BOARD OF PUBLIC WORKS AND SAFETY MINUTES January 7, 2025 Regular Session: The Board of Public Works and Safety met in regular session on Tuesday, January 7, 2025 at 9:00 a.m. in the Common Council Chambers. Members present were: Gary Henriott, Cindy Murray, Amy Moulton, Eric Rody and Ron Shriner Jacque Chosnek, City Attorney, was present at the meeting. President Henriott called the meeting to order. The Pledge of Allegiance was given to the flag of our Country. ELECTION OF OFFICERS Mrs. Murray moved to nominate Gary Henriott as 2025 Board of Public Works and Safety President. Mrs. Moulton seconded. Motion Carried. MINUTES Mrs. Moulton moved for approval of the minutes from the December 17, 2024 regular meeting. Mrs. Murray seconded. Passed. BIDS UNDER ADVISEMENT Lead Service Line Replacements, Phase 1 President Henriott stated that this item will remain under advisement. NEW BUSINESS Economic Development Historic Demolition Permit-714 S. 10th Street (Garage Only) Myles Holtsclaw, Economic Development, presented to the Board and recommended approval of a Historic Demolition Permit for 714 S. 10th Street for the Garage Only. Mr. Holtsclaw stated that because the property is listed as historic, the demolition request was reviewed by Dann Keiser, Lafayette Historic Preservation Officer, who determined that the loss of the garage would be a loss of an historic resource. Mr. Holtsclaw stated that Mr. Keiser recommended upholding the 60-day waiting period. Mr. Shiner moved to uphold the 60-day waiting period. Mr. Rody seconded. Passed. Engineering Certificate of Completion-Small Concrete Projects Jeromy Grenard, Public Works Director, presented to the Board and recommended approval of a Certificate of Completion for the Small Concrete Projects with Dixon Construction. Mr. Grenard stated that all work has passed inspections, no outstanding work items, and the final pay requests have been submitted. Mr. Grenard stated that Board of Public Works and Safety January 7, 2025 Page 2 the 1-year warranty period began December 1, 2024. Mrs. Murray moved for approval. Mrs. Moulton seconded. Passed. Certificate of Completion-Sherwood Drive Concrete Street Patching Mr. Grenard presented to the Board and recommended approval of a Certificate of Completion for the Sherwood Drive Concrete Street Patching with Dixon Construction. Mr. Grenard stated that all work has passed inspections, no outstanding work items, and the final pay requests have been submitted. Mr. Grenard stated that the 1-year warranty period began December 1, 2024. Mrs. Moulton moved for approval. Mr. Shriner seconded. Passed. Certificate of Completion- Sarasota Drive Curb Project Mr. Grenard presented to the Board and recommended approval of a Certificate of Completion for the Sarasota Drive Curb Project with Dixon Construction. Mr. Grenard stated that all work has passed inspections, no outstanding work items, and the final pay requests have been submitted. Mr. Grenard stated that the 1-year warranty period began October 1, 2024. Mrs. Murray moved for approval. Mr. Rody seconded. Passed. Certificate of Completion-Haggerty Lane and VMP Intersection Curb Replacement Mr. Grenard presented to the Board and recommended approval of a Certificate of Completion for the Haggerty Lane and VMP Intersection Curb Replacement with Dixon Construction. Mr. Grenard stated that all work has passed inspections, no outstanding work items, and the final pay requests have been submitted. Mr. Grenard stated that the 1-year warranty period began October 1, 2024. Mrs. Moulton moved for approval. Mr. Shriner seconded. Passed. Certificate of Completion-S. 4th Street Concrete Project Mr. Grenard presented to the Board and recommended approval of a Certificate of Completion for the S. 4th Street Concrete Project with Dixon Construction. Certificate of Completion-Romig Street Concrete Project Mr. Grenard presented to the Board and recommended approval of a Certificate of Completion for the Romig Street Concrete Project with Dixon Construction. Mr. Grenard stated that all work has passed inspections, no outstanding work items, and the final pay requests have been submitted. Mr. Grenard stated that the 1-year warranty period began August 1, 2024. Mr. Shriner moved for approval. Mrs. Moulton seconded. Passed. Certificate of Completion-2024 Tecumseh Addition CDBG Project Mr. Grenard presented to the Board and recommended approval of a Certificate of Completion for the 2024 Tecumseh Addition CDBG Project with Dixon Construction. Mr. Grenard stated that all work has passed inspections, no outstanding work items, and the final pay requests have been submitted. Mr. Grenard stated that the 1-year warranty period began January 1, 2025. Mr. Rody moved for approval. Mrs. Murray seconded. Mr. Grenard stated that all work has passed inspections, no outstanding work items, and the final pay requests have been submitted. Mr. Grenard stated that the 1-year warranty period began August 1, 2024. Mr. Rody moved for approval. Mrs. Murray seconded. Passed. Certificate of Completion-Saw Mill Run Subdivision Concrete Project Mr. Grenard presented to the Board and recommended approval of a Certificate of Completion for the Saw Mill Run Subdivision Concrete Project with Promised Land Construction and Landscaping, Inc., Mr. Grenard stated that all work has passed inspections, no outstanding work items, and the final pay requests have been submitted. Mr. Grenard stated that the 1-year warranty period began July 1, 2024. Mrs. Moulton moved for approval. Mr. Shriner seconded. Passed. Legal Counsel Resolution 01-2025 A Resolution of the Lafayette Board of Works and Public Safety to Offer Certain Real Estate for Sale to an Abutting Landowner-Old Romney Road Parcel 1 and Parcel 2 Ms. Chosnek presented to the Board and recommended approval of Resolution 01-2025 A Resolution of the Lafayette Board of Works and Public Safety to Offer Certain Real Estate for Sale to an Abutting Landowner-Old Romney Road Parcel 1 and Parcel 2. Ms. Chosnek stated that the City has surplus property off Old Romney Road near the State Road 25 intersection. The real estate was originally acquired to build a trail however the State came in and put down sidewalks therefore there is no current use for this land. The land will be offered for sale to the two abutting landowners for the average of two appraisal plus all title, insurance, survey and engineering expenses. This resolution is for Parcel 1 and 2. Mrs. Murray moved for approval. Mr. Rody seconded. Passed. President Henriott asked if there were any further questions and there were none. Mr. Rody moved for approval. Mrs. Murray seconded. Passed. MISCELLANEOUS Taxicab Permit-Lester Chaney Police Chief, Scott Galloway, presented to the Board and recommended approval of a Taxicab Permit for Lester Chaney. Chief Galloway stated that the background check was fine. Mrs. Murray moved for approval. Mr. Shriner seconded. Passed. Time: 9:10 a.m. Animal Control Appeal Hearing-Mary Burciaga BOARD OF PUBLIC WORKS AND SAFETY ANIMAL APPEAL MINUTES January 7, 2025 Appeal Hearing: The Board of Public Works and Safety met on Tuesday, January 7, 2025 at 9:15 a.m. in the Common Council Chambers. Members present were: Gary Henriott, Ron Shriner, Cindy Murray, Amy Moulton and Eric Rody. Jacque Chosnek, City Attorney, was also present. President Henriott called the meeting to order. Animal Control Appeal Hearing-Mary Burciaga Ms. Chosnek gave a brief description of the procedure for this hearing. Ms. Chosnek stated that the owner of Luna is Mary Burciaga and lives at 4835 Gage Way Apt #207. Ms. Chosnek stated that Ms. Burciaga’s dog Luna was impounded on January 1, 2025 and submitted her appeal on January 2, 2025. Spencer Hitchcock, Animal Control Officer (ACO), confirmed that the ACO’s have had contact with Ms. Burciaga about two times that include June 19, 2024 and December 30, 2024. Ms. Chosnek stated that ACO’s were called on June 19, 2024 due to Luna chasing a small dog around the apartment complex. A Dangerous Animal Agreement (DAA) was entered into at that time. Ms. Chosnek went of the details of the DAA agreement with the Board and ACO Hitchcock confirmed that Ms. Burciaga was aware of the outcome if the DAA was not followed. ACO Hitchcock confirmed that he was called out on December 30, 2024 due to a dog killing another dog. After further investigation it was deemed that Luna in fact killed another small dog in the apartment complex. ACO Hitchcock stated that Ms. Burciaga was very cooperative and forthcoming about the incident. Luna was very friendly to ACO Hitchcock. The victim family was also present at this time and wanting to speak to the ACO. ACO Hitchcock did confirm at that time that Luna did kill the other dog and was deceased upon arrival. ACO Hitchcock told Ms. Burciaga that he would have to seize Luna at this time. Luna was taken to Humane Society for Greater Lafayette for impoundment. Discussion ensued regarding the first incident and the second incident as to it being two different dogs. Ms. Chosnek went of the details of the timeline again with ACO Hitchcock. ACO Hitchcock confirmed all accounts. Board of Public Works and Safety January 7, 2025 Page 5 Ms. Chosnek asked Ms. Burciaga to confirm the timeline and details that led up to the seizure of Luna. Ms. Burciaga confirmed the details of the timeline of Luna leading up to the seizure on January 1, 2025. Ms. Burciaga stated that Luna is always kept on a leash when being taken out for walks and makes sure that there are no other dogs out in the area. Ms. Burciaga stated that she did not know that a new tenant moved in that owned a dog. So when Luna saw that new dog she was spooked and accidentally killed the small dog. Ms. Burciaga stated that she has a new home for Luna to go to in Greentown Indiana on a farm where there are no other dogs. Ms. Burciaga stated that Luna is people friendly and not aggressive. As a result of the incident Ms. Burciaga feels terrible for the victim family. Ms. Burciaga also stated that because of this incident she was evicted from her apartment. Ms. Chosnek explained what the Boards responsibility is regarding upholding the ordinances and rules of the City. Ms. Burciaga stated that she understood. Mrs. Murray asked how Luna behaves at the animal shelter. ACO Hitchcock stated that Luna appeared ok but a little nervous being there. Luna has been friendly to him each time that he has visited. President Henriott asked if Ms. Burciaga is willing to give the dog up and transfer ownership to her friend in Greentown Indiana. Ms. Burciaga stated that she is more than willing to give the dog to her friend so she can live. President Henriott stated that the dog is considered dangerous and needs to leave this community. Mrs. Moulton asked for clarification on what the options for the dog are moving forward. President Henriott voiced concern that it needs to be verified that the dog was in fact taken to Greentown Indiana. Ms. Chosnek stated that her office can come up with ways to make that happen and get the verification. Mr. Rody moved to approve the appeal with several factors taking place as a result. The factors include Luna getting spayed, Luna being removed from the community and release to Lorena King in Greentown Indiana, all shelter and animal control fees must to made; and if Luna is found in the community again she will be seized with no appeal process.
