahold of the neighbor that picked up Macy on April 4, 2023 but the neighbor ignored her daughter. Ms. Sanders stated that Hudson did get out of the yard a lot and when the dog was not reclaimed at AHHS it was because Ms. Sanders was in the hospital. Ms. Sanders stated that Macy got out of the yard this last time because of her sister not knowing that the fence between the Board of Public Works and Safety April 11, 2023 Page 5 homes was removed from the neighbor. Ms. Sanders stated that Lilly no longer lives at the home because an ex- boyfriend took her with him, and Hudson was adopted out when he wasn’t reclaimed at the AHHS. Ms. Sanders stated that she believes that the problem will be solved now that the fence is fixed. Macy is the only dog that is currently with Ms. Sanders. Mr. Childress questioned if all the dogs that have gotten out of the yard are due to a faulty fence. Ms. Sanders stated that the people in her home are not paying attention and also the holes in the fence. Mr. Childress asked ACO Goans if Macy was adoptable. ACO Goans stated that Macy is a petite pitbull and very friendly. Mr. Childress moved to deny the appeal. Mrs. Moulton seconded. Denied.
