BOARD OF PUBLIC WORKS AND SAFETY MINUTES April 23, 2024 Regular Session: The Board of Public Works and Safety met in regular session on Tuesday, April 23, 2024 at 9:00 a.m. in the Common Council Chambers. Members present were: Gary Henriott, Cindy Murray, Amy Moulton, Eric Rody and Ron Shriner. Jacque Chosnek, City Attorney, was also present. President Henriott called the meeting to order. The Pledge of Allegiance was given to the flag of our Country. MINUTES Mrs. Murray moved for approval of the minutes from the April 16, 2024 regular meeting. Mr. Rody seconded. Passed. QUOTE OPENING Quotes-Romig Street Concrete Project This being the time set to open bids for the Board of Public Works and Safety for Quotes-Romig Street Concrete Project the following bids were received and opened: Dixon Construction Lafayette, Indiana Base Bid: $23,583.00 Heartland Contractors Inc Lafayette, Indiana Base Bid: $27,826.00 Milestone Contractors Lafayette, Indiana Base Bid: $89,340.00 Mr. Shriner moved to take the bids under advisement for further review. Mr. Rody seconded. Passed. BIDS UNDER ADVISEMENT Water Service Line Potholing Project President Henriott stated that this item will remain under advisement. Board of Public Works and Safety April 23, 2024 Page 2 NEW BUSINESS Lafayette Renew Contract- Proposal for GMAX for Guaranteed Savings Contract-Three Pack Project Brad Talley, Renew Superintendent, presented to the Board and recommended approval of a Contract for the GMAX for Guaranteed Savings Contract Three Pack Project with Bowen Engineering. The Three Pack Project consists of an Aeration Project, Coarse Bar Screen Project, and Underwood Collection System Project. These projects have been procured through the Guaranteed Maximum Price (GMP) Proposal. The contract is in the amount of $3,669,000.00. Discussion ensued regarding the overall cost savings this project will have after completion in 20 years. Mrs. Moulton moved for approval. Mrs. Murray seconded. Passed. Notice to Proceed- Proposal for GMAX for Guaranteed Savings Contract-Three Pack Project Mr. Talley presented to the Board and recommended approval of a Notice to Proceed for the GMAX for Guaranteed Savings Contract Three Pack Project. The notice to proceed is set for today with a substantial completion on May 23, 2025 and a final completion on June 23, 2025. Mrs. Murray moved for approval. Mr. Shriner seconded. Passed. Certificate of Final Completion-Prairie Oak Sanitary Sewer Rehabilitation Project Mr. Talley presented to the Board and recommended approval of a Certificate of Final Completion for the Prairie Oaks Sanitary Sewer Rehabilitation Project. The contractor had completed all work for this project with final completion as of March 14, 2024. Mrs. Moulton moved for approval. Mr. Rody seconded. Passed. Mr. Talley thanked Bowen Engineering and Inliner Solutions for their work with the project. Engineering Recommendation for Award-2024 Tecumseh Addition CDBG Project Jeromy Grenard, Public Works Director, presented to the Board and recommended approval of a Recommendation for Award for the 2024 Tecumseh Addition CDBG Project with Dixon Construction. The project consists of 52 curb ramps in the Tecumseh Addition. The bid was determined to be complete with the bid bond, Form 96 and company financial information submitted. Mrs. Murray moved for approval. Mr. Rody seconded. Passed. Contract-2024 Tecumseh Addition CDBG Project Mr. Grenard presented to the Board and recommended approval of a Contract for the 2024 Tecumseh Addition CDBG Project with Dixon Construction in the amount of $161,200.00. Mr. Shriner moved for approval. Mrs. Moulton seconded. Passed. Notice to Proceed-2024 Tecumseh Addition CDBG Project Mr. Grenard presented to the Board and recommended approval of a Notice to Proceed for the 2024 Tecumseh Addition CDBG Project that is set to start today. Mrs. Moulton moved for approval. Mr. Rody seconded. Passed. Board of Public Works and Safety April 23, 2024 Page 3 Permission to Advertise-Veterans Memorial Parkway Resurface and Shoulder Reconstruction US 52 to SR 38 Mr. Grenard presented to the Board and recommended approval of a Permission to Advertise for the Veterans Memorial Parkway Resurface and Shoulder Reconstruction US 52 to SR 38. The publications are set to run on April 26 and May 3, 2024 with the bid opening on May 21, 2024. Mr. Grenard gave the Board a brief description of the details of the project. Discussion ensued. Mr. Shriner moved for approval. Mrs. Moulton seconded. Passed. Fire Department Resolution 03-2024 A Resolution Authorizing the Transfer of Certain Property Owned by the Fairfield Township, Indiana to the City of Lafayette Fire Department Brian Alkire, Lafayette Fire Chief, presented to the Board and recommended approval of Resolution 03-2024 A Resolution Authorizing the Transfer of Certain Property Owned by the Fairfield Township, Indiana to the City of Lafayette Fire Department. Chief Alkire stated that the Aluminum 82x16 Flatbed Trailer is being transferred to the City of Lafayette from Fairfield Township at no cost to the city. Mrs. Moulton moved for approval. Mrs. Murray seconded. Passed. Legal Counsel Agreement with Area IV Development and Snowy Owl Commons for READI Funds Ms. Chosnek presented to the Board and recommended approval of an Agreement with Area IV Development and Snowy Owl Commons for READI Funds. Ms. Chosnek stated that the city is a sub recipient under the READI 1.0 Funds for $200,000.00 to support the Snowy Owl Commons low-income senior housing project. This will include 50 housing units. Mr. Rody moved for approval. Mr. Shriner seconded. Passed. CLAIMS Jermy Diehl, Controller, presented to the Board approval of Claims in the amount of $5,287,397.36. President Henriott asked a question on Page 18 regarding the Gripp Incorporated invoice for the Flow Study. Mr. Diehl stated that study is for an ongoing process to make sure that everything is flowing correctly through the sewer system. Mr. Talley that they are looking for wet weather infiltration in several sewers. Mr. Rody moved for approval. Mr. Shriner seconded. Passed. MISCELLANEOUS Special Event Request-Mosey Down Main Street (Various Dates) Ken McCammon, Event Representative, presented to the Board and recommended approval of a Special Event Request for Mosey Down Main Street to be held on May 18, June 8, July 13, August 10 and August 31, 2024 from 3:00pm-1:00am located on Main Street from 6th to 11th Streets and 9th Street from Columbia to Ferry Street. Passed. Board of Public Works and Safety April 23, 2024 Page 4 Special Event Request-Lowe Block Party Brian Lowe, Event Representative, presented to the Board and recommended approval of a Special Event Request for the Lowe Block Party to be held on June 1, 2024 from 5:00pm-11:00pm located on Corinthian Street between King Fisher Drive and Abbotsbury Drive. Mrs. Murray moved for approval. Mr. Rody seconded. Passed. Special Event Request-Indiana Historical Marker Dedication Ceremony Nancy Nargi, Event Representative, presented to the Board and recommended approval of a Special Event Request for the Indiana Historical Marker Dedication Ceremony to be held on May 23, 2024 from 4:00pm- 7:00pm located on Hitt Street from 7th Street to 9th Street. The historical marker is for Evaleen Stein who was a nationally known poet, author, artist and life-long resident of Lafayette from 1863-1923. Mrs. Moulton moved for approval. Mr. Shriner seconded. Time: 9:21 a.m. Animal Control Appeal Hearing-Samantha Russell BOARD OF PUBLIC WORKS AND SAFETY ANIMAL APPEAL MINUTES April 23, 2024 Appeal Hearing: The Board of Public Works and Safety met on Tuesday, April 23, 2024 at 9:30 a.m. in the Common Council Chambers. Members present were: Gary Henriott, Ron Shriner, Cindy Murray, Amy Moulton and Eric Rody. Jacque Chosnek, City Attorney, was also present. President Henriott called the meeting to order. Animal Control Appeal Hearing-Samantha Russell Ms. Chosnek gave a brief description of the procedure for this hearing. Ms. Chosnek stated that the Board has received copies of incident reports by both LPD and Animal Control Officer (ACO)’s, Ms. Chosnek stated that the owners of Sky are Samantha and Jeff Russell. Animal Control Officer (ACO), Aaron Gravely, stated that his first interactions with Sky was on May 31, 2023 when Sky was Running at Large (RAL) around the property and on the roof of the home at 1218 Holloway Drive, Lafayette. ACO Gravely stated that most of the calls for Sky have been for running at large. Ms. Chosnek confirmed with ACO Gravley that Sky was running at large again on September 12, 2023 when Sky was impounded at Almost Home Humane Society (AHHS) and then released the next day on September 13, 2023 with a warning to the owners regarding the violations. ACO Gravely confirmed that encounter. Sky was found running at large again on September 15, 2023 and the owners were again warned along with a discussion of a Nuisance Animal Agreement or fines in the future. Ms. Chosnek stated that there was another incident on October 11, 2023 where Sky was running at large and a Nuisance Animal Agreement (NAA) was issued; and signed by the owners. Ms. Chosnek stated that the NAA are to help rectify animals that are running at large by being kept in a secure enclosure from which the animal cannot escape, restrained by a leash no more that 6 feet when they are off the Board of Public Works and Safety April 23, 2024 Page 5 property, implanted with a microchip; and that that if further violations occur the animal could be impounded and a decision made not to return the animal to the owners. ACO Gravely stated that he has gone over these things with the Russell’s on nearly every occasion. ACO Gravely stated that he has been called out to the Russell’s regarding Sky and the owners have received 2 additional warnings about Sky running at large. ACO Gravely stated that on April 10, 2024 he was in AHHS for another call and happen to see Sky in the facility and asked the shelter to identify the dog. ACO Gravley scanned the dog chip, and it was in fact Sky. AHHS told ACO Gravely that Sky was running at large and jumped into a neighbor’s car. At that point the neighbor brought Sky to the AHHS. Sky running at large on this day was the third time after the NAA was issued therefore ACO Gravely impounded/seized Sky. Ms. Chosnek stated that the Russell’s then submitted a letter of appeal for the Board of Works to the Clerk’s Office on April 11, 2024. ACO Gravely stated that Sky is a very nice dog but will continue to run at large due to the lack of restrictions in the yard. Samantha Russell, 1218 Holloway Drive, stated that on April 10, 2024 she out Sky out on a chain inside the fenced in back yard and doesn’t know how she got out of the backyard and ended up in the neighbor’s car. The neighbor stated that Sky was running around out front of the house and got her in the car. The neighbor dropped Sky off of AHHS so the Russell’s could pick Sky up there. Mrs. Russell stated that Sky’s chip was never scanned that day. Mrs. Russell stated that she has pages and pages of statements from her neighbors stating that Sky is a good dog. She is a little over a year old and is still a puppy. Mrs. Russell stated that they have all kinds of repairs to the backyard and it shows because Sky has not gotten out since October 2023. Mrs. Russell has considered using a shock collar but is uncomfortable with that. Sky has not hurt anybody or anything when she gets out of the yard. President Henriott stated that Sky has a history with the ACO’s for the past year. Mrs. Russell confirmed that Sky is an indoor dog unless outside to do her business. Mrs. Russell stated that they did call the ACO’s the morning of April 10, 2024 to help assist them in finding Sky. It wasn’t until later that Sky was found at AHHS. Mr. Shriner stated that the ACO’s have described several times that Sky was running at large and is a public nuisance. Mr. Shriner stated that the Board has to take into account all the calls to ACO about Sky and not just one instance. Mr. Shriner stated that the city has an ordinance that pertains to this issue and has a process where warnings where issued, NAA was signed and now the dog was impounded. ACO Gravely stated that they are receiving complaints from neighbors about Sky running at large. Mr. Russell stated that he is in the process of training Sky. Discussion ensued regarding future for Sky after ownership is terminated. Mr. Shriner moved to deny the appeal. Mrs. Moulton seconded. Denied. Ayes: Shriner, Moulton and Rody. Nays: Henriott and Murray.
